and United States-flag vessels, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H38AAF79F497740B4A59142A88511EB84"><section section-type="section-one" id="H5F13A8F51277414581FD69AAC60C5BD3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energizing American Shipbuilding Act of 2023</short-title></quote>.</text></section><section id="HA071526B061A498BAE50ED04D20FAC4B"><enum>2.</enum><header>National policy on strategic energy asset export transportation</header><subsection id="H640BB7562F1C4DA6ADA360D67C55D8B6"><enum>(a)</enum><header>LNG exports</header><paragraph id="HBCCFEC736F264DBEB675803C840C87F6"><enum>(1)</enum><header>Requirement for transportation of exports of natural gas on vessels documented under laws of the United States</header><text>Section 3 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC2E7A6E75C4A4AE3B6D4DB3B89136CDE"><subsection id="H0C0CF9E0845B483096601A45B8C9D3E1"><enum>(g)</enum><header>Transportation of exports of natural gas on vessels documented under laws of the United States</header><paragraph commented="no" id="H4759CC9B57F9403E92DF4A45C6BACFAF"><enum>(1)</enum><header>Condition for approval</header><text display-inline="yes-display-inline">Except as provided in paragraph (7), with respect to an application to export natural gas under subsection (a), the Commission shall include in the order issued for that application the condition that the person transport the natural gas on a vessel that meets the requirements described in paragraph (3).</text></paragraph><paragraph commented="no" id="id7FDBA7E9ACB346E7ACE889B6FE0EC94D"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the requirement under paragraph (1) is to ensure that, of all natural gas exported by vessel in a calendar year, the following percentage is exported by a vessel that meets the requirements described in paragraph (3):</text><subparagraph commented="no" id="HCC9956BE0EB2470EB230AA85852C1B65"><enum>(A)</enum><text display-inline="yes-display-inline">In each of the 7 calendar years following the calendar year in which this subsection is enacted, not less than 2 percent.</text></subparagraph><subparagraph commented="no" id="H8FF2A3A220BB448AA3A439B33826BA9E"><enum>(B)</enum><text display-inline="yes-display-inline">In each of the 8th and 9th calendar years following the calendar year in which this subsection is enacted, not less than 3 percent.</text></subparagraph><subparagraph commented="no" id="H50C7BC735C594E0C80BC1D35247FDD87"><enum>(C)</enum><text>In each of the 10th and 11th calendar years following the calendar year in which this subsection is enacted, not less than 4 percent.</text></subparagraph><subparagraph commented="no" id="HB5BE7C64E7EA41B7BB633795168AF082"><enum>(D)</enum><text display-inline="yes-display-inline">In each of the 12th and 13th calendar years following the calendar year in which this subsection is enacted, not less than 6 percent.</text></subparagraph><subparagraph commented="no" id="HA4EDC1B56D1E4B57A4784AA231A65387"><enum>(E)</enum><text>In each of the 14th and 15th calendar years following the calendar year in which this subsection is enacted, not less than 7 percent.</text></subparagraph><subparagraph commented="no" id="H467D9C6DCEB94B02AB78D9AB2836E0C2"><enum>(F)</enum><text display-inline="yes-display-inline">In each of the 16th and 17th calendar years following the calendar year in which this subsection is enacted, not less than 9 percent.</text></subparagraph><subparagraph commented="no" id="HA296EA9EB3E140D99186686046B3E361"><enum>(G)</enum><text display-inline="yes-display-inline">In each of the 18th and 19th calendar years following the calendar year in which this subsection is enacted, not less than 11 percent.</text></subparagraph><subparagraph commented="no" id="HCD926E51A97149C1AE715F73670505B1"><enum>(H)</enum><text display-inline="yes-display-inline">In each of the 20th and 21st calendar years following the calendar year in which this subsection is enacted, not less than 13 percent.</text></subparagraph><subparagraph commented="no" id="H612254B975A44CECBA2DF1FA04F290ED"><enum>(I)</enum><text display-inline="yes-display-inline">In the 22nd calendar year after the calendar year in which this subsection is enacted and each calendar year thereafter, not less than 15 percent.</text></subparagraph></paragraph><paragraph id="H7F7CD01DB66544D5910AE801017B67B7"><enum>(3)</enum><header>Requirements for vessels</header><text>A vessel meets the requirements described in this paragraph—</text><subparagraph commented="no" id="HCCC000995F204540B8F53236559D6643"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to each of the 5 calendar years following the calendar year in which this subsection is enacted—</text><clause commented="no" id="H8DCF1CAACD8744A38F4C0076402B9562"><enum>(i)</enum><text>if—</text><subclause commented="no" id="H62399610A81B4663AA7264C7AEFA8C46"><enum>(I)</enum><text display-inline="yes-display-inline">the vessel is documented under the laws of the United States; and</text></subclause><subclause commented="no" id="H70127A92038C44FBBEA54C6079136833"><enum>(II)</enum><text>with respect to any retrofit work necessary for the vessel to export natural gas—</text><item id="HBC530CF6B91D4EBF9986EC6724506C0B"><enum>(aa)</enum><text>such work is done in a shipyard in the United States; and</text></item><item commented="no" id="H1C5F4BDE34344387B3635CB3C4AB7AD9"><enum>(bb)</enum><text>any component of the vessel listed in paragraph (4) that is installed during the course of such work is manufactured in the United States; or</text></item></subclause></clause><clause commented="no" id="H62BFC10950394669B9F2F7FB57E25A1C"><enum>(ii)</enum><text>if—</text><subclause commented="no" id="H8BA3F2CA70E54C6FBED5C6DC2A0944DB"><enum>(I)</enum><text>the vessel is built in the United States;</text></subclause><subclause commented="no" id="HD5249F8541E840BD87467D85DFD0A1BD"><enum>(II)</enum><text>the vessel is documented under the laws of the United States;</text></subclause><subclause commented="no" id="H74DCAE396B2447DE8B77C1211F3B12F0"><enum>(III)</enum><text>all major components of the hull or superstructure of the vessel are manufactured (including all manufacturing processes from the initial melting stage through the application of coatings for iron or steel products) in the United States; and</text></subclause><subclause commented="no" id="H110A5DE50E1B46ACBF631A7908F37F22"><enum>(IV)</enum><text>the components of the vessel listed in paragraph (4) are manufactured in the United States; and</text></subclause></clause></subparagraph><subparagraph id="H27A932512EBB4F91BA42E8B535DBA312"><enum>(B)</enum><text>with respect to the 6th calendar year following the calendar year in which this subsection is enacted, and each calendar year thereafter, if the vessel meets the requirements of subparagraph (A)(ii).</text></subparagraph></paragraph><paragraph commented="no" id="H22693475C55441E590A8294F8C729949"><enum>(4)</enum><header>Components</header><text>The components of a vessel listed in this paragraph are the following:</text><subparagraph commented="no" id="H88D6590FB2554B758FE01DE40BB18602"><enum>(A)</enum><text>Air circuit breakers.</text></subparagraph><subparagraph commented="no" id="HBACC218CEA484089AD4D0AD43E269DA0"><enum>(B)</enum><text>Welded shipboard anchor and mooring chain.</text></subparagraph><subparagraph commented="no" id="HFA29C7019DBE414F8BD0A946EDD76D8C"><enum>(C)</enum><text>Powered and non-powered valves in Federal Supply Classes 4810 and 4820 used in piping.</text></subparagraph><subparagraph commented="no" id="HC58366EF14FA4604AF9D5C0DFA07E8AB"><enum>(D)</enum><text>Machine tools in the Federal Supply Classes for metal-working machinery numbered 3405, 3408, 3410 through 3419, 3426, 3433, 3438, 3441 through 3443, 3445, 3446, 3448, 3449, 3460, and 3461.</text></subparagraph><subparagraph commented="no" id="HACC71B4CE7F34A72A46F81901B9EEFAD"><enum>(E)</enum><text>Auxiliary equipment for shipboard services, including pumps.</text></subparagraph><subparagraph commented="no" id="H0D4215E49A45458AB60939541569F6CF"><enum>(F)</enum><text>Propulsion equipment, including engines, propulsion motors, reduction gears, and propellers.</text></subparagraph><subparagraph commented="no" id="HABC5CB25DD5C40C0A427BACFCB0954C2"><enum>(G)</enum><text>Shipboard cranes.</text></subparagraph><subparagraph commented="no" id="H61A6C26335B746609FDB8416AB6F0586"><enum>(H)</enum><text>Spreaders for shipboard cranes.</text></subparagraph><subparagraph id="H7D0C4FF033CD487295B068EF5641F29C"><enum>(I)</enum><text display-inline="yes-display-inline">Rotating electrical equipment, including electrical alternators and motors.</text></subparagraph><subparagraph commented="no" id="H1F62A38D52154C85AC6A15ED41884928"><enum>(J)</enum><text display-inline="yes-display-inline">Compressors, pumps, and heat exchangers used in managing and re-liquefying boil-off gas from liquefied natural gas.</text></subparagraph></paragraph><paragraph id="H1CBA2B804D8A44B98623E60D71F0E7DF"><enum>(5)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The Commission may waive the requirement under clause (i)(II)(bb) or (ii)(IV), as applicable, of paragraph (3)(A) with respect to a component of a vessel if the Maritime Administrator determines that—</text><subparagraph id="HE4927AB0DF104278B5F3DBEEFD823290"><enum>(A)</enum><text>application of the requirement would—</text><clause id="idB15E0D620C7B4DE5BFF0744ABA38872F"><enum>(i)</enum><text>result in an increase of 25 percent or more in the cost of the component of the vessel; or</text></clause><clause id="idA7589A6BAF3D46BD9BB4826DC37C4023"><enum>(ii)</enum><text>cause unreasonable delays to be incurred in building or retrofitting the vessel; or</text></clause></subparagraph><subparagraph commented="no" id="H7F35E54EBA2F4CF9A9C2BFA8C9CC3E20"><enum>(B)</enum><text>such component is not manufactured in the United States in sufficient and reasonably available quantities of a satisfactory quality.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id980D0A0C763F4850AA6DD62BCF9BC922"><enum>(6)</enum><header display-inline="yes-display-inline">Opportunities for licensed and unlicensed mariners</header><text display-inline="yes-display-inline">Except as provided in paragraph (7), the Commission shall include, in any order issued under subsection (a) that authorizes a person to export natural gas, a condition that the person provide opportunities for United States licensed and unlicensed mariners to receive experience and training necessary to become credentialed in working on a vessel transporting natural gas.</text></paragraph><paragraph commented="no" id="H2323535DCF7F4DDEBCC11C0DFEA8829F"><enum>(7)</enum><header>Exception</header><text display-inline="yes-display-inline">The Commission may not include in any order issued under subsection (a) authorizing a person to export natural gas to a nation with which there is in effect a free trade agreement requiring national treatment for trade in natural gas a condition described in paragraph (1), or a condition described in paragraph (6), if the United States Trade Representative certifies to the Commission, in writing, that such condition would violate obligations of the United States under such free trade agreement.</text></paragraph><paragraph display-inline="no-display-inline" id="H4DE4243CE58F4C829FFBDF39B3F68B72"><enum>(8)</enum><header>Use of Federal information</header><text>In carrying out paragraph (1), the Commission—</text><subparagraph id="HC4394FD8317A477F963B2738C4238E78"><enum>(A)</enum><text>shall use information made available by—</text><clause id="id7C760FECAFD44A46A00BFA09CF755013"><enum>(i)</enum><text>the Energy Information Administration; or</text></clause><clause id="id11D9C354E9EB444B83AD154C6228B3AA"><enum>(ii)</enum><text>any other Federal agency or entity the Commission determines appropriate; and</text></clause></subparagraph><subparagraph id="HC01B14E28D9E41758B9D0C967F97581E"><enum>(B)</enum><text>may use information made available by a private entity only if applicable information described in subparagraph (A) is not available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H7074664B739349C0946372BA89AE5220"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3(c) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717b">15 U.S.C. 717b(c)</external-xref>) is amended by striking <quote>or the exportation of natural gas</quote> and inserting <quote>or, subject to subsection (g), the exportation of natural gas</quote>.</text></paragraph></subsection><subsection id="H6B1E376F29B84B07A617AD5D920E1ED7"><enum>(b)</enum><header>Crude oil</header><text>Section 101 of title I of division O of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="usc" parsable-cite="usc/42/6212a">42 U.S.C. 6212a</external-xref>) is amended—</text><paragraph id="H2998A8D26EC8436CB1D5224CA4513DB0"><enum>(1)</enum><text>in subsection (b), by striking <quote>subsections (c) and (d)</quote> and inserting <quote>subsections (c), (d), and (f)</quote>; and</text></paragraph><paragraph id="HA9C80A524F1647A58E420F0EEBC0AA18"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H0F6AF7AC66F345F69C7DD04BC78D76AA"><subsection id="HAE338A2AF55D4F3EA463A7893E89C27F"><enum>(f)</enum><header>Transportation of exports of crude oil on vessels documented under laws of the United States</header><paragraph id="H6F558F52E7B54AEFB84174F2468BA616"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (6), as a condition to export crude oil, the President shall require that a person exporting crude oil transport the crude oil on a vessel that meets the requirements described in paragraph (3).</text></paragraph><paragraph id="id703280F54D064EC59D117648334DE46C"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the requirement under paragraph (1) is to ensure that, of all crude oil exported by vessel in a calendar year, the following percentage is exported by a vessel that meets the requirements described in paragraph (3):</text><subparagraph id="H2F75CB5737094B849382A7F6CB351344"><enum>(A)</enum><text display-inline="yes-display-inline">In each of the 7 calendar years following the calendar year in which this subsection is enacted, not less than 3 percent.</text></subparagraph><subparagraph id="H9A00BCAB033041BC94E0885ACB2CB12B"><enum>(B)</enum><text display-inline="yes-display-inline">In each of the 8th, 9th, and 10th calendar years following the calendar year in which this subsection is enacted, not less than 6 percent.</text></subparagraph><subparagraph id="H617B42503D6A44AE9B2DFD9CE685002D"><enum>(C)</enum><text display-inline="yes-display-inline">In each of the 11th, 12th, and 13th calendar years following the calendar year in which this subsection is enacted, not less than 8 percent.</text></subparagraph><subparagraph id="H41B1FD04C34348B284DF872B88902EF8"><enum>(D)</enum><text display-inline="yes-display-inline">In the 14th calendar year following the calendar year in which this subsection is enacted and each calendar year thereafter, not less than 10 percent.</text></subparagraph></paragraph><paragraph id="H4B418E11F4734F79B9F94BE6D5D4EFB2"><enum>(3)</enum><header>Requirements for vessels</header><text>A vessel meets the requirements described in this paragraph—</text><subparagraph commented="no" display-inline="no-display-inline" id="H1D86B3E1F2604FDE86417E345C204A7B"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to each of the 4 calendar years following the calendar year in which this subsection is enacted—</text><clause commented="no" id="H84B38ED734CC4FB99A1B0597633E8039"><enum>(i)</enum><text>if—</text><subclause commented="no" id="idC61C3205228547CFA0ADD158F49A3DCF"><enum>(I)</enum><text>the vessel is documented under the laws of the United States; and</text></subclause><subclause commented="no" id="HADDA8609AA0E4A438809D0D60C7C3A6B"><enum>(II)</enum><text>with respect to any retrofit work necessary for the vessel to export crude oil—</text><item id="HD7465BE17863498C8244B51920FE8917"><enum>(aa)</enum><text>such work is done in a shipyard in the United States; and</text></item><item commented="no" id="H09D8CD7FEC51470CA22804AF6C6DCB8D"><enum>(bb)</enum><text>any component of the vessel listed in paragraph (4) that is installed during the course of such work is manufactured in the United States; or</text></item></subclause></clause><clause commented="no" id="HABC810825D984F84803DDDA68C3FB8E6"><enum>(ii)</enum><text>if—</text><subclause commented="no" id="HDB38756EFDF74610B3C8AD6569574AEA"><enum>(I)</enum><text>the vessel is built in the United States;</text></subclause><subclause commented="no" id="HC6740BB7BE8F4809B593A0D6F01781E7"><enum>(II)</enum><text>the vessel is documented under the laws of the United States;</text></subclause><subclause commented="no" id="H81E5201E9C6545E092813FED319C8FB0"><enum>(III)</enum><text>all major components of the hull or superstructure of the vessel are manufactured (including all manufacturing processes from the initial melting stage through the application of coatings for iron or steel products) in the United States; and</text></subclause><subclause commented="no" id="HA785DEC030FD40B6B58EF6D03389F442"><enum>(IV)</enum><text>the components of the vessel listed in paragraph (4) are manufactured in the United States; and</text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H12801052AFF345E19167AC0D2F79C13C"><enum>(B)</enum><text>with respect to the 5th calendar year following the calendar year in which this subsection is enacted and each calendar year thereafter, if the vessel meets the requirements of subparagraph (A)(ii).</text></subparagraph></paragraph><paragraph commented="no" id="H57D5CAD193064981837D127065E2439D"><enum>(4)</enum><header>Components</header><text display-inline="yes-display-inline">The components of a vessel listed in this paragraph are the following:</text><subparagraph commented="no" id="H5A7FBB31D7F94BAB83ABB05ACD1A88D7"><enum>(A)</enum><text>Air circuit breakers.</text></subparagraph><subparagraph commented="no" id="HD450D0B5135E420BA9F17A09C4498D99"><enum>(B)</enum><text>Welded shipboard anchor and mooring chain.</text></subparagraph><subparagraph cranes.</text></subparagraph><subparagraph commented="no" id="HFA48DF19F2C249C9BD6228E0C5EBC166"><enum>(H)</enum><text>Spreaders for shipboard cranes.</text></subparagraph><subparagraph id="HE8C9EC2B1CB143398226EB12AB66D6B0"><enum>(I)</enum><text display-inline="yes-display-inline">Rotating electrical equipment, including electrical alternators and motors.</text></subparagraph></paragraph><paragraph commented="no" id="H4C05900FCB56460D9003A6B9103437FF"><enum>(5)</enum><header>Waiver authority</header><text display-inline="yes-display-inline">The President may waive the requirement under clause (i)(II)(bb) or clause (ii)(IV), as applicable, of paragraph (3)(A) with respect to a component of a vessel if the Maritime Administrator determines that—</text><subparagraph id="idAE397706981B42AFB7DCA6441523632E"><enum>(A)</enum><text>application of the requirement would—</text><clause id="idE4E7A31919CB493E83C6622CE625CF4C"><enum>(i)</enum><text>result in an increase of 25 percent or more in the cost of the component of the vessel; or</text></clause><clause id="id2B26227C568C4CDDAFE98CCC88E7264D"><enum>(ii)</enum><text>cause unreasonable delays to be incurred in building or retrofitting the vessel; or</text></clause></subparagraph><subparagraph commented="no" id="H73A760D458B94CF085077B16FD65EBA6"><enum>(B)</enum><text display-inline="yes-display-inline">such component is not manufactured in the United States in sufficient and reasonably available quantities of a satisfactory quality.</text></subparagraph></paragraph><paragraph commented="no" id="H84DDDFFA806B411187D71BD47DB0676F"><enum>(6)</enum><header>Exception</header><text>The President may not, under paragraph (1), condition the export of crude oil to a nation with which there is in effect a free trade agreement requiring national treatment for trade in crude oil if the United States Trade Representative certifies to the President, in writing, that such condition would violate obligations of the United States under such free trade agreement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HECC5DDADFC2B47B481EC862093E01B7E"><enum>(7)</enum><header display-inline="yes-display-inline">Opportunities for licensed and unlicensed mariners</header><text display-inline="yes-display-inline">The Maritime Administrator shall ensure that each exporter of crude oil by vessel provides opportunities for United States licensed and unlicensed mariners to receive experience and training necessary to become credentialed in working on such vessels.</text></paragraph><paragraph id="HFBBBD753F841439A9604338C570846E5"><enum>(8)</enum><header>Use of Federal information</header><text>In carrying out paragraph (1), the President—</text><subparagraph id="id077592C5018B48B1B6537CCE1CA1FC23"><enum>(A)</enum><text>shall use information made available by—</text><clause id="id2F78B95AF7E24D6B97739C86DACD0AF1"><enum>(i)</enum><text>the Energy Information Administration; or</text></clause><clause id="id92EE96C2EB9B478483C8861954589444"><enum>(ii)</enum><text>any other Federal agency or entity the Commission determines appropriate; and</text></clause></subparagraph><subparagraph id="id98FD3784456847BBB058E45FFC880C2A"><enum>(B)</enum><text>may use information made available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="HA3719456356248EF8C0F6B5A9E00F2C6"><enum>3.</enum><header>Energy Information Administration information</header><text display-inline="no-display-inline">The Secretary of Energy, acting through the Administrator of the Energy Information Administration (referred to in this section as the <quote>Secretary</quote>), shall collect, and make readily available to the public on the internet website of the Energy Information Administration, information on exports by vessel of natural gas and crude oil, including—</text><paragraph commented="no" id="H68E2C6195A8346978B8021D2C9A74C77"><enum>(1)</enum><text>forecasts for, and data on, those exports for the calendar year following the calendar year in which this Act is enacted and each calendar year thereafter; and</text></paragraph><paragraph commented="no" id="H461418A9138B4FBC8DC3296980660EB4"><enum>(2)</enum><text>forecasts for those exports for multiyear periods after the date of enactment of this Act, as determined appropriate by the Secretary.</text></paragraph></section></legis-body></bill>
