which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to authorize the ordering of units of the Selected Reserve to active duty to respond to significant cyber incidents, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defense Support for Cyber Emergencies Response Act of 2023</short-title></quote>.</text></section><section id="HA984C61994544616A9F7105206E12BF6"><enum>2.</enum><header>Selected Reserve order to active duty to respond to a significant cyber incident</header><text display-inline="no-display-inline">Section 12304 of title 10, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H5E56274B6F534CD6A959E1511CC10575"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>for any named operational mission</quote>;</text></paragraph><paragraph id="HA624B8B307C741A19CEEFE213AF1CEB4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) through (j) as subsections (d) through (k), respectively; </text></paragraph><paragraph id="H2598B8DC2AC6419181EDEA60F2297749" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCB4EFF04BE8A432687B8C28A4E9D2505"><subsection id="H021476D6A5C049B0BC489CADD036FCE2" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authority relating to significant cyber incidents</header><text display-inline="yes-display-inline">When the Secretary of Defense or the Secretary of the department in which the Coast Guard is operating determines that it is necessary to augment the active armed forces for the response of the Department of Defense or other department under which the Coast Guard is operating, respectively, to a covered incident, such Secretary may, without the consent of the member affected, order any unit, and any member not assigned to a unit organized to serve as a unit of the Selected Reserve (as defined in section 10143(a) of this title), under the respective jurisdiction of such Secretary, to active duty for not more than 365 consecutive days. </text></subsection><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph id="HDFEDB6AD6D1E444D86113023F93646D9" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (1) of subsection (d), as redesignated by paragraph (2), by inserting <quote>or subsection (c)</quote> after <quote>subsection (b)</quote>;</text></paragraph><paragraph id="H158F830F36AD46B9822FD305F0B20C9E"><enum>(5)</enum><text>in subsection (g), as redesignated by paragraph (2), by inserting <quote>or subsection (c)</quote> after <quote>subsection (a)</quote>; </text></paragraph><paragraph id="H322B9B7C47AA42D88BEBE971F9833911" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">by amending subsection (h), as redesignated by paragraph (2), to read as follows:</text><quoted-block style="USC" id="HB767EA6200FE40818A336C329A42FB6E" display-inline="no-display-inline"><subsection id="HF6B1024A4C7F4EE58AC3C04F2274FDE4"><enum>(h)</enum><header>Termination of duty</header><paragraph commented="no" display-inline="yes-display-inline" id="H6ADA80E3B4E7403F8104D0ED7EA1AEEC"><enum>(1)</enum><text display-inline="yes-display-inline">Whenever any unit of the Selected Reserve or any member of the Selected Reserve not assigned to a unit organized to serve as a unit, or any member of the Individual Ready Reserve, is ordered to active duty under authority of subsection (a), the service of all units or members so ordered to active duty may be terminated by—</text><subparagraph id="H30A94F0673F74907A01128DF9F216EA4" indent="up1"><enum>(A)</enum><text>order of the President; or</text></subparagraph><subparagraph id="H53BFA63C3D45421497459D0463EA3C1B" indent="up1"><enum>(B)</enum><text>law.</text></subparagraph></paragraph><paragraph id="H58334042E1C5492F8F3C9533B725F8E2" indent="up1"><enum>(2)</enum><text>Whenever any unit of the Selected Reserve or any member of the Selected Reserve not assigned to a unit organized to serve as a unit is ordered to active duty under authority of subsection (c), the service of all units or members so ordered to active duty may be terminated by—</text><subparagraph id="HE4981C0860044B14B5E3F3CFE3BC95EB" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">order of the Secretary of Defense or, with respect to the Coast Guard, the Secretary of the Department in which the Coast Guard is operating; or</text></subparagraph><subparagraph id="H7BC0360CB00D4EEA91E0140588C27FBC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">law.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1C738C493CBA4298922BAA3CF85CB101" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">in subsection (k), as redesignated by paragraph (2)—</text><subparagraph id="HF3D4BF688F624D1AA69F6925AB8C9530" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text></subparagraph><subparagraph id="H2DAF984D660B4B909BAA3F412548094B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after the matter preceding paragraph (2), as so redesignated, the following new paragraph:</text><quoted-block id="HF7CB36362ECF4A9C858AC5605FE105DA" display-inline="no-display-inline" style="OLC"><paragraph id="H1C6AC17813324F00B48699B8E360E258" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered incident</term> means—</text><subparagraph id="HD248E49D503C4444BF1FB60379329AF4" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a cyber incident involving a Department of Defense information system, or a breach of a Department of Defense system that involves personally identifiable information, that the Secretary of Defense determines is likely to result in demonstrable harm to the national security interests, foreign relations, or the economy of the United States, or to the public confidence, civil liberties, or public health and safety of the people of the United States;</text></subparagraph><subparagraph id="H7B6895BCCF6A4AB3A8B8BDC39CE481D0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a cyber incident involving a Department of Homeland Security information system, or a breach of a Department of Homeland Security system that involves personally identifiable information, that the Secretary of Homeland Security determines is likely to result in demonstrable harm to the national security interests, foreign relations, or the economy of the United States or to the public confidence, civil liberties, or public health and safety of the people of the United States; </text></subparagraph><subparagraph id="HD949DA858BCB4337B4DCFB8525C61DB5" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a cyber incident, or collection of related cyber incidents, that the President determines is likely to result in demonstrable harm to the national security interests, foreign relations, or economy of the United States or to the public confidence, civil liberties, or public health and safety of the people of the United States; or</text></subparagraph><subparagraph id="H57BE786BA45840A4995D638A28DB6E3E" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">a significant incident declared pursuant to section 2233 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/677b">6 U.S.C. 677b</external-xref>).</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
