which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Harmful Algal Blooms and Hypoxia Research and Control Act of 1998 to address harmful algal blooms, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Harmful Algal Bloom and Hypoxia Research and Control Amendments Act of 2023</short-title></quote>.</text></section><section id="id3f4139c2099a4e079d7be65c96838098"><enum>2.</enum><header>Amendments to the Harmful Algal Blooms and Hypoxia Research and Control Act of 1998</header><subsection id="idb347b6d90de245c3be1ba99c84f7fd24"><enum>(a)</enum><header>Assessments</header><paragraph commented="no" display-inline="no-display-inline" id="idaa019d29cfcc44fa83c495fff9557c1c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 603 of the Harmful Algal Blooms and Hypoxia Research and Control Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/4001">33 U.S.C. 4001</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb7b44fd2e56543ac83cdd40ff2cde04a"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">Assessments</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">Task Force, assessments, and Action Strategy</header-in-text></quote>;</text></subparagraph><subparagraph id="id136b11a38322432a9601c8cef0534bd7"><enum>(B)</enum><text>in subsection (a)—</text><clause id="id373f7c964672453aa3a23891f03fe8b9"><enum>(i)</enum><text>by redesignating paragraphs (13) and (14) as paragraphs (14) and (15), respectively; and</text></clause><clause id="idd954240b26224d8780c12cd4186a70bb"><enum>(ii)</enum><text>by inserting after paragraph (12) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1b5eea8d83f044fea365af103c660340"><paragraph id="id133cb168e1fa46a685089d466f8bdc82"><enum>(13)</enum><text>the Department of Energy;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id715eb29c8fbd4e1db4a75c12d137fd35"><enum>(C)</enum><text>by striking subsections (b), (c), (d), (e), (g), (h), and (i) and redesignating subsection (f) as subsection (b); </text></subparagraph><subparagraph id="idc9dd741c645043bca394f4d197f74c8e"><enum>(D)</enum><text>in subsection (b), as so redesignated—</text><clause id="id24c076cad3a54200980a92cd3cd89a8c"><enum>(i)</enum><text>in paragraph (1), in the first sentence, by striking <quote>coastal waters including the Great Lakes</quote> and inserting <quote>marine, estuarine, and freshwater systems</quote>; and</text></clause><clause id="idc31d3c696bfa4e2193dddac10c999e35"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="idf2dbfd3798b54c2e95ec4267c5ae8cee"><enum>(I)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idef7ecf0a9cdf4dda91dbaad1f922a18c"><subparagraph id="id1cf4c755b3cd4e8dbcaa31dbc170f22c" indent="up1"><enum>(A)</enum><text>examine—</text><clause commented="no" display-inline="no-display-inline" id="id75a28e457fa645c2b96119c838c64b74"><enum>(i)</enum><text display-inline="yes-display-inline">the causes and ecological consequences of hypoxia on marine and aquatic species in their natural environments; and </text></clause><clause commented="no" display-inline="no-display-inline" id="ida48ff07779314d0ca02d611f8f4ba047"><enum>(ii)</enum><text display-inline="yes-display-inline">the socio-cultural or economic costs of hypoxia, including impacts on food safety and security;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="id904c92d23d52489f9964d906781b7ca6"><enum>(II)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (D), (E), and (F), respectively;</text></subclause><subclause id="idf8ed3ac7b79f4b6a858584cb9027a3ec"><enum>(III)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE0E8C57B1F0D4F03ABA0E76256C76693"><subparagraph id="id3a22ab95c490401f882d1e9fd2e3febc" indent="up1"><enum>(B)</enum><text>examine the effect of other environmental stressors on hypoxia;</text></subparagraph><subparagraph id="id522588a752094b2980999c1b75276938" indent="up1"><enum>(C)</enum><text>evaluate alternatives for reducing, mitigating, and controlling hypoxia and its environmental impacts;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subclause><subclause id="ided4973f3e0ac42a6b63f7cb559dac4f4"><enum>(IV)</enum><text>in subparagraph (D), as redesignated by subclause (II), by inserting <quote>, social,</quote> after <quote>ecological</quote>; and</text></subclause><subclause id="idfc5a6f7a5cf8495ba986711a044cbbd1"><enum>(V)</enum><text>in subparagraph (E), as redesignated by subclause (II), by striking <quote>hypoxia modeling and monitoring data</quote> and inserting <quote>hypoxia modeling, forecasting, and monitoring and observation data</quote>; and</text></subclause></clause></subparagraph><subparagraph id="id6f06c59a8db141b482b149b59cf5a96b"><enum>(E)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3770fe196739465681728724235232d4"><subsection id="id3212b7b347c2408a87f7eacce75751bf"><enum>(c)</enum><header>Action Strategy and scientific assessment for marine and freshwater harmful algal blooms</header><paragraph id="id701c64d91f444dd48721dba056d66c81"><enum>(1)</enum><header>In general</header><text>Not less frequently than once every 5 years, the Task Force shall complete and submit to Congress an action strategy for harmful algal blooms in the United States. </text></paragraph><paragraph id="idee700ba4a02b48deba6b891d2e3500d3"><enum>(2)</enum><header>Elements</header><text>Each Action Strategy shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id066a17d8ebd648bda79c33bd8aace460"><enum>(A)</enum><text>examine, and include a scientific assessment of, marine and freshwater harmful algal blooms, including such blooms—</text><clause commented="no" display-inline="no-display-inline" id="idc61ec5ac0b3a4acc86147baebc77efad"><enum>(i)</enum><text display-inline="yes-display-inline">in the Great Lakes and upper reaches of estuaries; </text></clause><clause commented="no" display-inline="no-display-inline" id="id8138301cf24c467cbfbd7f34fe9f024b"><enum>(ii)</enum><text display-inline="yes-display-inline">in freshwater lakes and rivers; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idab78b9926d1e4c0ebf5e7cd1a9ffa348"><enum>(iii)</enum><text display-inline="yes-display-inline">that originate in freshwater lakes or rivers and migrate to coastal waters;</text></clause></subparagraph><subparagraph id="ida24fbfbe15a544319562f7a17ca11129"><enum>(B)</enum><text>examine the causes, ecological consequences, and economic or socio-cultural impacts, including food safety and security, of harmful algal blooms;</text></subparagraph><subparagraph id="idc8e76b90a7404a9082104eeb2514b09b"><enum>(C)</enum><text>examine the effect of other environmental stressors on harmful algal blooms;</text></subparagraph><subparagraph id="idaf64d062a81542edb800d22579e256ca"><enum>(D)</enum><text>examine potential methods to prevent, control, and mitigate harmful algal blooms and the potential ecological, social, cultural, and economic costs and benefits of such methods; </text></subparagraph><subparagraph id="idaee6925e13de43c7b2fe483ee37e9393"><enum>(E)</enum><text>identify priorities for research needed to advance techniques and technologies to detect, predict, monitor, respond to, and minimize the occurrence, duration, and severity of harmful algal blooms, including recommendations to eliminate significant gaps in harmful algal bloom forecasting, monitoring, and observation data;</text></subparagraph><subparagraph id="id5b127615fa4845f3b52ec2a74f03d7a0"><enum>(F)</enum><text>evaluate progress made by, and the needs of, activities and actions of the Task Force to prevent, control, and mitigate harmful algal blooms;</text></subparagraph><subparagraph id="id2ef1d798fa1c4418a9d0f9645d22a9d1"><enum>(G)</enum><text>identify ways to improve coordination and prevent unnecessary duplication of effort among Federal agencies with respect to research on harmful algal blooms; and</text></subparagraph><subparagraph id="idd5bce26e38694a4197f973a52b61c80e"><enum>(H)</enum><text>include regional chapters relating to the requirements described in this paragraph in order to highlight geographically and ecologically diverse locations with significant ecological, social, cultural, and economic impacts from harmful algal blooms.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfc3139fdff494e28bc42563f9507a47e"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out subsections (b) and (c), the Task Force shall consult with—</text><paragraph commented="no" display-inline="no-display-inline" id="idff2c5313c3c146c48aa552987d687410"><enum>(1)</enum><text display-inline="yes-display-inline">States, Indian tribes, and local governments; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d34d3ab0ccc4a5f98bda11d8c88b390"><enum>(2)</enum><text display-inline="yes-display-inline">appropriate industries (including fisheries, agriculture, and fertilizer), academic institutions, and nongovernmental organizations with relevant expertise.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d56cfa41e244d90aa5ad118cd65078a"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 2 of the Coast Guard Authorization Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/383">Public Law 105–383</external-xref>; 112 Stat. 3412; 136 Stat. 1268) is amended by striking the item relating to section 603 and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idC170D7498FC541ADAA7D2901501DB8EE"><toc><toc-entry level="section" bold="off">Sec. 603. Task Force, assessments, and Action Strategy.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0934810337fe49b383e03e64d9e5a809"><enum>(3)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text>Section 102 of the Harmful Algal Bloom and Hypoxia Amendments Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/33/4001a">33 U.S.C. 4001a</external-xref>) is amended by striking <quote>In developing</quote> and all that follows through <quote>management.</quote>.</text></paragraph></subsection><subsection id="idbf7172ee4a97446e83e5808bb9841dee"><enum>(b)</enum><header>National Harmful Algal Bloom and Hypoxia Program</header><text>Section 603A of the Harmful Algal Blooms and Hypoxia Research and Control Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/4002">33 U.S.C. 4002</external-xref>) is amended—</text><paragraph id="id42f8ff38eac0494e9ae3b2c71e043af6"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id26b1bacb373b4b30bba5efd28e18e2bf"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id4879f15520634abfa26ea9559af8e413"><enum>(i)</enum><text>by striking <quote>predicting,</quote> and inserting <quote>monitoring, observing, forecasting,</quote>; and</text></clause><clause id="id60f7b81ae0bc4a8dbc9a5ffed5863e93"><enum>(ii)</enum><text>by striking <quote>and</quote> after the semicolon; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f3f1facf06446fbbe900ffeabacd171"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following: </text><quoted-block id="idFD3D5A0BEE66480CBBF15690B20CCE36" style="OLC" act-name=""><paragraph id="id3F67ED225CD546E5955A6F9139261D14"><enum>(2)</enum><text>the scientific assessment submitted under section 603(b); and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05a188def08f44ca9d7fe588cba22665"><enum>(3)</enum><text display-inline="yes-display-inline">the Action Strategy.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2cc57a6891c049bca444d21ad24d46ae"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id9563ed17a55849d7a48a4c0e42ff5ab1"><enum>(A)</enum><text>in paragraph (3), by striking <quote>ocean and Great Lakes science and management programs and centers</quote> and inserting <quote>programs and centers relating to the science and management of marine, estuarine, and freshwater systems</quote>; and</text></subparagraph><subparagraph id="id3c499b00c99745c197d8cc5647ddd776"><enum>(B)</enum><text>in paragraph (5), by inserting <quote>while recognizing each agency is acting under its own independent mission and authority</quote> before the semicolon;</text></subparagraph></paragraph><paragraph id="id3ac00dd50cc7425a89cf2551e0d6038a"><enum>(3)</enum><text>in subsection (d), by striking <quote>Except as provided in subsection (h), the</quote> and inserting <quote>The</quote>;</text></paragraph><paragraph id="id7e3106099b1942ce923f8f007548d898"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id057cb6fc6bba43029a602f96819d51e5"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>(or the Administrator, as provided under subsection (g))</quote> after <quote>Under Secretary</quote>; </text></subparagraph><subparagraph id="id5daed404aa224b0398c72a0c59975ab7"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1a82474167f74db0b3588f43b8a8017f"><paragraph id="idaf62a81abef245919058f1580c0a0051"><enum>(2)</enum><text>examine, in collaboration with State and local entities and Indian tribes, including island communities, low-population rural communities, Indigenous communities, subsistence communities, fisheries, and recreation industries that are most dependent on coastal and water resources that may be impacted by marine and freshwater harmful algal blooms and hypoxia, the causes, ecological consequences, cultural impacts, and social and economic costs of harmful algal blooms and hypoxia;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id711766ce45984f9fa3c0b035ec8d2995"><enum>(C)</enum><text>by striking paragraph (3);</text></subparagraph><subparagraph id="id88c1b9a9c267482686b78a4de0a7453c"><enum>(D)</enum><text>by redesignating paragraphs (4), (5), and (6) as paragraphs (3), (4), and (5), respectively;</text></subparagraph><subparagraph id="id82f7d6234b854fccab05eabb7056e4df"><enum>(E)</enum><text>in paragraph (3), as so redesignated, by striking <quote>agencies</quote> and inserting <quote>entities, regional coastal observing systems (as defined in section 12303 of the Integrated Coastal and Ocean Observation System Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3602">33 U.S.C. 3602</external-xref>)),</quote>; </text></subparagraph><subparagraph id="idf736a397e42e4795b3cebc89aa28d7b9"><enum>(F)</enum><text>in paragraph (5), as redesignated by subparagraph (D), by inserting <quote>and communities</quote> after <quote>ecosystems</quote>;</text></subparagraph><subparagraph id="id61efb736e1d040e68c47bd71e95720f2"><enum>(G)</enum><text>by inserting after paragraph (5), as redesignated by subparagraph (D), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8c0b800a4d1f446f82d9f2a8ba0b6992"><paragraph id="ida8614f4e09d04828aad71c1585d71852"><enum>(6)</enum><text>support sustained observations, including through peer-reviewed, merit-based, competitive grant funding, to provide State and local entities, Indian tribes, and other entities access to real-time or near real-time observation data for decision-making to protect human and ecological health and local economies;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id158ba5288f0642af8e475134dc4b40dc"><enum>(H)</enum><text>in paragraph (8), by inserting <quote>and Indian tribes</quote> after <quote>managers</quote>; and</text></subparagraph><subparagraph id="ida30e9552196e49e0808c3fabe3a3f529"><enum>(I)</enum><text>in paragraph (9)(A), by striking <quote>, tribal, and local stakeholders</quote> and inserting <quote>and local stakeholders and Indian tribes</quote>; </text></subparagraph></paragraph><paragraph id="idfbc9f5b1df554eefa483c2218a8d29d7"><enum>(5)</enum><text>by amending subsections (f), (g), and (h) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id1a90a948f06c49f3babe409ac41232d6"><subsection id="id20a1e7eeee9e47819babd688400c3026"><enum>(f)</enum><header>Cooperation and coordination</header><text>The Under Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id3155907c7bd1473f9b56a792c60fd393"><enum>(1)</enum><text display-inline="yes-display-inline">work cooperatively with and avoid duplication of effort of other agencies on the Task Force and States, Indian tribes, and nongovernmental organizations concerned with marine and freshwater issues; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3d43fb61aa245dbab7c3a926cea8118"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate harmful algal bloom and hypoxia and related activities and research with those entities.</text></paragraph></subsection><subsection id="id677573f467034773994dcbd95b795df4"><enum>(g)</enum><header>Freshwater and estuarine program duties</header><text>The Administrator, in coordination with the Task Force, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idbf2e876b94864c84997f2efc61c340e2"><enum>(1)</enum><text display-inline="yes-display-inline">carry out the duties under the Administrator’s purview under subsection (e) for freshwater aspects of the Program through the activities required under section 603C; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd6e7660cb7f499dacf30146de01787b"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate with the Under Secretary on estuarine aspects of the Program through the activities required under this section. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc49662ad09594a13b30ef8004a7f0593"><enum>(h)</enum><header>Anti-Deficiency Act applied to harmful algal bloom services</header><text display-inline="yes-display-inline">Any services accepted by an officer or employee of the United States Government under this title relating to the development and dissemination of forecasts and bulletins through the Harmful Algal Bloom Operational Forecast System of the National Centers for Coastal Ocean Science and the National Oceanic and Atmospheric Administration shall be considered, for purposes of section 1342 of title 31, United States Code, services for an emergency involving the safety of human life or the protection of property. Such consideration shall apply only to services performed for areas with active harmful algal blooms during any lapse in appropriations beginning on or after the date of the enactment of the <short-title>Harmful Algal Bloom and Hypoxia Research and Control Amendments Act of 2023</short-title>.</text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida51ffcee8c0d43c599f0fee4e412b90f"><enum>(6)</enum><text>by striking subsection (i). </text></paragraph></subsection><subsection id="idf33c15be810143edbd901517889d77f6"><enum>(c)</enum><header>National Oceanic and Atmospheric Administration activities</header><paragraph id="id57c280a7bf90433bbd1fba9292dbbdea"><enum>(1)</enum><header>In general</header><text>Section 603B of the Harmful Algal Blooms and Hypoxia Research and Control Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/4003">33 U.S.C. 4003</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="ida4b94a17f05041bb939731525ed17da4"><section id="id2b05488cd3d34d8d9961f8bcd8e42f98"><enum>603B.</enum><header>National Oceanic and Atmospheric Administration activities</header><subsection id="id4ffc6879d4e740e2b4cab9a6b0cc7856"><enum>(a)</enum><header>In general</header><text>The Under Secretary shall—</text><paragraph id="idec5a9db087dd4e409961bc94ca3e8389"><enum>(1)</enum><text>carry out response activities for marine, coastal, and Great Lakes harmful algal bloom and hypoxia events;</text></paragraph><paragraph id="id691c52edef234b92a17d1bfacfb48cce"><enum>(2)</enum><text>develop and enhance operational harmful algal bloom observing and forecasting programs, including operational observations and forecasting, monitoring, modeling, data management, and information dissemination;</text></paragraph><paragraph id="idb3b1b4f7dc55459186060bcf7db0b817"><enum>(3)</enum><text>maintain and enhance peer-reviewed, merit-based, competitive grant funding relating to harmful algal blooms and hypoxia—</text><subparagraph id="idd3599ec7f8ab4444ad45aa2ced6c16db"><enum>(A)</enum><text>to maintain and enhance baseline monitoring programs established by the Program;</text></subparagraph><subparagraph id="idd4b3c7f5614a472e996ed5c54d5464e5"><enum>(B)</enum><text>to support the projects maintained and established by the Program;</text></subparagraph><subparagraph id="id1a86476e809b4beeb2933d640fd6da0b"><enum>(C)</enum><text>to address the research and management needs and priorities identified in the Action Strategy;</text></subparagraph><subparagraph id="idbe568f86826c4e34ad8a877d1e6c6975"><enum>(D)</enum><text>to accelerate the utilization of effective methods of intervention and mitigation to reduce the frequency, severity, and impacts of harmful algal bloom and hypoxia events;</text></subparagraph><subparagraph id="idae22e5c5101b4569acbcfbe43a5b3107"><enum>(E)</enum><text>to identify opportunities to improve monitoring of harmful algal bloom and hypoxia, with a particular focus on coastal waters that may affect fisheries, public health, or subsistence harvest;</text></subparagraph><subparagraph id="id95270bbe766840b58c1acc13590d2d67"><enum>(F)</enum><text>to examine the effects of other environmental stressors on harmful algal blooms and hypoxia;</text></subparagraph><subparagraph id="id9d50c5f998514e96a0de4fc6e93cfb0b"><enum>(G)</enum><text>to assess the effects of multiple environmental stressors on living marine resources and coastal ecosystems; and</text></subparagraph><subparagraph id="idd64d03abb8c345eeb7f21915c89b810b"><enum>(H)</enum><text>to evaluate adaptation and mitigation strategies to address the impacts of harmful algal blooms and hypoxia;</text></subparagraph></paragraph><paragraph id="id81a62e80cd554fe09139603becd4e6d3"><enum>(4)</enum><text>enhance communication and coordination among Federal agencies carrying out activities and research relating to marine and freshwater harmful algal bloom and hypoxia;</text></paragraph><paragraph id="id58fd2de81ebc456ba6f269eaa823c2ce"><enum>(5)</enum><text>to the greatest extent practicable, leverage existing resources and expertise available from local research universities and institutions; and</text></paragraph><paragraph id="ida9ed54b068d34d5cbbef82cbeb2e3536"><enum>(6)</enum><text>use cost effective methods in carrying out this section.</text></paragraph></subsection><subsection id="id9f553c1559744517b183acd5d2beab4e"><enum>(b)</enum><header>Integrated Coastal and Ocean Observation System</header><text>The collection of monitoring and observing data under this section shall comply with all data standards and protocols developed pursuant to the Integrated Coastal and Ocean Observation System Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3601">33 U.S.C. 3601 et seq.</external-xref>). National harmful algal bloom observing network.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idA00958764FA0469E82EC7E941200A8C3"><enum>(f)</enum><header>National-Level incubator program</header><paragraph id="id2678E742B66E4495BC69087B4421E68C"><enum>(1)</enum><header>In general</header><text>The Harmful Algal Blooms and Hypoxia Research and Control Act of 1998 is amended by inserting after section 606 (<external-xref legal-doc="usc" parsable-cite="usc/33/4005">33 U.S.C. 4005</external-xref>) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C775ED715E64E008CF58A51B3C60DAA"><section id="idD248707DD81A4B81BD9890088FF48D22"><enum>606A.</enum><header>National-level incubator program</header><subsection id="id138DF017E81644B5BF4B4C53666E51EC"><enum>(a)</enum><header>In general</header><text>The Under Secretary, in collaboration with the Administrator and research universities and institutions, shall establish a national-level incubator program (in this section referred to as the <quote>program</quote>) to increase the number of strategies, technologies, and measures available to prevent, mitigate, and control harmful algal blooms.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1CFD5914491A4F96B833D9154A2CED6F"><enum>(b)</enum><header>Framework</header><text display-inline="yes-display-inline">The program shall establish a framework for preliminary assessments of novel strategies, technologies, and measures to prevent, mitigate, and control harmful algal blooms in order to determine the potential effectiveness and scalability of such technologies.</text></subsection><subsection id="idE694BE9033084BC99E6D4E0698C925B7"><enum>(c)</enum><header>Funding</header><text>The program shall provide merit-based funding, using amounts otherwise available to the Under Secretary for the award of grants, for strategies, technologies, and measures that eliminate or reduce, through biological, chemical, or physical means, the levels of harmful algae and associated toxins resulting from harmful algal blooms. </text></subsection><subsection id="id48389FC05FE44FBFB6131F8CB6786CEA"><enum>(d)</enum><header>Database</header><text>The program shall include a database for cataloging the licensing and permitting requirements, economic costs, feasibility, effectiveness, and scalability of novel and established strategies, technologies, and measures to prevent, mitigate, and control harmful algal blooms.</text></subsection><subsection id="idE02266FF03F8496CAD1468D3C9E122EE"><enum>(e)</enum><header>Prioritization</header><text>In carrying out the program, the Under Secretary shall prioritize proposed strategies, technologies, and measures that would, to the maximum extent practicable—</text><paragraph id="id16A32141DE264CB196DB93F89DB5FE49"><enum>(1)</enum><text>protect key habitats for fish and wildlife;</text></paragraph><paragraph id="id40D2D41455FB418A88F7D81C25D5362B"><enum>(2)</enum><text>maintain biodiversity;</text></paragraph><paragraph id="idAC6396CF042C4D9DB25470603E341890"><enum>(3)</enum><text>protect public health;</text></paragraph><paragraph id="idAB6AD2AFEE1345D89258BE875437AD5B"><enum>(4)</enum><text>protect coastal resources of national, historical, and cultural significance; or</text></paragraph><paragraph id="id294AD9880C25462A98347E9763B9C5C6"><enum>(5)</enum><text>benefit low-income communities, Indian tribes or Indigenous communities, and rural communities.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id038E6249C5624548984908C6AFF9B30E" commented="no"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 2 of the Coast Guard Authorization Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/383">Public Law 105–383</external-xref>; 112 Stat. 3412; 136 Stat. 1268) is amended by inserting after the item relating to section 606 the following:</text><quoted-block style="OLC" id="id2D1B6C4F420D481F8B5ADEA829385E82"><toc><toc-entry level="section">Sec. 606A. </text></paragraph><paragraph id="idc37c537970ae450cb0964f84a4b7d6ab"><enum>(5)</enum><text>by inserting after paragraph (3) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id5b77af58665b4b448ca29ac968d1754e"><paragraph id="idc9988889f2814ecfaf900637b6aa6c83"><enum>(4)</enum><header>Harmful algal bloom and hypoxia event</header><text>The term <term>harmful algal bloom and hypoxia event</term> means the occurrence of a harmful algal bloom or hypoxia as a result of a natural, anthropogenic, or undetermined cause.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id152d5da974fe4fc5a7ebaa75dc43c64e"><enum>(5)</enum><header>Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idff099547ccc64cedb5942cceb58834af"><enum>(6)</enum><text>in paragraph (6), as redesignated by paragraph (4)—</text><subparagraph id="id29bd818a50504cd89b42399ba2647419"><enum>(A)</enum><text>by striking <quote>aquatic</quote> and inserting <quote>marine or freshwater</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA4AA8C2C4B464D4C872B3F3C28DC9129"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block id="id7B1A993BC53F4EE388A16A50442643B7" style="OLC" act-name=""><subsection id="id997EAEFE9B98410991FC9BB201277748"><enum>(e)</enum><header>Harmful algal bloom technologies</header><text>In carrying out the demonstration program under subsection (a), the Secretary may enter into agreements with water and irrigation districts located in the focus areas described in subsections (c) and (d) for the use or sale of any new technologies developed under the demonstration program to expedite the removal of harmful algal blooms in those areas.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
