which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit certain telework employees from receiving certain annual adjustments to pay schedules, and for other purposes.</official-title></form><legis-body id="H65212816123745D9B9BD8E6FD9899ADB" style="OLC"><section id="H42FB9CBDD02C4EC1A9AEDB4FF8396F52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Return to Work Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HFAB428724B474AB498A7F04BA3ECC1BA" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="H0465EDD5A6844138BB0E1AF7457F56FE"><enum>(1)</enum><header>Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="H6086113200C24968AFBA2C9B0E5D3BF7"><enum>(A)</enum><text display-inline="yes-display-inline">means an employee who teleworks not fewer than 1 day, or in the case of an alternative work schedule, not less than 20 percent, a week; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1BCC4E07D0F74B11BABE7E167C917956"><enum>(B)</enum><text>does not include an employee who—</text><clause commented="no" display-inline="no-display-inline" id="H38CAEBA4B6E2459E88B519F80DC9B90E"><enum>(i)</enum><text display-inline="yes-display-inline">teleworks not fewer than 1 day a week; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H036D9B3901214D80B86469207DEFEAAD"><enum>(ii)</enum><text display-inline="yes-display-inline">is—</text><subclause commented="no" display-inline="no-display-inline" id="H7CFB82FDCABB4D78A887207AD3947BC6"><enum>(I)</enum><text display-inline="yes-display-inline">is disabled and receives reasonable accommodations;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7C0D36038C8449EFB1E2A790B1BAEE4D"><enum>(II)</enum><text display-inline="yes-display-inline">a member of the Foreign Service of the United States;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD8EE211A2D884659B29DEFE4EA0668B6"><enum>(III)</enum><text display-inline="yes-display-inline">a Federal law enforcement officer;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF20A3DF7052D4B168EEE90DBD80E73E3"><enum>(IV)</enum><text display-inline="yes-display-inline">a member of the Armed Forces on active duty; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6ACF22F3DEC54A7290CB8DC24687CAEC"><enum>(V)</enum><text>any other employee, the official worksite of whom is not described in section 531.605(a)(1) of title 5, Code of Federal Regulations (or any corresponding similar regulation or ruling). </text></subclause></clause></subparagraph></paragraph><paragraph id="H3198B665515D4497A79F76592DD13BF4"><enum>(2)</enum><header>Employee</header><text>The term <term>employee</term> has the meaning given the term in section 2105 of title 5, United States Code.</text></paragraph><paragraph id="H9CBFECB7A87E472399FA261A98949F79" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Telework</header><text>The term <term>telework</term> has the meaning given the term in section 6501 of title 5, United States Code.</text></paragraph></section><section id="HF28BD868BBCB420FBEB601F7ECB425FF"><enum>3.</enum><header>Annual adjustments to pay schedules</header><text display-inline="no-display-inline">No covered employee may receive an annual adjustment under section 5303 of title 5, United States Code.</text></section><section commented="no" display-inline="no-display-inline" id="HA3C52B4A15D146469B63B4C0A1930262"><enum>4.</enum><header>Pay localities</header><text display-inline="no-display-inline">Each covered employee shall be paid at the rate of basic pay under the applicable grade and step for that employee under the locality pay area designated as <quote>Rest of U.S.</quote>—</text><paragraph commented="no" display-inline="no-display-inline" id="H6CBDDD7E37334F92A82DC403637C6D91"><enum>(1)</enum><text display-inline="yes-display-inline">as of the date on which the employee becomes a covered employee; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H500B1F174B9949099C4881F48778176A"><enum>(2)</enum><text>which shall not be adjusted under section 5304 of title 5, United States Code.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H9B639465BC3E430E9C96F5D442E5407F"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the first day of the first full fiscal year beginning after the date of enactment of this Act.</text></section></legis-body></bill>
