and</text></clause><clause id="idBFDAEB3471D143B9842849D577FF6DE0"><enum>(ii)</enum><text>by inserting after <quote>reasonable care</quote> the following: <quote>make entry therefor by filing with U.S. Customs and Border Protection, pursuant to an authorized electronic data interchange system</quote>;</text></clause></subparagraph><subparagraph id="id4B5F6DB2354D4961845AE24D0E274499"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="id369BA930BFF14E6D8AB483483823DB23"><enum>(i)</enum><text>by striking <quote>make entry</quote> and all that follows through <quote>interchange system, such</quote> and inserting <quote>such documentation or</quote>; and</text></clause><clause id="id871FFCB5F9BC4BAABC79230BF1E04262"><enum>(ii)</enum><text>by striking the semicolon and inserting <quote>; and</quote>; and</text></clause></subparagraph><subparagraph id="id819ED96B5D2C4912B3440A6BF222CAB7"><enum>(C)</enum><text>in subparagraph (B)—</text><clause id="idCAD9B7AED0644A3C9ADAF9135F26E005"><enum>(i)</enum><text>by striking <quote>complete the entry</quote> and all that follows through <quote>with the Customs Service</quote>; and</text></clause><clause id="idD964ECD33A88479B9D4C56F95A124B84"><enum>(ii)</enum><text>by striking <quote>, pursuant to an electronic data interchange system, such other</quote>;</text></clause></subparagraph></paragraph><paragraph id="id9A727AD13A984ACFA7E5628E67A37288"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id67B75E4390AA434A85F49E850C908E0D"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id33347CB195454AB2842F8224A3DEF61E"><enum>(i)</enum><text>in the second sentence, by striking <quote>regulations shall provide</quote> and inserting <quote>regulations may provide</quote>; and</text></clause><clause id="idC60F5F52CD09479E9A8DF290DC86794F"><enum>(ii)</enum><text>in the third sentence, by striking <quote>paragraph (1)(A)</quote> and inserting <quote>paragraph (1)</quote>; and</text></clause></subparagraph><subparagraph id="id263226CBB0D24306A54CC231E0C886A6"><enum>(B)</enum><text>in subparagraph (B), in the first sentence, by striking <quote>filed or electronically transmitted</quote> and inserting <quote>electronically filed</quote>; and</text></subparagraph></paragraph><paragraph id="idFFA6A27EFC384C3D93C3967C4F2BAF51"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6F921B87B1AB4E3F830BFA5F0CED8C6D"><paragraph id="idB41E59D974EE4396A63E44871922A581"><enum>(3)</enum><header>Exemptions from electronic filing requirement</header><text>The Secretary may, for such reasons as the Secretary deems necessary, exempt the filing of documentation or information required under this section from the requirement that the documentation or information be filed through an authorized electronic data interchange system, including by providing for temporary exemptions to that requirement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAD2A98F53156490D85A4352C08AA8622"><enum>(b)</enum><header>Provision of advance information</header><text>Section 484(a)(2) of the Tariff Act of 1930, as amended by subsection (a)(2), is further amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idDB4361DF6E8A472AAFFBC4CC22E9F00F"><subparagraph id="id46BF1C1262484193A1C8A7489D005170" indent="up1"><enum>(D)</enum><header>Provision of advance information</header><clause id="id2B5E0AEE365441D1B15BC4EB8B268C3B"><enum>(i)</enum><header>In general</header><text>Upon request by a party that would qualify as an importer of record or an authorized agent of that party and under such regulations as the Secretary may prescribe, U.S. Customs and Border Protection may—</text><subclause id="idA3937D8EB75947938F8ACAC5DFD85E88"><enum>(I)</enum><text>permit the party or agent, or a party other than the party or agent, to provide to U.S. Customs and Border Protection documentation or information with respect to merchandise in advance of entry of the merchandise; and </text></subclause><subclause id="idF37E8EEC04764CB6ABC40FCFC4C28264"><enum>(II)</enum><text>permit the importer of record to, using reasonable care, convert that documentation or information into a filing under subparagraph (B), subject to the certification requirement under subsection (d). </text></subclause></clause><clause id="id6F86F0ADA1424DCB9A5A0B72D50D1788"><enum>(ii)</enum><header>Type of documentation or information and usage</header><text>Documentation or information with respect to merchandise provided to U.S. Customs and Border Protection pursuant to regulations prescribed by the Secretary under clause (i) may be used by U.S. Customs and Border Protection for any lawful purpose.</text></clause><clause id="id9D3D6256B42E4AC597F8EC81BB12F04D"><enum>(iii)</enum><header>Accuracy of documentation and information</header><subclause id="idEAF235D6FC68427DAF602A18082EAFD0"><enum>(I)</enum><header>In general</header><text>A party providing documentation or information under clause (i)(I) shall ensure that the documentation or information is true and correct to the best of the knowledge and belief of the party, subject to any penalties authorized by law.</text></subclause><subclause id="id470694E8869D41589C976C3F2B005DC6"><enum>(II)</enum><header>Exception</header><text>The Secretary shall, in the regulations prescribed under clause (i), permit a party to provide to U.S. Customs and Border Protection documentation or information under clause (i)(I) on the basis of the reasonable belief of the party that the documentation or information is true and correct if the party is not reasonably able to verify the documentation or information.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id463DD9B18D7E41FBB65552022226DA1A"><enum>(iv)</enum><header>Civil penalty</header><subclause commented="no" display-inline="no-display-inline" id="idD72F409205DA4F6CB031AE2DC72FB09D"><enum>(I)</enum><header>In general</header><text>Any person who violates the regulations prescribed under this subparagraph is liable for a civil penalty in an amount not to exceed—</text><item commented="no" display-inline="no-display-inline" id="idA5397429251D490FAB2D9E4249303C12"><enum>(aa)</enum><text>$5,000 for the first violation; and </text></item><item commented="no" display-inline="no-display-inline" id="id755FD64F50F24C778B202F05E757465D"><enum>(bb)</enum><text>$10,000 for each subsequent violation. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id931BEE65959D4188872B361DD83C24FC"><enum>(II)</enum><header>Assessment per unit</header><text>A penalty imposed under this clause shall be assessed per item on the bill of lading.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf717a8bef3e1480c9d9ad74bd6c2c90b"><enum>(III)</enum><header display-inline="yes-display-inline">Additional penalties</header><text>A penalty imposed under this clause may be in addition to any other penalty provided by law.</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idC294C08544C543CF8D0157555A62C75B"><enum>(IV)</enum><header>Remission; mitigation</header><text>A penalty imposed under this clause may be remitted or mitigated, as appropriate, under section 618.</text></subclause></clause><clause id="id42c13df621e240b19fc762635a150771"><enum>(v)</enum><header>Regulations</header><text>Except with respect to merchandise the importation of which into the United States is prohibited or merchandise subject to a presumption of inadmissibility by operation of law, the Secretary, in promulgating such regulations as may be necessary to carry out the provisions of this subparagraph, shall give due consideration, where appropriate, with respect to the manner in which documentation or information that is provided to U.S. Customs and Border Protection prior to entry of the merchandise to which the documentation or information relates, and pursuant to such regulations, will support trade facilitation (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4301">19 U.S.C. 4301</external-xref>)), including whether such documentation or information would—</text><subclause id="id0e75e08fada04bf0a351ca94eb461959"><enum>(I)</enum><text>facilitate the priority processing and expedited release of merchandise from customs custody;</text></subclause><subclause id="id4c9bf50f276d4dec8c477a7a610f5587"><enum>(II)</enum><text>reduce redundancies in the trade data that parties in a supply chain are required to provide; and</text></subclause><subclause id="id6e0c1c4dd4c64610990373ca366c87ba"><enum>(III)</enum><text>allow for the opportunity to resolve requests for additional information prior to departure or arrival of the merchandise.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id35FA7871D9E54AF1BF24CAD4462A4D5B"><enum>(vi)</enum><header>Definition</header><text>In this subparagraph, the terms <term>provide</term>, <term>providing</term>, and <term>provision</term>, with respect to documentation or information provided to U.S. Customs and Border Protection, include—</text><subclause commented="no" display-inline="no-display-inline" id="idD9A1FBBBF9204604BFDA98C14F4E448A"><enum>(I)</enum><text>the submission or transmission of the documentation or information; </text></subclause><subclause id="id3c927fe472784ea49de1ad9bed5b1f4a"><enum>(II)</enum><text>the provision of the documentation or information in a manner that is progressive over time, as long as such provision concludes prior to conversion into an entry filing under subparagraph (B), and may include documentation or information that is also provided to U.S. Customs and Border Protection pursuant to other requirements or authorities; and </text></subclause><subclause id="id82717000890c4ff197d8b52f5c111794"><enum>(III)</enum><text>otherwise making available to U.S. Customs and Border Protection the documentation or information in accordance with such terms and conditions as the Secretary may by regulation prescribe.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id190B988B48754685B9C1ADF568BC0792"><enum>(c)</enum><header>Release of merchandise</header><text>Section 484(c) of the Tariff Act of 1930 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B0B18C7E5694B4691683D333DC8BB14"><subsection id="id645e4b4b7ab847be91820fca36fafeeb" commented="no"><enum>(c)</enum><header>Release of merchandise</header><paragraph id="idFAD994F6607A4BE5A80E769E50BA8B17" commented="no"><enum>(1)</enum><header>In general</header><text>U.S. Customs and Border Protection may permit the entry and release of merchandise from customs custody in accordance with such regulations as the Secretary may prescribe.</text></paragraph><paragraph commented="no" id="idFB248285519A4A55A0219EDB5DEB2742"><enum>(2)</enum><header>Liability of customs officers</header><text>No employee of U.S. Customs and Border Protection shall be liable to any person with respect to the delivery of merchandise released from customs custody in accordance with regulations prescribed under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8A804B9517CD434693BA4D6D8B43CA25"><enum>(d)</enum><header>Certification of entry filings</header><text>Section 484(d) of the Tariff Act of 1930 is amended—</text><paragraph id="idDB8CCD6B66D445EFBE926C15326AE37B"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Signing</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Certification</header-in-text></quote>; </text></paragraph><paragraph id="idFD54387BCCEA4DD995C0C011BE147EC5"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="id70857F0B0B124F588BCB1D3541CE8864"><enum>(A)</enum><text>by striking <quote>Entries shall be</quote> and all that follows through <quote>transmission of data</quote> and inserting <quote>Each filing under subsection (a)(2)(B)</quote>;</text></subparagraph><subparagraph id="id5318B4B5FFE44A1AAD6B989E770A481D"><enum>(B)</enum><text>by striking <quote>his agent</quote> and inserting <quote>an agent of the importer of record</quote>; </text></subparagraph><subparagraph id="id333169934D154E769EB0C757B3D612AC"><enum>(C)</enum><text>by striking <quote>his knowledge and belief</quote> and inserting <quote>the knowledge and belief of the importer of record or agent</quote>; and</text></subparagraph><subparagraph id="id543A8139DE8848D7B8D8B7CA4D667751"><enum>(D)</enum><text>by striking <quote>The entry shall</quote> and inserting <quote>If exempt from electronic filing, the entry shall be signed by the importer of record or agent. The entry shall</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida429f39802da44a1829e96ae72f82c17"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd99cc760f5854287b0f879c9cbbf396b"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>imported merchandise bears</quote> and inserting the following: “imported merchandise—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id49FD6B2C287E42EEA0E6588BBAA948EA"><subparagraph commented="no" display-inline="no-display-inline" id="idc5e3171de8d74409ac12b81aef2d06f4" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">bears</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b8aff9e0f684495a70fee3d467a177c"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b2a32e18eaa4d07be5eac7b26071a30"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD59B90904CD14C5496DC5DC2ED7D6909"><subparagraph commented="no" display-inline="no-display-inline" id="idda1cdef65b95489dbd97448c4bfc7606" indent="up1"><enum>(B)</enum><text>infringes a copyright in violation of section 602 of title 17, United States Code.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id29B973987F2544A180A3EE6E2F372BB0"><enum>(e)</enum><header>Technical and conforming amendments</header><text>Section 484 of the Tariff Act of 1930, as amended by this section, is further amended—</text><paragraph id="id90A95B707CBB4FC699340420924E7EB3"><enum>(1)</enum><text>in subsection (b)(1), in the third sentence, by striking <quote>subsection (a)(1)(B)</quote> and inserting <quote>subsection (a)(1)</quote>;</text></paragraph><paragraph id="id6E598E61109B4C548DAE3F84DAE83438"><enum>(2)</enum><text>by striking <quote>the Bureau of Customs and Border Protection</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>; and</text></paragraph><paragraph id="id76223698F7604CC7AFBB3B85000C7DBF" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>.</text></paragraph></subsection></section><section id="id43150E940879437F8CA5F73FFD424684" commented="no"><enum>102.</enum><header>Expansion of recordkeeping requirements relating to importation</header><text display-inline="no-display-inline">Section 508(a) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1508">19 U.S.C. 1508(a)</external-xref>) is amended—</text><paragraph id="idABCF85E1FC064544AEC9E14EB152E6FF" commented="no"><enum>(1)</enum><text>in paragraph (1)(B), by inserting <quote>, directs, or facilitates</quote> after <quote>causes</quote>;</text></paragraph><paragraph id="id426D8C669C85477794E8D8F6F2D34E49" commented="no"><enum>(2)</enum><text>in paragraph (2), by striking <quote>; or</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idB5F6FFC5BD1C4C20A7CDC6E10F22D0BB" commented="no"><enum>(4)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2243CAE1816C4DD09F5B98F9493B17F5"><paragraph id="idD74EC7CA7FA341AC8DAAEE7756B353AB" commented="no"><enum>(4)</enum><text>owner or operator of a commercial or marketing platform or marketplace, including an electronic commerce platform or marketplace, through which merchandise that is imported into the United States is offered for sale or purchase within the United States;</text></paragraph><after-quoted-block>; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id1E77A67C1A154DD3BCFD57ABF5D6A0B6" commented="no"><enum>103.</enum><header>Expansion of authority of U.S. Customs and Border Protection to obtain information relating to importation and trade enforcement</header><subsection id="idB2406BED55B0430FA0DAFD79B22C2D5E" commented="no"><enum>(a)</enum><header>In general</header><text>Section 509(a) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1509">19 U.S.C. 1509(a)</external-xref>) is amended—</text><paragraph id="id62A9598EC0EB4DC59121BBC9C4FC64DB" commented="no"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>insuring</quote> and all that follows through <quote>charge)</quote> and inserting the following: <quote>ensuring compliance with the customs and trade laws of the United States (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4301">19 U.S.C. 4301</external-xref>)) administered by U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement, the Secretary (but no delegate of the Secretary below the rank of port director, director of a Center of Excellence and Expertise, field director of regulatory audit, or special agent in charge)</quote>;</text></paragraph><paragraph id="id1770D63875EE4F18A4DE00CC9967DEED" commented="no"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="id0DEE0140A95846F6965A7E049F5A9FC0" commented="no"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>except that</quote> and inserting <quote>and</quote>;</text></subparagraph><subparagraph id="id281DB9DBFF7B4C16A1F9133D2807447B" commented="no"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>by law</quote> and all that follows through <quote>Customs Service within</quote> and inserting the following: <quote>to be kept under section 508, the record shall be provided to the agency demanding the record within</quote>; and</text></subparagraph><subparagraph id="id205BDC20CD864EAB805E3B647FDA9168" commented="no"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>the demand</quote> and all that follows and inserting the following: “the demand—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5E6F105BCF23447DA190D5CE2BC90B40"><clause id="id1D3B850751FD43608B7794F7D80D82CB" commented="no"><enum>(i)</enum><text>the person may be subject to penalty under subsection (g); and </text></clause><clause id="id759CCCDC57314C7791986C874C431127" commented="no"><enum>(ii)</enum><text>if U.S. Customs and Border Protection determines that the person has failed to make reasonable efforts to comply with the demand, U.S. Customs and Border Protection may use, in selecting from among the facts otherwise available, an inference that is adverse to the interests of the person in—</text><subclause id="idED21990547864611B0A25A8F2C86DB88" commented="no"><enum>(I)</enum><text>ascertaining the correctness of any entry; and</text></subclause><subclause id="idF83953813FE4406BAE5C2C4EA1624711" commented="no"><enum>(II)</enum><text>determining the liability of any person for—</text><item id="id0CF9FF6B38504C10934ACBFEBE5DD8F1" commented="no"><enum>(aa)</enum><text>fines and penalties; and</text></item><item id="id1E6DB97821FA44C3B694D491DE565A96" commented="no"><enum>(bb)</enum><text>duty, fees, and taxes that may be due to the United States.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id44B5C90FD7F24EA5901661DBBBFFC3FD" commented="no"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph commented="no" id="idB26A5846C32443FBAB05075B5F5164EF"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id98EAC216C4F64F3096D1A9FA6706E200" commented="no"><enum>(i)</enum><text>by redesignating clauses (ii), (iii), and (iv) as clauses (iii), (iv), and (v), respectively, and by moving such clauses, as so redesignated, 2 ems to the left;</text></clause><clause id="idD89EBDDA9CD74CAA9D2491B2D984EDAF" commented="no"><enum>(ii)</enum><text>by striking <quote>(A) the person who—</quote> and all that follows through <quote>Act),</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC2D482DC2A624D0CA02EB61FA329AFA9"><subparagraph id="id6092D103C7F244F18C72BE56F8C68029" commented="no"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idF5E9A35F67004B19BBAFEEC94BE8A8A0"><enum>(i)</enum><text>a person that imported, or knowingly caused to be imported, merchandise into the customs territory of the United States, or participated in, facilitated, or was otherwise knowingly connected or related to the importation of merchandise;</text></clause><clause id="id23C8C6D7C2534F6380B1C84B2FCA303F" indent="up1" commented="no"><enum>(ii)</enum><text>a vehicle producer whose good is subject to a claim of preferential tariff treatment under the USMCA (as defined in section 3 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4502">19 U.S.C. 4502</external-xref>)),</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id43575D8B22D14B48883B7A5A0387639A" commented="no"><enum>(iii)</enum><text>in clause (iii), as redesignated by clause (i), by inserting <quote>a person that</quote> before <quote>exported merchandise</quote>;</text></clause><clause id="id6DBC2F4E483D4B0FA4F9B30121FA7AD9" commented="no"><enum>(iv)</enum><text>in clause (iv), as so redesignated—</text><subclause id="id66623638F97440BC9D8733F4E14F5913" commented="no"><enum>(I)</enum><text>by inserting <quote>a person that</quote> before <quote>transported</quote>; and</text></subclause></clause><clause id="id7764B6993BD049CF8DF0AA0FD23B3241" commented="no"><enum>(vi)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD162909B2FA744B5822D5CDD8D94FD8B"><clause id="id07a004a15e274cc0b4ac08233230f570" indent="up1" commented="no"><enum>(v)</enum><text>an owner or operator of a commercial or marketing platform or marketplace through which merchandise that is imported into the United States is offered for sale or purchase within the United States;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="id597F32A3FD47458EBED2C061BAB541F0"><enum>(B)</enum><text>in the flush text following subparagraph (D), by striking <quote>records, as defined in subsection (d)(1)(A)</quote> and inserting <quote>records, which may include records defined in subsection (d)(1)(A)</quote>.</text></subparagraph></paragraph></subsection><subsection id="idAA0FB1CBE0124B74A448D410036D5CC7" commented="no"><enum>(b)</enum><header>Definition of records</header><text>Section 509(d)(1)(A) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1509">19 U.S.C. 1509(d)(1)(A)</external-xref>) is amended—</text><paragraph id="id0121CE86726F49B7B5920827D45859BA" commented="no"><enum>(1)</enum><text>in clause (i), by striking <quote>; or</quote>; and</text></paragraph><paragraph id="idE618B71A676C445A80F931348CAAE6C6" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3D745B92AE8C42F1B417E1F35C7CB288"><clause id="id2651aab778814b6a85cc08c5cabb0439" commented="no"><enum>(iii)</enum><text>that pertain to nonpayment of all or a portion of any lawful duties, taxes, or fees that may be due to the United States.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf9c1a385cd0747fbaad4a73c3b43ddd2" commented="no"><enum>(c)</enum><header>Identification of records and information</header><text>Section 509(e) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1509">19 U.S.C. 1509(e)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99824634c3084986b0527c44199885fd"><subsection id="idcd3273bad13e48e0979b3593d3b7c668" commented="no"><enum>(e)</enum><header>Identification of records and information</header><text>The Commissioner of U.S. Customs and Border Protection shall prescribe regulations identifying the records and information required to be maintained and produced under subsection (a)(1)(A).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1E794CF10A044A70B5BDCB7E226FE061" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Technical amendments</header><text>Section 509 of the Tariff Act of 1930, as amended by this section, is further amended by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>.</text></subsection></section><section id="id68850D1B959641C7B86A6E5AD1CF4D37"><enum>104.</enum><header>Use of mandatory advance electronic information for cargo</header><text display-inline="no-display-inline">Section 343 of the Customs Border Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/19/1415">19 U.S.C. 1415</external-xref>) is amended—</text><paragraph id="idCA775C0C45AA4D6F9241B79341E7940E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idB3DC87557ABC423DA6E17278333F2222"><enum>(A)</enum><text>in paragraph (2), in the first sentence, by striking <quote>cargo safety</quote> and all that follows through <quote>Customs Service</quote> and inserting <quote>compliance with customs and trade laws of the United States (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4301">19 U.S.C. 4301</external-xref>)) administered by U.S. Customs and Border Protection</quote>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4BF4EAFC792645D7AA65FEAA0D4C8C62"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D195DE31A2E4EDAB18829EB5353C28A"><subsection id="idBFCB1DAE15CD463CA16DC117C11EF353" commented="no"><enum>(e)</enum><header>Notification</header><text>If U.S. Customs and Border Protection provides under subsection (a)(3) nonpublic information to a person described in subsection (b), U.S. Customs and Border Protection shall provide to that person notification of the information so provided, in accordance with such regulations as the Secretary may prescribe.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2646CAD4CA04499AAFF66AF03FE710C7"><enum>(b)</enum><header>Sharing of importation data related to trade enforcement</header><text display-inline="yes-display-inline">The Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304 et seq.</external-xref>) is amended by inserting after section 628A the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id650F1A25BE564C3E99522BD84DD704B4"><section id="id461a6267b45d440bb1bf7ba87176e7ff"><enum>628B.</enum><header>Exchange of shipment information related to trade enforcement</header><subsection id="idF9D132A1A0B3487A8D25D32A9B7FB74A"><enum>(a)</enum><header>In general</header><text>Subject to subsection (d), and pursuant to regulations prescribed by the Secretary of the Treasury, the Commissioner of U.S. Customs and Border Protection may provide information about a shipment to a person described in subsection (b) if the Commissioner determines that—</text><paragraph id="idBC18326F48384D45A245B2FA0085D3BE"><enum>(1)</enum><text>the shipment is being imported into the United States in violation of section 526(e) of this Act or section 602, 1201(a)(2), or 1201(b)(1) of title 17, United States Code; or </text></paragraph><paragraph id="idF0D0388504AF42A0B40F29C36EA67D73"><enum>(2)</enum><text>subject to subsection (d), sharing of information with respect to the shipment with a person described in subsection (b) would promote compliance with the customs and trade laws of the United States (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4301">19 U.S.C. 4301</external-xref>)).</text></paragraph></subsection><subsection id="idf1e17b1edcd4494bb3fd3d3741eb604f"><enum>(b)</enum><header>Person described</header><text>A person described in this subsection, with respect to a shipment described in subsection (a), is—</text><paragraph commented="no" id="id3E603707167B45C2B2458C5B60A098F5"><enum>(1)</enum><text>a person described in section 628A(b);</text></paragraph><paragraph id="idAC600941D0D845AFA36B6B81F40DF011"><enum>(2)</enum><text>an online marketplace or other similar market platform that facilitates the importation of merchandise into the United States or the sale of imported merchandise in the United States; </text></paragraph><paragraph id="id1C5B3B8EAF764093BD5972DAA8C81D26"><enum>(3)</enum><text>an express consignment operator; </text></paragraph><paragraph id="idF22D02629208454DA045DF409BF19752"><enum>(4)</enum><text>a freight forwarder; or </text></paragraph><paragraph id="idF484F8490DE0498A9617B0110337A691"><enum>(5)</enum><text>any other entity that plays a role in the sale or importation, or facilitation of the sale or importation, of merchandise into the United States. </text></paragraph></subsection><subsection id="idE36562F1EF0143A3B63CD62B8815CDDA" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">If U.S. Customs and Border Protection provides under subsection (a)(2) information to a person described in subsection (b), U.S. Customs and Border Protection shall provide to that person notification of the information so provided, in accordance with such regulations as the Secretary may prescribe. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2a94f6d393f44f5ca31ca2ba22d1b2f1"><enum>(d)</enum><header>Exception</header><text>The Commissioner may not provide information under subsection (a) to a person described in subsection (b) if providing that information would compromise an ongoing law enforcement investigation or national security.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id42F13B33F43F42D2BF56E98A4906323A" commented="no"><enum>202.</enum><header>Seizure and forfeiture and disposition of, and expanded liability for, merchandise bearing a counterfeit mark or infringing a copyright</header><subsection id="idEAB4D12E816D4F91A6A1971809C9CFC5"><enum>(a)</enum><header>Seizure and forfeiture and disposition</header><text display-inline="yes-display-inline">Section 526(e) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1526">19 U.S.C. 1526(e)</external-xref>) is amended to read as follows:</text><quoted-block id="idFBBC8BC826C1487AB4218D361D3A2226" display-inline="no-display-inline" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ID56095536A5F048B3AB5AB3A8FC2D6B52"><enum>(e)</enum><header>Seizure and forfeiture and disposition of merchandise bearing a counterfeit mark or infringing a copyright</header><paragraph commented="no" display-inline="no-display-inline" id="id98679799797047238384E623B952E4DF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Merchandise described in paragraph (2) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3E266A12EF5642B9A77D130909CDE830"><enum>(A)</enum><text display-inline="yes-display-inline">be seized or otherwise interdicted pursuant to such regulations as the Secretary shall prescribe; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57E31B7B053C4478BB4029BD1514F3EC"><enum>(B)</enum><text display-inline="yes-display-inline">in the absence of the written consent of the owner of the mark or copyright being infringed, be forfeited for violations of the customs laws.</text></subparagraph></paragraph><paragraph id="idD81FCC2C14D24535BE0064118531736E"><enum>(2)</enum><header>Merchandise described</header><text>Merchandise described in this paragraph is—</text><subparagraph id="id5A2BA7AD4E354FF1B7B7BCAE405FC552"><enum>(A)</enum><text>merchandise bearing a counterfeit mark that is—</text><clause id="id5C0B543DB38545A2A91630329A49610F"><enum>(i)</enum><text>imported into the United States in violation of the provisions of section 42 of the Lanham Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1124">15 U.S.C. 1124</external-xref>); or</text></clause><clause id="id0BC41AFD7BDA4F65A2F43AA6A393D46E"><enum>(ii)</enum><text>exported or sent from the United States or attempted to be exported or sent from the United States; or</text></clause></subparagraph><subparagraph id="idD7214835AAF740A78DC96731081E2CA7"><enum>(B)</enum><text>merchandise that is imported into or exported from the United States in violation of section 602 of title 17, United States Code.</text></subparagraph></paragraph><paragraph id="idD0AC5D931934427EA31A91BAA4CBC785"><enum>(3)</enum><header>Summary forfeiture</header><subparagraph commented="no" display-inline="no-display-inline" id="id5FD8A6D7C62F4E1682F57C44DC5E0E30"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of merchandise described in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="id93F2B501F8A14A94BA71B6417B948C06"><enum>(i)</enum><text display-inline="yes-display-inline">such merchandise may be summarily forfeited for violations of the customs laws; and</text></clause><clause display-inline="no-display-inline" commented="no" id="idB4A9BF383A514F0392D4981DC2347B7A"><enum>(ii)</enum><text>title to such merchandise shall vest immediately in the United States.</text></clause></subparagraph><subparagraph id="id758D743FC52F467A84157D0169DF32E8"><enum>(B)</enum><header>Merchandise described</header><text>Merchandise is described in this subparagraph if—</text><clause id="idD612B0460BC5434BB1661DAFA7C033C7"><enum>(i)</enum><text>the merchandise is merchandise described in paragraph (2); and</text></clause><clause id="id007B0B4BA29D4021A0EFD9B1C44374E2"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1769BF7B56C24BC19D11A4C9FAD195B1"><enum>(I)</enum><text>in the case of merchandise being imported or attempted to be imported, an administrative exemption under section 321(a)(2)(C) is claimed with respect to the merchandise; or</text></subclause><subclause id="idB3AC7DFF6A5C425E808B24AA425262D1" indent="up1"><enum>(II)</enum><text>in the case of merchandise being exported or sent or attempted to be exported or sent from the United States, the aggregate value of the shipment of the merchandise at the time the merchandise is exported or sent from the United States or attempted to be exported or sent from the United States is equal to or less than $800.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id441AD06077634A93A978D29D8E3B8BF8"><enum>(C)</enum><header>Notice</header><text display-inline="yes-display-inline">Upon seizure of merchandise described in subparagraph (B), the Secretary shall notify the owner of the mark or copyright being infringed in such form and manner as the Secretary shall prescribe by regulation, which may include communication through an authorized electronic data interchange system.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id5CD53B8F90CB42D997804A7C5029856E"><enum>(4)</enum><header>Disposition of merchandise</header><text display-inline="yes-display-inline">After forfeiture of merchandise under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAB4382C9F9864043AFBDCC0F8630DBBD"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary shall destroy the merchandise; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idABADEE06C1D14AD89EFF4B32B3FF544E"><enum>(B)</enum><text display-inline="yes-display-inline">if the merchandise is not unsafe or a hazard to health, and the Secretary has the consent of the owner of the mark or copyright being infringed, the Secretary may obliterate the mark where feasible and dispose of the merchandise—</text><clause commented="no" display-inline="no-display-inline" id="IDE4BE8BA64F71415797054152A746AD80"><enum>(i)</enum><text>by delivery to such Federal, State, and local government agencies as in the opinion of the Secretary have a need for such merchandise;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDC06DFDACA47C433595EB23122AB6F48A"><enum>(ii)</enum><text>by gift to such eleemosynary institutions as in the opinion of the Secretary have a need for such merchandise; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID49C1417FCBEE4CDBA060784707234D24"><enum>(iii)</enum><text>more than 90 days after the date of forfeiture, by sale by U.S. Customs and Border Protection at public auction under such regulations as the Secretary prescribes, except that before making any such sale the Secretary shall determine that no Federal, State, or local government agency or eleemosynary institution has established a need for such merchandise under clause (i) or (ii).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA809A76AFB04414FB9E80B510E83B560"><enum>(5)</enum><header>Definition</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id21030D3D7AD04F7E81D4D9FD4C001B41"><enum>(A)</enum><header>Counterfeit mark</header><text>The term <term>counterfeit mark</term> means a mark that is counterfeit within the meaning of section 45 of the Lanham Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0DCC40774FE149C79ABD73C333F95E2E"><enum>(B)</enum><header>Lanham Act</header><text>The term <term>Lanham Act</term> means the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</quote>, approved July 5, 1946 (commonly known as the <quote>Trademark Act of 1946</quote> or the <quote>Lanham Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>).</text></subparagraph><subparagraph id="id0F03084F43794D4287ED1741AC9C4729" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Mark</header><text>The term <term>mark</term> has the meaning given that term in section 45 of the Lanham Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1127">15 U.S.C. 1127</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id9470F5B0385E4BF08C75DE37CFFC3D0D"><enum>(b)</enum><header>Expansion of liability for importing merchandise bearing a counterfeit mark or infringing a copyright</header><text display-inline="yes-display-inline">Section 526(f) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1526">19 U.S.C. 1526(f)</external-xref>) is amended—</text><paragraph id="id03068D91445F416985FB6187DC299911" commented="no"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" id="id7E8D8424F4274E78A3AD658425ABCB88"><enum>(A)</enum><text>by striking <quote>assists</quote> and inserting <quote>or assists,</quote>; and</text></subparagraph><subparagraph commented="no" id="idDBD056B6F431486886B345D503243BFE"><enum>(B)</enum><text>by striking <quote>the importation</quote> and all that follows through <quote>subsection (e)</quote> and inserting <quote>any importation or exportation of merchandise in violation of subsection (e)</quote>;</text></subparagraph></paragraph><paragraph commented="no" id="idC5235237798B41388BE45E7A6D3DF718"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>or for the first interdiction of such merchandise for which notice has been provided pursuant to such regulations as the Secretary shall prescribe,</quote> after <quote>such seizure,</quote>;</text></paragraph><paragraph commented="no" id="idB8A0150C49F34F9481E021D1378973B3"><enum>(3)</enum><text>in paragraph (3), by inserting <quote>or for the second interdiction and thereafter of such merchandise for which notice has been provided pursuant to such regulations as the Secretary shall prescribe,</quote> after <quote>thereafter,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD026FF713DEB499981547CBC49CD1645"><enum>(4)</enum><text>in paragraph (4), by striking <quote>the Customs Service</quote> and inserting <quote>U.S. Customs and Border Protection</quote>. </text></paragraph></subsection><subsection id="idBAFA94472DB64CA2A2E2718AFCCE566A"><enum>(c)</enum><header>Conforming amendment</header><text>Section 526 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1526">19 U.S.C. 1526</external-xref>) is amended, in the section heading, by inserting <quote><header-in-text style="OLC" level="section">or protected copyrighted work</header-in-text></quote> after <quote><header-in-text style="OLC" level="section">trade-mark</header-in-text></quote>.</text></subsection></section><section id="id9AFDFDA36FA0427BB6637E4FD416AD9D"><enum>203.</enum><header>Summary forfeiture of certain merchandise</header><subsection id="id6AA4C57FDC6D473CA7862493FA548222"><enum>(a)</enum><header>Merchandise imported or exported contrary to law</header><text display-inline="yes-display-inline">Section 596 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1595a">19 U.S.C. 1595a</external-xref>) is amended—</text><paragraph id="idE6D78397177442A69D985D3438D48F32"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF76FECB2CC01472F84F13C64B81D3BC2"><subsection id="idFDDCA75F9F77444EB4D86B7EB7F4F33C"><enum>(e)</enum><header>Summary forfeiture</header><paragraph id="id95F416FF87094AB6B6E457375FE710F9"><enum>(1)</enum><header>In general</header><text>Merchandise described in paragraph (2) may be summarily forfeited to the United States and title shall vest immediately in the United States.</text></paragraph><paragraph id="idD7DF8F21010A4E85A640AD2AD3028F55"><enum>(2)</enum><header>Merchandise described</header><text>Merchandise is described in this paragraph if—</text><subparagraph id="id3BF7203FAF824BB6B09EDC89B23BA8D4"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id9F1729BCCF484462B7B4D3A996ABA152"><enum>(i)</enum><text>in the case of merchandise being imported or attempted to be imported, an administrative exemption under section 321(a)(2)(C) is claimed with respect to the merchandise; or</text></clause><clause id="id0ED4BA144EEA4DF9AF1F7DCB1B6ADA77" indent="up1"><enum>(ii)</enum><text>in the case of merchandise being exported or sent or attempted to be exported or sent from the United States, the aggregate value of the shipment of the merchandise at the time the merchandise is exported or sent from the United States or attempted to be exported or sent from the United States is equal to or less than $800; and</text></clause></subparagraph><subparagraph id="idD24F44D52F45473B9B887AE69ABA68D1"><enum>(B)</enum><text>the merchandise is—</text><clause id="idb8bab90581ef44148f0f806479f4fc8b"><enum>(i)</enum><text>a controlled substance, as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>), in schedule III, IV, or V under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>), imported or exported contrary to law and seized under subsection (c)(1)(B) or (d);</text></clause><clause id="id019AB90199CA4639A11A8BD56339C419"><enum>(ii)</enum><text>merchandise—</text><subclause id="id3002ADB0BDA1480E9B8CFA10E8018589"><enum>(I)</enum><text>that is—</text><item id="id718E04B5034C41EFA329DE6C51EDB2FA" commented="no"><enum>(aa)</enum><text>subject to any restriction or prohibition on its importation under section 536 or 801 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 360mm and 381); and</text></item><item id="idFA14A1DD27E749DBAAE30F9D2E55F80F" commented="no"><enum>(bb)</enum><text>is not in compliance, as applicable, with the Federal Food and Drug Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) or section 351 or 361 of the Public Health Service Act (42 U.S.C. 262 and 264); and </text></item></subclause><subclause id="idCA4A6C8F019841AA86D5A6D5E3675BEE"><enum>(II)</enum><text>seized under subsection (c)(2)(A) or (d); or</text></subclause></clause><clause id="idFDBFC84A187B4C4EA7CDE0081E68002E"><enum>(iii)</enum><text>merchandise that—</text><subclause id="id672DABE3059A4254B30B42BEF36AC361"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idE24B061E2C9B438981DB00ED2B5CF078"><enum>(aa)</enum><text>bears a counterfeit mark or otherwise infringes a copyright; or</text></item><item indent="up1" id="id2A044E51867B41F6B7D03BCE54FBBA5A"><enum>(bb)</enum><text>is capable of circumventing technological measures for protection of a copyright; and</text></item></subclause><subclause id="id611D6FAC22D246329EADBF6E120CA330"><enum>(II)</enum><text>is seized under subparagraph (C) or (G) of subsection (c)(2) or subsection (d).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF9B36C4DA31A4DE2B6E9840E106CD70B"><enum>(3)</enum><header>Notice</header><text display-inline="yes-display-inline">In any case in which merchandise is summarily forfeited pursuant to this subsection, U.S. Customs and Border Protection shall notify the carrier of the merchandise in such form and manner as the Secretary shall prescribe by regulation, which may include communication through an authorized electronic data interchange system.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id254D60EA5967469B9856F62DA398C559"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to affect the discretion of the Commissioner to impose a penalty as provided by law instead of using the authority provided by paragraph (1).</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idD67E199C15E345478D1671C775E2D0D9"><enum>(2)</enum><text>in the section heading, by inserting <quote><header-in-text style="OLC" level="section">and exportation</header-in-text></quote> after <quote><header-in-text style="OLC" level="section">importation</header-in-text></quote>.</text></paragraph></subsection><subsection id="id3B5E61E871654DE292FE2188D6924B44"><enum>(b)</enum><header>Vessels, vehicles, and aircraft used To transport merchandise illegally</header><text>Section 607 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1607">19 U.S.C. 1607</external-xref>) is amended—</text><paragraph id="idC1BDB3DF56C2414C92FD852E4800E9B8"><enum>(1)</enum><text>in subsection (a), in the flush text following paragraph (4), by inserting <quote>subject to subsection (d),</quote> before <quote>the appropriate customs officer</quote>; and</text></paragraph><paragraph id="idF5D0A866056F427F806AE870A1EE93CE"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="idD75917F1478B4B32B8C65078A41C2644" display-inline="no-display-inline" style="OLC"><subsection id="idB7681993105A4ADD83A290BED77A45D1"><enum>(d)</enum><header>Summary forfeiture</header><text>In the case of merchandise seized under section 526(e) or subject to summary forfeiture under section 596(e)—</text><paragraph id="idC1ABBB86F5594F9B88DFA9A1D7505C6C"><enum>(1)</enum><text>the provisions of subsection (a) shall not apply; and</text></paragraph><paragraph id="idC7576BAFE2A04C55AC836B5AADC20CF0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the merchandise may be summarily forfeited and title shall vest immediately in the United States pursuant to such regulations as the Secretary shall prescribe.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="idB03E0EFF1DEC47BB9EE9291F014C8BD9" style="OLC"><enum>III</enum><header>Liability for violations of customs and trade laws</header><section id="idCD523B93C7A8490584A4DE35D6D3DBAB" commented="no"><enum>301.</enum><header>Expansion of liability for certain violations of arrival, reporting, entry, and clearance requirements</header><text display-inline="no-display-inline">Section 436 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1436">19 U.S.C. 1436</external-xref>) is amended—</text><paragraph id="id1E8665327DF04168B68679797CF2FDC4" commented="no"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id792733F08DA0431DA5A0914D22CAE975" commented="no"><enum>(A)</enum><text>in paragraph (2), by striking <quote>the Customs Service</quote> and inserting <quote>U.S. Customs and Border Protection</quote>; and </text></subparagraph><subparagraph id="id00D22A1F8F214E09A3609482505FCF1F" commented="no"><enum>(B)</enum><text>by striking <quote>section 4197 of the Revised Statutes of the United States (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/91">46 U.S.C. App. 91</external-xref>)</quote> each place it appears and inserting <quote>section 60105 of title 46, United States Code</quote>;</text></subparagraph></paragraph><paragraph id="idFE67D05B43C74D50BAD046784D26CA70" commented="no"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idFA7C7679D11147DFA7182D658DC21AFC" commented="no"><enum>(A)</enum><text>by striking <quote>Any master</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A882C616D2D4005BCA69852DBF9DD69"><paragraph id="idF789C444BF044B5FB2BCDED41D74C724" commented="no"><enum>(1)</enum><header>In general</header><text>Any master</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id690806CF4EE143B48C849ECA8FDB9EB4" commented="no"><enum>(B)</enum><text>by striking <quote>or aircraft pilot</quote> and inserting <quote>aircraft pilot, or other person</quote>; and</text></subparagraph><subparagraph id="id05FA486BFFE143BF9A8903F0D50C462A" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9E2468447934474B91108CB65CD1E21B"><paragraph id="id5386EA5A2CD14F6B8664C3FF0B727978" commented="no"><enum>(2)</enum><header>Provision of incorrect information</header><text>Any person who knowingly provides incorrect information, or provides incorrect information in deliberate or reckless ignorance of the truth or falsity of the information, to a person described in paragraph (1) who is required to present or transmit that information to U.S. Customs and Border Protection pursuant to section 431, 433, or 434 of this Act or section 60105 of title 46, United States Code, is liable for a civil penalty of $5,000 for the first violation, and $10,000 for each subsequent violation.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idE7B72982E5304094874BA3112C4B765F" commented="no"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="idE386ADC1F39141E580893107103E61AC" commented="no"><enum>(A)</enum><text>in the first sentence, by striking <quote>or aircraft pilot</quote> and inserting <quote>aircraft pilot, or other person described in subsection (b)(1)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F310B2C4C944581A33EAEB9D1EAD612"><enum>(B)</enum><text>in the second sentence—</text><clause commented="no" display-inline="no-display-inline" id="idCFF868DD774543779836AC8AE1376220"><enum>(i)</enum><text>by striking <quote>or pilot shall</quote> and inserting <quote>aircraft pilot, or other person described in subsection (b)(1) may</quote>; and</text></clause><clause display-inline="no-display-inline" commented="no" id="id3C5ACEFE6D6B41EAA6D57C7E2338AE3E"><enum>(ii)</enum><text>by striking <quote>liable to</quote> and inserting <quote>liable for</quote>.</text></clause></subparagraph></paragraph></section><section id="id361E5906FCE249FFA0B403D1A644725B"><enum>302.</enum><header>Modification of standards and penalties for fraud and negligence</header><subsection id="idDC5C152610B64AEAA72140CD85313263"><enum>(a)</enum><header>Standards for fraud and negligence</header><text>Section 592 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1592">19 U.S.C. 1592</external-xref>) is amended—</text><paragraph id="id435B28F8A4374EAA9D1956899372CEF7"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">, gross negligence,</header-in-text></quote>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idD644BE6167504743B272773F251D1424"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6A1E5A952F7E42CA89E7FFD8546772DD"><paragraph id="idb525553709af47628ff476dde0c62f36"><enum>(3)</enum><header>Standards for fraud and negligence</header><subparagraph id="id60578e3ef0c34e5c8c2ef48208e6752c"><enum>(A)</enum><header>Fraud</header><text>A violation of paragraph (1) is by fraud if the violation results from an act (including the transmission of a statement or document to U.S. Customs and Border Protection) or omission, done knowingly or with deliberate ignorance or reckless disregard of the offender's obligations to act in accordance with applicable provisions of law.</text></subparagraph><subparagraph id="idcb089ad455c94f5793c45d7706aef70c"><enum>(B)</enum><header>Negligence</header><text>A violation of paragraph (1) is by negligence if the violation results from an act (including the transmission of a statement or document to U.S. Customs and Border Protection) or omission done through the failure to exercise the degree of reasonable care—</text><clause id="idA7F91DF01E0248C5B29395F899E886D1"><enum>(i)</enum><text>to ensure that statements made and information provided in connection with the importation of merchandise are complete and accurate; or </text></clause><clause id="idCBD3F38A4B3940DA982E68D57465EC69"><enum>(ii)</enum><text>to perform any material act required by the customs and trade laws of the United States (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4301">19 U.S.C. 4301</external-xref>)) or any regulation prescribed pursuant to such laws.</text></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="idE4DA7CED384E4A72A0F79B16B28CF621"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph commented="no" id="id2A3F166282A1437DACF4A3CD45138B76"><enum>(A)</enum><text>by striking paragraph (2); and</text></subparagraph><subparagraph id="id6ADD0E842EA444B7BE0C2B8F09FA8D67" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (4)(B), by striking <quote>or gross negligence</quote>; </text></subparagraph></paragraph><paragraph commented="no" id="id8660D440ED2A4EBEA9D4F1211195EB09"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph commented="no" id="id626550E595E64D8396196CAA0A329EA8"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting after <quote>this section</quote> the following: <quote>, without regard to whether U.S. Customs and Border Protection asserts that the violation to which the penalty relates was done by fraud or negligence</quote>;</text></subparagraph><subparagraph commented="no" id="idEF6CFDB3BF264E549BE554429BDB5590"><enum>(B)</enum><text>by striking paragraph (3); and</text></subparagraph><subparagraph id="id1FFE12046E3D4AB4A83544593D013179" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc4d117143054b4b94bbdc0c2ea660fd"><enum>(5)</enum><text>in subsections (f) through (l), by striking <quote>, gross negligence,</quote> each place it appears.</text></paragraph></subsection><subsection id="id94A8960B33AE40EFB4FD1DFD38E6D172"><enum>(b)</enum><header>Penalty procedures</header><text>Section 592(b) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1592">19 U.S.C. 1592(b)</external-xref>) is amended—</text><paragraph commented="no" id="idC19203613E754718BC1A8FECD2457C44"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" id="idAF0F9091126B471B87BFFC3DF084A6FF"><enum>(A)</enum><text>in subparagraph (A)—</text><clause commented="no" id="id0EE0101594D0471CAAFF1E516550C9E3"><enum>(i)</enum><text>in clause (ii)—</text><subclause commented="no" id="id0D9DB5111989410493A0CF0FE1EB40DC"><enum>(I)</enum><text>by striking <quote>, or</quote> and inserting a comma; and</text></subclause><subclause commented="no" id="id4D249ABF47B148B7B7775E108AE71D8A"><enum>(II)</enum><text>by inserting before the semicolon the following: <quote>, or the direction or facilitation of the entry or introduction</quote>;</text></subclause></clause><clause commented="no" id="idC7C6C0267C364C3F98CB69F345C3B1DF"><enum>(ii)</enum><text>in clause (v), by striking <quote>whether</quote> and all that follows through <quote>or negligence</quote> and inserting <quote>the alleged level of culpability</quote>; and</text></clause></subparagraph><subparagraph commented="no" id="idD579B0E62DAF46D9BEA787E8030C8EB2"><enum>(B)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ECF58B9F1F64936A5C90E3AA4D6ACBB"><subparagraph commented="no" display-inline="no-display-inline" id="IDAD8D3564475842738AA531ED5A9E9621"><enum>(B)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection is not required to issue a notice under subparagraph (A) if—</text><clause commented="no" display-inline="no-display-inline" id="ID387E0D33DB2E44A0AE51B16E74A233B5"><enum>(i)</enum><text>the importation with respect to which the violation of subsection (a) occurs is noncommercial in nature, or</text></clause><clause commented="no" display-inline="no-display-inline" id="ID793D3BF12EF042D0B38608CEAE5B667A"><enum>(ii)</enum><text>the amount of the penalty in the penalty claim issued under paragraph (2) is less than an amount established by the Secretary by regulation.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="idE44B555A0E134313A7556C5418B81A2C"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD1EFF2B7BF824448865505637C7707D8"><paragraph commented="no" display-inline="no-display-inline" id="IDBE6097DE149C494D83DE0696C221AAF7"><enum>(2)</enum><header display-inline="yes-display-inline">Penalty claim</header><subparagraph commented="no" display-inline="no-display-inline" id="id5E60B8FC2437476B8DECE91235C50D2F"><enum>(A)</enum><header>Determination of violations</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall determine whether any violation of subsection (a) has occurred after considering representations, if any, made by the person concerned.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C750F389CA54457A1A143CB743B1612"><enum>(B)</enum><header>Effect of negative determination</header><text display-inline="yes-display-inline">If U.S. Customs and Border Protection determines under subparagraph (A) that a person described in that subparagraph did not violate subsection (a), U.S. Customs and Border Protection shall promptly issue a written statement of the determination to that person. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2745473646AF44CBA94271C193B181D8"><enum>(C)</enum><header>Effect of affirmative determination</header><clause commented="no" display-inline="no-display-inline" id="id3D846934A7D24479AD82478FFBA2651D"><enum>(i)</enum><header>Issuance of penalty claim</header><text display-inline="yes-display-inline">If U.S. Customs and Border Protection determines under subparagraph (A) that a person described in that subparagraph violated subsection (a), U.S. Customs and Border Protection shall issue a written penalty claim to that person. </text></clause><clause commented="no" display-inline="no-display-inline" id="id1B3D5A0366084F03ABBF4A349DE7DA62"><enum>(ii)</enum><header>Contents</header><text display-inline="yes-display-inline">A written penalty claim issued under clause (i) with respect to a violation of subsection (a) shall specify—</text><subclause commented="no" display-inline="no-display-inline" id="id486EF0CBCD0344FA82BF118ECD1EC48E"><enum>(I)</enum><text display-inline="yes-display-inline">the information described in clauses (i) through (vi) of paragraph (1)(A); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id52821D32E7714C9D950E2A8018306CD9"><enum>(II)</enum><text display-inline="yes-display-inline">if a notice was issued under paragraph (1)(A) with respect to the violation, any changes to the information described in clauses (i) through (vi) of that paragraph. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9CE59E75EE3E43B69A91F1CE083F2459"><enum>(D)</enum><header>Opportunity to make representations</header><clause commented="no" display-inline="no-display-inline" id="idED16826D7D7A4CBA8DAA80A02630BB68"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided by clause (iii), a person to which U.S. Customs and Border Protection issues a penalty claim under subparagraph (C) shall have a reasonable opportunity under section 618 to make representations, both oral and written, seeking remission or mitigation of the monetary penalty. </text></clause><clause commented="no" display-inline="no-display-inline" id="idE189349F80E74226856F19B220122F00"><enum>(ii)</enum><header>Final determination</header><text display-inline="yes-display-inline">At the conclusion of any proceeding under section 618 described in clause (i), U.S. Customs and Border Protection shall provide to the person to which U.S. Customs and Border Protection issued a penalty claim a written statement (which may be issued electronically) that sets forth the final determination and the findings of fact and conclusions of law on which that determination is based.</text></clause><clause id="idb7101f01551947ba8a36abbc0838a7ee"><enum>(iii)</enum><header>Violations by fraud</header><text>A penalty for a violation of subsection (a) by fraud may be enforced in the United States Court of International Trade without the issuance of a notice under paragraph (1)(A) or an administrative proceeding under section 618.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idCA6B9E6D5F0A4A69B6D3C9D53B3126F0" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Court of International Trade proceedings</header><text>Section 592(e) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1592">19 U.S.C. 1592(e)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id92db04bda6ea4abaade7cf1f2eeb843e"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting after <quote>under this section</quote> the following: <quote>(without regard to the level of culpability asserted by U.S. Customs and Border Protection in any proceeding under subsection (b))</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe35d2dab66d46a9b62abdf3911b9dbd"><enum>(2)</enum><text>in paragraph (2), by striking the semicolon and inserting <quote>; and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc267ad59b0e3436eb1e013d77521b7a5"><enum>(3)</enum><text>by striking paragraph (3); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b277fa6e15e476cae2e554a1f113fff"><enum>(4)</enum><text>by redesignating paragraph (4) as paragraph (3).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id84ee749dab934c90a2595eb7eea0f6cd"><enum>(d)</enum><header display-inline="yes-display-inline">Technical amendment</header><text>Section 592 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1592">19 U.S.C. 1592</external-xref>), as amended by this section, is further amended by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>.</text></subsection></section><section id="idBB2282A1D4B44786B7C2E27135A4CB63"><enum>303.</enum><header>Expansion of liability for aiding unlawful importation and exportation</header><text display-inline="no-display-inline">Section 596 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1595a">19 U.S.C. 1595a</external-xref>) is amended—</text><paragraph id="idE31949DA55924D579661EE665DF86283"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC90358B8A864443688644E236EE23B23"><subsection commented="no" display-inline="no-display-inline" id="ID28BB5098D212436182E28F57FA2017AC"><enum>(b)</enum><header>Penalty</header><paragraph commented="no" display-inline="no-display-inline" id="id94D659807EBA44D4800693968E892B21"><enum>(1)</enum><header>In general</header><text>A person is liable for a penalty not to exceed the domestic value of an article or articles introduced or attempted to be introduced into the United States contrary to law if the person directs, assists financially or otherwise, or is in any way concerned in—</text><subparagraph commented="no" display-inline="no-display-inline" id="id085482727F3F42C48CC818BF77C9E686"><enum>(A)</enum><text>the importation, introduction, bringing in, unlading, landing, removal, concealing, harboring, or subsequent transportation of the article or articles; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA71C083A2034E0D80A9E06FB7963011"><enum>(B)</enum><text>the attempted importation, introduction, bringing in, unlading, landing, removal, concealing, harboring, or subsequent transportation of the article or articles.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17DA8CBA87694D79A90C0293CE46E59C"><enum>(2)</enum><header>Seizure not required</header><text display-inline="yes-display-inline">The penalty specified in paragraph (1) applies with respect to a person described in that paragraph without regard to whether the article or articles described in that paragraph were seized.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idD5D3F8F4561F4E5DA18967CFFEFC5EEB"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id9DFACAA71C6E4C14A293B4E271BCE6D1"><enum>(A)</enum><text>by striking <quote>Merchandise exported</quote> and inserting the following: “<header-in-text style="OLC" level="subsection">Merchandise exported contrary to law</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2DD85311713F426BAB11356A903B595E"><paragraph id="idBD20BA0F33914A3EBDB2FC2C1BDABDB4"><enum>(1)</enum><header>In general</header><text>Merchandise exported</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id99D316C1379D480D88C1E159AA0E043E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by striking <quote>shall</quote> and inserting <quote>may</quote>; and</text></subparagraph><subparagraph id="idF60F5C48AA214FF4B0405960313D7012"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="idA5933EFAB2F147A7BA19AF3FE98C9FD6" display-inline="no-display-inline" style="OLC"><paragraph id="id6447BB1FA2624D48BEACAADA61569019"><enum>(2)</enum><header>Penalty</header><subparagraph id="idDB397FFC0C2849FEA9C544170B8C5017"><enum>(A)</enum><header>In general</header><text>A person that directs, assists financially or otherwise, or is in any way concerned in, the exportation or sending from the United States or the attempted exportation or sending from the United States of merchandise contrary to law is liable for a penalty not to exceed the export value of the merchandise. </text></subparagraph><subparagraph id="idBFE26E21294446CD834FA65A0DF721C2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Seizure not required</header><text display-inline="yes-display-inline">The penalty specified in subparagraph (A) applies with respect to a person described in that subparagraph without regard to whether the merchandise exported or sent or attempted to be exported or sent from the United States contrary to law was seized.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1650E69C6A8D4DF8BBF86904D28A6CF9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0ED34254FA64409686685A05F3FCB1AD"><subsection id="idb021cb09aa1f487d998e28bfa58027e9"><enum>(e)</enum><header>Discretion of Secretary To impose penalties</header><text>For any violation for which merchandise may be seized and forfeited under this section, the Secretary retains discretion to assess a penalty as provided by law, including a penalty pursuant to subsection (b) or (d), as appropriate, instead of seizure and forfeiture.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idd5fc0f6da97f4be1a9c38da9554b2df2"><enum>304.</enum><header>Procedures for investigating claims of evasion of antidumping and countervailing duty orders</header><subsection id="id892D1001E83447E59042D9F6C786EF4D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 517(b) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1517">19 U.S.C. 1517(b)</external-xref>) is amended—</text><paragraph id="id42c2b22dc08041ccb018261047da18c1"><enum>(1)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>a person has entered covered merchandise</quote> and inserting <quote>covered merchandise has been entered</quote>; and</text></paragraph><paragraph id="idd655901ae2f247c0b652703fa42971b6"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCAED8975053D4562BA0375DD9B07D79F"><paragraph id="id5416207091cd436b9356f9c7966163cb"><enum>(8)</enum><header>Identification of importer</header><text>If the Commissioner determines under subsection (e) that there is a reasonable suspicion that covered merchandise was entered into the customs territory of the United States through evasion, the identity of the importer of the covered merchandise shall not be considered confidential information that is protected from public disclosure, regardless of whether the allegation described in paragraph (2) identifies the importer.</text></paragraph><paragraph id="id1f8fc42b0e484ce2ba9878f2b76f8e56"><enum>(9)</enum><header>Addition of importers to investigations</header><text>The Commissioner may, at any time while conducting an investigation under paragraph (1), expand the investigation to include an additional importer if the Commissioner determines that there is reasonable suspicion that the additional importer is engaged in the same or similar conduct as an importer previously subject to the investigation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id91858C78FC324439B54E0A4564FC1B7E"><enum>(b)</enum><header>Technical correction</header><text>Section 517(d)(1)(B)(ii) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1517">19 U.S.C. 1517(d)(1)(B)(ii)</external-xref>) is amended by striking <quote>subsection (e)(1)</quote> and inserting <quote>subsection (e)(2)</quote>.</text></subsection></section><section id="id4af28873e0a4413abff531e6c5aa3c62"><enum>305.</enum><header>Obstruction of investigations</header><text display-inline="no-display-inline">Section 592 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1592">19 U.S.C. 1592</external-xref>), as amended by section 302, is further amended by adding at the end the following:</text><quoted-block id="id31BCE495C992499183138C388AA528BE" display-inline="no-display-inline" style="OLC"><subsection id="id1F431D4BA126471487BAD3F6C87FACF5"><enum>(m)</enum><header>Obstruction of investigations</header><paragraph id="id133ecf072bec400992028e2bd13a3f0f"><enum>(1)</enum><header>In general</header><text>No person, with the intent of avoiding payment of a duty, tax, fee, or penalty owed or obstructing or influencing the investigation or proper administration of any investigation by U.S. Customs and Border Protection into the payment of a duty, tax, fee, or penalty owed, may alter, destroy, mutilate, conceal, cover up, falsify, or make a false entry in any record, document, or tangible object, or transfer, or otherwise conceal or disguise funds or assets.</text></paragraph><paragraph id="idd4319db45ee74ad296ead9b3cf37b958"><enum>(2)</enum><header>Penalty</header><subparagraph id="id4e5b24835f834730a431ea76256a3bd5"><enum>(A)</enum><header>In general</header><text>A person that violates paragraph (1) is liable for a civil penalty in an amount not to exceed the greater of—</text><clause id="id8207e35674aa4b0f9151c50350886f8c"><enum>(i)</enum><text>the value of any concealed funds or altered assets; or</text></clause><clause id="id60da43072b0149609919bc87ce3f0cd0"><enum>(ii)</enum><text>an amount that is 3 times the amount of the duty, tax, fee, or penalty described in paragraph (1).</text></clause></subparagraph><subparagraph id="id854dde41519945058821f5d83f6d657b"><enum>(B)</enum><header>Adverse inference</header><text>The Commissioner of U.S. Customs and Border Protection may make an inference that is adverse to the interests of a person that violates paragraph (1) in any investigation into the payment of a duty, tax, fee, or penalty described in that paragraph.</text></subparagraph></paragraph><paragraph id="idd6a07f716f594458a22a7223d219278f" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Standard of proof at court of international trade</header><text>In any action at the United States Court of International Trade relating to a violation of paragraph (1), the United States shall have the burden of proof to establish the act or omission constituting the violation by clear and convincing evidence.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id7FCBC732F04A48E1A20E78D8B763B7A6"><enum>306.</enum><header>Modification of bonding requirements</header><subsection id="idFC9DFE2468BB47188B856C1D0DA37422"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 623 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1623">19 U.S.C. 1623</external-xref>) is amended—</text><paragraph id="id77C4102E9E9149F390598303CEA11E82"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idDBCB33AF231C4A6686E1489EAF126CEF"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idB5B30BA94D5C45B0B669E3EB5C65A131"><enum>(i)</enum><text>by striking <quote>of penalty thereof</quote> and inserting <quote>of the bond</quote>; </text></clause><clause id="idC14F3A3912B24F54A2EE67C25D9B83EA"><enum>(ii)</enum><text>by striking <quote>paragraph 4</quote> and inserting <quote>paragraph (4)</quote>; and</text></clause><clause id="idD6DC77B2192A41C29EDDCCCB970CB8D8"><enum>(iii)</enum><text>by striking <quote>penalty of such bond</quote> and inserting <quote>amount of such bond</quote>; and</text></clause></subparagraph><subparagraph id="idB26BDFBA9A7749B0B4CB94CF4A32C8AE"><enum>(B)</enum><text>in paragraph (2), by inserting before the end period the following: <quote>, and make rules and regulations for the disclosure of information or records to, and the collection of information or records from, sureties approved under this paragraph, without regard to any other provision of statute or regulation, including section 1905 of title 18, United States Code, and section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>)</quote>; </text></subparagraph></paragraph><paragraph id="idEA63B8144CA64EB7BCFA4E2D3C7C401A"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18397CCDCE5849F0B43708D13C09E899"><subsection id="id737C7DED1B72460D9E27ECB456B98D65" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Interest due to default on bond</header><text display-inline="yes-display-inline">If any amount due to the United States under a bond is not paid in full by the date the amount is due, the unpaid balance under the bond shall bear interest until the full balance under the bond is paid, in accordance with such regulations and at such rate as the Secretary of the Treasury may prescribe. Interest charged under this subsection shall be without regard to the limit of liability of the bond and shall not be charged against the bond.</text></subsection><subsection id="id8ae2b62df98f4c82b268bcb6e671cdc8"><enum>(g)</enum><header>Notice to person from whom a bond is required</header><paragraph id="id51EA3FB245E14C60883706755AF8B3E9"><enum>(1)</enum><header>In general</header><text>U.S. Customs and Border Protection shall give notice to a person from which a bond is required under this section of the conditions, form, manner of filing or transmission, amount, and reason for the amount of the bond in accordance with regulations prescribed by the Secretary of the Treasury. </text></paragraph><paragraph id="id9BC511E401274C52B1AB1E62F25D2166"><enum>(2)</enum><header>Form of notice</header><text>U.S. Customs and Border Protection may provide notice under paragraph (1) by publishing the notice to the public instead of providing the notice directly to a person described in paragraph (1).</text></paragraph></subsection><subsection id="id68628ab180a242eaa2093ae742543938"><enum>(h)</enum><header>Review of bond requirements</header><paragraph id="id2471d6d9c3ee4b4584e6a2b1d59e2d79"><enum>(1)</enum><header>Administrative review</header><subparagraph id="id4F7C2A8CDC0F4A1895ABDC121914194C"><enum>(A)</enum><header>Appeal</header><text>A person from which a bond is required under this section may, not later than 30 days after the later of the date on which notice is provided under subsection (g) or the date on which the bond is required, appeal the bond requirement in accordance with regulations prescribed by the Secretary of the Treasury. </text></subparagraph><subparagraph id="idF1DB44FD23D34572BE5CD36CEE3AE281"><enum>(B)</enum><header>Notice</header><text>The Secretary shall provide notice to a person that filed an appeal under subparagraph (A)—</text><clause id="id11553736F6B9430E807E661ECD8DD645"><enum>(i)</enum><text>of the decision with respect to the appeal in the form and manner prescribed by the Secretary; and </text></clause><clause id="id1CA6DF37718743F6BDC889ECD0A7D052"><enum>(ii)</enum><text>if the appeal is denied, including a statement of the reasons for the denial. </text></clause></subparagraph></paragraph><paragraph id="id9dc81290ca6e48fc81ee49b9d07406cb"><enum>(2)</enum><header>Review by the court of international trade</header><subparagraph id="idA8F6EAE17DD841938CAFA8B1648C0C69"><enum>(A)</enum><header>In general</header><text>In the case of an appeal filed under paragraph (1) that is denied in whole or in part, the person that filed the appeal may file a civil action in the Court of International Trade to contest the denial. </text></subparagraph><subparagraph id="id9F73C672557048ED93E787B9B6EA67F9" commented="no"><enum>(B)</enum><header>Review by court</header><text>The Court shall—</text><clause id="id758706410D654E7C8C10518FA66287F3" commented="no"><enum>(i)</enum><text>review the action on the basis of the record before the official deciding the appeal at the time the appeal was decided; and </text></clause><clause id="id7098F40E605943A6B913CC9082AD96FC" commented="no"><enum>(ii)</enum><text>set aside and remand a decision with respect to an appeal filed under paragraph (1) that the Court finds to be an abuse of discretion.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idD8B2C9A0D9974EFB80C1882237DE9773"><enum>(3)</enum><text>by striking <quote>the Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>.</text></paragraph></subsection><subsection id="id36b03eac12af4baf9bfdda102aa61899"><enum>(b)</enum><header>Exclusive jurisdiction of Court of International Trade</header><text display-inline="yes-display-inline">Section 1581 of title 28, United States Code, is amended by adding at the end of the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4BB05D6DAFFF40CFBC958716DC5DB5C3"><subsection id="id4da272260ff04e9e86b0284b9432c8d1"><enum>(k)</enum><text>The Court of International Trade shall have exclusive jurisdiction of any civil action commenced under section 623 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1623">19 U.S.C. 1623</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1724d43aaae8469197b0b5258cd743dc"><enum>(c)</enum><header>Scope and standard of review by Court of International Trade</header><text display-inline="yes-display-inline">Section 2640 of title 28, United States Code, is amended—</text><paragraph id="idB9B4ED9D71F14237B4744F164599497A"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="id738232B9A9634F9FBB8B753C4A28EB92"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9B86288ECB146FDA15B3682C7F4CFDB"><subsection id="idb7966252bedf47c680a93a7a4b0269cb"><enum>(e)</enum><text>In any civil action commenced in the Court of International Trade under section 623 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1623">19 U.S.C. 1623</external-xref>), the court shall review the matter as specified in subsection (h) of such section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id18974DEF1508452FBD7EC6F30A96EF45"><enum>307.</enum><header>Treatment of importations involving suspended or debarred persons</header><subsection id="idF345ECE4044E40C49BD9512095DCC8A4" commented="no"><enum>(a)</enum><header>Importer of record program</header><text display-inline="yes-display-inline">Section 114(b) of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4320">19 U.S.C. 4320(b)</external-xref>) is amended—</text><paragraph id="idC4E085AECA2748F3A34214F758A4FA5F" commented="no"><enum>(1)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="idC87C22A88CB14746922155B7934BF3B6" commented="no"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idBA85A5D588204F949D9C939CB86581C0" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7FEDA032704147BC92AEDC0E8ADE4406"><paragraph id="idc877a8ae6c7b4afdb701a6f616188889" commented="no"><enum>(6)</enum><text>takes measures to protect the integrity of the program, including by—</text><subparagraph commented="no" id="idB7C8E7418BE147D8A3AD17E9B50D59BC"><enum>(A)</enum><text>assessing the role and circumstances of importers that are identified with active exclusion records in the System for Award Management Exclusions (as defined in section 180.945 of title 2, Code of Federal Regulations (or any corresponding similar regulation)) or any successor system; </text></subparagraph><subparagraph id="ida51a13cd8d7544ff86d31893f20c797a"><enum>(B)</enum><text>facilitating cross-referencing of importer of record numbers with active exclusion records in the System for Award Management Exclusions or any successor system; and</text></subparagraph><subparagraph id="id4c021604218f4b38803e876cfb491a9d"><enum>(C)</enum><text>providing an opportunity for importers described in subparagraph (A) to demonstrate to the satisfaction of U.S. Customs and Border Protection, in accordance with such regulations as the Secretary may prescribe, that they are sufficiently responsible to act as importers of record.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC20920DE97FF468D97264AC1576D44FD"><enum>(b)</enum><header>Entry under regulations</header><text>Section 498(a)(1) of the Tariff Act of 1930 (19U.S.C. 1498(a)(1)) is amended—</text><paragraph id="idFE33BDDE86A34607870DAC017D4A3069"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="id1B0D3184F5EA47079ECA3F0F82BCFA67"><enum>(2)</enum><text>in subparagraph (B), by striking the semicolon and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="idD89D46932EAB4CFAB44EA09C636ECEBE"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B16ACACB26F4AC985B4763B3B03B89F"><subparagraph id="id6ce5d0ab1a5f44249a2f83e92478430c"><enum>(C)</enum><text>the importation is caused or facilitated by a person identified with an active exclusion record in the System for Award Management Exclusions (as defined in section 180.945 of title 2, Code of Federal Regulations (or any corresponding similar regulation)) or any successor system;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="idA7CD27F01FB0492682BBA575E18E9BFB" style="OLC"><enum>IV</enum><header>Administrative exemptions from duties</header><section id="id5A87CAAC2AF34A96AED8A143ABA67FA7"><enum>401.</enum><header>Collection and use of data relating to eligibility for administrative exemption to duties</header><subsection id="idA688FA023EDE4CB08A9F4FA2051F62FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 321 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1321">19 U.S.C. 1321</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1EA897FA114143DA910BF816BB376EF8"><subsection id="idDB5A20A39A94407785883884594144FF"><enum>(c)</enum><header>Submission of documentation and information</header><paragraph id="id698701A3528C4E53BAA3C5FC7370B362"><enum>(1)</enum><header>In general</header><text>The Secretary may prescribe regulations for the provision to U.S. Customs and Border Protection, separate from any entry filing, of such documentation or information as the Secretary determines to be reasonably necessary for U.S. Customs and Border Protection to determine the eligibility of an article for an administrative exemption under subsection (a)(2). </text></paragraph><paragraph id="id51389847D80A44408EFCC336959A78BF"><enum>(2)</enum><header>Type of documentation or information</header><text>Documentation or information with respect to an article provided to U.S. Customs and Border Protection pursuant to regulations prescribed by the Secretary under paragraph (1) may include documentation or information related to an offer for sale or purchase or subsequent sale, purchase, transportation, importation, or warehousing of the article, including documentation or information related to the offering of the article for sale or purchase within the United States through a commercial or marketing platform (including an electronic commerce platform or marketplace).</text></paragraph><paragraph id="id9BAA5E8F6CD5465BBAA09E864A86F38D"><enum>(3)</enum><header>Parties providing information</header><text>The Secretary may provide, in the regulations prescribed under paragraph (1), for the provision of information or documentation with respect to an article by a party other than a party qualified to make entry of the article pursuant to regulations prescribed under section 498.</text></paragraph><paragraph id="id0EB87536712C431086589A3F66F69B2A"><enum>(4)</enum><header>Accuracy of documentation and information</header><subparagraph id="id079C14BA2DA94529B628CF1F326FF66E"><enum>(A)</enum><header>In general</header><text>A party providing documentation or information under paragraph (1) shall ensure that the documentation or information is true and correct to the best of the knowledge and belief of the party, subject to any penalties authorized by law.</text></subparagraph><subparagraph id="id937F7B0459B3461B8C8D4884359AB517"><enum>(B)</enum><header>Exception</header><text>The Secretary shall, in the regulations prescribed under paragraph (1), permit a party to provide to U.S. Customs and Border Protection documentation or information under paragraph (1) on the basis of the reasonable belief of the party that the documentation or information is true and correct if the party is not reasonably able to verify the documentation or information. </text></subparagraph></paragraph><paragraph id="idA1D9389AD3EB4EC398D66321AE1D8737"><enum>(5)</enum><header>Use of documentation and information</header><text>Documentation or information with respect to an article provided to U.S. Customs and Border Protection pursuant to regulations prescribed by the Secretary under paragraph (1) may be used by U.S. Customs and Border Protection for any lawful purpose. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83B38ABB787A4C8D8C2EB1461A2FFA9E"><enum>(6)</enum><header>Civil penalty</header><subparagraph commented="no" display-inline="no-display-inline" id="id9ED85B2BA7E04328A6CD428C108E6731"><enum>(A)</enum><header>In general</header><text>Any person who violates the regulations prescribed under paragraph (1) with respect to an article is liable for a civil penalty in an amount not to exceed the amount that is 3 times the amount of the duty applicable to the article. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id860e2974bbd94cad9f9a1d141fcbf09d"><enum>(B)</enum><header>Assessment of penalties</header><text>A penalty imposed under this subsection shall be assessed per person, per article, per entry, and per day.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idACD0579DD1964A23BDAF50027DD7CF8C"><enum>(C)</enum><header>Additional penalties</header><text>A penalty imposed under this subsection may be in addition to any other penalty provided by law.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idA458CD2DA8E74F49AF4B39CCE4704CF7"><enum>(D)</enum><header>Remission; mitigation</header><text>A penalty imposed under this subsection may be remitted or mitigated, as appropriate, under section 618.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6089BDB3CC8A4BC0A88F62CBA00E4A22"><enum>(7)</enum><header>Definition</header><text>In this subsection, the terms <term>provide</term>, <term>providing</term>, and <term>provision</term>, with respect to documentation or information provided to U.S. Customs and Border Protection, include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id703A2E4CE76E44EABB1B2A10A9587BC3"><enum>(A)</enum><text>the submission or transmission of the documentation or information; and</text></subparagraph><subparagraph id="id0A57578D94C146BF844FCA4EC79A1DD8"><enum>(B)</enum><text>otherwise making available to U.S. Customs and Border Protection the documentation or information in accordance with such terms and conditions as the Secretary may by regulation prescribe.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0B16BED05BEA4DE59223BC3EEAAAE1E7"><enum>(b)</enum><header>Regulations</header><text>Section 498 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1498">19 U.S.C. 1498</external-xref>)—</text><paragraph id="id801BAFC34EEC46A9862591D962948783"><enum>(1)</enum><text>in subsection (a), by striking paragraph (12) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id856D525D710B45E9904DE0B4802898BB"><paragraph id="idED82744C7F9A433CB2DE18D1190F6418" commented="no"><enum>(12)</enum><text>Subject to subsection (c), articles eligible for an administrative exemption under section 321(a)(2)(C).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0C16C31B25A34EAC90DFCFB82CDA74CA"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="idFA1D0DAA48D249789A65F3AB96BFB186" display-inline="no-display-inline" style="OLC"><subsection id="id9D1E999224F947BD95FB1B86B85B7DDA"><enum>(c)</enum><header>Requirements with respect to articles eligible for administrative exemptions</header><text>In prescribing rules and regulations under subsection (a)(12) with respect to articles eligible for an administrative exemption under section 321(a)(2)(C), the Secretary shall require that, when such an article is entered, the required documentation or information be filed or electronically transmitted by—</text><paragraph id="id5D8F765AA49449C68A42ECB70DD6A1EA"><enum>(1)</enum><text>one of the parties qualifying to make entry, as specified by the Secretary by regulation; or </text></paragraph><paragraph id="id7F6AE5B95842434EBA2B91EFEA1491CA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>a customs broker (as defined in section 641(a)) designated by a party described in subparagraph (A).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idB3C7C5182A9C41CC91F9FCE41E896C12" commented="no"><enum>402.</enum><header>Streamlined disposition of merchandise subject to administrative exemptions</header><subsection id="id41822FD010214372890F0F5D2B89B6C7" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 499 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1499">19 U.S.C. 1499</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5CB3C2317F084AF292B63E589D149E59"><subsection id="id1F9717F142C143C18FC4AA172E1C7422" commented="no"><enum>(d)</enum><header>Special rules for merchandise subject to administrative exemptions</header><paragraph id="id2D8F5063748E4D8E9FAFF318F76A2510" commented="no"><enum>(1)</enum><header>In general</header><text>In the case of detained merchandise subject to an administrative exemption under section 321(a)(2)(C), the following shall apply:</text><subparagraph id="id53BCE1580DA149FEB23F48A5A267EA51" commented="no"><enum>(A)</enum><text>U.S. Customs and Border Protection shall provide notice under subsection (c)(2) to the importer and each other party that appears to have an interest in the merchandise, based on information reasonably available to U.S. Customs and Border Protection, in such form and manner as the Secretary shall by regulation prescribe.</text></subparagraph><subparagraph id="id4815924ABEF14E6C8DDC6CA92EC16018" commented="no"><enum>(B)</enum><text>The notice required under subsection (c)(2) shall include, in addition to the information required by subparagraphs (A) through (E) of that subsection, notice that the party may voluntarily abandon the merchandise.</text></subparagraph><subparagraph id="id6138249EF197446AB0E1C090174C5BD5" commented="no"><enum>(C)</enum><text>If U.S. Customs and Border Protection does not receive a response to the notice under subsection (c)(2) from a party by the date that is 15 days after the date of the notice—</text><clause id="idEC97BF7F26CD46E6B9F60BE110C2888E" commented="no"><enum>(i)</enum><text>the merchandise shall be deemed abandoned; </text></clause><clause id="id0652E56909B64C84BFD576FE4B359D31" commented="no"><enum>(ii)</enum><text>title to the merchandise shall be vested in the United States; and </text></clause><clause id="id11662D0980C04BCDB2B2C00D6DDDB17B" commented="no"><enum>(iii)</enum><text>the merchandise shall be disposed of in accordance with law.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69593928EA4A41FCAFFE44CA32902B4A"><enum>(2)</enum><header>Nonapplicability of provision relating to failure to make determination</header><text>Subsection (c)(5) does not apply with respect to detained merchandise subject to an administrative exemption under section 321(a)(2)(C).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD8AFB7A1541A433797DB528AEE679717" commented="no"><enum>(b)</enum><header>Technical amendments</header><text>Section 499 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1499">19 U.S.C. 1499</external-xref>) is amended—</text><paragraph id="idCC5D8941037949EFAFDBE517EAE99BBD" commented="no"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id7A1F435A7C4B4CA1AAF2DF7A3A257A78" commented="no"><enum>(A)</enum><text>in paragraph (1), by striking <quote>Customs Service laboratories</quote> and inserting <quote>laboratories of U.S. Customs and Border Protection</quote>;</text></subparagraph><subparagraph id="id1E428F01A33446578689A0F14FA783A6" commented="no"><enum>(B)</enum><text>in paragraph (3), by striking <quote>a Customs Service laboratory</quote> and inserting <quote>a laboratory of U.S. Customs and Border Protection</quote>;</text></subparagraph></paragraph><paragraph id="idA51C543F1D04479BAEBD08A557308819" commented="no"><enum>(2)</enum><text>by striking <quote>The Customs Service</quote> each place it appears and inserting <quote>U.S. Customs and Border Protection</quote>; App. 91</external-xref>)</quote> and inserting <quote>section 60105 of title 46, United States Code, and every aircraft or vehicle arriving in the United States for which a manifest is required by U.S. Customs and Border Protection,</quote>; and</text></paragraph><paragraph id="id7DD61A0DD9E741319005235992F3544D"><enum>(2)</enum><text>in subsection (c)(1)—</text><subparagraph id="id64C7C13F50774E5790027998E64E3236"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>subparagraph (2)</quote> and all that follows through <quote>shall be available</quote> and inserting <quote>paragraph (2), the following information, when contained in a vessel, aircraft, or vehicle manifest, shall be available</quote>; </text></subparagraph><subparagraph id="id3B40E0310DD74995B6B0AEFD06F8A9F6"><enum>(B)</enum><text>in subparagraph (B), by inserting before the end period the following: <quote>and the subheadings of the Harmonized Tariff Schedule of the United States under which the cargo is classifiable</quote>; and</text></subparagraph><subparagraph id="id1645DDC92E3B434FB8E8CC48C1E7B805"><enum>(C)</enum><text>by striking subparagraph (G) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id649259D398D845D49806A2CEBBF49A34"><subparagraph id="idFFC75D10A8F248C6A4E9B3EED7ACAB0B" indent="up1"><enum>(G)</enum><text>The country in which the cargo was produced and the last country through which the cargo was transported.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id82d389fb761348a1a52bdc97b35479eb"><enum>(b)</enum><header>Protection of personally identifiable information</header><text>Section 431(c) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1431">19 U.S.C. 1431(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id75dcb0bbb94a47c8808d38c8ec444421"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id402d9e0b76224847afdb3ae47296ff6f"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf967963016704805845cf3268521fd6f"><enum>(B)</enum><text>by inserting <quote>(A)</quote> after <quote>(2)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5641f27e75d2446ba25f7472b9fefb28"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbf31ddf0536d49ca8fe6fdef5b090a24"><subparagraph id="idf24b588ea1df45fca457ee1d9d044e15" indent="up1"><enum>(B)</enum><text>The Secretary shall ensure that the following information is removed from any manifest signed, produced, delivered, or electronically transmitted under this section before access to the manifest is provided to the public:</text><clause commented="no" display-inline="no-display-inline" id="idf7c2a02159e9487cadd1db1de5cb41ac"><enum>(i)</enum><text display-inline="yes-display-inline">Social Security numbers.</text></clause><clause commented="no" display-inline="no-display-inline" id="id734dca51705d490e84ef6efa8dfef056"><enum>(ii)</enum><text>Passport numbers.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9f765a8866d0496981ac5119199f5912"><enum>(iii)</enum><text display-inline="yes-display-inline">Dates of birth.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2dc294f79c434950992ea018bbe3d3a9"><enum>(iv)</enum><text>Personal phone numbers.</text></clause><clause commented="no" display-inline="no-display-inline" id="id55c42054464f482898f74ed93cdf3496"><enum>(v)</enum><text>Personal email addresses.</text></clause><clause commented="no" display-inline="no-display-inline" id="iddf510cd59dd246f181a4a4346a7b20ec"><enum>(vi)</enum><text>Driver’s license and State identification numbers.</text></clause><clause id="idbe1dced8477d434aa09780487d2011d2"><enum>(vii)</enum><text>Residential addresses that are not the primary address of the trade or business (excluding ZIP Codes).</text></clause><clause commented="no" display-inline="no-display-inline" id="idfea768483135496c8106a0d6cbb4fb49"><enum>(viii)</enum><text display-inline="yes-display-inline">Names of individuals who are end-consumers.</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idcda60392977447398c50571b27fad497"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to permit the removal from a manifest signed, produced, delivered, or electronically transmitted under this section of the name, address, or identification number of a business, except as provided by section 103.31(d) of title 19, Code of Federal Regulations (or a successor regulation).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb23d0c5daef146c5916f6404779dc538"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id321955B38F3C47CEB5647237F3EC5044"><paragraph commented="no" display-inline="no-display-inline" id="id80f652bb2bb943ecb928d27370f605de" indent="up1"><enum>(4)</enum><text>Each manifest signed, produced, delivered, or electronically transmitted under this section shall include a checkbox to indicate whether the shipment is going to a private individual or a business.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idcd8a6bc2d9694f758bb70d39c7d07fc2"><enum>(c)</enum><header>Technical amendments</header><text>Section 431 of the Tariff Act of 1930, as amended by this section, is further amended—</text><paragraph id="id930DD417C8C34942A9694EFAB40A3A1B"><enum>(1)</enum><text>in subsection (b), in the fourth sentence, by striking <quote>The Customs Service</quote> and inserting <quote>U.S. Customs and Border Protection</quote>;
