which was read twice and referred to the <committee-name committee-id="SSAS00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Armed Services</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20230725">July 25, 2023</action-date><action-desc>Reported by <sponsor name-id="S259">Mr. Reed</sponsor>, with an amendment</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To terminate the Department of Defense memorandum relating to access to abortions, to prohibit the use of travel and transportation allowances, medical convalescent leave, and administrative absences to travel to obtain abortions, and for other purposes.</official-title></form><legis-body id="HEF4386C20EA540B4BDA31B84740B4FDC"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modification to Department of Defense Travel Authorities for Abortion-Related Expenses Act of 2023</short-title></quote>.</text></section><section id="idf358efe57a354ff7a438a01291885778" changed="deleted" reported-display-style="strikethrough"><enum>2.</enum><header>Termination of Department of Defense memorandum relating to access to abortions</header><subsection id="id055dfba8dd3b4bde8371d78269241998"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="id5c8e5c133e3a4a518e34ec40c67b7d09"><enum>(1)</enum><text>consistent with section 1093 of title 10, United States Code, the Department of Defense may not use any funds for abortions except in a case in which the life of the mother would be endangered if the fetus were carried to term or in which the pregnancy is the result of an act of rape or incest;</text></paragraph><paragraph id="idf5f0b938218846b79a3f12a0af84e0c3"><enum>(2)</enum><text>the Secretary of Defense has no legal authority to implement any policies under which funds are to be used for that purpose; and</text></paragraph><paragraph id="idf44d9f90bb264516a988a5668aaeceeb"><enum>(3)</enum><text>the Department of Defense memorandum entitled <quote>Ensuring Access to Reproductive Health Care</quote>, dated October 20, 2022, is therefore in direct conflict with section 1093 of title 10, United States Code, and the intent of Congress, and must be rescinded.</text></paragraph></subsection><subsection id="id467f4869481048048ff48bacca7eafcc"><enum>(b)</enum><header>Termination of memorandum</header><paragraph id="ida89f3682ec15477fa28c069bef86dea4"><enum>(1)</enum><header>In general</header><text>The Department of Defense memorandum entitled <quote>Ensuring Access to Reproductive Health Care</quote>, dated October 20, 2022, shall have no force or effect.</text></paragraph><paragraph id="id3106c28f95ab47b0a9144f8f40a4f2ac"><enum>(2)</enum><header>Prohibition on availability of funds to carry out memorandum</header><text>None of the funds authorized to be appropriated or otherwise made available to the Department of Defense may be obligated or expended to carry out the memorandum described in paragraph (1) or any successor to such memorandum. </text></paragraph></subsection></section><section id="id19d8ee26103a413f853fa261907d89a7" changed="deleted" reported-display-style="strikethrough"><enum>3.</enum><header>Prohibition on provision of travel and transportation allowances to obtain abortions</header><subsection id="id8e6d8ff63b8842168abf70b8da87cec9"><enum>(a)</enum><header>In general</header><text>Section 452 of title 37, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id79ec63e425794abab14f44c0044a46b5" changed="deleted" reported-display-style="strikethrough"><subsection id="id4c493f19c9f845c7b1558da440e9f3a2"><enum>(j)</enum><header>Prohibition on allowances To obtain abortions</header><text>The Secretary of Defense may not provide transportation-, lodging-, meals-in-kind, or any actual or necessary expenses of travel or transportation, for, or in connection with, official travel under circumstances as specified in regulations prescribed under section 464 of this title for a member of the Armed Forces or a dependent of such a member seeking an abortion or any abortion-related service, except in a case in which the life of the mother would be endangered if the fetus were carried to term or the pregnancy is the result of an act of rape or incest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id67c45014ad4c47519cbb7a74ff32d272"><enum>(b)</enum><header>Prohibition on considering limited access to abortions as unusual, extraordinary, hardship, or emergency circumstances</header><text>Section 453(d) of title 37, United States Code, is amended—</text><paragraph id="id54f22439f41d4f08b1bbd5d9f0fa897d"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>An authorized traveler</quote>; and</text></paragraph><paragraph id="idcfc63da82336436fa84269d47258b5cd"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13932f0632884380bce4d138ccb25753" changed="deleted" reported-display-style="strikethrough"><paragraph id="id10a6a2da8cee470289b3f8fc75fdef97" indent="up1"><enum>(2)</enum><text>The access of a member of the Armed Forces or a dependent of such a member to an abortion or abortion-related services being limited because of the duty location of the member does not constitute an unusual, extraordinary, hardship, or emergency circumstance for the purposes of section 452 of title 37, United States Code, except in a case in which the life of the mother would be endangered if the fetus were carried to term or the pregnancy is the result of an act of rape or incest.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id6dfa6f5f94fb4425b6660500980f51bc" changed="deleted" reported-display-style="strikethrough"><enum>4.</enum><header>Prohibition on use of medical convalescent leave or administrative absences for travel to obtain abortions</header><subsection commented="no" display-inline="no-display-inline" id="idfb018ec2e47e4de994f544ed897d5d1e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/40">Chapter 40</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/701">section 701</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idfa40500297bb40cc8fd2103cdbe30b34" changed="deleted" reported-display-style="strikethrough"><section id="id2c393d0fca964447b4267ff50eab3c49"><enum>701a.</enum><header>Prohibition on use of medical convalescent leave or administrative absences for travel to obtain abortions</header><text display-inline="no-display-inline">A member of the Armed Forces may not take convalescent leave under section 701(m) or use an administrative absence for travel for the purposes of obtaining an abortion or abortion-related service, except in a case in which the life of the mother would be endangered if the fetus were carried to term or the pregnancy is the result of an act of rape or incest.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idde6a2f94228c48588990b492b39db05b"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 40 of such title is amended by inserting after the item relating to section 701 the following new item:</text><quoted-block style="USC" id="id69783e41-9297-463f-b217-778c3494c5d0" changed="deleted" reported-display-style="strikethrough"><toc changed="deleted" reported-display-style="strikethrough"><toc-entry level="section" idref="id2c393d0fca964447b4267ff50eab3c49">701a. Prohibition on use of medical convalescent leave or administrative absences for travel to obtain abortions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id890676eebab343bd85f66ce65b1aff6a" changed="deleted" reported-display-style="strikethrough"><enum>5.</enum><header>Rule of construction</header><subsection commented="no" display-inline="no-display-inline" id="id816a47a0ef7b4ac68aa968cfbea7e2fc"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act may be construed to affect the treatment of any infection, injury, disease, or disorder that has been caused by or exacerbated by the performance of an abortion. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddfdd9c105c964ff689f85f5cd7beac1a"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) applies without regard to whether—</text><paragraph commented="no" display-inline="no-display-inline" id="idad289e280c1240bf9b19f9459c1f6626"><enum>(1)</enum><text display-inline="yes-display-inline">the abortion was performed in accordance with Federal or State law; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7df4a1803954804914bccb89e38a288"><enum>(2)</enum><text display-inline="yes-display-inline">funding for the abortion is permissible under section 1093 of title 10, United States Code.</text></paragraph></subsection></section><section id="id452cbf4d76f549bf8db97cdb3cacba8c" changed="added" reported-display-style="italic"><enum>2.</enum><header>Briefing or report on implementation of certain policies of the Department of Defense relating to abortion</header><subsection commented="no" display-inline="no-display-inline" id="idea103effd08644a0a65dc72edcd2c6bd"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than July 24, 2023, the Secretary of Defense, in consultation with the Attorney General and the Defense Advisory Committee on Women in the Services, shall provide to the Committees on Armed Services of the Senate and the House of Representatives a briefing or a report that contains an assessment of the following:</text><paragraph id="idad22449694e54e6c8e799da5ad32b6cf"><enum>(1)</enum><text>The legality of the implementation by the Department of Defense of policies allowing members of the Armed Forces to seek medical procedures that are not covered by the Department, including elective abortions, including with respect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id12c7a652c4124e5d8c0532573eb25e69"><enum>(A)</enum><text>existing requirements and prohibitions relating to abortion under section 1093 of title 10, United States Code; and</text></subparagraph><subparagraph id="idf8eab87fb7b844a58aeeebf274bf4dcb"><enum>(B)</enum><text>the rule submitted by the Department of Health and Human Services relating to <quote>Ensuring Access to Equitable, Affordable, Client-Centered, Quality Family Planning Services</quote> (86 Fed. Reg. 19812; published April 15, 2021).</text></subparagraph></paragraph><paragraph id="id0b97eb42515c49c6a92a530f21a54a64"><enum>(2)</enum><text>The oversight functions of the Department of Defense in preventing abuse of policies described in paragraph (1).</text></paragraph><paragraph id="id9d66420a11964636b86ccfd95867b819"><enum>(3)</enum><text>The ability of those polices to cover medical services for late-stage elective abortions after 20 weeks gestation.</text></paragraph><paragraph id="id86bc7a76cc5440cabe3912b88c68e773"><enum>(4)</enum><text>The approval process necessary for a member of the Armed Forces to request coverage under those policies.</text></paragraph><paragraph id="id7f8b859bdb224293b91013956ca76cbd"><enum>(5)</enum><text>The requirement of approval by multiple physicians to be covered under those policies.</text></paragraph><paragraph id="idb8a670a4fb81440b8d10faab817697a7"><enum>(6)</enum><text>The applicability of those policies to the family members of members of the Armed Forces.</text></paragraph><paragraph id="idb4279bfba7fa4c638216c4a0c145d1f1"><enum>(7)</enum><text>The protections in place for members of the Armed Forces who choose to utilize those policies.</text></paragraph><paragraph id="id1145a511ee254e4c9f18255b07af31bc"><enum>(8)</enum><text>The reproductive health care services that are not covered by the Department of Defense that have been accessed pursuant to those policies as of the date of the briefing or report, as the case may be.</text></paragraph><paragraph id="iddca10168ed4347a9a3642e7dfdb2f58a"><enum>(9)</enum><text>Whether or not the provisions of S. 822 of the 118th Congress, as introduced on March 15, 2023—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfc25a010a8584539bff1274f7eb63118"><enum>(A)</enum><text display-inline="yes-display-inline">return the Department to the standard held before those policies were implemented; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id818a0685b337474ba32e959a5abe0be4"><enum>(B)</enum><text display-inline="yes-display-inline">do not restrict access to health care not covered by the Department further than the standard held before those policies were implemented. </text></subparagraph></paragraph></subsection><subsection id="id726725be43a04244912c3e50eaa8524a"><enum>(b)</enum><header>Protection of personally identifiable information</header><text>In providing the briefing or report, as the case may be, required under subsection (a), the Secretary of Defense shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idbee559446d0b42a8bb3847fc6d7be57d"><enum>(1)</enum><text display-inline="yes-display-inline">observe all protections required under the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/106/191">Public Law 106–191</external-xref>), or any other provision of law; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa4a9374061449ccbf724e4c451f1a2e"><enum>(2)</enum><text display-inline="yes-display-inline">take any necessary precautions to prevent the disclosure of any personal identifiable information of individuals included within the population assessed for purposes of such briefing or report, as the case may be. </text></paragraph></subsection></section></legis-body><endorsement><action-date date="20230725">July 25, 2023</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
