STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To establish a demonstration program for the active remediation of orbital debris and to require the development of uniform orbital debris standard practices in order to support a safe and sustainable orbital environment, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="ide8560757-02e4-4d87-bbd5-7725c37db571" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Orbital Sustainability Act of 2023</short-title></quote> or the <quote><short-title>ORBITS Act of 2023</short-title></quote>.</text></section><section id="idfbb013dc1b6b42d3b1d8c198c918f00e" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings; sense of Congress</header><subsection id="id02a2e746a5c34e88b4578b0c3974af71" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text><paragraph id="id89d85278a7c349728122170c0800f51d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The safety and sustainability of operations in low-Earth orbit and nearby orbits in outer space have become increasingly endangered by a growing amount of orbital debris.</text></paragraph><paragraph id="idabd8c9afc3b04fab98835aee5a70dc36" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Exploration and scientific research missions and commercial space services of critical importance to the United States rely on continued and secure access to outer space.</text></paragraph><paragraph id="id035f7ab364b1452aa3c2f6d929e21852" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Efforts by nongovernmental space entities to apply lessons learned through standards and best practices will benefit from government support for implementation both domestically and internationally.</text></paragraph></subsection><subsection id="id8d8c47c71bbd4deebcbcc9b7e6fb44f0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that to preserve the sustainability of operations in space, the United States Government should—</text><paragraph id="id2b72cbaf134442ee91442c852b86667a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent practicable, develop and carry out programs, establish or update regulations, and commence initiatives to minimize orbital debris, including initiatives to demonstrate active debris remediation of orbital debris generated by the United States Government or other entities under the jurisdiction of the United States;</text></paragraph><paragraph id="iddfa99d03383d49c997cd3743401ce0b1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">lead international efforts to encourage other spacefaring countries to mitigate and remediate orbital debris under their jurisdiction and control; and</text></paragraph><paragraph id="id5c6707979ba74fbbaa398bfee383eb2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">encourage space system operators to continue implementing best practices for space safety when deploying satellites and constellations of satellites, such as transparent data sharing and designing for system reliability, so as to limit the generation of future orbital debris.</text></paragraph></subsection></section><section id="id635e4532fc3b461dab8c34bae9f54b10" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id405da9414fae46b2b8f138389d0ac81e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Active debris remediation</header><text display-inline="yes-display-inline">The term <term>active debris remediation</term>—</text><subparagraph id="id920dcf5ea46a47f88e0b347712b8f4c3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">means the deliberate process of facilitating the de-orbit, repurposing, or other disposal of orbital debris, which may include moving orbital debris to a safe position, using an object or technique that is external or internal to the orbital debris; and</text></subparagraph><subparagraph id="id2ad8bc722d7f47b79d83408e519849d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">does not include de-orbit, repurposing, or other disposal of orbital debris by passive means.</text></subparagraph></paragraph><paragraph id="id61b6dbe0d2f247ada0ba46b8a463dd1e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the National Aeronautics and Space Administration.</text></paragraph><paragraph id="id096818f54d274ab9b62f0aad04ae9ca6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Appropriate committees of congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id01ac7daebee1498d9ff212949f1025fe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Appropriations, the Committee on Commerce, Science, and Transportation, the Committee on Foreign Relations, and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="id9b93f9b72f9a413e815c2156e7cba3d5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Appropriations, the Committee on Science, Space, and Technology, the Committee on Foreign Affairs, and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id1db294dc84124783865712d841cc5c84" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Demonstration project</header><text display-inline="yes-display-inline">The term <term>demonstration project</term> means the active orbital debris remediation demonstration project carried out under section 4(b).</text></paragraph><paragraph id="ide1471969c45f43cda1c3b6ebfada3c2a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="idf10390e467094fefbb7a7d14e47597d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a United States-based—</text><clause id="idc31fa47fcffa441ab0954319c5a3e92d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">non-Federal, commercial entity;</text></clause><clause id="id2ee2f293b64a49e1adf047cc63002b36" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)); or</text></clause><clause id="id4b433fd2e04c47088ca9b472b0b2b76e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">nonprofit organization;</text></clause></subparagraph><subparagraph id="id2c976561feb846fea706301a7fdc7afd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any other United States-based entity the Administrator considers appropriate; and</text></subparagraph><subparagraph id="id37fe457815924ad794aaafb3b3b770e6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a partnership of entities described in subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph id="id019a29dc236d427abcb19aa4b9c46643" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Orbital debris</header><text display-inline="yes-display-inline">The term <term>orbital debris</term> means any human-made space object orbiting Earth that—</text><subparagraph id="idd5a906e5874f490b91d83da69f014501" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">no longer serves an intended purpose; and</text></subparagraph><subparagraph id="ida87f9ae7a07041aeaa492aa2a2a55594" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="ide1661c7e14d24e6298d66d0541db3bae" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">has reached the end of its mission; or</text></clause><clause id="id03613171b6094859a54a34eafbf4ed42" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">is incapable of safe maneuver or operation.</text></clause></subparagraph></paragraph><paragraph id="id665a1ffd789a4ca4908f90882a2361ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Project</header><text display-inline="yes-display-inline">The term <term>project</term> means a specific investment with defined requirements, a life-cycle cost, a period of duration with a beginning and an end, and a management structure that may interface with other projects, agencies, and international partners to yield new or revised technologies addressing strategic goals.</text></paragraph><paragraph id="idc9915d7491784953ba49c3815a65b1f6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="id8e3304b55ee64f16b3b4a30084b89a2b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Space traffic coordination</header><text display-inline="yes-display-inline">The term <term>space traffic coordination</term> means the planning, coordination, and on-orbit synchronization of activities to enhance the safety and sustainability of operations in the space environment.</text></paragraph></section><section id="id13d03a4d30df448f8cde09426a69497d" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Active debris remediation</header><subsection id="id35385b8ed9274dd3b5a5a451e323fc11" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Prioritization of orbital debris</header><paragraph id="id90e2d4002cdb44018fc48ee5b65ab39a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">List</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary, in consultation with the Administrator, the Secretary of Defense, the Secretary of State, the National Space Council, and representatives of the commercial space industry, academia, and nonprofit organizations, shall publish a list of select identified orbital debris that may be remediated to improve the safety and sustainability of orbiting satellites and on-orbit activities.</text></paragraph><paragraph id="idf8f77919619744e5955b1fdcbed7f45b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The list required under paragraph (1)—</text><subparagraph id="idb3b76bfb3d044ba5a086935006805989" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall be developed using appropriate sources of data and information derived from governmental and nongovernmental sources, including space situational awareness data obtained by the Office of Space Commerce, to the extent practicable;</text></subparagraph><subparagraph id="idb472bb12db524b54849889000b0e0400" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">shall include, to the extent practicable—</text><clause id="id681bb2ed9799436ea616d14b09869d84" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the approximate age, location in orbit, size, mass, tumbling state, post-mission passivation actions taken, and national jurisdiction of each orbital debris identified; and</text></clause><clause id="idb3bb6f01828444feaad5a969a1f2e9aa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">data required to inform decisions regarding potential risk and feasibility of safe remediation; </text></clause></subparagraph><subparagraph id="id84e662474de14f6c9568240a3725b2de" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">may include orbital debris that poses a significant risk to terrestrial people and assets, including risk resulting from potential environmental impacts from the uncontrolled reentry of the orbital debris identified; and</text></subparagraph><subparagraph id="idcca58080a4d04abe9e412bfaeeca2717" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">may include collections of small debris that, as of the date of the enactment of this Act, are untracked.</text></subparagraph></paragraph><paragraph id="id6182c55e12bd4a99a7d0039482904616" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Public availability; periodic updates</header><subparagraph id="idf34f4b82e64347a8bae28abe594142fe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the list required under paragraph (1) shall be published in unclassified form on a publicly accessible internet website of the Department of Commerce.</text></subparagraph><subparagraph id="id649a420d8a9142b5a48487d794738d4d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The Secretary may not include on the list published under subparagraph (A) data acquired from nonpublic sources.</text></subparagraph><subparagraph id="id5e8cd3ff50f644b198cabf052b333000" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Periodic updates</header><text display-inline="yes-display-inline">Such list shall be updated periodically.</text></subparagraph></paragraph><paragraph id="idcc22d40a2c464e0cbea4f890955f84e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Acquisition, access, use, and handling of data or information</header><text display-inline="yes-display-inline">In carrying out the activities under this subsection, the Secretary—</text><subparagraph id="idd2e01a777b8f4b6aa0a6a019a3c203c1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall acquire, access, use, and handle data or information in a manner consistent with applicable provisions of law and policy, including laws and policies providing for the protection of privacy and civil liberties, and subject to any restrictions required by the source of the information;</text></subparagraph><subparagraph id="id335fcddb8a1e4c12aa9ae4bae3bf0028" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">shall have access, upon written request, to all information, data, or reports of any executive agency that the Secretary determines necessary to carry out the activities under this subsection, provided that such access is—</text><clause id="id945af70cb6a544218b11656be5cfc0b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">conducted in a manner consistent with applicable provisions of law and policy of the originating agency, including laws and policies providing for the protection of privacy and civil liberties; and</text></clause><clause id="idfe1699d3f5ce44e3bd9f6bfe4097333f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">consistent with due regard for the protection from unauthorized disclosure of classified information relating to sensitive intelligence sources and methods or other exceptionally sensitive matters; and</text></clause></subparagraph><subparagraph id="ide9ec14f96a2e42b2a8184bf15a801106" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">may obtain commercially available information that may not be publicly available.</text></subparagraph></paragraph></subsection><subsection id="idb6da86f765b24822b25add08501dd44c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Active orbital debris remediation demonstration project</header><paragraph id="id5a7dbdceca4e4b149bb5da9de578fd05" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, subject to the availability of appropriations, the Administrator, in consultation with the head of each relevant Federal department or agency, shall establish a demonstration project to make competitive awards for the research, development, and demonstration of technologies leading to the remediation of selected orbital debris identified under subsection (a)(1).</text></paragraph><paragraph id="idf5e972bec7a948d8a97c8f4bf519fb5a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the demonstration project shall be to enable eligible entities to pursue the phased development and demonstration of technologies and processes required for active debris remediation.</text></paragraph><paragraph id="id6ac33fddcda3493db650c1ce0e3ecdfc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Procedures and criteria</header><text display-inline="yes-display-inline">In establishing the demonstration project, the Administrator shall—</text><subparagraph id="id463dcb451f8549aa96a7be74e4da67b2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">establish—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id5748e14c36834407976c7f4eaa7d26a3"><enum>(i)</enum><text display-inline="yes-display-inline">eligibility criteria for participation; and</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id4d62285b3e8743cca9cf2958e203768e"><enum>(ii)</enum><text display-inline="yes-display-inline">a process for soliciting proposals from eligible entities;</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="idd94bfaf8619746a784e66fc2e1f1a171"><enum>(iii)</enum><text display-inline="yes-display-inline">criteria for the contents of such proposals;</text></clause><clause id="id372d60eb71ac457fa4a1dfd4933b29cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">project compliance and evaluation metrics; and</text></clause><clause id="id64273f686bc34d4caaffb6d304e90cc3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">project phases and milestones;</text></clause></subparagraph><subparagraph id="ide84d41eac40b4d1d83b1947c0f264be1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">identify government-furnished data or equipment; </text></subparagraph><subparagraph id="id2aa3180791f44e5386703fba0c024a04" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">develop a plan for National Aeronautics and Space Administration participation, as appropriate, in technology development and intellectual property rights that—</text><clause commented="no" display-inline="no-display-inline" id="id64612780b589439b94e24dbbd75f7ecb" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">leverages National Aeronautics and Space Administration Centers that have demonstrated expertise and historical knowledge in measuring, modeling, characterizing, and describing the current and future orbital debris environment; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idadc1045306f14954b2b7d039750e9d7d" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">develops the technical consensus for adopting mitigation measures for such participation; and</text></clause></subparagraph><subparagraph id="idb32a92bbca034ec696ea606c6d7fe85e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id99a8261c09a54ec9a939b60d39e1ad4a" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">assign a project manager to oversee the demonstration project and carry out project activities under this subsection; and</text></clause><clause id="idfa8838303fdb4286959d63bcf81b21cf" changed="not-changed" commented="no" display-inline="no-display-inline" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in assigning such project manager, leverage National Aeronautics and Space Administration Centers and the personnel of National Aeronautics and Space Administration Centers, as practicable.</text></clause></subparagraph></paragraph><paragraph id="id7cd567748702492194c9f60f957269ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Research and development phase</header><text display-inline="yes-display-inline">With respect to orbital debris identified under paragraph (1) of subsection (a), the Administrator shall, to the extent practicable and subject to the availability of appropriations, carry out the additional research and development activities necessary to mature technologies, in partnership with eligible entities, with the intent to close commercial capability gaps and enable potential future remediation missions for such orbital debris, with a preference for technologies that are capable of remediating orbital debris that have a broad range of characteristics described in paragraph (2)(B)(i) of that subsection.</text></paragraph><paragraph id="id748a9987b9d0416da289a7fa91301a3b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Demonstration mission phase</header><subparagraph id="idb6052757404d4d76999b41bec23929b5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall evaluate proposals for a demonstration mission, and select and enter into a partnership with an eligible entity, subject to the availability of appropriations, with the intent to demonstrate technologies determined by the Administrator to meet a level of technology readiness sufficient to carry out on-orbit remediation of select orbital debris.</text></subparagraph><subparagraph id="id91f1a9f532b940fd8adf726e335632ff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">In evaluating proposals for the demonstration project, the Administrator shall—</text><clause id="id70158c82fb6b44a1a0095f1d660fca78" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">consider the safety, feasibility, cost, benefit, and maturity of the proposed technology;</text></clause><clause id="id4e5378e5c54a46e092cfe154945a9625" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">consider the potential for the proposed demonstration to successfully remediate orbital debris and to advance the commercial state of the art with respect to active debris remediation;</text></clause><clause id="id47848f74d790441ea3da225b99440753" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">carry out a risk analysis of the proposed technology that takes into consideration the potential casualty risk to humans in space or on the Earth’s surface;</text></clause><clause id="id41140f9e935a446d90d7d78dbaaf804e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">in an appropriate setting, conduct thorough testing and evaluation of the proposed technology and each component of such technology or system of technologies; and</text></clause><clause id="id7bab0bc0dfb244b2afa653cf9d29252d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">consider the technical and financial feasibility of using the proposed technology to conduct multiple remediation missions.</text></clause></subparagraph><subparagraph id="ida11c4594327a41af9ed41b0c6135fc92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Administrator shall consult with the head of each relevant Federal department or agency before carrying out any demonstration mission under this paragraph.</text></subparagraph><subparagraph id="id1bce1c9097894b85a703c9c8f1bf6ce8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Active debris remediation demonstration mission</header><text display-inline="yes-display-inline">It is the sense of Congress that the Administrator should consider maximizing competition for, and use best practices to engage commercial entities in, an active debris remediation demonstration mission.</text></subparagraph></paragraph><paragraph id="id42900b68dd914e58b55505419b4750bb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Briefing and reports</header><subparagraph id="id88da25526d144670b87720617cba44e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Initial briefing</header><text display-inline="yes-display-inline">Not later than 30 days after the establishment of the demonstration project under paragraph (1), the Administrator shall provide to the appropriate committees of Congress a briefing on the details of the demonstration project.</text></subparagraph><subparagraph id="id54E3F8CC89F44A4C8DDED5875B2000C4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than 1 year after the initial briefing under subparagraph (A), and annually thereafter until the conclusion of the 1 or more demonstration missions, the Administrator shall submit to the appropriate committees of Congress a status report on—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id1253bec4d68947e4badc96584cfa74fa"><enum>(i)</enum><text display-inline="yes-display-inline">the technology developed under the demonstration project;</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id569f2803d42d4263ba2cbe5f4d685487"><enum>(ii)</enum><text display-inline="yes-display-inline">progress toward the accomplishment of the 1 or more demonstration missions; and</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="idc6bc89a96ef54e109cbdd73770f7bbde"><enum>(iii)</enum><text display-inline="yes-display-inline">any duplicative efforts carried out or supported by the National Aeronautics and Space Administration or the Department of Defense. </text></clause></subparagraph><subparagraph id="id4fe3dab04acd411ba590e76334d31f0e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the first demonstration mission is carried out under this subsection, the Administrator, in consultation with the head of each relevant Federal department or agency, shall submit to Congress a report that provides legislative, regulatory, and policy recommendations to improve active debris remediation missions, as applicable.</text></subparagraph><subparagraph id="id198b49cb82d24e4c9e2016ef1dfe6fea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Technical analysis</header><clause id="id54472c4754024b4691dbaa542bb6b250" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To inform decisions regarding the acquisition of active debris remediation services by the Federal Government, not later than 1 year after the date on which an award is made under paragraph (1), the Administrator shall submit to Congress a report that—</text><subclause id="id47e3faca03574e8ab9d5a20a03aac9e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">summarizes the cost-effectiveness, and provides a technical analysis of, technologies developed under the demonstration project;</text></subclause><subclause id="idc897ff74496a4967b71143941391e827" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">identifies any technology gaps addressed by the demonstration project and any remaining technology gaps; and</text></subclause><subclause id="id1b4e1bd1d0b14f769397d8fe7ae7f62c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">provides, as applicable, any further legislative, regulatory, and policy recommendations to enable active debris remediation missions.</text></subclause></clause><clause id="idf8db0340b82d4003b2b5cfe550621b9a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The Administration shall make the report submitted under clause (i) available to the Secretary, the Secretary of Defense, and other relevant Federal departments and agencies, as determined by the Administrator.</text></clause></subparagraph></paragraph><paragraph id="idc900bd31e31f4a16a8dcaf7e7ea3dfd8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Sense of Congress on international cooperation</header><text display-inline="yes-display-inline">It is the sense of Congress that, in carrying out the demonstration project, it is critical that the Administrator, in coordination with the Secretary of State and in consultation with the National Space Council, cooperate with one or more partner countries to enable the remediation of orbital debris that is under their respective jurisdictions.</text></paragraph></subsection><subsection id="idF2C957614CF349C7BD7D6B904FD6CDDF" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator to carry out this section $150,000,000 for the period of fiscal years 2024 through 2028.</text></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id6243d7b31a474997bab7366c97223e89"><enum>(d)</enum><header display-inline="yes-display-inline">Rescission of unobligated funds</header><text display-inline="yes-display-inline">Unobligated balances of amounts appropriated or otherwise made available by subsection (c) as of September 30, 2028, shall be rescinded not later than December 31, 2028.</text></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id939c143f9ff14cb4b884e0fd81c19978"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to grant the Administrator the authority to issue any regulation relating to activities under subsection (b) or related space activities under title 51, United States Code.</text></subsection></section><section id="id9c20043a206e47d986eafcd6dfdc97b3" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Active debris remediation services</header><subsection id="id0861881226a949eba1ff1a484172eebe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To foster the competitive development, operation, improvement, and commercial availability of active debris remediation services, and in consideration of the economic analysis required by subsection (b) and the briefing and reports under section 4(b)(6), the Administrator and the head of each relevant Federal department or agency may acquire services for the remediation of orbital debris, whenever practicable, through fair and open competition for contracts that are well-defined, milestone-based, and in accordance with the Federal Acquisition Regulation.</text></subsection><subsection id="idaa33517bb092440f82c6c66bc1ae6a46" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Economic analysis</header><text display-inline="yes-display-inline">Based on the results of the demonstration project, the Secretary, acting through the Office of Space Commerce, shall publish an assessment of the estimated Federal Government and private sector demand for orbital debris remediation services for the 10-year period beginning in 2025.</text></subsection></section><section id="id8f0bd4e91f904cb09d6a678dfdf8fed2" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Uniform orbital debris standard practices for United States space activities</header><subsection id="id8129d01f26ce4d309787dc9bec978fd4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the National Space Council, in coordination with the Secretary, the Administrator of the Federal Aviation Administration, the Secretary of Defense, the Secretary of State, the Federal Communications Commission, and the Administrator, shall initiate an update to the Orbital Debris Mitigation Standard Practices that—</text><paragraph id="id9c361381336840db8121b3a47bec782a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">considers planned space systems, including satellite constellations; and</text></paragraph><paragraph id="ide5f707ad5bcf4c62954c580211ee68c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">addresses—</text><subparagraph id="id1714f839c62149459fd15b56193e9282" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">collision risk;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb9d045cac2644c408085d86dece07978" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">explosion risk;</text></subparagraph><subparagraph id="idc008319e1ec54bca897bb0e002246676" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">casualty probability;</text></subparagraph><subparagraph id="idb510d38a21b24b549f8ae19a3da9fb8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">post-mission disposal of space systems;</text></subparagraph><subparagraph id="idd17168d5a4c743beb9cff1b10d890472" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">time to disposal or de-orbit;</text></subparagraph><subparagraph id="id35461e05db784b9492a636f1a3f5283c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">spacecraft collision avoidance and automated identification capability; and</text></subparagraph><subparagraph id="id9a15b0a38a5e41fd83f256fd3a84d663" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the ability to track orbital debris of decreasing size.</text></subparagraph></paragraph></subsection><subsection id="id8c848dc6c5bb4b09b1decce15e643fd6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In developing the update under subsection (a), the National Space Council, or a designee of the National Space Council, shall seek advice and input on commercial standards and best practices from representatives of the commercial space industry, academia, and nonprofit organizations, including through workshops and, as appropriate, advance public notice and comment processes under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code.</text></subsection><subsection id="ide695d1b9f41e4018ba4d895e28edae4d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, such update shall be published in the Federal Register and posted to the relevant Federal Government internet websites.</text></subsection><subsection id="id8c157f6dd2eb4fef80a48a358a5bc8f4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">To promote uniformity and avoid duplication in the regulation of space activity, including licensing by the Federal Aviation Administration, the National Oceanic and Atmospheric Administration, and the Federal Communications Commission, such update, after publication, shall be used to inform the further development and promulgation of Federal regulations relating to orbital debris.</text></subsection><subsection id="id4e0a62597f694aa9a6b7e6384860c631" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">International promotion</header><text display-inline="yes-display-inline">To encourage effective and nondiscriminatory standards, best practices, rules, and regulations implemented by other countries, such update shall inform bilateral and multilateral discussions focused on the authorization and continuing supervision of nongovernmental space activities.</text></subsection><subsection id="ida93481dcaeb24bf5b159f6789f655c43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">Not less frequently than every 5 years, the Orbital Debris Mitigation Standard Practices referred to in subsection (a) shall be assessed and, if necessary, updated, used, and promulgated in a manner consistent with this section.</text></subsection></section><section id="id589968ef33fc428dbfde45411ecfeb49" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Standard practices for space traffic coordination</header><subsection id="iddc6d13faf9ce48ecbffc2753820afa37" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Defense and members of the National Space Council and the Federal Communications Commission, shall facilitate the development of standard practices for on-orbit space traffic coordination based on existing guidelines and best practices used by Government and commercial space industry operators.</text></subsection><subsection id="id3b9b7be5b9e8440fbe6ea2433a5702d4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In facilitating the development of standard practices under subsection (a), the Secretary, through the Office of Space Commerce, in consultation with the National Institute of Standards and Technology, shall engage in frequent and routine consultation with representatives of the commercial space industry, academia, and nonprofit organizations.</text></subsection><subsection id="idc1955365190147c2b85766010294a359" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Promotion of standard practices</header><text display-inline="yes-display-inline">On completion of such standard practices, the Secretary, the Secretary of State, the Secretary of Transportation, the Administrator, and the Secretary of Defense shall promote the adoption and use of the standard practices for domestic and international space missions. </text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20231031" chamber="Senate">Passed the Senate October
