<official-title display="yes">Establishing grounds under which Members of Congress may vote by proxy and remotely attend committee proceedings in the event of illness, a death in the family, jury service, military service, and other emergency situations, and for other purposes.</official-title>

<section id="H60648B8B9CC248A5A07EA940E258A9DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This resolution may be cited as the <quote><short-title>Legislative Proxy and Absence Accommodation Resolution</short-title></quote>. </text></section> <section display-inline="no-display-inline" section-type="subsequent-section" id="H17FBE51C9BC548C39798FF49086AFA59"><enum>2.</enum><header>Permitting proxy voting and remote attendance at committee proceedings for Members of the House of Representatives in certain cases</header> <subsection id="HDEF2C511D6514BB38CF8C011CA7BA5F8"><enum>(a)</enum><header>Proxy voting</header><text>Rule III of the Rules of the House of Representatives is amended—</text>
<paragraph id="H89BED6721A9C4F75A493C7CA2027208D"><enum>(1)</enum><text display-inline="yes-display-inline">in clause 2(a), by striking <quote>A Member may not</quote> and inserting <quote>Except as provided in clause 4, a Member may not</quote>;</text></paragraph> <paragraph id="H2A88DFAE288947DD848064BDA5117D72"><enum>(2)</enum><text>in clause 2(b), by striking <quote>No other person may</quote> and inserting <quote>Except as provided in clause 4, no other person may</quote>; and </text></paragraph>
<paragraph id="H0B2241657C004AE1B3ED2A14E5DF5F14"><enum>(3)</enum><text>by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H9BB53EB2BC214E7EAC4BF00A634699FC" display-inline="no-display-inline"> <rules-clause id="HC3F45AF2D70B4DC3B376820D83DE1B45"> <rules-clause-header>Proxy voting</rules-clause-header><enum>4.</enum> <subsection id="HA86A1C39760D49F4940BE6D5338D3AA8" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">If any of the grounds described in paragraph (b) applies to a Member, such Member may designate another Member as a proxy who may cast the vote of such Member or record the presence of such Member in the House if such Member submits to the Clerk a signed letter (which may be in electronic form)—</text>
<paragraph id="H09A01D152F214186BF0F48ED476D95A2"><enum>(1)</enum><text display-inline="yes-display-inline">certifying that one of those grounds applies to such Member; and</text></paragraph> <paragraph id="H3F584F19944C4D919E2BD5F735D9C951"><enum>(2)</enum><text>specifying by name the other Member who is designated as a proxy for such Member.</text></paragraph></subsection>
<subsection id="H18F9BFF2DFB34AED93C12F0DD08C5C6C" display-inline="no-display-inline" commented="no"><enum>(b)</enum><text display-inline="yes-display-inline">The grounds described in this paragraph with respect to a Member are as follows:</text> <paragraph id="HFDE61368D3BD42B4A3BC7E7E4043C0BB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Any of the grounds under which an eligible employee is entitled to leave under subparagraphs (A) through (E) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>), but only if the Member includes with the signed letter required under this paragraph such documentation as the Clerk may require.</text></paragraph>
<paragraph id="HAFB59D6A99DF4F9190BB753B1805689A" commented="no"><enum>(2)</enum><text>An illness of the Member which would not be treated as a serious health condition under section 102(a)(1)(D) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)(D)</external-xref>) if the Member were an eligible employee under such Act, except that the number of days during which a Member may designate a proxy under this clause on the basis of this subparagraph in a calendar year may not exceed 7.</text></paragraph> <paragraph id="H7AE56EC956CD453CA4053A366BA4933E"><enum>(3)</enum><text>The summoning of the Member, in connection with a judicial proceeding, by a court or authority responsible for the conduct of that proceeding, to serve as a juror, but only if the Member includes with the signed letter required under this paragraph such documentation of the summoning as the Clerk may require.</text></paragraph>
<paragraph id="H8A03BD172C534473A563CAD619441562"><enum>(4)</enum><text display-inline="yes-display-inline">The death of a family member, except that the number of consecutive days during which a Member may designate a proxy under this clause on the basis of this subparagraph with respect to a family member may not exceed 4. For purposes of this subparagraph, the term <term>family member</term> means a spouse (including a domestic partner) and a spouse’s parent; a child and a child’s spouse; a parent and a parent’s spouse; a sibling and a sibling’s spouse; a grandparent, a grandchild, or a spouse of a grandparent or grandchild; and any other individual who is related by blood or affinity and whose association with the individual is the equivalent of a family relationship under regulations issued by the Committee on House Administration.</text></paragraph> <paragraph id="HA8CF07BF6F0044DB93EC2EE1826DDF0E"><enum>(5)</enum><text>The Member is absent by reason of service in the uniformed services, as defined in section 4303(13) of title 38, United States Code, except that the number of days during which a Member may designate a proxy under this clause on the basis of this subparagraph in a calendar year may not exceed 15 in the case of service consisting of active duty, active duty for training, and inactive duty training and may not exceed 22 days in the case of service consisting of State active duty in response to a national emergency or a major disaster referred to in such section. A Member may designate a proxy under this clause on the basis of this subparagraph only if the Member includes with the signed letter required under this paragraph such documentation of the service as the Clerk may require.</text></paragraph>
<paragraph id="H0561CAB4FD954C4B8F5146A9D8EC59D4"><enum>(6)</enum><text>The Member is prevented from safely traveling to or performing work at the location of the committee proceeding due to—</text> <subparagraph id="H6764D8DD77654FBC8FB6B5E65606AC20"><enum>(A)</enum><text>an act of God;</text></subparagraph>
<subparagraph id="H19924BA78E5649F98FA21513CEB41B2C"><enum>(B)</enum><text>a terrorist attack; or</text></subparagraph> <subparagraph id="H6373E35EC39A4F85B95BD851176ADBA7"><enum>(C)</enum><text>another condition that prevents the Member from safely traveling to or performing work at the location of the proceeding.</text></subparagraph></paragraph></subsection>
<subsection id="H5B84D551A0CD45A2B06E85A7D452E69C"><enum>(c)</enum><text>The Clerk shall maintain an updated list of the following information, and shall make such list publicly available in electronic form:</text> <paragraph id="H463DEC488E7444C6A3FCDD73EC99041A"><enum>(1)</enum><text>The designations submitted or in effect under paragraph (a).</text></paragraph>
<paragraph id="HCF1BE1A34E90492EBFC8E40817384BEE"><enum>(2)</enum><text>With respect to each Member who designated a proxy under paragraph (a)—</text> <subparagraph id="H13F94B3C3A01431DB007712F904DFF0D"><enum>(A)</enum><text display-inline="yes-display-inline">the number of days for which the Member designated a proxy; and</text></subparagraph>
<subparagraph id="HA4DC4296A3F946F99E85B2B7A5803710"><enum>(B)</enum><text>the grounds under paragraph (b) on which the Member designated the proxy.</text></subparagraph></paragraph></subsection> <subsection id="H7712FF4B773242289F782AD49B797C01"><enum>(d)</enum><text display-inline="yes-display-inline">Any Member whose vote is cast or whose presence is recorded by a designated proxy under this clause shall be counted for the purpose of establishing a quorum under the rules of the House.</text></subsection></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H29A6BBBCD2D74480ADB59C0DAB20DB4D"><enum>(b)</enum><header>Remote attendance at committee proceedings</header><text display-inline="yes-display-inline">Rule XI of the Rules of the House of Representatives is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H617EA664451D473DBE74A110B2F47382" display-inline="no-display-inline"> <rules-clause id="H5DC5AB1521BC4764ACC3BB4C0EEED15B"> <rules-clause-header>Remote attendance at committee proceedings in certain cases</rules-clause-header><enum>7.</enum> <subsection id="H91FB70D394DB4978A7ED82B9351E71ED" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this rule, if any of the grounds described in paragraph (b) applies to a Member and such Member has submitted to the Clerk a signed letter (which may be in electronic form) certifying that one of those grounds applies to such Member—</text>
<paragraph id="HA16F820EE0EC4568B41E1D8E568AD089"><enum>(1)</enum><text display-inline="yes-display-inline">such Member may participate remotely during in-person committee proceedings, including by casting a vote or recording such Member’s presence remotely;</text></paragraph> <paragraph id="H887B863436AC4D0185CA92352E5D8B1E"><enum>(2)</enum><text>such remote participation shall not be considered an absence for purposes of clause 5(c) of rule X or clause 2(d) of rule XI; and</text></paragraph>
<paragraph id="HCF4143AF6F8B4FC79F6C7A3D131DC70B"><enum>(3)</enum><text>such Member shall be counted for the purpose of establishing a quorum under the rules of the House and the committee.</text></paragraph></subsection> <subsection id="HA69A0171354D42A190A1D56ED4AF488F" display-inline="no-display-inline" commented="no"><enum>(b)</enum><text display-inline="yes-display-inline">The grounds described in this paragraph with respect to a Member are as follows:</text>
<paragraph id="H2BD7670F802644B6B8B029407D8707DD" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Any of the grounds under which an eligible employee is entitled to leave under subparagraphs (A) through (E) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>), but only if the Member includes with the signed letter required under this paragraph such documentation as the Clerk may require.</text></paragraph> <paragraph id="H05D8458D5C634DA0AF39B868DF20FF7B" commented="no"><enum>(2)</enum><text>An illness of the Member which would not be treated as a serious health condition under section 102(a)(1)(D) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)(D)</external-xref>) if the Member were an eligible employee under such Act, except that the number of days during which a Member may participate remotely under this clause on the basis of this subparagraph in a calendar year may not exceed 7.</text></paragraph>
<paragraph id="HB3AF1DDF728841E98ECBE6E8CCCFA148"><enum>(3)</enum><text>The summoning of the Member, in connection with a judicial proceeding, by a court or authority responsible for the conduct of that proceeding, to serve as a juror, but only if the Member includes with the signed letter required under this paragraph such documentation of the summoning as the Clerk may require.</text></paragraph> <paragraph id="H8A3D380D7AC34A6F9532D187281FD252"><enum>(4)</enum><text display-inline="yes-display-inline">The death of a family member, except that the number of consecutive days during which a Member may participate remotely under this clause on the basis of this subparagraph with respect to a family member may not exceed 4. For purposes of this subparagraph, the term <term>family member</term> means a spouse (including a domestic partner) and a spouse’s parent; a child and a child’s spouse; a parent and a parent’s spouse; a sibling and a sibling’s spouse; a grandparent, a grandchild, or a spouse of a grandparent or grandchild; and any other individual who is related by blood or affinity and whose association with the individual is the equivalent of a family relationship under regulations issued by the Committee on House Administration.</text></paragraph>

<subparagraph id="HB61C20DE322844249A69F7B6B176B20E"><enum>(A)</enum><text>an act of God;</text></subparagraph> <subparagraph id="HB2ACB731F989430BB33033485D2575A7"><enum>(B)</enum><text>a terrorist attack; or</text></subparagraph>
<subparagraph id="H7659D64E1E444D1DA642B536A8E129AF"><enum>(C)</enum><text>another condition that prevents the Member from safely traveling to or performing work at the location of the proceeding.</text></subparagraph></paragraph></subsection> <subsection id="HAC9798CED99D48689284FD8861AE770B"><enum>(c)</enum><text>The Clerk shall maintain an updated list of the following information, and shall make such list publicly available in electronic form:</text>
<paragraph id="HBAD9E85E1EDD493D817FA61576B1F655"><enum>(1)</enum><text>The Members who are eligible to participate remotely under this clause.</text></paragraph> <paragraph id="HA439E7E83B984FD9B9D892AAF3F2069A"><enum>(2)</enum><text>With respect to each such Member—</text>
<subparagraph id="H708676669AC945D9A0907648935E3A16"><enum>(A)</enum><text>the number of days for which the Member participated remotely; and</text></subparagraph> <subparagraph id="HD7263F9B285E4D05B02BC2A22F88192D"><enum>(B)</enum><text>the grounds under paragraph (b) on which the Member participated remotely.</text></subparagraph></paragraph></subsection></rules-clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H4AF0766CDC7C4A97B9CDE76556A3AA44"><enum>3.</enum><header>Permitting proxy voting and remote attendance at committee proceedings for Senators in certain cases</header>
<subsection id="H8F25C09C7C664D39BEA78C20F8084DA1"><enum>(a)</enum><header>Proxy voting</header>
<paragraph id="HE8898A591BF145E1BA6DA4E5736B1D9C"><enum>(1)</enum><header>Authorizing designation of proxies</header><text>Notwithstanding any other provision of any of the Standing Rules of the Senate, if any of the grounds described in subsection (c) applies to a Senator, such Senator may designate another Senator as a proxy who may cast the vote of such Senator or record the presence of such Senator in the Senate if such Senator submits to the Secretary of the Senate a signed letter (which may be in electronic form)—</text> <subparagraph id="H44A4C9DE70EE4E459E64DC09D49C9545"><enum>(A)</enum><text>certifying that one of those grounds applies to such Senator; and</text></subparagraph>
<subparagraph id="HE614FF8EF08748A89F7830E78B5DCCED"><enum>(B)</enum><text>specifying by name the other Senator who is designated as a proxy for such Senator.</text></subparagraph></paragraph> <paragraph id="HD2F1163FC081408E956751635651B329"><enum>(2)</enum><header>Determination of quorum</header><text display-inline="yes-display-inline">Any Senator whose vote is cast or whose presence is recorded by a designated proxy under this section shall be counted for the purpose of establishing a quorum under the Standing Rules of the Senate.</text></paragraph></subsection>
<subsection id="H4D27E659E4C14D41AB2A089FE5FC2FF5"><enum>(b)</enum><header>Remote attendance at committee proceedings</header><text>Notwithstanding any other provision of any of the Standing Rules of the Senate, if any of the grounds described in subsection (c) applies to a Senator, and such Senator has submitted to the Secretary of the Senate a signed letter (which may be in electronic form) certifying that one of those grounds applies to such Senator, such Senator may participate remotely during in-person committee proceedings, including by casting a vote or recording such Senator’s presence remotely, and—</text> <paragraph id="H9B1AAA91E0B741B5BD9101C386FD32C9"><enum>(1)</enum><text display-inline="yes-display-inline">such remote participation shall not be considered an absence for purposes of any provision of the Standing Rules of the Senate; and</text></paragraph>
<paragraph id="HA541C4D9A20E46799B263AB642D20DF9"><enum>(2)</enum><text display-inline="yes-display-inline">a Senator participating remotely pursuant to this subsection shall be counted for the purpose of establishing a quorum under the Standing Rules of the Senate and the committee.</text></paragraph></subsection> <subsection id="H2097B6C43E7345049FD3E038C2758349"><enum>(c)</enum><header>Grounds described</header><text>The grounds described in this subsection with respect to a Senator are as follows:</text>
<paragraph id="HACFA15C36AF54002832523E4D1D1A14B"><enum>(1)</enum><text display-inline="yes-display-inline">Any of the grounds under which an eligible employee is entitled to leave under subparagraphs (A) through (E) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>), but only if the Member includes with the signed letter required under this paragraph such documentation as the Secretary may require.</text></paragraph> <paragraph id="H1954B9B8C7A94003B8BFBA91FB337066"><enum>(2)</enum><text display-inline="yes-display-inline">An illness of the Senator which would not be treated as a serious health condition under section 102(a)(1)(D) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)(D)</external-xref>) if the Senator were an eligible employee under such Act, except that the number of days during which a Senator may designate a proxy under subsection (a) or may participate remotely under subsection (b) on the basis of this paragraph in a calendar year may not exceed 7.</text></paragraph>

<subparagraph id="H0284340B313648B6B4C309631669F2B4"><enum>(A)</enum><text>an act of God;</text></subparagraph> <subparagraph id="H8A22B8808C164DAABDFBC2A7436C3533"><enum>(B)</enum><text>a terrorist attack; or</text></subparagraph>
<subparagraph id="HEE517EB1CE8E4DA6A4DE787B6B705A37"><enum>(C)</enum><text>another condition that prevents the Senator from safely traveling to or performing work at the location of the proceeding.</text></subparagraph></paragraph></subsection> <subsection id="HC5A7C082D3444351BEDA4B2F369109E4"><enum>(d)</enum><header>Maintenance of information by Secretary</header><text display-inline="yes-display-inline">The Secretary shall maintain an updated list of the following information, and shall make such list publicly available in electronic form:</text>
<paragraph id="HB300D64D5A27456E9D5EEA23C69672FE"><enum>(1)</enum><text>The designations of proxies submitted or in effect under subsection (a).</text></paragraph> <paragraph id="H426754AF897D467583EFC8A3A04CB083"><enum>(2)</enum><text>With respect to each Senator who designated a proxy under subsection (a)—</text>
<subparagraph id="HFEAC9833C0384B73AD7936D4ED239CA3"><enum>(A)</enum><text>the number of days for which the Senator designated a proxy; and</text></subparagraph> <subparagraph id="HF410D87078A04AFB9E2928BB99B44929"><enum>(B)</enum><text>the grounds under subsection (c) on which the Senator designated the proxy.</text></subparagraph></paragraph>
<paragraph id="H5EF5BE320A804B6EAF75CB99532B339F"><enum>(3)</enum><text>The Senators who are eligible to participate remotely under subsection (b).</text></paragraph> <paragraph id="H4D2147EA22A24A7CBFE487E5C1EB5B35"><enum>(4)</enum><text>With respect to each Senator who is eligible to participate remotely under subsection (b)—</text>
<subparagraph id="H9CA7A92E7CE043C5B7A646E6E19F5EB0"><enum>(A)</enum><text>the number of days for which the Senator participated remotely; and</text></subparagraph> <subparagraph id="HF686A5E3D2544E6EA033DCFA1F030502"><enum>(B)</enum><text>the grounds under subsection (c) on which the Senator participated remotely.</text></subparagraph></paragraph></subsection></section>
