R. 10015</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241018">October 18, 2024</action-date><action-desc><sponsor name-id="G000600">Ms. Perez</sponsor> (for herself and <cosponsor name-id="F000450">Ms. Foxx</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require that States that receive a grant under the Child Care and Development Block Grant Act of 1990, will not prohibit licensed child care providers from performing simple food preparation of fruits and vegetables.</official-title></form><legis-body id="H335076782F544BCC8F3A44F2DCEB13B9" style="OLC"><section id="HFD9A106E0EE849BBB41045AC21295136" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cutting Red Tape on Child Care Providers Act of 2024</short-title></quote>. </text></section><section id="H7A767F715C4F4FCF8A2D9BA1CED4AAD8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H54FF69160999453889ACEBB3C1E29CD6"><enum>(1)</enum><text>Access to minimally processed fruits, vegetables, nuts and seeds is crucial for the development and well-being of children.</text></paragraph><paragraph id="HAC2D845F581D4B3AA504417607AE195E"><enum>(2)</enum><text>Licensed child care providers often face restrictions on food preparation that limit their ability to serve fresh fruits and vegetables.</text></paragraph><paragraph id="H0531232B850F4ABF9367267CE5EE58B3"><enum> (3)</enum><text>Home and family based child care options, (estimated to serve about <fraction>1/4</fraction> of families), have seen steady declines over the past decade. While this decreases child care choices for all families, it disproportionately impacts low-income and rural families and those requiring daycare at non-traditional times because of shift work.</text></paragraph><paragraph id="HE103A2A27B024ADE9E2B74CA8DE5CF9E"><enum>(4)</enum><text>Complicated and burdensome regulations are more challenging for home-based providers and are likely a part of the reason these centers are declining.</text></paragraph><paragraph id="H2C518ACCE79444D0A66A67E42C1B1225"><enum>(5)</enum><text>Current regulations can make it easier to open a pre-packaged, often ultra-processed, snack than it is to, for example, peel a banana. This undermines the ability of child care providers to provide basic nutrition to our kids.</text></paragraph><paragraph id="H600E4360EBAE4CFEAEE27D986B7DD6F7"><enum>(6)</enum><text display-inline="yes-display-inline">Simplifying regulations to encourage simple food preparation of minimally processed agricultural products can improve nutritional outcomes for children.</text></paragraph></section><section id="HB23C40B05C35441CB314DEDB9A7913A2"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>simple food preparation</quote> means the basic preparation of fruits and vegetables, including washing, peeling, cutting, and serving raw or minimally processed produce.</text></section><section id="H8506E1F4BEAE4952BD2D5C8F0FC095F5"><enum>4.</enum><header>Prohibition of barriers under the Child Care and Development Block Grant Act of 1990</header><text display-inline="no-display-inline">Section 658E(c)(2)(F) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(2)(F)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H811D8EB20913439895DA47CB67BB8921" display-inline="no-display-inline"><clause id="H468BF7A8906E49C6B467CAFFD0ADD69F"><enum>(iii)</enum><header>Prohibition of barriers</header><text display-inline="yes-display-inline">The State shall not create any barriers on the simple preparation of fresh fruits and vegetables for facilities, licensed or licensed exempt.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
