<committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To end the use of solitary confinement and other forms of restrictive housing in all Federal agencies and entities with which Federal agencies contract.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H32F111537C1742FEAE334C7D24327DB7"><section section-type="section-one" id="HA0FA1E5F4F5B471FB74B659B09CCF8C2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Solitary Confinement Act</short-title></quote>.</text></section><section id="H91D444D28C094AE9A9E8887F1BCF9435"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HE134483317F142E5B3ADCE9E80B2D8CF"><enum>(1)</enum><text>the use of solitary confinement as a carceral practice causes devastating harm and constitutes a form of torture;</text></paragraph><paragraph id="H29B571D9E6C74D36BB79779A95E56003"><enum>(2)</enum><text>solitary confinement of any length of time, measured in days or even hours, can cause self-mutilation, suicide, heart disease, anxiety, depression, psychosis, mental and physical deterioration, and a significantly heightened risk of death;</text></paragraph><paragraph id="H5745834F49914A68B908F898EC0005BC"><enum>(3)</enum><text>over 120,000 people are estimated to be in solitary confinement on any given day in Federal, State, local, and immigration detention facilities;</text></paragraph><paragraph id="HC105E0C85D7C405994CCAFC12D77B0F4"><enum>(4)</enum><text>solitary confinement and other forms of restrictive housing and practices are disproportionately inflicted on Black, Latinx, Native, and other people of color, as well as transgender and gender nonconforming people, people with mental health needs, and young people;</text></paragraph><paragraph id="H4D19B8D2A7FC4E2592A4B8588FB6F6A3"><enum>(5)</enum><text>survivors of solitary confinement often carry significant trauma and other physical and psychological harm with them for the rest of their lives;</text></paragraph><paragraph id="HE7E87B6047734CFDAF0989100B2BE559"><enum>(6)</enum><text>solitary confinement has directly caused the deaths of far too many people and has increased violence and harm in prisons, detention facilities, and communities;</text></paragraph><paragraph id="HE2C5C8442425450A8E004020ED29A601"><enum>(7)</enum><text>solitary confinement derives from, and helps perpetuate, a horrific and brutal incarceration system that is rooted in racism and focuses on extreme punishment and abuse, rather than on providing opportunities for growth, healing, redemption, and transformation;</text></paragraph><paragraph id="H856D786BBF5C4978B76B40D2C959AC65"><enum>(8)</enum><text>the United States is an outlier among advanced democracies in the use of solitary confinement;</text></paragraph><paragraph id="H9169EE3F68CD4DE8871A79C3AD505E75"><enum>(9)</enum><text>evidence shows that out-of-cell, prosocial engagement and programming increase safety, well-being, and reentry outcomes;</text></paragraph><paragraph id="H2CC2A44648774A1BBDE42EE1AE39602D"><enum>(10)</enum><text>solitary confinement is expensive, and cost analyses at the Federal and State levels indicate that the elimination of solitary confinement would save taxpayers billions of dollars; and</text></paragraph><paragraph id="H0A1E4DBE5F304FB0AA1F64FB66D26D92"><enum>(11)</enum><text>solitary confinement is costly to taxpayers, does not make communities safer, jeopardizes the safety of incarcerated people and correctional staff, constitutes inhumane and degrading treatment, and has no place in a civilized society.</text></paragraph></section><section id="HA60D90A7BD1542F097D2625F9A2905F2"><enum>3.</enum><header>Ending solitary confinement and establishing minimum standards</header><subsection id="H0BB636FEB3CA4B17AF79C67C393C98F4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HBF4BFDCBCC394F77B4DCC008C856B05F"><section id="H7700257F8E0D4C618BC3AC10AADF0F8F"><enum>4015.</enum><header>Ending solitary confinement and establishing minimum standards</header><subsection id="H026E2DE332DE44A3AFCB168654CA984E"><enum>(a)</enum><header>Prohibition on the use of solitary confinement and establishment of minimum standards</header><paragraph id="H08F664520F444332B93CC6255C23D74C"><enum>(1)</enum><header>In general</header><text>Except in the circumstances described in paragraph (2)(B), a person incarcerated in a Federal facility may not be placed in solitary confinement. </text></paragraph><paragraph id="HB47A8CA1A6CC4B0389F033FEA5CFB5B2"><enum>(2)</enum><header>Minimum standards for out-of-cell time and meaningful human engagement</header><subparagraph id="H8A7C049AD17748C085C71C4D4DC8387C"><enum>(A)</enum><header>Congregate interaction required</header><text>Except as provided in subparagraphs (B)(iii), (B)(iv), and (B)(v), all persons incarcerated in a Federal facility, regardless of housing unit or detention status, shall have access to not less than 14 hours per day of out-of-cell congregate interaction in a shared space, without physical barriers, that is conducive to meaningful group interaction, including access to—</text><clause id="H63CBD88C54354AE7B1BFD719D3126B63"><enum>(i)</enum><text>not less than 7 hours per day of structured out-of-cell, congregate programming led by a staff member, incarcerated person, or community member, including access to educational, vocational, volunteer, mental health, violence prevention, alcohol and substance use treatment, financial, religious, and reentry programming;</text></clause><clause id="H786E01EDC73F479F8F9179FBFFB87EC9"><enum>(ii)</enum><text>not less than 1 hour per day of out-of-cell congregate recreation; and</text></clause><clause id="HB34C84453E484FECAB17DCDA6326CDEE"><enum>(iii)</enum><text>other unstructured out-of-cell congregate activities, including time in a day room or equivalent space, meals, library and law library, legal visits, social and legal telephone calls, contact social visitation without physical barriers, and personal property and commissary.</text></clause></subparagraph><subparagraph id="H4394702FF25F4902BEFDE70824D04CB5"><enum>(B)</enum><header>Prohibition on solitary confinement</header><text>A person incarcerated in a Federal facility may not be placed in solitary confinement unless such placement is necessary—</text><clause id="H88760F3F67A641D89CDE7C7D10E9F980"><enum>(i)</enum><text>at night for count or sleep, not to exceed 8 hours in any 24-hour period;</text></clause><clause id="HF2A4699405D94192A8892E9475023719"><enum>(ii)</enum><text>during the day for count or required facility business that can only be carried out while a person incarcerated in a Federal facility is placed in a cell, not to exceed 2 hours during any 24-hour period;</text></clause><clause id="H7712186C9E38415F82B0FA664172060D"><enum>(iii)</enum><text>for purposes of medical quarantine or medical isolation, only if done in a medical unit overseen by health care staff—</text><subclause commented="no" display-inline="no-display-inline" id="ideccbed910b3d421d94a66a6c25513aaa"><enum>(I)</enum><text display-inline="yes-display-inline">for as limited a time as medically necessary as determined by health care staff; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id316c5af0010d43b7bb6f5ac6952ff975"><enum>(II)</enum><text display-inline="yes-display-inline">with comparable access granted to persons incarcerated in the general population to phone calls, emails, and programming at a physical distance determined appropriate by health care staff;</text></subclause></clause><clause id="H41CB26F69CB24944B8EBF3FF77C8FDD9"><enum>(iv)</enum><text display-inline="yes-display-inline">subject to subparagraphs (C) and (D), in an emergency situation as a last resort, only if necessary to de-escalate immediate circumstances that pose a specific and significant risk of imminent serious physical injury to the person, staff, or other incarcerated persons, and for as short a time as necessary to de-escalate such circumstances, not to exceed—</text><subclause commented="no" display-inline="no-display-inline" id="ide21e2b9684f741578f2a2bab3c454a5a"><enum>(I)</enum><text display-inline="yes-display-inline">4 hours total immediately following such emergency situation; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id94ff544853344ffba0a5947f11f04899"><enum>(II)</enum><text display-inline="yes-display-inline">4 hours total during any 24-hour period; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2a704cac44ac4d9eba1f40f019fdd46f"><enum>(III)</enum><text display-inline="yes-display-inline">12 hours total during any 7-day period; or</text></subclause></clause><clause id="H951C535D5A324928AE1DFFB9D1B53311"><enum>(v)</enum><text display-inline="yes-display-inline">as part of a Federal agency-wide, Federal facility-wide, or partial Federal facility-wide lockdown, and—</text><subclause commented="no" display-inline="no-display-inline" id="id6629d993cb0646e99e09808581f50b87"><enum>(I)</enum><text display-inline="yes-display-inline">only if a head of a Federal facility or Federal agency has determined the lockdown is necessary to de-escalate an emergency that involves several incarcerated persons and poses a specific and significant risk of imminent serious physical injury to the staff or incarcerated persons;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id76428081623d42c19d3b6073d23b3761"><enum>(II)</enum><text display-inline="yes-display-inline">only when there are no less restrictive means to address an emergency, as a last resort after exhausting less restrictive measures;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc807ada3c3db4ebb88f0c2ec22cb7ead"><enum>(III)</enum><text display-inline="yes-display-inline">if the lockdown is confined to as narrow an area as possible and to as limited number of people as possible; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc3806c09d4634cb09a788747410aff3e"><enum>(IV)</enum><text display-inline="yes-display-inline">if the lockdown is reviewed every hour by the head of the Federal facility or Federal agency, with notification provided to the Federal agency regional or field office, or equivalent office responsible for oversight of the Federal facility, beginning at the time the lockdown has lasted 2 hours, and is lifted as quickly as possible, provided that such lockdown shall not exceed—</text><item commented="no" display-inline="no-display-inline" id="id7c175889a6404dc183c5f726260f1a3f"><enum>(aa)</enum><text display-inline="yes-display-inline">4 hours total from the time at which the lockdown starts;</text></item><item commented="no" display-inline="no-display-inline" id="idcb5ac4534d854a24ac0abec0893f1e6b"><enum>(bb)</enum><text display-inline="yes-display-inline">4 hours total during any 24-hour period; or </text></item><item commented="no" display-inline="no-display-inline" id="id68e385a82a78411a906c77e34c5910da"><enum>(cc)</enum><text display-inline="yes-display-inline">12 hours total during any 7-day period.</text></item></subclause></clause></subparagraph><subparagraph id="H126B3F4F7D8446A1BFD22CEC95A901F2"><enum>(C)</enum><header>De-escalation</header><clause commented="no" display-inline="no-display-inline" id="id69889f1e474a44249e35650524ba07a6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any placement pursuant to subparagraph (B)(iv), Federal facility staff shall meet with the incarcerated person not less frequently than once per hour to attempt de-escalation, work toward the release of the person from such confinement, and determine whether it is necessary to continue to hold the person in such confinement, and with respect to any placement pursuant to subparagraph (B)(iv) or (B)(v), health care staff must conduct a thorough medical, mental health, social, and behavioral assessment upon admission to such placement, conduct meaningful check-ins every 15 minutes to engage with the person in custody, evaluate and treat any urgent health needs, and attempt any de-escalation. </text></clause><clause commented="no" display-inline="no-display-inline" id="id79a3c7f2ba594d09a0fe740c914b28ff"><enum>(ii)</enum><header>Removal by health care staff</header><text display-inline="yes-display-inline">If health care staff determines an incarcerated person should be removed from solitary confinement for assessment or treatment purposes, or because of a negative impact of such confinement, the person shall be removed to an appropriate setting as determined by health care staff. </text></clause></subparagraph><subparagraph id="HA284647B879D4804BE91E9C4D493798B"><enum>(D)</enum><header>Prohibition on involuntary confinement</header><text display-inline="yes-display-inline">No person may be involuntarily confined in a cell under subparagraph (B)(iv) who— </text><clause id="H3FA6296B3F694014BBDA9F01A7BABA9A"><enum>(i)</enum><text>is 25 years of age or younger;</text></clause><clause id="H4D925244C43F4B91B25595AFF95B5D28"><enum>(ii)</enum><text>is 55 years of age or older;</text></clause><clause id="H0C490251BD134399860CDA47E030E068"><enum>(iii)</enum><text>has a disability, as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>);</text></clause><clause id="H7CED04AF235C4C53900E158EBAAFF6B4"><enum>(iv)</enum><text>has any diagnosed mental health need;</text></clause><clause id="H0674458FDD254C7BA0B43C305F8DC30B"><enum>(v)</enum><text>is pregnant, in the first 8 weeks of the postpartum recovery period, or caring for a child in a facility program; or</text></clause><clause id="H130759E7587D42CBB8612A20915410F6"><enum>(vi)</enum><text display-inline="yes-display-inline">has identified as, or is known or perceived by any facility staff to be, lesbian, gay, bisexual, transgender, intersex, or gender nonconforming.</text></clause></subparagraph><subparagraph id="HB9B37590D7134887B44E96B1E32E8C1D"><enum>(E)</enum><header>Requirements for separation</header><text display-inline="yes-display-inline">If a Federal facility determines that a person must be separated from the general facility population, including any placement in protective custody, for any reasons other than, or in a manner other than as provided under subparagraph (B)(iii), (B)(iv), or (B)(v), such separation in an alternative unit must—</text><clause id="H8BD6258561194A2A860C4685685163A0"><enum>(i)</enum><text display-inline="yes-display-inline">comply with—</text><subclause commented="no" display-inline="no-display-inline" id="id9a849ff861f649b6888cece58f8d1e17"><enum>(I)</enum><text display-inline="yes-display-inline">subparagraphs (A) and (F); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2fb265f478234033ae49245cd723fb69"><enum>(II)</enum><text display-inline="yes-display-inline">paragraphs (3), (4), and (5); and</text></subclause></clause><clause id="H911D4D218DCC4F8F9684CD0FEC014195"><enum>(ii)</enum><text>provide access to out-of-cell, congregate, trauma-informed, therapeutic programming aimed at promoting personal development, addressing underlying causes of problematic behavior resulting in the alternative unit placement, and helping prepare for discharge from the unit to the general population and to the community.</text></clause></subparagraph><subparagraph id="HDF09A9AF83144D8D82C61D67C40252FD"><enum>(F)</enum><header>Prohibition on limitation of services</header><text display-inline="yes-display-inline">In all Federal facilities, the following may not be imposed as a form of punishment, discipline, or for any other reason:</text><clause commented="no" display-inline="no-display-inline" id="id7e4187dfbdd24f73953f85f740b9d2bd"><enum>(i)</enum><text display-inline="yes-display-inline">Limitation on services, programming, treatment, contact visitation, phone calls, email, mail, or basic needs such as clothing, food, or bedding.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7dbf534c608c488c9533f9956bd4eda2"><enum>(ii)</enum><text display-inline="yes-display-inline">Involuntary restricted diets or any other involuntary change in diet.</text></clause><clause commented="no" display-inline="no-display-inline" id="id602e7afe0ceb412f9b262015affa83e2"><enum>(iii)</enum><text display-inline="yes-display-inline">Confiscation of approved personal property.</text></clause></subparagraph></paragraph><paragraph id="H8A633987526044FB8B2AEF112EF1B89E"><enum>(3)</enum><header>Due process requirements</header><subparagraph id="H4BAE08FFDBE649919275276B59772A4B"><enum>(A)</enum><header>Hearing regulations</header><clause commented="no" display-inline="no-display-inline" id="id1fc0d084c8fa4518ba1160b2aa1aaa12"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The reasons and procedures for placement in protective custody shall be subject to the regulations, rules, standards, and procedures (or any successors thereof) applicable to each Federal agency. </text></clause><clause commented="no" display-inline="no-display-inline" id="ida39634b199a24ae687bbacad04fb74ca"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">All hearings under regulations described in clause (i) shall comply with paragraph (4), and the conditions for all people in protective custody shall comply with—</text><subclause commented="no" display-inline="no-display-inline" id="id9018eaae2c4e41d4bcb03ec51fdf9e6a"><enum>(I)</enum><text display-inline="yes-display-inline">subparagraphs (A), (E), and (F) of paragraph (2); and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2ba7b1dcbc344f1cb52c7cc56ee72c50"><enum>(II)</enum><text display-inline="yes-display-inline">paragraph (5).</text></subclause></clause></subparagraph><subparagraph id="H341D53B59C3E4E0598F1965CCE4622A2"><enum>(B)</enum><header>Review of placement</header><clause commented="no" display-inline="no-display-inline" id="id55acd385ed8d45f09d2dffb3156496fe"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The placement of an incarcerated person in an alternative unit shall be meaningfully reviewed not less than the first 15 days after placement in solitary confinement, and not less frequently than every 15 days thereafter, by a multidisciplinary team, including program and health care staff, to determine whether the release of the incarcerated person to the general facility population continues to present a specific and significant risk of imminent serious physical injury to the person, staff, or other incarcerated persons. </text></clause><clause commented="no" display-inline="no-display-inline" id="idb081826422934c04a1fede604f6cf0a0"><enum>(ii)</enum><header>Notice of reasons for determination</header><text display-inline="yes-display-inline">If an incarcerated person is not discharged from an alternative unit at a review described under clause (i), the incarcerated person shall promptly receive in writing the reasons for the determination and the program, treatment, service, or corrective action required before discharge. </text></clause><clause commented="no" display-inline="no-display-inline" id="idb0e4bb4508e2451ab32377a4f17b15ed"><enum>(iii)</enum><header>Access to services; discharge</header><text display-inline="yes-display-inline">Each incarcerated person shall be given access to the programs, treatment, and services specified under subparagraph (A), and shall be permitted to be discharged from an alternative unit if the person so chooses and does not engage in behavior that presents a specific and significant risk of imminent serious physical injury to the person, staff, or other incarcerated persons during the subsequent 15 days. </text></clause><clause commented="no" display-inline="no-display-inline" id="iddcf2bbfefc174a3b88a4ba8b31f4f74c"><enum>(iv)</enum><header>Duration</header><text display-inline="yes-display-inline">Other than for purposes of protective custody, or upon written request by the person, no person may be held in an alternative unit for more than 60 days during any 6-month period.</text></clause></subparagraph><subparagraph id="H0220BFF8A0EC4D48B6E912B44EF87B48"><enum>(C)</enum><header>No placement based on previous incident</header><text>No person may be placed in an alternative unit for an act or incident for which the person was previously placed in such unit.</text></subparagraph></paragraph><paragraph id="H9EC7A0E6A0A14896B3A14BB2673DBF0D"><enum>(4)</enum><header>Placement hearings</header><subparagraph id="H8470FA06473542038EE8AF666383C043"><enum>(A)</enum><header>Placement in alternative unit</header><text>Other than separation of persons in protective custody or for purposes of confinement under paragraphs (2)(B)(iii), (2)(B)(iv), and (2)(B)(v), no person incarcerated in a Federal facility may be placed in an alternative unit unless and until it is determined in writing following a placement hearing that clear and convincing evidence shows that the person committed 1 of the following acts at the time placement is sought, and the specific circumstances of the acts were so heinous or destructive that placement of the person in general facility housing creates a specific and significant risk of imminent serious physical injury to staff or other incarcerated persons: </text><clause id="H69DF21F7D83647DCB38288B4D0F6636B"><enum>(i)</enum><text>Causing or attempting to cause serious physical injury or death to another person. </text></clause><clause id="H0A6BFEA955F94C69B3F58365AD608DF0"><enum>(ii)</enum><text>Compelling or attempting to compel another person, by force or threat of force, to engage in a sexual act.</text></clause><clause id="HD80A738A3CF444E2B53A03B09B66EC42"><enum>(iii)</enum><text>Leading, organizing, inciting, or attempting to cause a riot, or other similarly serious disturbance that results in the taking of a hostage, major property damage, or serious physical harm to another person.</text></clause><clause id="HBDD71B0232424688A25A1C34C53F1B9C"><enum>(iv)</enum><text>Escaping, attempting to escape or facilitating an escape from a Federal facility or escaping, attempting to escape, or facilitating an escape while under supervision outside the Federal facility.</text></clause></subparagraph><subparagraph id="H913DA625B636465587D7391679FA6684"><enum>(B)</enum><header>Neutral decision maker required</header><text>Each placement hearing shall be conducted by a neutral decision maker. </text></subparagraph><subparagraph id="HAC16506AA9864DFBAF4ADC67D4CD44B3"><enum>(C)</enum><header>Department of Justice</header><text>For all placement hearings involving placement in facilities operated by the Federal Bureau of Prisons or facilities contracting with the Federal Bureau of Prisons or United States Marshals Service for incarcerating people in the care or custody of those facilities or entities, the neutral decision maker shall be—</text><clause commented="no" display-inline="no-display-inline" id="id0827484ff0c34b14a5606fd4c207857a"><enum>(i)</enum><text display-inline="yes-display-inline">appointed by the Assistant Attorney General for Civil Rights;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7ad9d144c24249e8b38459a793a28e3e"><enum>(ii)</enum><text display-inline="yes-display-inline">employed by the Department of Justice; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf20fb85594fb4b0c98ce8b4ea3e7f374"><enum>(iii)</enum><text display-inline="yes-display-inline">independent of—</text><subclause commented="no" display-inline="no-display-inline" id="id6011414da6e549a89aa82152448397df"><enum>(I)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Justice that has people in its care or custody or engages in any prosecuting activities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf8fb7a6ac1e74dabac33d87dfaadabc8"><enum>(II)</enum><text display-inline="yes-display-inline">any other Federal agency; and </text></subclause><subclause commented="no" entity.</text></subclause></clause></subparagraph><subparagraph id="H28E887C5DE2E4E8E9F63F4A9D70D053A"><enum>(D)</enum><header>Department of Homeland Security</header><text>For all placement hearings involving placement in facilities operated by or contracting with U.S. Immigration and Customs Enforcement, the Department of Homeland Security, or U.S. Customs and Border Protection for incarcerating people in the care or custody of those facilities or entities, the neutral decision maker shall be—</text><clause commented="no" display-inline="no-display-inline" id="idde32c2125e774222be1a27a46af928dc"><enum>(i)</enum><text display-inline="yes-display-inline">appointed by the Officer for Civil Rights and Civil Liberties;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc05a1b2e9b5f4a86b4b843d4ce4df3d7"><enum>(ii)</enum><text display-inline="yes-display-inline">employed by the Department of Homeland Security; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5df5becc9704d69a99f132f2705e815"><enum>(iii)</enum><text display-inline="yes-display-inline">independent of—</text><subclause commented="no" display-inline="no-display-inline" id="id9ad8b57366bc488caf64c40ebed41d62"><enum>(I)</enum><text display-inline="yes-display-inline">the Office for Civil Rights and Civil Liberties;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb1a608b61c50443485a4581d10715d4b"><enum>(II)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Homeland Security that has people in its care or custody or engages in any prosecuting activities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7ea42c47b08b4a449519ef90c0820cb1"><enum>(III)</enum><text display-inline="yes-display-inline">any other Federal agency; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id292aeb7b594f41ad80e63ea1c5a17501"><enum>(IV)</enum><text display-inline="yes-display-inline">any prosecuting entity.</text></subclause></clause></subparagraph><subparagraph id="H0F198ABCE161427BB2D0BAF155D0291D"><enum>(E)</enum><header>Department of Health and Human Services</header><text display-inline="yes-display-inline">For all placement hearings involving placement in facilities operated by or contracting with the Department of Health and Human Services for incarcerating people in the care or custody of those facilities or entities, the neutral decision maker shall be—</text><clause commented="no" display-inline="no-display-inline" id="id8a0eeaeb224a4c8aa04f4fcfbbb66665"><enum>(i)</enum><text display-inline="yes-display-inline">appointed by the Director of the Office for Civil Rights;</text></clause><clause commented="no" display-inline="no-display-inline" id="id042eabd5717f447a8073370987f2212d"><enum>(ii)</enum><text display-inline="yes-display-inline">employed by the Department of Health and Human Services; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide4229763a3634606966e84072e89f605"><enum>(iii)</enum><text display-inline="yes-display-inline">independent of—</text><subclause commented="no" display-inline="no-display-inline" id="id804f9a750492450daab82d9c5dcf8bce"><enum>(I)</enum><text display-inline="yes-display-inline">the Office for Civil Rights;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9163f7b84054471988af773ee20e0622"><enum>(II)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Health and Human Services that has people in its care or custody;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id779fdf65ad4641f0b899a346aa1126f8"><enum>(III)</enum><text display-inline="yes-display-inline">any other Federal agency; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbd487f1479454da49be2e27e0e62e820"><enum>(IV)</enum><text display-inline="yes-display-inline">any prosecuting entity. </text></subclause></clause></subparagraph><subparagraph id="H5C95886F7D9A41C9A72C662DED5FAB72"><enum>(F)</enum><header>Evidence presented</header><text display-inline="yes-display-inline">At any placement hearing, the incarcerated person shall be permitted to offer documentary and testimonial evidence, cross-examine witnesses, and present any mitigating evidence, justification evidence, or other relevant evidence helpful in aiding the defense of the incarcerated person.</text></subparagraph><subparagraph id="H1E8A2C5628D34C7DA0FF0C5133A46F6C"><enum>(G)</enum><header>Representation</header><clause commented="no" display-inline="no-display-inline" id="id95b3728ca54a4f6f9fb890b529c619a7"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">At such a hearing, the incarcerated person shall be permitted to—</text><subclause commented="no" display-inline="no-display-inline" id="id2fa9162f4dc64276906741f3ffa4d3cd"><enum>(I)</enum><text display-inline="yes-display-inline">engage in self-representation; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id140f73c0c527467f8888e8d9758986a4"><enum>(II)</enum><text display-inline="yes-display-inline">be represented by any attorney, law student permitted to practice law, paralegal, community advocate, or other incarcerated person chosen by the person being represented.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id39f8e37d1cf54ca1b004565f3a8beab7"><enum>(ii)</enum><header>Assistance for representation</header><text display-inline="yes-display-inline">If a person does not have a representative, the person shall be offered the assistance of a representative as follows:</text><subclause id="HBF4A1ACE9EB044AE824A1D1495B1B53E"><enum>(I)</enum><header>Department of Justice placement hearings</header><text display-inline="yes-display-inline">For all placement hearings described in subparagraph (C), if an incarcerated person does not select a representative, an appointed representative shall be—</text><item commented="no" display-inline="no-display-inline" id="id3841030864a44cb1919e5f95fa8ec43b"><enum>(aa)</enum><text display-inline="yes-display-inline">selected by the Assistant Attorney General for Civil Rights;</text></item><item commented="no" display-inline="no-display-inline" id="ideb8f084f4d984b61848382a60f065d2d"><enum>(bb)</enum><text display-inline="yes-display-inline">employed by the Department of Justice; and </text></item><item commented="no" display-inline="no-display-inline" id="ida242ebce3bd44b0194f0b850013a3408"><enum>(cc)</enum><text display-inline="yes-display-inline">independent of—</text><subitem commented="no" display-inline="no-display-inline" id="idb91212b25c1247359cc125d1013239d5"><enum>(AA)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Justice that has people in its care or custody or engages in any prosecuting activities;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id622ce64a2b864313a40620f45bafc5e2"><enum>(BB)</enum><text display-inline="yes-display-inline">any other Federal agency; and </text></subitem><subitem commented="no" display-inline="no-display-inline" id="id5fb33bebb2204d1faa678c0e43b31b2e"><enum>(CC)</enum><text display-inline="yes-display-inline">any prosecuting entity.</text></subitem></item></subclause><subclause id="HA5F2AA16137F4931AE0A2C79006FADFA"><enum>(II)</enum><header>Department of Homeland Security hearings</header><text display-inline="yes-display-inline">For all placement hearings described in subparagraph (D), if an incarcerated person does not select a representative, an appointed representative shall be—</text><item commented="no" display-inline="no-display-inline" id="id8560224191534a9392fee0ea271529b5"><enum>(aa)</enum><text display-inline="yes-display-inline">selected by the Officer for Civil Rights and Civil Liberties;</text></item><item commented="no" display-inline="no-display-inline" id="idb0e9485fc5f944d198fd925cc38cbae5"><enum>(bb)</enum><text display-inline="yes-display-inline">employed by the Department of Homeland Security; and </text></item><item commented="no" display-inline="no-display-inline" id="id2df8824cd4a044b08e792258cb684a3a"><enum>(cc)</enum><text display-inline="yes-display-inline">independent of—</text><subitem commented="no" display-inline="no-display-inline" id="ide3cf21a8806c40b09668013ddd229144"><enum>(AA)</enum><text display-inline="yes-display-inline">the Office for Civil Rights and Civil Liberties; </text></subitem><subitem commented="no" display-inline="no-display-inline" id="idd5e6b798ca6b44bab5c6b1c97abec09b"><enum>(BB)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Homeland Security that has people in its care or custody or engages in any prosecuting activities;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="iddbd0ebc9d08f4b478c6c12e0c8c114c6"><enum>(CC)</enum><text display-inline="yes-display-inline">any other Federal agency; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id1b1c64d293344383b62e41e3feb12903"><enum>(DD)</enum><text display-inline="yes-display-inline">any prosecuting entity.</text></subitem></item></subclause><subclause id="HD4AA173F5E1E4F178BD78E9ED583746C"><enum>(III)</enum><header>Department of Health and Human Services hearings</header><text display-inline="yes-display-inline">For all placement hearings described in subparagraph (E), if an incarcerated person does not select a representative, any appointed representative shall be—</text><item commented="no" display-inline="no-display-inline" id="id8ea961835ee34461af21099a88c5b099"><enum>(aa)</enum><text display-inline="yes-display-inline">selected by the Director of the Office for Civil Rights;</text></item><item commented="no" display-inline="no-display-inline" id="idf7b20e3252e94e1281965c66265ff5ff"><enum>(bb)</enum><text display-inline="yes-display-inline">employed by the Department of Health and Human Services; and</text></item><item commented="no" display-inline="no-display-inline" id="id3042cae2075b427ea40f47484f587849"><enum>(cc)</enum><text display-inline="yes-display-inline">independent of—</text><subitem commented="no" display-inline="no-display-inline" id="id3c5cbf6e35ff49ebb882847ddae635c0"><enum>(AA)</enum><text display-inline="yes-display-inline">the Office for Civil Rights;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id4a139a09794e481fadd8a80bf5fd90a6"><enum>(BB)</enum><text display-inline="yes-display-inline">any division or unit within the Department of Health and Human Services that has people in its care or custody; </text></subitem><subitem commented="no" display-inline="no-display-inline" id="idc4deff3b1cd749f484dea53b464373ac"><enum>(CC)</enum><text display-inline="yes-display-inline">any other Federal agency; and </text></subitem><subitem commented="no" display-inline="no-display-inline" id="idc1d9348941fc42a5be8fa23c31ea768f"><enum>(DD)</enum><text display-inline="yes-display-inline">any prosecuting entity. </text></subitem></item></subclause></clause></subparagraph><subparagraph id="H85B7ED408BCF4D4AB178CA6FD523129E"><enum>(H)</enum><header>Notice</header><clause commented="no" display-inline="no-display-inline" id="idef7e20b4488d4da898d4bcebcbe10fa8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not less than 2 days prior to any placement hearing under this paragraph, both the incarcerated person and the chosen representative of the incarcerated person shall be provided detailed written notice of the reason for proposed placement in an alternative unit, including all relevant evidence, during which time the person may not, other than for purposes of protective custody, be placed in such alternative unit. </text></clause><clause commented="no" display-inline="no-display-inline" id="id9d0c977c7e6f46338a9239090060af6c"><enum>(ii)</enum><header>Time to prepare</header><text display-inline="yes-display-inline">The incarcerated person and the chosen representative shall be provided adequate time to prepare for such hearings and afforded adjournments as appropriate. </text></clause><clause commented="no" display-inline="no-display-inline" id="id56ff5325fd6144d0a927a7717288a59f"><enum>(iii)</enum><header>Refusal to attend</header><text display-inline="yes-display-inline">Any refusal by an incarcerated person to attend such hearings shall be videotaped and made part of the evidentiary record that shall be maintained by the relevant Federal agency. </text></clause><clause commented="no" display-inline="no-display-inline" id="id03b4a1cf4b444ef285e6a036e577e92a"><enum>(iv)</enum><header>Failure to comply</header><text display-inline="yes-display-inline">Failure to provide the notice described in clause (i) or to enter into the record videotaped evidence of an alleged refusal to attend by an incarcerated person shall constitute a basis for resolving the hearing in the favor of the incarcerated person. </text></clause></subparagraph><subparagraph id="H30713417B6C74E13B999C2101ADE3E24"><enum>(I)</enum><header>Written determination</header><clause commented="no" display-inline="no-display-inline" id="id761df7ea1cb049a9bbdc15829aba8022"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 business days after the conclusion of the placement hearing, the neutral decision maker shall issue a written determination.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5082f74842347d291ba1918afc1fb8c"><enum>(ii)</enum><header>Clear and convincing evidence</header><text display-inline="yes-display-inline">Any finding that an incarcerated person meets the criteria of placement in an alternative unit under subparagraph (A) shall be supported by clear and convincing evidence. </text></clause><clause commented="no" display-inline="no-display-inline" id="id9fbc1cfa8a0441fa8a9ec8a89b87110d"><enum>(iii)</enum><header>Contents</header><text display-inline="yes-display-inline">The determination shall specify the finding, a summary of the testimony of each witness and an explanation of whether the testimony was credited or rejected, the evidence relied upon in reaching the finding, and the placement imposed, if any. </text></clause><clause commented="no" display-inline="no-display-inline" id="id1a59da8163ff4a46b93a327d6665e2c2"><enum>(iv)</enum><header>Notice of determination</header><text display-inline="yes-display-inline">Not later than 24 hours after issuance of the determination, a copy of the determination shall be provided to the incarcerated person and the chosen representative of the incarcerated person.</text></clause></subparagraph></paragraph><paragraph id="H56B50BC08A2945EF8C98CD967E5BA1BD"><enum>(5)</enum><header>Use of restraints</header><subparagraph id="H44AC3CD552B2455EA8E2C4AB0FB462B1"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraphs (B) through (E), no person incarcerated in a Federal facility shall be placed in restraints.</text></subparagraph><subparagraph id="HA9D5E8F64AD94CE8B8EA4B713E9B980B"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply if facility staff make an individualized determination at the time of, or immediately following, an incident precipitating placement in restraints that such restraints are necessary to prevent a specific and significant risk of imminent serious physical injury to the person, other incarcerated persons, or staff based on concrete evidence of such risk.</text></subparagraph><subparagraph id="H0CDD3D4FC4A14E80B91C6F9F5BE6DC66"><enum>(C)</enum><header>Least restrictive form</header><text>If restraints are used pursuant to subsection (B), the least restrictive form of restraints shall be used for no longer than necessary to abate such specific and significant risk of imminent serious physical injury, and in no circumstances shall continue beyond 4 hours unless a supervisory medical provider determines that such restraints are necessary to prevent such risk.</text></subparagraph><subparagraph id="H19E1836BA1E9470186FC4A827A3AE989"><enum>(D)</enum><header>Placement hearing required</header><clause commented="no" display-inline="no-display-inline" id="ide8a022d9a04f4fc4a9810d5a85c138e2"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Restraints shall not be used on the same person on consecutive days unless a placement hearing with protections established under paragraphs (3) and (4) establishes such restraints are necessary to prevent a specific and significant risk of imminent serious physical injury to the incarcerated person, other incarcerated persons, or staff based on concrete evidence of such risk, and subject to the same limitations each day as set forth in this paragraph. </text></clause><clause commented="no" display-inline="no-display-inline" id="id9eb2d0bf349f4bdbb03d63e4170412a2"><enum>(ii)</enum><header>Limitations</header><text display-inline="yes-display-inline">Any repeated use of restraints approved at such a due process hearing shall be no longer than 3 days, subject to the same limitations each day as set forth in this paragraph, meaningfully reviewed by a supervisory medical provider at least daily, and discontinued once restraints are no longer necessary to prevent a specific and significant risk of imminent serious physical injury to the person, other incarcerated persons, or staff.</text></clause></subparagraph><subparagraph id="H214595E197CC4E2DA15663109C278AE1"><enum>(E)</enum><header>Subsequent use of restraints</header><text display-inline="yes-display-inline">Once an approved use of restraints has been discontinued, any subsequent use of restraints on that person shall only be permitted to address a new incident and upon the same requirements under this paragraph.</text></subparagraph></paragraph><paragraph id="H5D57C677591443E18FA2D67084B0A791"><enum>(6)</enum><header>Special administrative measures</header><text display-inline="yes-display-inline">No Federal facility may use special administrative measures. </text></paragraph></subsection><subsection id="H00595287FEE44B3E852D6E1A7909048C"><enum>(b)</enum><header>Report Required</header><text>Not later than 15 days after the end of each quarter of the fiscal year, each Federal agency shall report on the website of the Federal agency the following:</text><paragraph id="H4B3D0F67869D4338AAEEA58F73B29DFA"><enum>(1)</enum><text display-inline="yes-display-inline">The total number of incidents at each facility operated by the Federal agency during the preceding quarter of self-harm, suicide attempts, and suicide, disaggregated by race, age, gender identity, documented mental health status, documented disability, pregnancy or postpartum status, identification as lesbian, gay, bisexual, transgender, intersex, or gender nonconforming, type of housing unit including confinement under subsections (a)(2)(B)(iii), (a)(2)(B)(iv), (a)(2)(B)(v), any alternative units, and length of time in such housing unit.</text></paragraph><paragraph id="HDFE8C9C0E5714832B37BB6D0E1FA504F"><enum>(2)</enum><text>The total number of placements at each facility during the preceding quarter, separately listed, in confinement under subsections (a)(2)(B)(iii), (a)(2)(B)(iv), and (a)(2)(B)(v), in protective custody under subsection (a)(2)(E), and in any other alternative units under subsection (a)(2)(E) during that quarter.</text></paragraph><paragraph id="HAA8FB8D2D0E343D7B9AB3980C4AC046C"><enum>(3)</enum><text>The total number of people at each facility on the last day of each quarter, separately listed, in confinement under subsections (a)(2)(B)(iii), (a)(2)(B)(iv), and (a)(2)(B)(v), in protective custody under subsection (a)(2)(E), and in any other alternative units under (a)(2)(E), disaggregated by race, age, gender identity, documented mental health status, documented disability, pregnancy or postpartum status, identification as lesbian, gay, bisexual, transgender, intersex, or gender nonconforming, and reason for placement.</text></paragraph><paragraph id="H8B73FAFB888243F28BA26D327DA0BF86"><enum>(4)</enum><text display-inline="yes-display-inline">The total number of placements at each facility during the preceding quarter, separately listed, for which confinement under subsections (a)(2)(B)(iv) and (a)(2)(B)(v) lasted for less than 1 hour, between 1 and 2 hours, between 2 and 3 hours, between 3 and 4 hours, and for longer than 4 hours, with a listing of the length of time of each placement that exceeded 4 hours.</text></paragraph><paragraph id="H023AB7B5077C4F64AE8888F64A5C21D0"><enum>(5)</enum><text>The total number of people at each facility who had reached a total period of time during the preceding quarter, separately listed, in confinement under subsection (a)(2)(B)(iii), in protective custody under subsection (a)(2)(E), and in any other alternative units under subsection (a)(2)(E) of less than 7 days, between 8 days and 15 days, between 16 days and 30 days, between 31 days and 45 days, between 46 days and 60 days, and for longer than 60 days, with a listing of the length of time of each person who had reached a period of time during the preceding quarter that exceeded a total of 60 days in such confinement or housing.</text></paragraph></subsection><subsection id="H1900212C1E1C41B5830F7F2A2420FE39"><enum>(c)</enum><header>Private cause of action</header><paragraph id="H6125EF6CEAC743F3BD34A81F9BE77A41"><enum>(1)</enum><header>In general</header><subparagraph commented="no" display-inline="no-display-inline" id="id08c24df79d644067ba003d0ae2761c33"><enum>(A)</enum><header>Civil action for injury</header><text display-inline="yes-display-inline">Any person who is injured by a violation of subsection (a) may bring a civil action in the appropriate United States district court against any person, entity, or any other relevant party who violated such subsection for declaratory and injunctive relief, including directing the closure of the facility, building, or unit where the violation took place if that facility, building, or unit is in repeated and systemic noncompliance with this Act, and for such money damages as the court determines appropriate, including for emotional pain and suffering. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4037665d552e4b41ae550b80d04aca5c"><enum>(B)</enum><header>Additional awards</header><text display-inline="yes-display-inline">In an action filed under subparagraph (A), the court may, in addition to any other relief awarded under that subparagraph, award reasonable attorney’s fees and costs of the action to a prevailing plaintiff.</text></subparagraph></paragraph><paragraph id="HFAC4971BC2454E399A98A0087CC4B388"><enum>(2)</enum><header>No liability for certain lockdowns</header><subparagraph commented="no" display-inline="no-display-inline" id="idf1f809f09aba4abaad64c0848ecb9859"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No Federal agency shall be liable for a Federal agency-wide, facility-wide, or partial facility-wide lockdown that exceeded the 4-hour limit under subsection (a)(2)(B)(v) if the agency can demonstrate that—</text><clause id="H722529EF96AA45C08AB62CA9F0CA4897"><enum>(i)</enum><text>the lockdown, and the length of the time of the lockdown, was necessary to address unexpected, extraordinary circumstances involving the detonation of an explosive device, an acute mass contamination or contagion situation, a violent riot, revolt, or insurrection involving a large number of people that resulted in the taking of a hostage, major property damage, or serious physical harm to a person, or other similar emergency of the same magnitude involving a large group of people;</text></clause><clause id="HBD247B47BDC14098B2463840906138D8"><enum>(ii)</enum><text>the head of facility who authorized the lockdown complied with all notification requirements, and received approval from the agency regional or field office, or equivalent office responsible for oversight of the facility, at the time the lockdown lasted longer than 4 hours; </text></clause><clause id="HF126EB14D9034D4A8C64D81A3602BA95"><enum>(iii)</enum><text>the head of the applicable Federal agency approved of the lockdown if the lockdown exceeded 8 hours and the approval occurred at that time;</text></clause><clause id="H2FCEB26398F949ADB50A81BDAA43FE39"><enum>(iv)</enum><text>the lockdown was ended as quickly as possible, did not last longer than necessary to address the unexpected, extraordinary circumstances, and did not exceed 24 hours; and</text></clause><clause id="H0F7013AB219D47F09AB73485998AF594"><enum>(v)</enum><text>the lockdown was not used as a substitute for medical isolation or quarantine nor individual lock-ins pursuant to subsections (a)(2)(B)(iii) and (a)(2)(B)(iv), nor as a way to circumvent the time limits or protections for people held under those subsections.</text></clause></subparagraph><subparagraph id="H63ED0D97AC5D4CAC8B77595ECB5C1715"><enum>(B)</enum><header>Civil action for constitutional violation</header><clause commented="no" display-inline="no-display-inline" id="id718da939a8484df8893ad828b6b05893"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who is injured by a violation of the Constitution of the United States by a Federal official or person contracting with a Federal agency in a Federal facility may bring a civil action in the appropriate United States district court against any person, entity, or relevant party who violated such constitutional provision for declaratory and injunctive relief, including directing the closure of the facility, building, or unit where the violation took place, and for such money damages as the court determines appropriate, including for emotional pain and suffering.</text></clause><clause commented="no" display-inline="no-display-inline" id="id57ccc99a36ef4d24b9d1cbf65d1b0a61"><enum>(ii)</enum><header>Additional awards</header><text display-inline="yes-display-inline">In an action filed under subparagraph (A), the court may, in addition to any other relief awarded under that subparagraph, award reasonable attorney’s fees and costs of the action to a prevailing plaintiff.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, as amended by section 3 of this Act, is further amended by adding at the end the following:</text><quoted-block style="USC" id="H84EE006044EB40F7A30A04B8703CAD69"><section id="H7C4DD15DE54147679AC8016F281D9C0A"><enum>4016.</enum><header>Oversight</header><subsection id="H2BB7D17877E84FF5B4CF8C5CE591A5A3"><enum>(a)</enum><header>Community monitoring body</header><text>Not later than 90 days after the date of enactment of this Act, the Attorney General, in consultation with the Assistant Attorney General for Civil Rights of the Department of Justice, Officer for Civil Rights and Civil Liberties of the Department of Homeland Security, and Director of the Office for Civil Rights of the Department of Health and Human Services, shall establish a community monitoring body that shall operate independently of the Attorney General and of any other unit or division within the Department of Justice or any other Federal agency. </text></subsection><subsection id="H6E1CF2547ED74A6B850FF636AE2FC3E4"><enum>(b)</enum><header>Appointment</header><text>The Attorney General, in consultation with the Assistant Attorney General for Civil Rights of the Department of Justice, Officer for Civil Rights and Civil Liberties of the Department of Homeland Security, and Director of the Office for Civil Rights of the Department of Health and Human Services, and after obtaining input and recommendations from community organizations that provide educational services and legal support to incarcerated persons or otherwise advocate for the rights of incarcerated people and an end to solitary confinement, shall appoint not less than 15 people to serve as members of the community monitoring body. </text></subsection><subsection id="H3DC9385E15874C0EBAA0BF802005343A"><enum>(c)</enum><header>Membership</header><paragraph commented="no" display-inline="no-display-inline" id="idff78a35811494fcd8403d27828e6d03a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each member of the community monitoring body shall be an individual who— </text><subparagraph commented="no" display-inline="no-display-inline" id="id5a1ad505282b46b998ce4504d04f6b7b"><enum>(A)</enum><text display-inline="yes-display-inline">has survived solitary confinement—</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id358c829708ca4295953d0f1b1faffbba"><enum>(B)</enum><text display-inline="yes-display-inline">has had loved ones who have experienced solitary confinement or lost loved ones because of solitary confinement; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a504de61f3f4223ac309c33b58ab1e3"><enum>(C)</enum><text display-inline="yes-display-inline">is a faith leader, medical or mental health professional; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29d1e40e27024c77b2a194781eb47dcf"><enum>(D)</enum><text display-inline="yes-display-inline">is a civil rights or human rights advocate. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e59a940c5e34652819d1589450a7831"><enum>(2)</enum><header>Prior experience</header><text display-inline="yes-display-inline">Each member of the community monitoring body shall have experience engaging in advocacy, service provision, or program operation aimed at enhancing the rights and treatment of incarcerated persons. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5673ff715e7f4f489c6d7d31c9194cd5"><enum>(3)</enum><header>Requirement relating to incarceration</header><text display-inline="yes-display-inline">Not less than half of the members of the community monitoring body shall be individuals who were incarcerated or have had family members incarcerated.</text></paragraph></subsection><subsection id="HB09E2E4013D245ECB9504DA75527049F"><enum>(d)</enum><header>Membership term</header><text>Each member of the community monitoring body shall be appointed for a term of 5 years, with the possibility of 1 reappointment by the Attorney General for a total of 10 years. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8c3ff337856240b6824f6213efa470d7"><enum>(e)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Each member shall be reimbursed by the Department of Justice for any per diem expenses of the member in connection with service on the community monitoring body.</text></subsection><subsection id="HCF26E7333BBB49C0BE66DC5EF89FF126"><enum>(f)</enum><header>Assistance</header><text>The community monitoring body shall have the ability to designate any person to assist the work of the community monitoring body.</text></subsection><subsection id="H0BB547B5C47843179D7DBBE4F94161E7"><enum>(g)</enum><header>Access</header><text>Notwithstanding any other provision of law, the community monitoring body and its designees shall have the ability to make unannounced visits to Federal agencies and Federal facilities, and have access to every area of every Federal facility and all nonclassified, nonprivileged data from every Federal agency.</text></subsection><subsection id="H384880C1A6FC4798A6D9D66DEB047064"><enum>(h)</enum><header>In-Person interviews</header><text>The community monitoring body and its designees shall have the ability to conduct in-person interviews and correspond and communicate with incarcerated persons and Federal agency and Federal facility staff freely, privately, and confidentially, upon consent of the incarcerated person or staff.</text></subsection><subsection id="H4FC3ABF0FB9A4D27AFDB67E65E254012"><enum>(i)</enum><header>Meetings</header><text>Administrators of each Federal agency and Federal facility shall meet privately with the community monitoring body or its designees upon request.</text></subsection><subsection id="HF2DDF61268C54201B206BA59BAB2B083"><enum>(j)</enum><header>Communications</header><paragraph commented="no" display-inline="no-display-inline" id="id1d53ea3b98234dfb8cd40ec9d10ffe16"><enum>(1)</enum><header>In general</header><text>All persons incarcerated in Federal facilities shall have the right and access to confidentially communicate with the community monitoring body and its designees, including while the community monitoring body or its designees are at a Federal facility and through free phone calls, free mail correspondence, and free email correspondence. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50583ab239f54304bce99ed473d8e0a7"><enum>(2)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Communications described in paragraph (1) shall be afforded the same levels of protection, confidentiality, and privilege as attorney-client correspondence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82a1879f6f9a4124978542e61ee598ce"><enum>(3)</enum><header>Retaliation</header><text display-inline="yes-display-inline">No person shall face any form of retaliation or adverse impact for having contact with, or being perceived to have had contact with, the community monitoring body or its designees.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95a9aaaf2166458ea1d13f66512fce6f"><enum>(4)</enum><header>Complaints</header><text display-inline="yes-display-inline">An incarcerated person shall not be required to raise a complaint with the community monitoring body before seeking other remedies in connection with that complaint.</text></paragraph></subsection><subsection id="H363EE8FB0C974E5DAEE0E340DF74CEB9"><enum>(k)</enum><header>Electronic equipment</header><text>The community monitoring body and its designees shall have the right to bring and use electronic equipment in any Federal facility, including video cameras, photographic cameras, audio recording devices, mobile telephones, computers, and tablets, for the purposes of recording, documentation, administration of surveys, and other related purposes.</text></subsection><subsection display-inline="no-display-inline" id="HB86FA8E811EC458EA54C43599D7B94D4"><enum>(l)</enum><header>Access to certain information</header><paragraph display-inline="no-display-inline" commented="no" id="idb15bb24370ce44a6b3cfc309a5a63204"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The community monitoring body and its designees shall have the right to receive, access, inspect, and copy all relevant non-classified, non-privileged information, records, and documents in the possession or control of any Federal facility, Federal agency, or employee of any Federal facility or Federal agency.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id9ecc00aa916f4835b233e97a07555699"><enum>(2)</enum><header>Required delivery date</header><subparagraph display-inline="no-display-inline" commented="no" id="id8a4ea4f1e204495899fb580840c765ff"><enum>(A)</enum><header>General delivery date</header><text display-inline="yes-display-inline">The community monitoring body and its designees shall receive any records requested under paragraph (1) not later than 7 days after the date of request to the head of a Federal facility or Federal agency. </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idc3548c78e34f4aada917f216beec0ee5"><enum>(B)</enum><header>Expedited delivery</header><text display-inline="yes-display-inline">In a situation in which the records requested under paragraph (1) by the community monitoring body or its designees pertain to a death of an incarcerated person, threats of bodily harm including sexual or physical assaults, or the denial of necessary medical treatment, the records shall be provided not later than 48 hours after the date of the request unless members of the community monitoring body or their designees consent to an extension of the deadline.</text></subparagraph></paragraph></subsection><subsection id="HC43CC8E306AA4347B4E096A04227E59C"><enum>(m)</enum><header>Recommendations</header><paragraph commented="no" display-inline="no-display-inline" id="id6cf64dad79ac4d3894f7953f5e1194e2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The community monitoring body may make periodic recommendations to any Federal agency or Federal facility, as well as to the President, Attorney General, Secretary of Homeland Security, Secretary of Health and Human Services, Committee on the Judiciary of the House of Representatives, Committee on Oversight and Accountability of the House of Representatives, Committee on the Judiciary of the Senate, Committee on Homeland Security and Governmental Affairs of the Senate, and other Government entities. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id761df9a4dcca42a28c54fca399b09f22"><enum>(2)</enum><header>Remedial action plans</header><text display-inline="yes-display-inline">For any recommendations made by the community monitoring body to each Federal agency or Federal facility, such agency or facility shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide303b6efc5084e8a958242e4229cd268"><enum>(A)</enum><text display-inline="yes-display-inline">report to the community monitoring body not later than 90 days after receipt of the recommendations as to whether the agency or facility has designed and implemented a remedial action plan to address the recommendations; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb779dd1517f2418fb7e92b6473a2abee"><enum>(B)</enum><text display-inline="yes-display-inline">transmit any such remedial action plan to the community monitoring body. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27fc1c6406b04abc9abdef3d5a25252c"><enum>(3)</enum><header>Publication</header><text display-inline="yes-display-inline">The community monitoring body may publish its findings and recommendations on its website that the community monitoring body shall establish.</text></paragraph></subsection><subsection id="H2B2A4FD275924456832855A1A8DEAAFD"><enum>(n)</enum><header>Access for certain persons</header><text>Representatives of the news media, public defenders, representatives of the Legal Orientation Program of the Department of Justice, elected Federal, State, and local representatives, and their designees, shall have the ability to—</text><paragraph id="H3B920CDD8A45448E868DD5ADA6C49C91"><enum>(1)</enum><text>make unannounced visits to Federal agencies and Federal facilities and access every area of every Federal facility, except that— </text><subparagraph commented="no" display-inline="no-display-inline" id="id47af5bac6179443da3cb4efcb46efa81"><enum>(A)</enum><text display-inline="yes-display-inline">access to enter the cell of a person incarcerated in the Federal facility shall only be granted with the consent of the person housed in that cell; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc47bc68fe124633b2c785057a4dd3b2"><enum>(B)</enum><text display-inline="yes-display-inline">access to enter a bathroom or shower area shall only be allowed when such area is unoccupied by persons incarcerated in the Federal facility;</text></subparagraph></paragraph><paragraph id="HA1F2C02362D042C3A2F0EFD0BE5AE0B2"><enum>(2)</enum><text>receive in a timely manner, pursuant to section 552 of title 5, or any successor thereto, all requested data from every Federal agency that has persons in its care or custody; and</text></paragraph><paragraph id="HC38D5E538C404832A821C67ECEE3CB31"><enum>(3)</enum><text>correspond with and interview, with the ability to take notes and use electronic and other recording devices, incarcerated persons freely, privately, and confidentially upon the consent of the incarcerated persons.</text></paragraph></subsection><subsection id="HE2A70A623BB14D36B5BF67A231A99355"><enum>(o)</enum><header>Inspectors general</header><text>Nothing in this section shall be construed to modify, supersede, or otherwise affect the authority of any Inspector General to access all records, reports, audits, reviews, documents, papers, recommendations, or other materials, as authorized by law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HE43FC370D5764447A083547EF13FCA1B"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" Oversight.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA380F4D5A0BD46E0B8FBE0E85BC7CEB0"><enum>5.</enum><header>Creating State incentives to end solitary confinement</header><subsection id="H0AA864BA1FC649AA95F56EDAD93CB95D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, as amended by sections 3 and 4 of this Act, is further amended by inserting after section 4016, as added by section 4 of this Act, the following:</text><quoted-block style="USC" id="H1BEE576B9DFB4B83B869905D215AC065"><section id="H0221A14097634FEEACBCCD1B1B2EFD55"><enum>4017.</enum><header>Creating State incentives to end solitary confinement</header><subsection id="HF7DD76467B5A402F8C690C478CA0A1DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State or local entity that receives any Federal funds under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>) (commonly known as the <quote>Edward Byrne Memorial Justice Assistance Grant Program</quote>) shall annually certify to the Attorney General with comprehensive documentation that the State or local entity has in effect (or shall have in effect, not later than 180 days after the date of enactment of this Act) laws, policies, and programs that substantially comply with section 4015 to fully and meaningfully end solitary confinement and ensure all people in the prisons, jails, and detention centers of the State or locality have access to not less than 14 hours of out-of-cell congregate interaction in a shared space, without physical barriers, that is conducive to meaningful group interaction. </text></subsection><subsection id="H0E1564FE0BC941B8839F86E843664F95"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date of enactment of this section, in the case of a State or local entity that is not in substantial compliance with section 4015, or an amendment made by the <short-title>End Solitary Confinement Act</short-title>, the Attorney General shall reduce by not less than 10 percent the total amount that such State or unit of local government would otherwise receive under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>) (commonly known as the <quote>Edward Byrne Memorial Justice Assistance Grant Program</quote>), except that funding for public defenders, community-based mental health care, community-based drug treatment, community-based violence interruption, and other similar community-based non-carceral and non-policing services shall be exempted from any reductions.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HF2F02446BFE44626BC58D543246F1550"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">chapter 301</external-xref> of title 18, United States Code, as amended by sections 3 and 4 of this Act, is amended by inserting after the item relating to section 4016, as added by section 4 of this Act, the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H2DB922E0EDBA4AE09F752E38D6268E53"><toc regeneration="no-regeneration"><toc-entry level="section">4017. Creating State incentives to end solitary confinement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0344F5C521324D4DAC582F53146660D4"><enum>6.</enum><header>Definitions</header><subsection id="HC59FC3667158482296D15970D49B7DA1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">Chapter 301</external-xref> of title 18, United States Code, as amended by sections 3, 4, and 5 of this Act, is further amended by inserting after section 4017, as added by section 5 of this Act, the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HF3E16883D62C4DAFBFE133EFE5EAEA48"><section id="HB1B239102B3E4C4C8A9E19FDB7E24C15"><enum>4018.</enum><header>Certain definitions.</header><text display-inline="no-display-inline">In sections 4015, 4016, and 4017:</text><paragraph id="H2E2A84D17EAD415283F05262DC32C079"><enum>(1)</enum><header>Alternative unit</header><text>The term <term>alternative unit</term> means any unit that is separate from the general facility population or is in any way more restrictive than the general facility population in terms of access to programming, services, or other aspects of daily life.</text></paragraph><paragraph id="H273ED5B8581047EF9C4671D12941F575"><enum>(2)</enum><header>Attempting</header><subparagraph commented="no" display-inline="no-display-inline" id="id16469cc646c74ae48d31e344ea25cb20"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>attempting</term> means having the intent to carry out a particular act and completing significant steps in the advancement of the attempt. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71ea8ddebb4d4db697d5478ed0278b82"><enum>(B)</enum><header>Withdrawal or abandonment</header><text display-inline="yes-display-inline">Evidence of withdrawal or abandonment of a plan to carry out a particular act shall negate a finding of intent.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a48365832ad4386abdd6061cf18d536"><enum>(3)</enum><header>Community monitoring body</header><text>The term <quote>community monitoring body</quote> means the community monitoring body established under section 4016(a). </text></paragraph><paragraph id="H8E71C2B7E95C4945AD306C97B39A80CF"><enum>(4)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33cecd830f67465ab8013417bbef0f20"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Bureau of Prisons; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb0efb26b5b249038cac65a31e9edad6"><enum>(B)</enum><text display-inline="yes-display-inline">U.S. Immigration and Customs Enforcement; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfad308b9cd7e44b083df028fbd218c94"><enum>(C)</enum><text display-inline="yes-display-inline">the Department of Homeland Security;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69feb37d6ed44d5dbc3d0b475f45008c"><enum>(D)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05bd39236c41461a973896c27624045f"><enum>(E)</enum><text display-inline="yes-display-inline">the Office of Refugee Resettlement; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaeafaa378d694993a469246087a9debd"><enum>(F)</enum><text display-inline="yes-display-inline">the United States Marshals Service; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6bb25138e2b04a3f8ab417031416c32b"><enum>(G)</enum><text display-inline="yes-display-inline">the Department of Health and Human Services; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec9163f60a51479cb26431c51a93210d"><enum>(H)</enum><text display-inline="yes-display-inline">any other Federal agency that has persons in its care or custody; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf598c26107e4d739cbeeed67c1b088c"><enum>(I)</enum><text display-inline="yes-display-inline">any Federal, State, local, or private entity that has contracted with any of the entities listed in subparagraphs (A) through (H) or with any other Federal agency for holding or providing services to people in their care or custody.</text></subparagraph></paragraph><paragraph id="H7EE2F737E7504AE780512676C8BAB94E"><enum>(5)</enum><header>Federal facility</header><text>The term <term>Federal facility</term> means— </text><subparagraph commented="no" display-inline="no-display-inline" id="idba50fbdb92cd496e9db456727148c4cd"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal Bureau of Prisons facility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24c2e250ddaf453eb7dc4d53d061579c"><enum>(B)</enum><text display-inline="yes-display-inline">a U.S. Immigration and Customs Enforcement facility; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f902f7cc7674ac1a14387dd55e8bd04"><enum>(C)</enum><text display-inline="yes-display-inline">a Department of Homeland Security facility; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ba1efd74ab747949eeae488506ab129"><enum>(D)</enum><text display-inline="yes-display-inline">a U.S. Customs and Border Protection facility; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida206f51b599f4630afb1a9d69bc9ba21"><enum>(E)</enum><text display-inline="yes-display-inline">an Office of Refugee Resettlement facility; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc84d33a5a3d24c889410c0e19c2873e4"><enum>(G)</enum><text display-inline="yes-display-inline">a Department of Health and Human Services facility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id416fa6dd2fd741b9a61bd7a468fea1e6"><enum>(H)</enum><text display-inline="yes-display-inline">any other facility operated by a Federal agency that has persons in its care or custody; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3780c4ea2d5748ababeef3820b21c610"><enum>(I)</enum><text display-inline="yes-display-inline">any Federal, State, local, or private facility that has contracted with any Federal agency for incarcerating people in their care or custody or providing services to incarcerated people in their care or custody.</text></subparagraph></paragraph><paragraph id="HED6F5C601F3F44909499B6617AF70510"><enum>(6)</enum><header>Health care staff</header><text>The term <term>health care staff</term> means individuals who are employed, contracted, or volunteer to provide medical, mental, and behavioral health care services at a Federal facility.</text></paragraph><paragraph id="H13B6584B86D840D08DE40A730312CC18"><enum>(7)</enum><header>Incarcerated</header><text>The term <term>incarcerated</term> means being held in a Federal facility for any reason.</text></paragraph><paragraph id="H1FA94F921B544E07A045C53FC4F3DB2E"><enum>(8)</enum><header>Mental health need</header><text>The term <term>mental health need</term> means having any current mental health diagnosis by any medical or mental health professional, or having had any such mental health diagnosis during the previous 2 years.</text></paragraph><paragraph id="H536E6A8C2FF54D88947DCF5D85D3742D"><enum>(9)</enum><header>Multidisciplinary team</header><text>The term <term>multidisciplinary team</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc453b338d3ee487fb2a97e2a46a126bc"><enum>(A)</enum><text display-inline="yes-display-inline">means a group of staff or other people working or operating in a Federal facility who have different professional backgrounds and roles in the facility; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf30f2fa8a01e47a28e2f6f9ebf3d3416"><enum>(B)</enum><text display-inline="yes-display-inline">includes program and health care staff.</text></subparagraph></paragraph><paragraph id="HCCBD278F8F53487F81C26D9E0C0010C0"><enum>(10)</enum><header>Placement hearing</header><text>The term <term>placement hearing</term> means an administrative hearing to determine whether a person may be placed in an alternative unit in a Federal facility.</text></paragraph><paragraph id="H034549EECFAC44ABAE497536B148FA87"><enum>(11)</enum><header>Protective custody</header><text>The term <term>protective custody</term> means any housing of a person for their own protection.</text></paragraph><paragraph id="H572AF5BF8A294067A5DB8D862D35CF22"><enum>(12)</enum><header>Representative of the news media</header><text>The term <term>representative of the news media</term> means any individual or entity that— </text><subparagraph commented="no" display-inline="no-display-inline" id="id3f60493524f1414db8e4b7121659a50f"><enum>(A)</enum><text display-inline="yes-display-inline">gathers information of potential interest to a segment of the public; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17b3289438dc4a7f971e9162e7d0836c"><enum>(B)</enum><text display-inline="yes-display-inline">uses its editorial skills to turn the raw materials into a distinct work; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d8e1b0ff072433fb81c0d23d4352431"><enum>(C)</enum><text display-inline="yes-display-inline">distributes that work to an audience.</text></subparagraph></paragraph><paragraph id="H8A1EF57204B044EFA8D3CFB4F948A55C"><enum>(13)</enum><header>Solitary confinement</header><text>The term <term>solitary confinement</term> means being confined in a cell or other space without access to meaningful group interaction in a shared space.</text></paragraph><paragraph id="HF3964882B0CA4B83825A68D360E7F193"><enum>(14)</enum><header>Special administrative measures</header><text>The term <term>special administrative measures</term> means the special administrative measures under section 501.3 of title 28, Code of Federal Regulations, or any successor thereto.</text></paragraph><paragraph id="HF3F11559A5D34EFE9DC68AC30182795B"><enum>(15)</enum><header>Supervisory medical provider</header><text>The term <term>supervisory medical provider</term> means a practicing doctor, nurse practitioner, or physician assistant who has supervisory responsibilities over other medical staff in a Federal facility.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF60E52F85AF44EC4A8B400E541672B80"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/301">chapter 301</external-xref> of title 18, United States Code, as amended by sections 3, 4, and 5 of this Act, is amended by inserting after the item relating to section 4017, as added by section 5 of this Act, the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA3D89D34F3D44FEABBD9D83F20146017"><toc regeneration="no-regeneration"><toc-entry level="section">4018. Certain definitions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2A67501D45FB4C54BE8EE969FF250B8E"><enum>7.</enum><header>Removal of limitation on recovery on certain suits by incarcerated people</header><text display-inline="no-display-inline">Section 7(e) of the Civil Rights of Institutionalized Persons Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1997e">42 U.S.C. 1997e(e)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H58AA6E383D3D40FE95962B5675744C12"><subsection id="HF71FD234D0BF481E8E2E28F24F3E1C62"><enum>(e)</enum><header>Limitation on recovery</header><text>No Federal civil action may be brought by a prisoner confined in a jail, prison, or other correctional facility, for mental or emotional injury suffered while in custody without a prior showing of physical injury, the commission of a sexual act (as defined in section 2246 of title 18, United States Code), or placement in solitary confinement or an alternative unit (as defined in section 4018 of title 18, United States Code).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9AC98BE1D7CD43D48B424BFE571CAF32"><enum>8.</enum><header>Revisions to standard operating procedures and standards</header><text display-inline="no-display-inline">Each Federal agency, as defined in section 4018 of title 18, United States Code, as added by this Act, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idf7c6489a219a47f2ad676121830b3c8a"><enum>(1)</enum><text display-inline="yes-display-inline">incorporate the requirements of this Act and the amendments made by this Act into the relevant standards and procedures governing confinement; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb19b9c79a4454447bcc0f196d8fe8bb6"><enum>(2)</enum><text display-inline="yes-display-inline">monitor compliance with the requirements of this Act and the amendments made by this Act. </text></paragraph></section><section id="H535050B8D7EB48C298CDEAB3B847F729"><enum>9.</enum><header>Appropriations and prohibition on use of funds</header><text display-inline="no-display-inline">No sums appropriated to carry out the provisions of this Act may be used for any—</text><paragraph id="HA9D8B8192BCA43588EF048C750F876BC"><enum>(1)</enum><text>buildings and facilities appropriations for the Bureau of Prisons;</text></paragraph><paragraph id="H8A54F4626A1A44A88CFD821C2F92AC1F"><enum>(2)</enum><text>procurement, construction, and improvements appropriations for the Department of Homeland Security, including Immigration and Customs Enforcement and Customs and Border Protection;</text></paragraph><paragraph id="H23D4F82F23AA4512AE050A7E8BC2A19F"><enum>(3)</enum><text>constructions appropriations for the United States Marshals Service;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfcebcbc1f7ea485ea78cd4b13c5185aa"><enum>(4)</enum><text display-inline="yes-display-inline">buildings and facilities appropriations for the Department of Health and Human Services, including the Administration for Children and Families and the Office of Refugee Resettlement;</text></paragraph><paragraph id="H37782C01726F4547842474139A6E095B"><enum>(5)</enum><text>Federal agency to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7ef7fa129b5940c68db9082613aefcbf"><enum>(A)</enum><text display-inline="yes-display-inline">construct facilities where persons will be incarcerated; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfaa2895c43904fb18a119d40650e0c85"><enum>(B)</enum><text display-inline="yes-display-inline">to construct or renovate buildings or spaces within facilities where persons are or will be incarcerated; or</text></subparagraph></paragraph><paragraph id="HFEA097EE2C0C4FD0B00BA4774D7EC356"><enum>(6)</enum><text>Federal agency to construct, install, or introduce any weapons, any objects or devices or mechanisms restricting the movement of a person or persons in any way, or any other objects or mechanisms that limit movement or create more restrictive environments.</text></paragraph></section><section id="H941984C935494027AB87FDC756D02F59"><enum>10.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or an amendment made by this Act, or the application thereof to any person or circumstance is held invalid, the remainder of this Act, and other amendments made by this Act, or the application of that provision to persons or circumstances other than those as to which it is held invalid, is not affected thereby. </text></section><section id="H96CC6C552C4A42F89A8F6BB3BC8E2962"><enum>11.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect not later than 60 days after the date of enactment of this Act.</text></section></legis-body></bill>
