which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the Intercountry Adoption Act of 2000 to provide a limited accreditation option for performing certain adoption services.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Limited Accreditation for Adoption Services Act</short-title></quote>.</text></section><section id="id0268a8997e0441ee84fb18dacc1b51c5"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id38c4632fa861405d98ef0844e235f079"><enum>(1)</enum><text>prospective adoptive parents should receive high-quality services from experienced providers for their child background studies, home studies, and post-placement reports;</text></paragraph><paragraph id="ida4ba1cc8fbc44100bdd3a96eef26e036"><enum>(2)</enum><text>the number of accredited adoption service providers is declining in the United States, leading to fewer options of accredited service providers;</text></paragraph><paragraph id="id5566d9db429947f4a8ba64b13cf04959"><enum>(3)</enum><text>some foreign countries, primary providers and many adoptive families have a preference that only accredited adoption service providers conduct intercountry home studies and post-placement/post-adoption reporting, if required;</text></paragraph><paragraph id="id11d6d141676940d58510af282c6e1a62"><enum>(4)</enum><text>accreditation and approval helps to ensure compliance with standards and requires accrediting entities to provide oversight, enforcement, and data and report collection for accredited and approved adoption service providers; and</text></paragraph><paragraph id="idc759538cf9be4ec88ad56da3679f1f64"><enum>(5)</enum><text>United States intercountry adoption practices can be enhanced by supporting an accreditation system that includes a new, limited accreditation option for the provision of a background study on a child, a home study on the prospective adoptive parents, or a post-placement report, in addition to current, comprehensive, mandatory accreditation for primary providers.</text></paragraph></section><section id="id687ab09a952144229f896c5cb6fec128"><enum>3.</enum><header>Amendments to the Intercountry Adoption Act of 2000</header><subsection id="id5a43b286c49747978ac53353b0b60d80"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Intercountry Adoption Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14902">42 U.S.C. 14902</external-xref>) is amended—</text><paragraph id="id25e4458a7ec64d79b9374a27d0f2b9be"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or limited accreditation</quote> after <quote>adoption services</quote>;</text></paragraph><paragraph id="id437EB7A69DA54CDE83164A3014AFE137"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (13) through (17) as paragraphs (14) through (18), respectively; and</text></paragraph><paragraph id="id49440D67B1BC4D7294DA0EE59EBCFE17"><enum>(3)</enum><text>by inserting after paragraph (12) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4A996BE887574C3E820EF9CD44E727A0"><paragraph id="idee3ec1ab83ab4a8db18681c36facd8ee"><enum>(13)</enum><header>Limited accreditation</header><text>The term <term>limited accreditation</term> means voluntary accreditation that is limited to the provision of 1 or more of the following services:</text><subparagraph id="id8fe9efebeac3484ca941d5f79c4a584c"><enum>(A)</enum><text>Performing a background study on a child in an outgoing case and reporting on such a study.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida947e877dc874e34a47f6aa2872054ec"><enum>(B)</enum><text display-inline="yes-display-inline">Performing a home study on a prospective adoptive parent in an incoming case and reporting on such a study.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0330a198d374873a517f3c3d78590dc"><enum>(C)</enum><text display-inline="yes-display-inline">Monitoring a case after a child has been placed with prospective adoptive parents until final adoption, including preparing post-placement reports.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5415b4050f374ae590b3abc77e2a8616"><enum>(b)</enum><header>Accreditation and approval</header><paragraph commented="no" display-inline="no-display-inline" id="id2928e768848f4c3686ae58713166058c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(b)(1) of the Intercountry Adoption Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14922">42 U.S.C. 14922(b)(1)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id200534305fbe4cd7989f14bda242d087"><paragraph id="id87dea945771b43dea58669d2ef345b51"><enum>(1)</enum><header>Accreditation and approval</header><text>Accreditation or limited accreditation of agencies, and approval of persons, to provide adoption services in the United States in cases subject to the Convention or Intercountry Adoption Universal Accreditation Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/276">Public Law 112–276</external-xref>). At the time of initial or renewal of accreditation or limited accreditation of agencies, and approval of persons, the applying entity shall indicate whether the entity seeks accreditation as—</text><subparagraph id="id9d3317f0b47641039d8c930b37478fc3"><enum>(A)</enum><text>an accredited agency or approved person; or</text></subparagraph><subparagraph id="idd77d3c3dcbfd45868d4f8cd479d8fcf1"><enum>(B)</enum><text>an agency with a limited accreditation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id7631725e5cdf4fc294d87be360665128"><enum>(2)</enum><header>Exemption from paperwork reduction act</header><text display-inline="yes-display-inline">Section 503(c) of the Intercountry Adoption Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14953">42 U.S.C. 14953(c)</external-xref>) is amended by inserting <quote>202(b)(1),</quote> after <quote>104,</quote>.</text></paragraph></subsection></section><section id="id490de424489c4499a27cde9615a47d73"><enum>4.</enum><header>Rules of construction</header><subsection id="id12050B245091404094733D2C016B362A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act may be construed to require that intercountry adoption service providers have a limited accreditation (as defined in section 3(13) of the Intercountry Adoption Act of 2000, as amended by section 3(a)(3)), to provide a home study on prospective adoptive parents pursuing an intercountry adoption. </text></subsection><subsection id="idB934DC0ED8C544AA8EE9D179DEFC781A"><enum>(b)</enum><header>Definition of adoption service</header><text>Nothing in this Act or in the amendments made by this Act may be construed to modify the definition of <quote>adoption service</quote> under section 3 of the Intercountry Adoption Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14902">42 U.S.C. 14902</external-xref>).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6741083a5e474e9aa809b28c3c74d91e"><enum>5.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">This Act shall take effect on the date that is 90 days after the date of the enactment of this Act. </text></section></legis-body></bill>
