<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881</external-xref> note)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc42429b9dcad42ca89cfb7d5d7454d19"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>December 31, 2023</quote> and inserting <quote>‘December 31, 2035</quote>; and</text></subparagraph><subparagraph id="id90c685f96199465c8ae46a73662bcb8d"><enum>(B)</enum><text>by striking <quote>and by the FISA Amendments Reauthorization Act of 2017</quote> and inserting <quote>, the FISA Amendments Reauthorization Act of 2017, and the <short-title>Foreign Intelligence Surveillance Act of 1978 Reform and Reauthorization Act of 2023</short-title></quote>; and</text></subparagraph></paragraph><paragraph id="id1c969d6ea4ee429382ecf099561ff264"><enum>(2)</enum><text>in paragraph (2) (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/18/2511">18 U.S.C. 2511</external-xref> note), in the matter preceding subparagraph (A), by striking <quote>December 31, 2023</quote> and inserting <quote>December 31, 2035</quote>. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id93699C319ED14C2AB6C0B2F54219EB7E"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 404(b) of the Foreign Intelligence Surveillance Act of 1978 Amendments Act of 2008 is amended—</text><paragraph id="id7386c3c635a14920a004af42e3290979"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33ce9cee6d564ec493ce5033a799b0d5"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">december 31, 2023</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">December 31, 2035</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0b8b32189c340fdb7ffcc9016a50d24"><enum>(B)</enum><text>by striking <quote>and by the FISA Amendments Reauthorization Act of 2017</quote> and inserting <quote>, the FISA Amendments Reauthorization Act of 2017, and the <short-title>Foreign Intelligence Surveillance Act of 1978 Reform and Reauthorization Act of 2023</short-title></quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec9b425ddbc749f79c6e721535bb49d6"><enum>(2)</enum><text>in paragraph (2), by striking <quote>and by the FISA Amendments Reauthorization Act of 2017</quote> and inserting <quote>, the FISA Amendments Reauthorization Act of 2017, and the <short-title>Foreign Intelligence Surveillance Act of 1978 Reform and Reauthorization Act of 2023</short-title></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11a839e4a1fb45a2a7473719940143be"><enum>(3)</enum><text>in paragraph (4), by striking <quote>and by the FISA Amendments Reauthorization Act of 2017</quote> each place it appears and inserting <quote>, the FISA Amendments Reauthorization Act of 2017, and the <short-title>Foreign Intelligence Surveillance Act of 1978 Reform and Reauthorization Act of 2023</short-title></quote>.</text></paragraph></subsection></section><section id="id2b54d311c72347adbe8a5de4d412233a"><enum>102.</enum><header>Expanded protections for United States person queries</header><text display-inline="no-display-inline">Paragraph (2) of section 702(f) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(f)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1579A15036264FD09930B0AAD8C4F4D8"><paragraph commented="no" display-inline="no-display-inline" id="id61e8a6f8fdd34443985c24c077267086"><enum>(2)</enum><header>Prohibition of queries that are solely designed to find and extract evidence of a crime</header><subparagraph commented="no" display-inline="no-display-inline" id="id8d93f25eb8ea4462ba08ac4d37292fbe"><enum>(A)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as provided by subparagraph (B), the querying procedures adopted under paragraph (1) shall prohibit queries of information collected pursuant to an authorization under subsection (a) that are solely designed to find and extract evidence of criminal activity. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcc54ecba94f496e850633de538c76eb"><enum>(B)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The restriction under subparagraph (A) prohibiting certain queries of information collected pursuant to an authorization under subsection (a) shall not apply with respect to a query if—</text><clause commented="no" display-inline="no-display-inline" id="idb851d84bc246427886971b4a3b4beaa2"><enum>(i)</enum><text display-inline="yes-display-inline">there is a reasonable belief that such query may retrieve information that could assist in mitigating or eliminating a threat to life or serious bodily harm; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide96581e07cc14966b9ebb7545a1a0dae"><enum>(ii)</enum><text display-inline="yes-display-inline">such query is necessary to identify information that must be produced or preserved in connection with a litigation matter or to fulfill discovery obligations in criminal matters under the laws of the United States or any State thereof.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idbcbe882d0342459baabb7af196f0cdb8"><enum>103.</enum><header>Federal Bureau of Investigation compliance requirements</header><text display-inline="no-display-inline">Section 702(f) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(f)</external-xref>), as amended by section 102, is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id174cac2a66f74c5bbad4bb9ced81856a"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id098e96e81067480fa14d2e92d2f8b0f2"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id06972A746B2D4A0C820295ABFD03A412"><paragraph id="id7761d11715d5452995cc834b4868114e"><enum>(3)</enum><header>Requirements relating to Federal Bureau of Investigation</header><subparagraph commented="no" display-inline="no-display-inline" id="id440e769c5db24e42bdbd70681d1292dc"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For any procedures adopted under paragraph (1) for the Federal Bureau of Investigation, the Attorney General, in consultation with the Director of National Intelligence, shall also ensure that the procedures—</text><clause id="idd774901b9f8f41198bef69fb782b49e8"><enum>(i)</enum><text>prohibit personnel of the Bureau from conducting any query, unless such personnel successfully complete relevant training;</text></clause><clause id="ide16c6a6118e24def8fe985b73733a5f2"><enum>(ii)</enum><text>require that all systems of the Bureau that store unminimized contents or noncontents obtained through acquisitions authorized under subsection (a) together with contents or noncontents obtained through other lawful means must—</text><subclause commented="no" display-inline="no-display-inline" id="id938bfc33e1734b33b5cfdca33b67411c"><enum>(I)</enum><text display-inline="yes-display-inline">be configured such that personnel of the Bureau must affirmatively opt-in in order to include such unminimized contents or noncontents obtained through acquisitions authorized under subsection (a) when running a query; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbe94748acd464f3a870d847041be5983"><enum>(II)</enum><text display-inline="yes-display-inline">contain other controls reasonably expected to prevent inadvertent queries of unminimized contents or noncontents obtained through acquisitions authorized under subsection (a);</text></subclause></clause><clause id="idfb760c645ca34592bc90df953df05e18"><enum>(iii)</enum><text>require prior approval from an attorney of the Bureau for any query using the Bureau’s batch job technology or a successor tool, absent exigent circumstances;</text></clause><clause id="id0e1e9fb8c27f46d09b2bb107634cf361"><enum>(iv)</enum><text>require prior approval, absent exigent circumstances, from the Director of the Bureau, the Deputy Director of the Bureau, or the Executive Assistant Director for the National Security Branch of the Bureau, in coordination with the General Counsel of the Bureau or an attorney designated by the General Counsel to provide appropriate legal review, for any query term reasonably believed to identify—</text><subclause commented="no" display-inline="no-display-inline" id="id7376df01b5e943c8b5fe0c8df25ce5b9"><enum>(I)</enum><text display-inline="yes-display-inline">a United States elected official;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id26d10ed774fa4cd3944c372e9e677d1d"><enum>(II)</enum><text display-inline="yes-display-inline">an appointee of the President or a State Governor;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id550ce708a4ad4098a3643347500f4973"><enum>(III)</enum><text display-inline="yes-display-inline">a United States political candidate;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id08eeb866337a4b6d8e48a98ff9d5ab0b"><enum>(IV)</enum><text display-inline="yes-display-inline">a United States political organization or an individual prominent in such organization;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9b7c3c040266412a900f666096c324d9"><enum>(V)</enum><text display-inline="yes-display-inline">a United States news media or a member of a United States news media; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddde85a3c06ad444299d8b0084a3f3103"><enum>(VI)</enum><text display-inline="yes-display-inline">a United States religious organization or an individual prominent in such organization; and</text></subclause></clause><clause id="id6ac09c9f3b9d4e628a4aacefb97cd9f4" commented="no"><enum>(v)</enum><text>require that, prior to conducting a query using a United States person query term, personnel of the Bureau provide a written statement of the specific factual basis to believe that such query meets the standard required by the procedures adopted under paragraph (1).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2617d57915d04f77b967e8c986376aca"><enum>(B)</enum><header>Record of written statements</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of Investigation shall develop a technical procedure whereby a record is kept of each written statement provided pursuant to subparagraph (A)(v).</text></subparagraph><subparagraph id="id46c01d938656409b98b498fe90a427e5"><enum>(C)</enum><header>Waiver authority for Foreign Intelligence Surveillance Court</header><text>If the Foreign Intelligence Surveillance Court finds that the procedures adopted under paragraph (1) for the Federal Bureau of Investigation include measures that are reasonably expected to result in similar compliance outcomes as the measures specified in clauses (i) through (v) of subparagraph (A), the Foreign Intelligence Surveillance Court may waive one or more of the requirements specified in such clauses.</text></subparagraph></paragraph><paragraph id="idd47710b847ed4b60907ef5c252cc93a0"><enum>(4)</enum><header>Accountability procedures for Federal Bureau of Investigation</header><subparagraph commented="no" display-inline="no-display-inline" id="id0e813c04d2494303b8ebeed8aaa6c8d8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of Investigation shall adopt accountability procedures which shall be reasonably designed to ensure investigation, consequences, and disciplinary action, where appropriate, for query compliance incidents.</text></subparagraph><subparagraph id="id1d0bf2810c55471db475f8da56a5b2e4"><enum>(B)</enum><header>Requirement to provide notification of material changes</header><text>The Director of the Federal Bureau of Investigation shall—</text><clause commented="no" display-inline="no-display-inline" id="idd75c852e437e4aedb8ddf5fbe7daab1b"><enum>(i)</enum><text display-inline="yes-display-inline">provide the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives the procedures adopted in accordance with subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8c211962eeca46908b6121f79abc2135"><enum>(ii)</enum><text>promptly provide to such committees notice whenever any material change is made to the procedures adopted in accordance with subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id2594c450980e4932b0e0d0a27f6425da" commented="no"><enum>104.</enum><header>Additional reporting regarding the FBI's use of section 702 of FISA</header><subsection commented="no" display-inline="no-display-inline" id="idf477ede6ef2f4d92bdde71380c29bb95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 603 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1873">50 U.S.C. 1873</external-xref>) is amended by—</text><paragraph commented="no" display-inline="no-display-inline" id="id1c66e884fec84a949819bf895066c0c5"><enum>(1)</enum><text>in subsection (b)(2)(B), inserting <quote>(or combination of unminimized contents and noncontents information)</quote> after <quote>unminimized contents</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7bfc3a9b9c824f718a508fdbe3a07cbd"><enum>(2)</enum><text>in subsection (d)(2), by striking <quote><header-in-text style="OLC" level="paragraph">to certain information</header-in-text></quote> and all that follows through <quote><header-in-text style="OLC" level="subparagraph">Electronic mail address and telephone numbers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">to electronic mail address and telephone numbers</header-in-text></quote>;</text></paragraph><paragraph id="id9c9e790d99a44a84ac615d60b3fe098d"><enum>(3)</enum><text>redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11d74e76ba044606849265f7728c1f31"><enum>(4)</enum><text>inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8e108e6d470040028e4868cfe87a177f"><subsection id="idf43d73ed426e42558e203e66821f9955"><enum>(e)</enum><header>Mandatory reporting by Director of the Federal Bureau of Investigation</header><paragraph commented="no" display-inline="no-display-inline" id="id9dcc1774c68c4b0aaa96cdb4b9586d18"><enum>(1)</enum><header>Annual report</header><text display-inline="yes-display-inline">Each year, the Director of the Federal Bureau of Investigation shall submit to the Select Committee on Intelligence and the Committee on the Judiciary of the Senate and the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives an annual report that includes—</text><subparagraph id="ida8b2115baacf4bfcbdce6b00f363eef4"><enum>(A)</enum><text>the number of United States person queries by the Federal Bureau of Investigation of unminimized contents or noncontents acquired pursuant to section 702(a);</text></subparagraph><subparagraph id="id60a5112e8dc44b219509165ae35fd2c4"><enum>(B)</enum><text>the number of approved queries using the Federal Bureau of Investigation’s batch job technology, or successor tool;</text></subparagraph><subparagraph id="idfaf8bdcdcaca4c1785749272c4240a28"><enum>(C)</enum><text>the number of queries using the Federal Bureau of Investigation’s batch job technology, or successor tool, conducted by the Federal Bureau of Investigation against information acquired pursuant to section 702(a) for which pre-approval was not obtained due to emergency circumstances; </text></subparagraph><subparagraph id="idc76256d37b4844898b7346faa137b95b"><enum>(D)</enum><text>the number of United States person queries conducted by the Federal Bureau of Investigation of unminimized contents or noncontents acquired pursuant to section 702(a) solely to retrieve evidence of a crime; </text></subparagraph><subparagraph id="idbee5867e16c94367a91cec070a8a77a1"><enum>(E)</enum><text>a good faith estimate of the number of United States person query terms used by the Federal Bureau of Investigation to conduct queries of unminimized contents or noncontents acquired pursuant to section 702(a) primarily to protect the United States person who is the subject of the query; and</text></subparagraph><subparagraph id="id155da2ccf1664897a2756126ee3d120b"><enum>(F)</enum><text>a good faith estimate of the number of United States person query terms used by the Federal Bureau of Investigation to conduct queries of unminimized contents or noncontents acquired pursuant to section 702(a) where the United States person who is the subject of the query is a target or subject of an investigation by the Federal Bureau of Investigation. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5a510f54ea741bd8e72db52c10fd599"><enum>(2)</enum><header>Public availability</header><text display-inline="yes-display-inline">Subject to declassification review by the Attorney General and the Director of National Intelligence, each annual report submitted pursuant to paragraph (1) shall be available to the public during the first April following the calendar year covered by the report.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idea5daf2001bc4fe99bb0ecbf92b4a434"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2025.</text></subsection></section><section id="id1f5a3afeeab5443dbff7a94fd5d4bc11"><enum>105.</enum><header>Increased oversight of activities involving Members of Congress</header><text display-inline="no-display-inline">Section 702(f) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(f)(1)</external-xref>), as amended by sections 102 and 103, is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id809050f7121f481193753b3d68625227"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph (6); or</text></subclause><subclause id="id107ee5e0c1ae4f89b098aeaf1f4aeaa5" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the date that such investigation ends.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id11c73330d4b2426683100d4c60aa06b0"><enum>106.</enum><header>Exception for consensual queries</header><text display-inline="no-display-inline">Section 702(f)(1) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(f)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB2397B200F0C4F6D987C3ED47FD75A58"><subparagraph id="id4f42cb7fbd2a46249b6dab27fad0082e"><enum>(D)</enum><header>Consensual queries</header><text>The query standard set forth in the procedures adopted pursuant to subparagraph (A) shall include an exception for cases in which the subject of the query, or a third party authorized to consent on behalf of the subject, has provided consent for the query.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idD4A1B1E17B0C4165B1ACD0C76E461ABF"><enum>107.</enum><header>Procedures to enable travel vetting of non-United States persons</header><text display-inline="no-display-inline">Section 702(f) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(f)</external-xref>), as amended by section 105, is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id801D4233736346D3919FA7814D9918C7"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (6) as paragraph (7); and</text></paragraph><paragraph id="idC466BB594CD74F49BEBA1B15F99E7783" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (5) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idB5EBE00180B649088E54C19ABF4BCB9A"><paragraph id="id5D66F3DCA06940CD9072EE6A9861D189"><enum>(6)</enum><header>Travel vetting of non-United States persons</header><text>For any procedures adopted under paragraph (1)(A), the Attorney General, in consultation with the Director of National Intelligence, shall ensure that the procedures enable the vetting of non-United States persons who are being processed for travel to the United States using terms that do not qualify as United States person query terms under this Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="id7f1e350819f74dacb106ba3792a55af2" style="OLC"><enum>II</enum><header>Accuracy and integrity of FISA process</header><section id="idd340c794c3714d6aa6a9f19c9864382d" commented="no"><enum>201.</enum><header>Certifications regarding accuracy of FISA applications</header><subsection id="id7749dc1c64874e9e9d5831881e4f32d9"><enum>(a)</enum><header>Title I</header><text>Subsection (a) of section 104 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804</external-xref>) is amended—</text><paragraph id="idfac9d9cf248c4ce1ac27134473226a14"><enum>(1)</enum><text>in paragraph (8), by striking <quote>; or</text></subparagraph><subparagraph id="id0724f66a406a4603ab1fa8522a438ce9"><enum>(B)</enum><text>otherwise raise doubts with respect to the findings required under section 105(a).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7a61e09abd754a3bb7f9b5043e6cceb3"><enum>(b)</enum><header>Title III</header><text>Subsection (a) of section 303 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1823">50 U.S.C. 1823</external-xref>) is amended—</text><paragraph id="idfa52230c42c24067ae43c2b4c89ab3e5"><enum>(1)</enum><text>in paragraph (7), by striking <quote>; or</text></subparagraph><subparagraph id="idb99c216ad46943fdb58bba046dcb0ea9"><enum>(B)</enum><text>otherwise raise doubts with respect to the findings required under subsection (d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6486a6b90ee047cf9da01b0e338d2a40"><enum>(d)</enum><header>Title V</header><text>Subsection (b) of section 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1862">50 U.S.C. 1862</external-xref>) is amended—</text><paragraph id="id154f9b5f1baa424fa8ff02be4705a6e3"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>; or</text></subparagraph><subparagraph id="id867944f9fb9148448108482efb1fd4f8"><enum>(B)</enum><text>otherwise raise doubts with respect to the findings required under subsection (c).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8d1a56f0d47a487bbdf0d7414ec98296"><enum>(e)</enum><header>Title VII</header><paragraph id="id895a99894e2640669e773c3bee209008"><enum>(1)</enum><header>Section 703</header><text>Subsection (b)(1) of section 703 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1881b">50 U.S.C. 1881b</external-xref>) is amended—</text><subparagraph id="id923eb41badd942cea56dc77b26f32d15"><enum>(A)</enum><text>in subparagraph (I), by striking <quote>; or</text></subparagraph><subparagraph id="idc21136ec90074d0a9fda7abf01d0afb6"><enum>(B)</enum><text>otherwise raise doubts with respect to the findings required under subsection (c).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id339014baa3a44da7a6a4d6791f3d4639" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Review of case files To ensure accuracy</header><text>Not later than 180 days after the date of the enactment of this Act, the Attorney General, in consultation with the Director of the Federal Bureau of Investigation, shall issue procedures governing the review of case files, as appropriate, to ensure that applications to the Foreign Intelligence Surveillance Court under title I or III of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) that target United States persons are accurate and complete.</text></subsection></section><section id="idbbd2617f97c1476eb5eecdbf711dd738"><enum>202.</enum><header>Submission of court transcripts to Congress</header><text display-inline="no-display-inline">Section 601(c) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7132f80c021d413a8aa13305519b2cee"><enum>(1)</enum><text>in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="id98ba801c7b0543b49ad3ad59d0aeb316"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe70cf792b3d481d97092cccf330dff2"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4D0AE5E941784FE5AEA08FD92CD18577"><paragraph id="id5a10f50335824514b123b5ae9e028484"><enum>(3)</enum><text>for any matter at which a court reporter is present and creates a transcript of a hearing or oral argument before the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review, a copy of each such transcript not later than 45 days after the government's receipt of the transcript or the date on which the matter concerning such hearing or oral argument is resolved, whichever is later.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="H704B2609C40F4870A02125404F3FF3B7"><enum>203.</enum><header>Enhanced authorities for amicus curiae</header><subsection id="id8f2693a35c3b462dbd306118cd1c2f73" changed="not-changed"><enum>(a)</enum><header>Expansion of appointment authority</header><paragraph id="id63e760552eeb457db191ab58055144f7" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Section 103(i)(2) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)(2)</external-xref>) is amended—</text><subparagraph id="id19FC82646E614B1284607D6D613DCE3E" changed="not-changed"><enum>(A)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id448814410d164b46bd5fb86bf4c4f3a2" changed="not-changed"><subparagraph id="id406d60bf7cad47469eab41daa7d5fd87" changed="not-changed"><enum>(A)</enum><text>shall appoint 1 or more individuals who have been designated under paragraph (1), not less than 1 of whom possesses privacy and civil liberties expertise, unless the court finds that such a qualification is inappropriate, to serve as amicus curiae to assist the court in the consideration of any application or motion for an order or review that, in the opinion of the court—</text><clause id="idf2223b477f7f41da955c89e0af7b94da" changed="not-changed"><enum>(i)</enum><text>presents a novel or significant interpretation of the law, unless the court issues a finding that such appointment is not appropriate;</text></clause><clause id="idceb1a5757aab49669125d21f2411c1f2" changed="not-changed"><enum>(ii)</enum><text>presents exceptional concerns with respect to the activities of a United States person that are protected by the first amendment to the Constitution of the United States, unless the court issues a finding that such appointment is not appropriate;</text></clause><clause id="ided0ccfe47f3d4874a743cc84afe8ae68" changed="not-changed"><enum>(iii)</enum><text>targets a United States person and presents or involves a sensitive investigative matter, unless—</text><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="id46b9ec594ccb4d42b027392a9fd6768b"><enum>(I)</enum><text display-inline="yes-display-inline">the matter represents an immediate danger to human life; and</text></subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="ida4f826547e1f46119fdbe228bb6c4143"><enum>(II)</enum><text>the court issues a finding that such appointment is not appropriate;</text></subclause></clause><clause id="id9fd5d78abb55461d9a5409316b94ce64" changed="not-changed"><enum>(iv)</enum><text>targets a United States person and presents a request for approval of a new programmatic surveillance or reauthorization of it, unless the court issues a finding that such appointment is not appropriate; or</text></clause><clause id="id9D1E4081B245481F8D238779A9AF4D35" changed="not-changed"><enum>(v)</enum><text>targets a United States person and otherwise presents novel or exceptional civil liberties issues, unless the court issues a finding that such appointment is not appropriate; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idEEBD2F662DE9463C9A536761A5632219" changed="not-changed"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>an individual or organization</quote> each place the term appears and inserting <quote>one or more individuals or organizations</quote>.</text></subparagraph></paragraph><paragraph id="idF072D2ACB94F45FAA1A72A3EE5B2A63E" changed="not-changed"><enum>(2)</enum><header>Definition of sensitive investigative matter</header><text>Subsection (i) of section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4C3D6F7168024C8C959CA11BAB6510D9" changed="not-changed"><paragraph id="id573002b3eecb491f970e9c8c7aaa68ac" changed="not-changed"><enum>(12)</enum><header>Definition of sensitive investigative matter</header><text>In this subsection, the term <term>sensitive investigative matter</term> means—</text><subparagraph id="id6d0b6bb47e484b1fa9e75439d4f14f78" changed="not-changed"><enum>(A)</enum><text>an investigative matter that targets a United States person who is—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id3e22cd24f1164ae7a730e1f7c6f927fc"><enum>(i)</enum><text>a United States elected official; </text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="idec12ef686e9b4f8fb780a4457105b2e3"><enum>(ii)</enum><text display-inline="yes-display-inline">an appointee of the President or a State Governor;</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="idffc343f96cec412a92983c01eebe02b1"><enum>(iii)</enum><text display-inline="yes-display-inline">a United States political candidate;</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id1ea546f80f54498384f1d4a357d09296"><enum>(iv)</enum><text display-inline="yes-display-inline">a United States political organization or an individual prominent in such organization;</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id96919ce1b0734c0eb035e5b677d925d4"><enum>(v)</enum><text display-inline="yes-display-inline">a United States news media or member of a United States news media; or</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id5534f8a5544b4eb182919b068cbe27e5"><enum>(vi)</enum><text display-inline="yes-display-inline">a United States religious organization or an individual prominent in such organization; or </text></clause></subparagraph><subparagraph id="id456DA5127DE745CCB941908F02A0D4BF" changed="not-changed"><enum>(B)</enum><text>any other investigative matter involving a domestic entity or a known or presumed United States person that, in the judgment of the applicable court established under subsection (a) or (b), is as sensitive as an investigative matter described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb53f3276233d4006ac2c8b3dafca6a66" changed="not-changed"><enum>(b)</enum><header>Authority To seek review</header><text>Subsection (i) of such section (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>), as amended by subsection (a) of this section, is amended—</text><paragraph id="ida0a9eecc61604d77a3d2368da5f8e2aa" commented="no" changed="not-changed"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph commented="no" id="id21040DBB45324C0ABF837FC7162A4704" changed="not-changed"><enum>(A)</enum><text>in the paragraph heading, by inserting <quote><header-in-text style="OLC" level="paragraph">; authority</header-in-text></quote> after <quote><header-in-text style="OLC" level="paragraph">Duties</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" id="idDEBC033C52A94C2EACD3A0B2183552E1" changed="not-changed"><enum>(B)</enum><text>by redesignating subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph commented="no" id="idC60CAC0CF66E4A69A7C99A109C2CED42" changed="not-changed"><enum>(C)</enum><text>in the matter preceding clause (i), as so designated, by striking <quote>the amicus curiae shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="idCA91D600BE8347C081D5BE1D6F75BD87" changed="not-changed"><text>the amicus curiae—</text><subparagraph commented="no" id="idDA20F7833E434D07A97879EB48ED7C1D" changed="not-changed"><enum>(A)</enum><text>shall</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="idD8DF8DED05AF47468E546B99BF9848A4" changed="not-changed"><enum>(D)</enum><text>in subparagraph (A)(i), as so designated, by inserting before the semicolon at the end the following: <quote>, including legal arguments regarding any privacy or civil liberties interest of any United States person that would be significantly impacted by the application or motion</quote>; and</text></subparagraph><subparagraph commented="no" id="idFF56E65615534912BD269496218C3472" changed="not-changed"><enum>(E)</enum><text>by striking the period at the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id14AA5BFC587E418B9E648BAD56D1032B" changed="not-changed"><text>; and</text><subparagraph commented="no" id="id6B1EBC7095C34233BBCAFD0EA7269B5E" changed="not-changed"><enum>(B)</enum><text>may seek leave to raise any novel or significant privacy or civil liberties issue relevant to the application or motion or other issue directly impacting the legality of the proposed electronic surveillance with the court, regardless of whether the court has requested assistance on that issue.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idd2b2b4f550cc4c1da41064be71cde714" changed="not-changed"><enum>(2)</enum><text>by redesignating paragraphs (7) through (12) as paragraphs (8) through (13), respectively; and</text></paragraph><paragraph id="idd718353180a64289a2839b86fbcc8c06" changed="not-changed"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id34c52eea441d4c0faa3c1d2beae0def8" changed="not-changed"><paragraph id="id247da5c1561845248588b96cceade1e5" changed="not-changed"><enum>(7)</enum><header>Authority to seek review of decisions</header><subparagraph id="H142BE361BE984EF58B8A6DBA796D9461" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><header>FISA Court decisions</header><text display-inline="yes-display-inline">Following issuance of a final order under this Act by the Foreign Intelligence Surveillance Court in a matter in which an amicus curiae was appointed under paragraph (2), that amicus curiae may petition the Foreign Intelligence Surveillance Court to certify for review to the Foreign Intelligence Surveillance Court of Review a question of law pursuant to subsection (j). If the court denies such petition, the court shall provide for the record a written statement of the reasons for such denial. Upon certification of any question of law pursuant to this subparagraph, the Court of Review shall appoint the amicus curiae to assist the Court of Review in its consideration of the certified question, unless the Court of Review issues a finding that such appointment is not appropriate. </text></subparagraph><subparagraph id="H76286897269744F69DA38256F9BFD21F" commented="no" changed="not-changed"><enum>(B)</enum><header>FISA Court of Review decisions</header><text display-inline="yes-display-inline">An amicus curiae appointed under paragraph (2) may petition the Foreign Intelligence Surveillance Court of Review to certify for review to the Supreme Court of the United States any question of law pursuant to section 1254(2) of title 28, United States Code, in the matter in which that amicus curiae was appointed.</text></subparagraph><subparagraph id="id199ba1c0042c4686bf34db10e734fea3" changed="not-changed"><enum>(C)</enum><header>Declassification of referrals</header><text>For purposes of section 602, if the Foreign Intelligence Surveillance Court or Foreign Intelligence Surveillance Court of Review denies a petition filed under subparagraph (A) or (B) of this paragraph, that petition and all of its content shall be considered a decision, order, or opinion issued by the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review described in paragraph (2) of section 602(a).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H42D6CD53300849DCB8D8CAF6D32E6217"><enum>(c)</enum><header>Access to information</header><paragraph id="id4603746511ad4d3c80e320c85ea17cc7" changed="not-changed"><enum/></paragraph><paragraph commented="no" display-inline="yes-display-inline" id="id84c726b1cd3f4b76aa2d76ef79872f66"><enum>(1)</enum><header>Application and materials</header><text>Subparagraph (A) of section 103(i)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)(6)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id23044ff6174b437b90d58e4f8f52391e" changed="not-changed"><subparagraph commented="no" display-inline="no-display-inline" id="HFA8A8DD8ED884C73BC750F42923BD97D" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><clause commented="no" display-inline="no-display-inline" id="id864D0359C55A47A7B19441E1784A7109" changed="not-changed"><enum>(i)</enum><header>Right of amicus</header><text display-inline="yes-display-inline">If a court established under subsection (a) or (b) appoints an amicus curiae under paragraph (2), the amicus curiae—</text><subclause id="ideb4d2cbb6d77414d880308596675a1f8" changed="not-changed"><enum>(I)</enum><text>shall have access to, to the extent such information is available to the Government and the court established under subsection (a) or (b) determines it is necessary to fulfill the duties of the amicus curiae—</text><item id="idb4fb1d95c385460b8eea5cee8d482e80" changed="not-changed"><enum>(aa)</enum><text>the application, certification, petition, motion, and other information and supporting materials submitted to the Foreign Intelligence Surveillance Court in connection with the matter in which the amicus curiae has been appointed, including access to any relevant legal precedent (including any such precedent that is cited by the Government, including in such an application);</text></item><item id="idD8094F683B76464994C574564C04FDBE" changed="not-changed"><enum>(bb)</enum><text>a copy of each relevant decision made by the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review in which the court decides a question of law, without regard to whether the decision is classified; and</text></item><item id="id59f245af957b4062bdf74acd4d987a93" changed="not-changed"><enum>(cc)</enum><text>any other information or materials that the court determines are relevant to the duties of the amicus curiae; and</text></item></subclause><subclause id="id2639d5d9baaa47be94678f5c23a918fa" changed="not-changed"><enum>(II)</enum><text>may make a submission to the court requesting access to any other particular materials or information (or category of materials or information) that the amicus curiae believes to be relevant to the duties of the amicus curiae.</text></subclause></clause><clause id="id96D06EE852084590B8B670D09189315B" changed="not-changed"><enum>(ii)</enum><header>Supporting documentation regarding accuracy</header><text>The Foreign Intelligence Surveillance Court, upon the motion of an amicus curiae appointed under paragraph (2) or upon its own motion, may require the Government to make available the supporting documentation if the court determines the information is relevant to the duties of the amicus curiae.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id1f6eb24d5d424139bf767448866c6b50" changed="not-changed"><enum>(2)</enum><header>Clarification of access to certain information</header><text>Such section is further amended by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEC29456ACCA1420AB2B1DBB92790E267" changed="not-changed"><subparagraph id="id0A3D081431184C55948BDB0CA33D3CBE" changed="not-changed"><enum>(C)</enum><header>Classified information</header><text>An amicus curiae appointed by the court shall have access, to the extent such information is available to the Government and the court determines such information is relevant to the duties of the amicus curiae in the matter in which the amicus curiae was appointed, to copies of each opinion, order, transcript, pleading, or other document of the Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review, including, if the individual is eligible for access to classified information, any classified documents, information, and other materials or proceedings, but only to the extent consistent with the national security of the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HEDF86FE40B644974B84B1CC4125362CE"><enum>(3)</enum><header>Consultation among amici curiae</header><text display-inline="yes-display-inline">Such section is further amended—</text><subparagraph commented="no" id="H84A8A9F34B664B88AF162B509EF7540E"><enum>(A)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (C), (D), and (E), respectively; and</text></subparagraph><subparagraph commented="no" id="H227F924DCCC540798837D8EAC8380F69"><enum>(B)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF506EBE553C34848B36A2D2390338343"><subparagraph commented="no" id="H3FE089E466AE4766AC76C7BE3D8EFDFD"><enum>(B)</enum><header>Consultation</header><text display-inline="yes-display-inline">If the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review determines that it is relevant to the duties of an amicus curiae appointed by the court under paragraph (2), the amicus curiae may consult with 1 or more of the other individuals designated by the court to serve as amicus curiae pursuant to paragraph (1) regarding any of the information relevant to any assigned proceeding.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H190017E1C4E24323B0D9FA74B571F29F"><enum>(d)</enum><header>Term limits</header><paragraph commented="no" id="HB8886170C4AC41F4B10F256DD017051A"><enum>(1)</enum><header>Requirement</header><text>Paragraph (1) of section 103(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)</external-xref>) is amended by adding at the end the following new sentence: <quote>An individual may serve as an amicus curiae for a 5-year term, and the presiding judges may, for good cause, jointly reappoint the individual to a single additional term.</quote>.</text></paragraph><paragraph id="H51058D13C8874BB8A626D6E0379D2B34" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Application</header><text>The amendment made by paragraph (1) shall apply with respect to the service of an amicus curiae appointed under section 103(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)</external-xref>) that occurs on or after the date of the enactment of this Act, regardless of the date on which the amicus curiae is appointed.</text></paragraph></subsection></section><section id="HB89A24E6DAC84CAAA6CD36CA22344334" section-type="subsequent-section"><enum>204.</enum><header>Prohibition on use of politically derived information in applications for certain orders by the Foreign Intelligence Surveillance Court</header><subsection id="H2B7FF8F004544DF78D2ADE4F618E6702"><enum>(a)</enum><header>Title I orders</header><text display-inline="yes-display-inline">Section 104(a)(6) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804(a)(6)</external-xref>) is amended—</text><paragraph id="HB6FE463976D54C82AD13084B628BB685"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H80A8E1BD090A496885DFCF23A06DC8B0"><enum>(2)</enum><text>in subparagraph (E)(ii), by striking the semicolon and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HD6C5D3C27FB843EA9A5E1F97F3D471AD"><enum>(3)</enum><text>by adding after subparagraph (E) the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H0036CC0052C248A2BF8ED3F03E4BE90F" style="OLC"><subparagraph id="HAE2A659421E340AE8937F05B4D6C19D8"><enum>(F)</enum><text display-inline="yes-display-inline">that none of the information included in the statement described in paragraph (3) was solely produced by, derived from, or collected using funds of, a political organization (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/527">section 527</external-xref> of the Internal Revenue Code of 1986) for the purpose of gaining an advantage against, or otherwise conducting research on, an opposing political candidate, unless—</text><clause id="HC47C749896D044CC87AA6396E880722C"><enum>(i)</enum><text>the political organization that produced the information is clearly identified in the body of the statement;</text></clause><clause id="HED6D141B2AF74CE0B650F2F5EA346CCA"><enum>(ii)</enum><text>the information has been corroborated by other investigative techniques; and</text></clause><clause id="H99978E6D9F2349BCBFE111F8AA2DF65C"><enum>(iii)</enum><text>the investigative techniques used to corroborate the information are clearly identified in the body of the statement.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA81D8EDF3AB34C3CA227CE3A98BA1868"><enum>(b)</enum><header>Title III orders</header><text display-inline="yes-display-inline">Section 303(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1823">50 U.S.C. 1823(a)(6)</external-xref>) is amended—</text><paragraph id="HDBA668C666514046AC6F32FB6A09B8C4"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="HC10316B46B81466E9C8785E43FE79975"><enum>(2)</enum><text>in subparagraph (E), by striking the semicolon and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H18B9E271DE7B4784B44C2A431B4ACA79"><enum>(3)</enum><text>by adding after subparagraph (E) the following new subparagraph:</text><quoted-block id="H6D6DFE9E970F45588DA6C117EEC81A5D" display-inline="no-display-inline" style="OLC"><subparagraph id="id47B3FEFF3EEC4C21B9DF9A547DB0616B"><enum>(F)</enum><text display-inline="yes-display-inline">that none of the information included in the statement described in paragraph (3) was solely produced by, derived from, or collected using funds of, a political organization (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/527">section 527</external-xref> of the Internal Revenue Code of 1986) for the purpose of gaining an advantage against, or otherwise conducting research on, an opposing political candidate, unless—</text><clause id="idE6E6C1736DE047A3B7EDC8305B55EBC0"><enum>(i)</enum><text>the political organization that produced the information is clearly identified in the body of the statement;</text></clause><clause id="id33B805D34F7349078BD60E2183897014"><enum>(ii)</enum><text>the information has been corroborated by other investigative techniques; and</text></clause><clause id="id4041145C283240C99896D385F463E892"><enum>(iii)</enum><text>the investigative techniques used to corroborate the information are clearly identified in the body of the statement.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HAC15DABC89054484BD36F9FA90ACBBA2"><enum>205.</enum><header>Investigations relating to Federal candidates and elected Federal officials</header><subsection id="H27FAFF993EA94DEFA15C1F1127266366"><enum>(a)</enum><header>Title I</header><text display-inline="yes-display-inline">Section 104(a)(6) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804(a)(6)</external-xref>), as amended by section 204, is further amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7B8D7B0611E84716B39869A8A540CADA"><subparagraph display-inline="no-display-inline" id="H859D3B07F0CE4860AE5800AB17AFF8F6"><enum>(G)</enum><text display-inline="yes-display-inline">if the target of the electronic surveillance is an elected Federal official or a candidate in a Federal election, that the Attorney General has approved in writing of the investigation;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8A82839E503240389B359D8759B7ED7D"><enum>(b)</enum><header>Title III</header><text display-inline="yes-display-inline">Section 303(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1823">50 U.S.C. 1823(a)(6)</external-xref>), as amended by section 204, is further amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD3EE1826682E41CD90D9529F9568A333"><subparagraph id="H723FAE1421AA4C96A2EF2B9996FA1A95"><enum>(G)</enum><text display-inline="yes-display-inline">if the target of the physical search is an elected Federal official or a candidate in a Federal election, that the Attorney General has approved in writing of the investigation;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H1AA7788A04EF4C1C8CE4ED94965470D1"><enum>206.</enum><header>Removal or suspension of Federal officers for misconduct before Foreign Intelligence Surveillance Court</header><text display-inline="no-display-inline">Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HEF5462B3829D413B9A6043939847F871"><subsection id="H0F58F3D920754CD4A2D28FDEC62A353E"><enum>(l)</enum><header>Removal or suspension of Federal officers for misconduct before courts</header><text display-inline="yes-display-inline">An employee, officer, or contractor of the United States Government who knowingly engages in misconduct with respect to proceedings before the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review shall be subject to appropriate adverse actions, including, as appropriate, suspension without pay or removal.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="HA5F861950F86490CB8FDABBE93F4AEEC"><enum>207.</enum><header>Additional penalties for offenses relating to FISA</header><subsection id="HA50548FBF1194AE1BD3E284BC1860426"><enum>(a)</enum><header>False declarations before FISC and FISCR</header><text display-inline="yes-display-inline">Section 1623(a) of title 18, United States Code, is amended by inserting before <quote>, or both</quote> the following: <quote>or, if such proceedings are before or ancillary to the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review established by section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>), imprisoned not more than 10 years</quote>. </text></subsection><subsection subsection (a)</quote> and inserting <quote>under paragraph (1) or (2) of subsection (a)</quote>.</text></paragraph></subsection></section><section id="H3B2D23154B61464783CFE49CB4F3A57A" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>208.</enum><header>Contempts constituting crimes before the Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review</header><text display-inline="no-display-inline">Section 402 of title 18, United States Code, is amended by inserting after <quote>any district court of the United States</quote> the following: <quote>, the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review established by section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>),</quote>.</text></section><section id="H5A0DF304988E4762A840573CAC074843"><enum>209.</enum><header>Effective and independent advice for the Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review</header><text display-inline="no-display-inline">Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>), as amended by section 206, is further amended by adding at the end the following new subsection:</text><quoted-block id="HFCFA92062E67457A8347BB531DBE492C" display-inline="no-display-inline" style="OLC"><subsection id="H904DA66340A943BA80A213007FEB7A61"><enum>(m)</enum><header>Independent legal advisors</header><paragraph id="H438E4D6D77AB40E7AE810B8439F2E6D5"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review may jointly employ legal advisors to assist the courts in all aspects of considering any matter before the courts, including with respect to—</text><subparagraph id="HD58BAC9877DF40318E9C003318238520"><enum>(A)</enum><text>providing advice on issues of law or fact presented by any application for an order under this Act;</text></subparagraph><subparagraph id="HDD51909FB0974D85A3C7CF4B5ED4613D"><enum>(B)</enum><text>requesting information from the Government in connection with any such application;</text></subparagraph><subparagraph id="H96382CFFE9B246208778D977535B7988"><enum>(C)</enum><text display-inline="yes-display-inline">identifying any concerns with any such application; and</text></subparagraph><subparagraph id="H0B5C6C15EEEA4637A1BCAC94A9D70C74"><enum>(D)</enum><text>proposing requirements or conditions for the approval of any such application.</text></subparagraph></paragraph><paragraph id="H918AEB4BEC134975A078F95942D82E03" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Direction</header><text display-inline="yes-display-inline">The legal advisors employed under paragraph (1) shall be subject solely to the direction of the presiding judges of the Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3F10EAE0B91D4BDFBE3BB3E22AB1F018"><enum>210.</enum><header>Enhancements to congressional oversight</header><subsection id="HA4F53A460EAE4DAA95DD284B3091DB68"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 601 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871</external-xref>) is amended—</text><paragraph id="HEF438421984742668F5A5331572CDEA3"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="H1955DB47A34A497895236605980C3865"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection (e):</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4385CF8F74404E718D8C8602B94AC4EE"><subsection id="H970A75BB8A1A4D24B2EEB535170E0C6B"><enum>(e)</enum><header>Congressional oversight</header><text display-inline="yes-display-inline">In a manner consistent with the protection of the national security, nothing in this Act or any other provision of law may be construed to preclude the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives from receiving in a timely manner, upon request, applications submitted under this Act to the Foreign Intelligence Surveillance Court, orders of the court, and relevant materials relating to such applications and orders.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H59FA5EEAC037499A9912BD51328CCA60" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 602(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1872">50 U.S.C. 1872(a)</external-xref>) is amended by striking <quote>in section 601(e)</quote> and inserting <quote>in section 601(f)</quote>.</text></subsection></section><section section-type="subsequent-section" id="HCA27BBB38DAE435C8AF196C1AC9BEBF7"><enum>211.</enum><header>Establishment of compliance officers</header><subsection id="HD447AEB896BE4EC9A5ECF0CFB4883332"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VI of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDE51811B135E4AB8876B358B0953CC3E"><section id="H9E7EF09D91634D7587508E6DF5FF0756"><enum>605.</enum><header>Compliance officers</header><subsection id="idBE73F8606EC84163A74B3E0D69F2B358"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id502886AB7C63488586AFEDCA3D9C3201"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph id="idDA1768E4C4914F4F9A5AB512CD5E6385"><enum>(A)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence and the Committee on the Judiciary of the Senate; and</text></subparagraph><subparagraph id="id82EEF7571C7A46978480D8C8E6038BF8"><enum>(B)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idDEE44B07401540708166B0AA809F402A"><enum>(2)</enum><header>Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means a department or agency of the United States Government that has the authority to submit applications to the Foreign Intelligence Surveillance Court under this Act and which receives unminimized collection pursuant to orders issued under this Act.</text></paragraph><paragraph id="idC73D7E8B42D9486B8F8BE88163ED3D84"><enum>(3)</enum><header>Foreign Intelligence Surveillance Court</header><text>The term <term>Foreign Intelligence Surveillance Court</term> has the meaning given that term in section 101.</text></paragraph></subsection><subsection id="HF49D106279D341969A205B15E3A9D82E"><enum>(b)</enum><header>Appointment</header><text display-inline="yes-display-inline">The head of each covered agency shall appoint a single Federal officer to serve as the Compliance Officer for that agency.</text></subsection><subsection id="H3AF86A9579E544F2A63D85C2ACD4F3DC"><enum>(c)</enum><header>Compliance</header><text display-inline="yes-display-inline">Each Compliance Officer appointed under subsection (b) shall be responsible for overseeing the compliance of the relevant covered agency with the requirements of this Act.</text></subsection><subsection display-inline="no-display-inline" id="HB8A9D462F01E494DB8F453C5E9F59023"><enum>(d)</enum><header>Audits</header><text display-inline="yes-display-inline">Each Compliance Officer shall oversee routine audits of the compliance by the relevant covered agency with—</text><paragraph id="H6F94DBAC2EA44A7CAD691647DBF64E50"><enum>(1)</enum><text>the requirements of this Act regarding submitting applications to the Foreign Intelligence Surveillance Court, including with respect to the accuracy of such applications; and</text></paragraph><paragraph id="H824E64B670674980809CAED537F26386"><enum>(2)</enum><text display-inline="yes-display-inline">the minimization, targeting, querying, and accuracy procedures required by this Act.</text></paragraph></subsection><subsection id="HFCBCFFF3C82D44019197A00B4D9213D5"><enum>(e)</enum><header>Assessments</header><text display-inline="yes-display-inline">Each Compliance Officer shall—</text><paragraph id="HC4A6E6F9C7864CB4AF897204B7A4D3A0"><enum>(1)</enum><text>conduct on a routine basis assessments of the efficacy of the minimization, targeting, querying, and accuracy procedures adopted by the Attorney General pursuant to this Act; and</text></paragraph><paragraph id="HD1355036174C4920818F70911F069901"><enum>(2)</enum><text display-inline="yes-display-inline">annually submit to the Assistant Attorney General designated as the Assistant Attorney General for National Security under section 507A of title 28, United States Code, and the head of the relevant covered agency the findings of such assessments, including any recommendations of the Compliance Officer with respect to improving such procedures.</text></paragraph></subsection><subsection id="H347F3A968B354175A32040121A57482F"><enum>(f)</enum><header>Remediation</header><text display-inline="yes-display-inline">Each Compliance Officer shall ensure the appropriate remediation of any compliance issues of the relevant covered agency identified pursuant to this section or the rules of the Foreign Intelligence Surveillance Court.</text></subsection><subsection id="H6B98178499184788BF8BA27AF27D274D"><enum>(g)</enum><header>Inspectors General assessments</header><text display-inline="yes-display-inline">On an annual basis, and consistent with the protection of sources and methods, each Inspector General of a covered agency shall submit to the Foreign Intelligence Surveillance Court and the appropriate congressional committees an assessment of the implementation of this section by the covered agency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD6A45F10E82C4745B5DEEFF872E9E22C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of the Foreign Intelligence Surveillance Act of 1978 is amended by inserting after the item relating to section 604 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0585CDDE71144881B9C24F407E767012"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 605. Compliance officers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2424004191174bd081ef59f5a50399ce" commented="no"><enum>212.</enum><header>FISA Reform Commission</header><subsection id="idf44f927ce7784df1bc55ba6cab4477d1" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="id82438ad1b7184dccab18325d2cc96ad7" commented="no"><enum>(1)</enum><header>In general</header><text>There is established a commission to consider ongoing reforms to the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text></paragraph><paragraph id="id8940d74c0f614b13b1f98d728677c6eb" commented="no"><enum>(2)</enum><header>Designation</header><text>The commission established under paragraph (1) shall be known as the <quote>FISA Reform Commission</quote> (in this section the <quote>Commission</quote>).</text></paragraph></subsection><subsection id="id63e58b3f13e84bc5aa376fc8b69a4732" commented="no"><enum>(b)</enum><header>Membership</header><paragraph id="id3cb7bee1d0ea4db398f702200c28adec" commented="no"><enum>(1)</enum><header>Composition</header><subparagraph id="id7AEF0B8F1DEF461DA2E857EE92A1E280" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Commission shall be composed of the following members:</text><clause id="id58ede7e7d2c64767ba30f28e3de4f78c" commented="no"><enum>(i)</enum><text>The Principal Deputy Director of National Intelligence.</text></clause><clause id="id37732b5a7fb44bed9d58801734533a82" commented="no"><enum>(ii)</enum><text>The Deputy Attorney General.</text></clause><clause id="id17ca25ca311f4a52a57984a2f310aceb"><enum>(iii)</enum><text>The Deputy Secretary of Defense.</text></clause><clause id="id295977b24c8d41c6bc287f5cdf800b97"><enum>(iv)</enum><text>The Deputy Secretary of State. </text></clause><clause id="id4e0b3d2386404cc9b31fd072daad98d0" commented="no"><enum>(v)</enum><text>The Chair of the Privacy and Civil Liberties Oversight Board.</text></clause><clause id="id2da5805c3737460aaf10d3eb474aba28" commented="no"><enum>(vi)</enum><text>Three members appointed by the majority leader of the Senate, in consultation with the Chairman of the Select Committee on Intelligence of the Senate and the Chairman of the Committee on the Judiciary of the Senate, 1 of whom shall be a member of the Senate and 2 of whom shall not be.</text></clause><clause id="id7f37901ebd5448d499ca51efaa93938e" commented="no"><enum>(vii)</enum><text>Three members appointed by the minority leader of the Senate, in consultation with the Vice Chairman of the Select Committee on Intelligence of the Senate and the Ranking Member of the Committee on the Judiciary of the Senate, 1 of whom shall be a member of the Senate and 2 of whom shall not be.</text></clause><clause id="id8a4813e06d5041298e9eab5c1054ff21" commented="no"><enum>(viii)</enum><text>Three members appointed by the Speaker of the House of Representatives, in consultation with the Chairman of the Permanent Select Committee on Intelligence of the House of Representatives and the Chairman of the Committee on the Judiciary of the House of Representatives, 1 of whom shall be a member of the House of Representatives and 2 of whom shall not be.</text></clause><clause id="id3830f7b603494c2da1c7385ffe5033b7" commented="no"><enum>(ix)</enum><text>Three members appointed by the minority leader of the House of Representatives, in consultation with the Ranking Member of the Permanent Select Committee on Intelligence of the House of Representatives and the Ranking Member of the Committee on the Judiciary of the House of Representatives, 1 of whom shall be a member of the House of Representatives and 2 of whom shall not be.</text></clause></subparagraph><subparagraph id="id89ccd2451dc64f05917e14741f06f8a5" commented="no"><enum>(B)</enum><header>Nonmembers of Congress</header><clause id="id7741E4E7078347CC902E6C91D6EDD1C4" commented="no"><enum>(i)</enum><header>Qualifications</header><text>The members of the Commission who are not Members of Congress and who are appointed under clauses (iv) through (vii) of subparagraph (A) shall be individuals who are nationally recognized for expertise, knowledge, or experience in—</text><subclause id="id733F7DA78008499997FBCB8FD751ADD8" commented="no"><enum>(I)</enum><text>use of intelligence information by the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), national policymakers and military leaders;</text></subclause><subclause id="id627E8369BACE41FA8D5050AC1CF257A8" commented="no"><enum>(II)</enum><text>the implementation, funding, or oversight of the national security laws of the United States; </text></subclause><subclause id="idA26637A1E8DB45CA84F9B16F1F5FCFEB" commented="no"><enum>(III)</enum><text>privacy, civil liberties, and transparency; or </text></subclause><subclause id="idC6EEB837509E475F8445D63B13D6E1B7" commented="no"><enum>(IV)</enum><text>laws and policies governing methods of electronic surveillance. </text></subclause></clause><clause id="idbf28abb26d7443aeb557363ae676715d" commented="no"><enum>(ii)</enum><header>Conflicts of interest</header><text>An official who appoints members of the Commission may not appoint an individual as a member of the Commission if such individual possesses any personal or financial interest in the discharge of any of the duties of the Commission.</text></clause><clause id="id8a13fa4e327942a4b18572571d918fa3" commented="no"><enum>(iii)</enum><header>Security clearances</header><text>All members of the Commission described in clause (i) shall possess an appropriate security clearance in accordance with applicable provisions of law concerning the handling of classified information.</text></clause></subparagraph></paragraph><paragraph id="idc78b363a28994ddeb8ced0431b15b81e" commented="no"><enum>(2)</enum><header>Co-chairs</header><subparagraph id="idce6bb4e176cf467a8a4e66cc3770ef96" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission shall have 2 co-chairs, selected from among the members of the Commission.</text></subparagraph><subparagraph id="id6bd2a63d8e694275b9269f5c338b5cff" commented="no"><enum>(B)</enum><header>Agreement</header><text>The individuals who serve as the co-chairs of the Commission shall be agreed upon by the members of the Commission.</text></subparagraph></paragraph></subsection><subsection id="ida22a500181a843b5a0e511adafa9257e" commented="no"><enum>(c)</enum><header>Appointment; initial meeting</header><paragraph id="id9f62cc7d0b1a4f058eab8671afbf367a" commented="no"><enum>(1)</enum><header>Appointment</header><text>Members of the Commission shall be appointed not later than 90 days after the date of the enactment of this Act.</text></paragraph><paragraph id="id5710e0e265b941459bff1dc40a47c165" commented="no"><enum>(2)</enum><header>Initial meeting</header><text>The Commission shall hold its initial meeting on or before the date that is 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="id3a70a4d5dfde41ec8399aff2a8a450a9" commented="no"><enum>(d)</enum><header>Meetings; quorum; vacancies</header><paragraph id="ide06fcdd0ac9a4580ae75cd758a2c0e4a" commented="no"><enum>(1)</enum><header>In general</header><text>After its initial meeting, the Commission shall meet upon the call of the co-chairs of the Commission.</text></paragraph><paragraph id="id9c776a800e6f404e84ae9bc416e1fb54" commented="no"><enum>(2)</enum><header>Quorum</header><text>Nine members of the Commission shall constitute a quorum for purposes of conducting business, except that 2 members of the Commission shall constitute a quorum for purposes of receiving testimony.</text></paragraph><paragraph id="id1988de13185d434ebe45777d6b8230ee" commented="no"><enum>(3)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall not affect its powers, but shall be filled in the same manner in which the original appointment was made.</text></paragraph><paragraph id="id718433fefdea4548b1ed4336e5c2f15e" commented="no"><enum>(4)</enum><header>Quorum with vacancies</header><text>If vacancies in the Commission occur on any day after 90 days after the date of the enactment of this Act, a quorum shall consist of a majority of the members of the Commission as of such day.</text></paragraph></subsection><subsection id="idc2cf56d91f4243bb82d20470a6597f46" commented="no"><enum>(e)</enum><header>Duties</header><text>The duties of the Commission are as follows:</text><paragraph id="id18f0b6a3d9404be88b1e31733b8726f9" commented="no"><enum>(1)</enum><text>To review the effectiveness of the current implementation of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text></paragraph><paragraph id="id08ee82d1ec4240a28a15ad462419d53e" commented="no"><enum>(2)</enum><text>To develop recommendations for legislative action to reform the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) that provide for the effective conduct of United States intelligence activities and the protection of privacy and civil liberties.</text></paragraph></subsection><subsection id="idf6cf697d9df846a0b5e77cdabe0fc745" commented="no"><enum>(f)</enum><header>Powers of Commission</header><paragraph id="idC9C382B66880471C990A9DDBD97CAB1F" commented="no"><enum>(1)</enum><header>In general</header><subparagraph id="id26DD250DDC684519B7902836BC42C52C" commented="no"><enum>(A)</enum><header>Hearings</header><text>The Commission or, on the authorization of the Commission, any subcommittee or member thereof, may, for the purpose of carrying out this section—</text><clause id="idAF17631807F94BDFB1B71E6596120274" commented="no"><enum>(i)</enum><text>hold such hearings and sit and act at such times and places, take such testimony, receive such evidence, and administer such oaths; and</text></clause><clause id="idD7A1D7D1EEC744A6B6D5932FCD34A317" commented="no"><enum>(ii)</enum><text>require, by subpoena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, and documents, as the Commission or such designated subcommittee or designated member considers necessary. </text></clause></subparagraph><subparagraph id="id91f14a088ff843aa8985cf9276929de4" commented="no"><enum>(B)</enum><header>Issuance and enforcement of subpoenas</header><clause id="IDE043443601D24505B9471995E5B38680" changed="not-changed" commented="no"><enum>(i)</enum><header>Issuance</header><text>A subpoena issued under subparagraph (A)(ii) shall—</text><subclause id="idF6F23D94FA7A4E5BA1FDAD20ED02AB07" changed="not-changed" commented="no"><enum>(I)</enum><text>bear the signature of the co-chairs of the Commission; and</text></subclause><subclause id="id1E06A669FB5445FDA932EAB3A58CF5B8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>be served by a person or class of persons designated by the co-chairs for that purpose.</text></subclause></clause><clause id="idcef27c935fb84dedbe6870c81a6a9612" commented="no"><enum>(ii)</enum><header>Enforcement</header><text>The provisions of sections 102 through 104 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/192">2 U.S.C. 192–194</external-xref>) shall apply in the case of any failure of a witness to comply with any subpoena or to testify when summoned under authority of this paragraph.</text></clause></subparagraph></paragraph><paragraph id="id5109CE8204DD48C9A4E105E905960F51" commented="no"><enum>(2)</enum><header>Information from Federal Agencies</header><subparagraph id="id309D0F0EBECE429FA9975354B5F673B0" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission may secure directly from any executive department, agency, bureau, board, commission, office, independent establishment, or instrumentality of the Federal Government information, suggestions, estimates, and statistics for the purposes of this section.</text></subparagraph><subparagraph id="idEC85B60606664CBA862CEE4E9132CBF3" commented="no"><enum>(B)</enum><header>Furnishing information</header><text>Each such department, agency, bureau, board, commission, office, establishment, or instrumentality described in subparagraph (A) shall, to the extent authorized by law, furnish such information, suggestions, estimates, and statistics directly to the Commission, upon request of the co-chairs of the Commission. </text></subparagraph><subparagraph id="id8939CA107E854D8299EC6B6B517E66EF" commented="no"><enum>(C)</enum><header>Protection of classified information</header><text>The Commission shall handle and protect all classified information provided to it under this section in accordance with applicable provisions of law. </text></subparagraph></paragraph><paragraph id="id34549028CDBB4216AEAF6E679A7E406A" commented="no"><enum>(3)</enum><header>Assistance from Federal agencies</header><subparagraph id="id41C567B537F74D458280B74B83C7A0F8" commented="no"><enum>(A)</enum><header>Director of National Intelligence</header><text>The Director of National Intelligence shall provide to the Commission, on a nonreimbursable basis, such administrative services, funds, staff, facilities, and other support services as are necessary for the performance of the duties of the Commission under this section.</text></subparagraph><subparagraph id="idE7850F770CB747A18EF8E719B2F077F5" commented="no"><enum>(B)</enum><header>Attorney General</header><text>The Attorney General may provide the Commission, on a nonreimbursable basis, with such administrative services, staff, and other support services as the Commission may request. </text></subparagraph><subparagraph id="idAC7476FF0208442FA3D8F7E7A829179F" commented="no"><enum>(C)</enum><header>Other departments and agencies</header><text>In addition to the assistance set forth in subparagraphs (A) and (B), other departments and agencies of the United States may provide the Commission such services, funds, facilities, staff, and other support as such departments and agencies consider advisable and as may be authorized by law. </text></subparagraph><subparagraph id="idBABB87CB83F2482FB40FD6AEF7DCF075" commented="no"><enum>(D)</enum><header>Cooperation</header><text>The Commission shall receive the full and timely cooperation of any official, department, or agency of the Federal Government whose assistance is necessary, as jointly determined by the co-chairs selected under subsection (b)(2), for the fulfillment of the duties of the Commission, including the provision of full and current briefings and analyses. </text></subparagraph></paragraph><paragraph id="id19311c68ff834a208f1dc48747d5a0e3" commented="no"><enum>(4)</enum><header>Postal services</header><text>The Commission may use the United States postal services in the same manner and under the same conditions as the departments and agencies of the Federal Governments.</text></paragraph><paragraph id="id67ed362f4706461f91195d833e11503b" commented="no"><enum>(5)</enum><header>Gifts</header><text>No member or staff of the Commission may receive a gift or benefit by reason of the service of such member or staff to the Commission.</text></paragraph></subsection><subsection id="id7d7837627ccf4e07a217146a4223140b" commented="no"><enum>(g)</enum><header>Staff of Commission</header><paragraph id="id6A19C60EDBA641B2928E690609FB3A2B" commented="no"><enum>(1)</enum><header>Appointment and compensation of staff</header><text>The co-chairs of the Commission, in accordance with rules agreed upon by the Commission, shall appoint and fix the compensation of a staff director and such other personnel as may be necessary to enable the Commission to carry out its duties, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates, except that no rate of pay fixed under this subsection may exceed the equivalent of that payable to a person occupying a position at level V of the Executive Schedule under section 5316 of such title. </text></paragraph><paragraph id="id99B052DEB0444D46BA4C26CC9829E07B" commented="no"><enum>(2)</enum><header>Detail of Government employees</header><text>Any Federal Government employee may be detailed to the Commission without reimbursement from the Commission, and such detailee shall retain the rights, status, and privileges of his or her regular employment without interruption. </text></paragraph><paragraph id="id93ED3CB2BE414C6593132E1749CC8F9D" commented="no"><enum>(3)</enum><header>Security clearances</header><text>All staff of the Commission and all experts and consultants employed by the Commission shall possess a security clearance in accordance with applicable provisions of law concerning the handling of classified information.</text></paragraph></subsection><subsection id="id5c174710101f48949e2bd1820feda5ce" commented="no"><enum>(h)</enum><header>Compensation and travel expenses</header><paragraph id="id647B9DDF92C54862A029F4B5420364F9" commented="no"><enum>(1)</enum><header>Compensation of members</header><subparagraph id="id035A57DC5D0945BC9DC5FF3564AED2D3" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (2), each member of the Commission may be compensated at not to exceed the daily equivalent of the annual rate of basic pay in effect for a position at level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day during which that member is engaged in the actual performance of the duties of the Commission under this title. </text></subparagraph><subparagraph id="idB218DBBC9C9A4CF1854F03C326FBE8E7" commented="no"><enum>(B)</enum><header>Exception</header><text>Members of the Commission who are officers or employees of the United States or Members of Congress shall receive no additional pay by reason of their service on the Commission. </text></subparagraph></paragraph><paragraph id="id56eb7ddf338348169168f4521e570938" commented="no"><enum>(2)</enum><header>Travel expenses</header><text>While away from their homes or regular places of business in the performance of services for the Commission, a member of the Commission may be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermittently in the Government service are allowed expenses under section 5703 of title 5, United States Code. </text></paragraph></subsection><subsection id="id9de1f6d5133a4fa3b1440e3a862e5e43" commented="no"><enum>(i)</enum><header>Treatment of information relating to national security</header><paragraph id="idD20E0BA48B3E4238BC9AF2D487F8432D" commented="no"><enum>(1)</enum><header>In general</header><text>The Director of National Intelligence shall assume responsibility for the handling and disposition of any information related to the national security of the United States that is received, considered, or used by the Commission under this title. </text></paragraph><paragraph id="id9F573BE6483F4CF78D90BE0452C7A304" commented="no"><enum>(2)</enum><header>Information provided by congressional intelligence committees</header><text>Any information related to the national security of the United States that is provided to the Commission by a congressional intelligence committee may not be further provided or released without the approval of the chairman of such committee. </text></paragraph><paragraph id="id01938005cb854694aaf12dfce687181b" commented="no"><enum>(3)</enum><header>Access after termination of commission</header><text>Notwithstanding any other provision of law, after the termination of the Commission under subsection (j)(2), only the members and designated staff of the congressional intelligence committees, the Director of National Intelligence (and the designees of the Director), and such other officials of the executive branch of the Federal Government as the President may designate shall have access to information related to the national security of the United States that is received, considered, or used by the Commission.</text></paragraph></subsection><subsection id="id50a16e14f8304087b6ba6f6171ad7813" commented="no"><enum>(j)</enum><header>Final report; termination</header><paragraph id="id229cd26659b34fe890a086b764cf2aab" commented="no"><enum>(1)</enum><header>Final report</header><subparagraph commented="no" display-inline="no-display-inline" id="idc185d510db274ec39400b226ebe63d8a"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause id="id8d12bf540ccb4e118f6463a2f2fc204f"><enum>(i)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subclause commented="no" display-inline="no-display-inline" id="iddcbf10198c0646558c2946a033af7cc0"><enum>(I)</enum><text display-inline="yes-display-inline">the congressional intelligence committees;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0eac4d2a84a64fe09a5a33f36d627f63"><enum>(II)</enum><text>the Committee on the Judiciary of the Senate; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5bae157aa70e4364a036d61e3e990cf5"><enum>(III)</enum><text>the Committee on the Judiciary of the House of Representatives.</text></subclause></clause><clause id="idc223addeae404d7e9acea6f5530d2612"><enum>(ii)</enum><header>Congressional leadership</header><text>The term <term>congressional leadership</term> means—</text><subclause id="id0b41d0854cde46029d0463b647716154"><enum>(I)</enum><text>the majority leader of the Senate;</text></subclause><subclause id="ide4b7d63412f74990a04bc975151d1611"><enum>(II)</enum><text>the minority leader of the Senate;</text></subclause><subclause id="idf9fb9ecfa85147cb91f785a7af5f172b"><enum>(III)</enum><text>the Speaker of the House of Representatives; and</text></subclause><subclause id="id6d23de8a0fb44aaa89f6c0124267f1b1" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>the minority leader of the House of Representatives. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id518e834138d842a89de3a02e42f78eaf"><enum>(B)</enum><header>Final report required</header><text display-inline="yes-display-inline">Not later than 7 years from the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress, congressional leadership, the Director of National Intelligence, and the Attorney General a final report on the findings of the Commission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1563c3e3aed4ce1b389140cd70d331d"><enum>(C)</enum><header>Form of final report</header><text display-inline="yes-display-inline">The final report submitted pursuant to subparagraph (B) shall be in unclassified form but may include a classified annex.</text></subparagraph><subparagraph id="id505931ecd0bb4ebc82a3280f83854323" commented="no"><enum>(D)</enum><header>Assessments of final report</header><text>Not later than 1 year after receipt of the final report under subparagraph (B), the Director of National Intelligence and the Attorney General shall each submit to the appropriate committees of Congress and congressional leadership an assessment of such report. </text></subparagraph></paragraph><paragraph id="idF8758C243DEA40EAAA7C5EFED05838E1" commented="no"><enum>(2)</enum><header>Termination</header><subparagraph id="id77EE7BB0742F4921B69B9E8B2402E685" commented="no"><enum>(A)</enum><header>In general</header><text>The Commission, and all the authorities of this section, shall terminate on the date that is 2 years after the date on which the final report is submitted under paragraph (1)(B).</text></subparagraph><subparagraph id="id672683E4E5524094A28E1456C7DEC695" commented="no"><enum>(B)</enum><header>Wind-down period</header><text>The Commission may use the 120-day period referred to in subparagraph (A) for the purposes of concluding its activities, including providing testimony to Congress concerning the final report referred to in that paragraph and disseminating the report. </text></subparagraph></paragraph></subsection><subsection id="id70b7b2f24c3b494386dcbe280a46149e" commented="no"><enum>(k)</enum><header>Inapplicability of certain administrative provisions</header><paragraph id="id0b52c5ae091948f78bd7fc04bfff3a91" commented="no"><enum>(1)</enum><header>Federal advisory committee act</header><text>The provisions of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the activities of the Commission under this section.</text></paragraph><paragraph id="ide44d103da02a4b5f90967ba701c97f0b" commented="no"><enum>(2)</enum><header>Freedom of Information Act</header><text>The provisions of section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>), shall not apply to the activities, records, and proceedings of the Commission under this section.</text></paragraph></subsection><subsection id="idCB4D539A97C342379D67EA0E16B9A1C0" commented="no"><enum>(l)</enum><header>Funding</header><paragraph id="idD59A98DE1BFD4C698FD768332C0D9FEE" commented="no"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $3,000,000.</text></paragraph><paragraph id="id252DDDCA18094FBB9A2A8F054141865A" commented="no"><enum>(2)</enum><header>Availability in general</header><text>Subject to paragraph (1), the Director of National Intelligence shall make available to the Commission such amounts as the Commission may require for purposes of the activities of the Commission under this section.</text></paragraph><paragraph id="id6626CA193E444326B0F302B1A8464008" commented="no"><enum>(3)</enum><header>Duration of availability</header><text>Amounts made available to the Commission under paragraph (2) shall remain available until expended or upon termination under subsection (i)(2), whichever occurs first.</text></paragraph></subsection><subsection id="idAD2AD194DE3D41F5991C3A9E4273EBD8" commented="no"><enum>(m)</enum><header>Congressional intelligence committees defined</header><text>In this section, the term <term>congressional intelligence committees</term> means—</text><paragraph id="id55A6C106ED5B4E32849624C56B35404B" commented="no"><enum>(1)</enum><text>the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="id80CC66F64C25413F9D860679C2C01127" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section></title></legis-body></bill>
