<congress>One Hundred Eighteenth Congress of the United States of America</congress><session display="yes">1st Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Tuesday, the third day of January, two thousand and twenty three</enrolled-dateline><legis-num display="yes">S. 788</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Permanent Electronic Duck Stamp Act of 2013 to allow States to issue fully electronic stamps under that Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Duck Stamp Modernization Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id6962267313574f2a8ba78c0d58d4ad89" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Authorizing fully electronic stamps</header><subsection id="H4BAFAF8233D74243B04F6B88628069BA" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5 of the Permanent Electronic Duck Stamp Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/16/718r">16 U.S.C. 718r</external-xref>) is amended—</text><paragraph id="HB485CC3D979D44DA97011F6B1613EC9E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H61FD7D05704242A6B667D0FD8D5C116A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">actual stamp</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">electronic stamp</header-in-text></quote>; </text></subparagraph><subparagraph id="H49DCDB55317448AA9448868E3786D080" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>an actual stamp</quote> and inserting <quote>the electronic stamp</quote>; and</text></subparagraph><subparagraph id="H85E456310E2545ED8F1A70EDC77D602C" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H42288B2FA8854118A5B82B0CAD31D99C"><paragraph id="HB5414BA150124622A13F23E340F361EB" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">on the date of purchase of the electronic stamp; and</text></paragraph><after-quoted-block display="yes">; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF0D11F979D9D4605ACD7611D993B5BF6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>actual stamps</quote> and inserting <quote>actual stamps under subsection (e)</quote>;</text></paragraph><paragraph id="H9FD205587CEB408BB0CDD2D5E6F3A3AA" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsection (e) as subsection (f); and </text></paragraph><paragraph id="id673A8491D18E40D58E600AADB68C205B" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBFE6E622BC864BA88A7E4CD748D43590"><subsection id="id7b7d081ac65b4bf2994b8718a7a21e78" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Delivery of actual stamps</header><text display-inline="yes-display-inline">The Secretary shall issue an actual stamp after March 10 of each year to each individual that purchased an electronic stamp for the preceding waterfowl season.</text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H86236321D2434E02AE8491F2D25CF934" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of electronic stamp</header><text display-inline="yes-display-inline">Section 2 of the Permanent Electronic Duck Stamp Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/16/718o">16 U.S.C. 718o</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide87dc1abf1a94e49bc07e4ab6dd35679"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Federal</quote> and all that follows through <quote>that is printed</quote> and inserting <quote>Migratory Bird Hunting and Conservation Stamp required under the Migratory Bird Hunting and Conservation Stamp Act (<external-xref legal-doc="usc" parsable-cite="usc/16/718a">16 U.S.C. 718a et seq.</external-xref>) that is printed</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd98a68762b4044329ece7d861d32c579"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><subparagraph id="HDFD2740CE8924771926340E0A3A9EF70" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H3CB1899E41124E60B686F5A2F3AF4C6A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H80727E5EF2CC4369B4274265438B6754" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H5BB752B8B6D74DDFA0CE0F48880E76EB" display-inline="no-display-inline"><subparagraph id="HC58D6B1517B048D2955E83EFACA74EF3" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">may contain an image of the actual stamp.</text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H61658242060E4F1F904B776E3B55D4AC" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Stamp valid through close of hunting season</header><text display-inline="yes-display-inline">Section 6 of the Permanent Electronic Duck Stamp Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/16/718s">16 U.S.C. 718s</external-xref>) is amended—</text><paragraph id="HCEDD9FA96F054FA4AC7C36D41E1F5711" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), in the matter preceding paragraph (1), by striking <quote>shall, during the effective period of the electronic stamp—</quote> and inserting <quote>shall—</quote>; and </text></paragraph><paragraph id="HB8FBB6E4C39748F9B9B82BC3ABCEBE10" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>for a period agreed to by the State and the Secretary, which shall not exceed 45 days</quote> and inserting <quote>through the first June 30 that occurs after the date of issuance of the electronic stamp by the State</quote>.</text></paragraph></subsection><subsection id="H37E1F3C12F554FDE85D0A5AC381129C4" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Electronic stamps as permit</header><text display-inline="yes-display-inline">Section 1(a)(1) of the Migratory Bird Hunting and Conservation Stamp Act (<external-xref legal-doc="usc" parsable-cite="usc/16/718a">16 U.S.C. 718a(a)(1)</external-xref>) is amended—</text><paragraph id="HAFA6A8CF38BD445AB132E153FE266B51" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>as an electronic stamp (as defined in section 2 of the Permanent Electronic Duck Stamp Act of 2013 (<external-xref legal-doc="usc" parsable-cite="usc/16/718o">16 U.S.C. 718o</external-xref>)) or</quote> after <quote>Conservation Stamp,</quote>; and</text></paragraph><paragraph id="H3E8BA3CDDF9143A2B50909C9EAC398B2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>face of the stamp</quote> and inserting <quote>face of the actual stamp (as defined in that section)</quote>.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
