which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Wild and Scenic Rivers Act to designate certain streams in the greater Yellowstone ecosystem and Smith River system in the State of Montana as components of the Wild and Scenic Rivers System, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Montana Headwaters Legacy Act</short-title></quote>.</text></section><section id="id7dd352da4d664525a27e64fae4359c93"><enum>2.</enum><header>Findings; purpose</header><subsection id="id093156168acd4a6092337c8b1afd1bf9"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id97db848d60bf4012af6a98e6f3b677be"><enum>(1)</enum><text>the streams designated as components of the Wild and Scenic Rivers System by the amendment made by section 4(a) are cherished by the people of the State of Montana and visitors from across the United States and around the world for their clean water, abundant fish and wildlife, spectacular natural settings, and outstanding recreational opportunities;</text></paragraph><paragraph id="ide01f52bfb76d4622ad6921e2455d1ce5"><enum>(2)</enum><text>Indian Tribes have used the streams referred to in paragraph (1) for hunting, fishing, gathering, and other cultural purposes since time immemorial; </text></paragraph><paragraph id="id5123d2d8815346f9a821317ee4dc9f16"><enum>(3)</enum><text>recreational activities (including fishing, hunting, camping, paddling, hiking, swimming, rock climbing, horseback riding, and wildlife watching) on the streams referred to in paragraph (1) and the surrounding land generate billions of dollars annually for the economy of the State of Montana;</text></paragraph><paragraph id="ida7235375b7ef4815b85a39ebe49727e8"><enum>(4)</enum><text>the multi-billion dollar agricultural industry in the State of Montana thrives on the availability of clean water that originates in headwaters streams on Federal public land;</text></paragraph><paragraph id="id83c27fee00e449f18755bfd77f64b907"><enum>(5)</enum><text>the streams referred to in paragraph (1)—</text><subparagraph id="idfcf13dea186b4051a1340ad0773d098d"><enum>(A)</enum><text>are national treasures;</text></subparagraph><subparagraph id="id610879fe3c5244e6a8383d9e9281373d"><enum>(B)</enum><text>possess outstandingly remarkable values; and</text></subparagraph><subparagraph id="idb4873cad06ee422a8b5e418a57e5ac42"><enum>(C)</enum><text>merit the high level of protection afforded by the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>) in order to maintain the benefits provided by the streams described in paragraphs (1) through (3) for future generations to enjoy; and</text></subparagraph></paragraph><paragraph id="id3cf92f22b08d4ae0a9e1ebd168ae845a"><enum>(6)</enum><text>designation of select public land segments of the streams referred to in paragraph (1) under the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>) would recognize the importance of maintaining the values of each stream while—</text><subparagraph id="id931FDD1009A945B580D8F28DD7D4AFAD"><enum>(A)</enum><text>preserving public access;</text></subparagraph><subparagraph id="idF2D5EA23B1C34B12A65F83A40C39A7BF"><enum>(B)</enum><text>respecting private property rights;</text></subparagraph><subparagraph id="id786A4ABE53CF426A987156977A846C57"><enum>(C)</enum><text>allowing appropriate maintenance of existing infrastructure; and </text></subparagraph><subparagraph id="idEDB264BCD28343069C51114CB053F1F7"><enum>(D)</enum><text>allowing historical uses to continue.</text></subparagraph></paragraph></subsection><subsection id="id9f2610478e8941c686583f533193d7ca"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to designate certain segments and tributaries of the Missouri River and Yellowstone River Headwaters in the State of Montana as components of the National Wild and Scenic Rivers System to preserve and protect for present and future generations the outstandingly remarkable values of each stream and tributary.</text></subsection></section><section id="idC4362FD860524BD694310B81B2C695FB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0456B56E6E584D8FBF09DB10E94A3074"><enum>(1)</enum><header>Covered segment</header><text>The term <quote>covered segment</quote> means a river segment designated by paragraphs (233) through (252) of section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) (as added by section 4(a)).</text></paragraph><paragraph id="id3fe0e33af1b947c8bc0614047d1910b4"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id16B7C5DD6AB54630A69DBF1D8414B435"><enum>(3)</enum><header>Secretary concerned</header><text>The term <quote>Secretary concerned</quote> means—</text><subparagraph id="idF412EB3292C24DEE8A53DCDF47B4D7C2"><enum>(A)</enum><text>the Secretary of the Interior, with respect to a covered segment under the jurisdiction of the Secretary of the Interior; and</text></subparagraph><subparagraph id="id0C7E4CC947B0498CA29DEE16682A15E4"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to a covered segment under the jurisdiction of the Secretary of Agriculture.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61CA392C7D8C41B2A65896A3F9B48BCD"><enum>(4)</enum><header>State</header><text>The term <quote>State</quote> means the State of Montana.</text></paragraph></section><section id="idc89f0657854c4965a808776dc429f3f0"><enum>4.</enum><header>Designation of wild and scenic river segments</header><subsection id="id45b88c05b4be4efa83ce95adec2d5da7"><enum>(a)</enum><header>In general</header><text>Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd3b302670095405993a9363bed4736e0"><paragraph id="id9389751d3092451d8ff73050145c693e"><enum>(233)</enum><header>Smith river, montana</header><text>The portion of the Smith River consisting of the approximately 24-mile segment from the confluence of Tenderfoot Creek downstream to the confluence of Deep Creek, to be administered by the Secretary of Agriculture as a scenic river.</text></paragraph><paragraph id="idd49115e85c0c4b12a2f63d7e2017882f"><enum>(234)</enum><header>Tenderfoot creek, montana</header><text>The portion of Tenderfoot Creek consisting of the approximately 21-mile segment from the confluence with Iron Mines Creek downstream to the confluence with the Smith River, to be administered by the Secretary of Agriculture as a scenic river.</text></paragraph><paragraph id="id23878139e6a8454192258cdb3e5223be"><enum>(235)</enum><header>Gallatin river, montana</header><text>The portion of the Gallatin River in the State of Montana consisting of the approximately 39-mile segment from the Yellowstone National Park boundary downstream to the confluence of Spanish Creek, to be administered by the Secretary of Agriculture as a recreational river.</text></paragraph><paragraph id="ida179e04b52bb4bc283cea38093baeded"><enum>(236)</enum><header>Hyalite creek, montana</header><text>The portion of Hyalite Creek consisting of the approximately 6-mile segment from the source in the Gallatin Range downstream to Hyalite Reservoir, to be administered by the Secretary of Agriculture as a scenic river.</text></paragraph><paragraph id="id156f44073182408f9db3da888e4987d3"><enum>(237)</enum><header>Taylor creek, montana</header><text>The portion of Taylor Creek consisting of—</text><subparagraph id="id22ac0ab8a043451c97b4e7025a2159f7"><enum>(A)</enum><text>the approximately 3-mile segment from the source in the Madison Range downstream to the Lee Metcalf Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="id872c2b2a6bb5482f9ea0d6b209b2f819"><enum>(B)</enum><text>the approximately 15-mile segment from the Lee Metcalf Wilderness boundary downstream to the Gallatin River, to be administered by the Secretary of Agriculture as a recreational river, with the boundary of the corridor flowing through the private land of Nine Quarter Circle Ranch being the ordinary high water mark. </text></subparagraph></paragraph><paragraph id="ida90549ad45734263815f45e57f52e3e1"><enum>(238)</enum><header>Madison river, montana</header><text>The portions of the Madison River in the State of Montana, consisting of—</text><subparagraph id="id5069bb498043499aa8a15762aaddc981"><enum>(A)</enum><text>the approximately 42-mile segment from the confluence of Cabin Creek downstream to the point at which the river leaves Bureau of Land Management land at the north boundary of T. 8 S., R. 1 W., sec. 10, approximately 1 mile north of the confluence of Cherry Creek, to be administered by the Secretary of Agriculture and the Secretary of the Interior as a recreational river;</text></subparagraph><subparagraph id="idbbd30c93857b455e832170fb1fdd6520"><enum>(B)</enum><text>the approximately 7-mile segment from 800 feet downstream of Madison Dam Powerhouse downstream to the Lee Metcalf Wilderness boundary, to be administered by the Secretary of the Interior as a wild river; and</text></subparagraph><subparagraph id="id0a4a264bb7e84eb6846f567343c3341d"><enum>(C)</enum><text>the approximately 7-mile segment from the Lee Metcalf Wilderness Boundary downstream to the Bureau of Land Management boundary at the Black’s Ford Fishing Access Site, to be administered by the Secretary of the Interior as a recreational river.</text></subparagraph></paragraph><paragraph id="id06ff752b312a416eade1e17cf9547c1e"><enum>(239)</enum><header>Bear creek, montana</header><text>The portions of Bear Creek consisting of—</text><subparagraph id="id91a563057af2460dbce86ce9f66985cb"><enum>(A)</enum><text>the approximately 2-mile segment from the source downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="id71e88483e31d4aa5b1932fc12eabd2c0"><enum>(B)</enum><text>the approximately 7-mile segment from the Absaroka-Beartooth Wilderness boundary to the confluence with the Yellowstone River, to be administered by the Secretary of Agriculture as a recreational river.</text></subparagraph></paragraph><paragraph id="id17811f6388ae4b93a97ea51602ef6758"><enum>(240)</enum><header>Boulder river, montana</header><text>The portions of the Boulder River consisting of—</text><subparagraph id="id5a1f34eaa31b40b69e31a44575d5fbce"><enum>(A)</enum><text>the approximately 3-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="idd7a5ff9db532459794d2b6f831260831"><enum>(B)</enum><text>the approximately 30-mile segment from the Absaroka-Beartooth Wilderness boundary downstream to the Custer Gallatin National Forest boundary downstream of Natural Bridge Falls, to be administered by the Secretary of Agriculture as a recreational river.</text></subparagraph></paragraph><paragraph id="id0aef106769914a26976d8dee7edeb7b7"><enum>(241)</enum><header>Hellroaring creek, montana</header><text>The portion of Hellroaring Creek consisting of the approximately 19-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Custer Gallatin National Forest boundary, to be administered by the Secretary of Agriculture as a wild river.</text></paragraph><paragraph id="idb824627119a841b6bc98548e032b91d2"><enum>(242)</enum><header>Lake fork rock creek, montana</header><text>The portions of Lake Fork Rock Creek consisting of—</text><subparagraph id="id30cc2cba38da4a9c8628ad45da5d3a0a"><enum>(A)</enum><text>the approximately 11-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="id35d3fce75f55405a91d7bc0b976bea00"><enum>(B)</enum><text>the approximately 2-mile segment from the Absaroka-Beartooth Wilderness boundary to the confluence with Rock Creek, to be administered by the Secretary of Agriculture as a recreational river.</text></subparagraph></paragraph><paragraph id="id4d8545332487498d8743995120642409"><enum>(243)</enum><header>Rock creek, montana</header><text>The portion of Rock Creek in the State of Montana consisting of the approximately 14-mile segment from the border between the States of Montana and Wyoming to the Custer Gallatin National Forest boundary, to be administered by the Secretary of Agriculture as a recreational river.</text></paragraph><paragraph id="id5310a6702a014a99b8dc546e82f9ebf5"><enum>(244)</enum><header>Slough creek, montana</header><text>The portion of Slough Creek consisting of the approximately 19-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Custer Gallatin National Forest boundary, to be administered by the Secretary of Agriculture as a wild river.</text></paragraph><paragraph id="id3294a01e17dc44a9b2abe8c6f08bed62"><enum>(245)</enum><header>Stillwater river, montana</header><text>The portions of the Stillwater River consisting of—</text><subparagraph id="idab43439264fb42a9b99db975d1ccdb91"><enum>(A)</enum><text>the approximately 26-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="idcd1730d36d39494e8afe3fed2e9cd7c1"><enum>(B)</enum><text>the approximately 3-mile segment from the Absaroka-Beartooth Wilderness boundary downstream to Flume Creek, to be administered by the Secretary of Agriculture as a recreational river.</text></subparagraph></paragraph><paragraph id="id776e5ecc25e84b6fb7d4fc256604f836"><enum>(246)</enum><header>West boulder river, montana</header><text>The portion of the West Boulder River consisting of the approximately 15-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river.</text></paragraph><paragraph id="id533048ecfbcf4350be806131d37f9c2d"><enum>(247)</enum><header>West fork stillwater river, montana</header><text>The portion of the West Fork Stillwater River consisting of the approximately 14-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river.</text></paragraph><paragraph id="id3d23b03d82c74d1e8ba1f5b45ff27704"><enum>(248)</enum><header>West fork of rock creek, montana</header><text>The portions of West Fork of Rock Creek consisting of—</text><subparagraph id="idb4dde413c3bd41dfa036369169ef1759"><enum>(A)</enum><text>the approximately 9-mile segment from the source in the Absaroka-Beartooth Wilderness downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a wild river; and</text></subparagraph><subparagraph id="id6BF694C90ADD4B3ABAABB8AF621F3840"><enum>(B)</enum><text>the approximately 1-mile segment from the fish barrier downstream to the confluence with the Madison River, to be administered by the Secretary of Agriculture as a recreational river, subject to the condition that the designation of the segment shall not preclude maintenance or management of the fish barrier by cooperating Federal and State agencies.</text></subparagraph></paragraph><paragraph id="id9E27BEE5D2EC4130B2BB56EC0534137F"><enum>(251)</enum><header>Middle fork of cabin creek, Montana</header><text>The portion of the Middle Fork of Cabin Creek in the State of Montana, consisting of the approximately 5-mile segment from the source in the Madison Range downstream to the confluence with Cabin Creek, to be administered by the Secretary of Agriculture as a wild river.</text></paragraph><paragraph id="id89B80F33B1A34505BBD7DE4F18A7C9F0"><enum>(252)</enum><header>Clarks fork of the yellowstone river, Montana</header><text>The portions of the Clarks Fork of the Yellowstone River in the State of Montana, consisting of—</text><subparagraph id="id3E21CACD57DB46629EA5929C1A4339F7"><enum>(A)</enum><text>the approximately 1-mile segment from Broadwater River downstream to the Absaroka-Beartooth Wilderness boundary, to be administered by the Secretary of Agriculture as a scenic river; and</text></subparagraph><subparagraph id="idD3EED080AC4944B99BA2A8AE91D67D05"><enum>(B)</enum><text>the approximately 2-mile segment from Absaroka-Beartooth Wilderness boundary downstream to the Montana-Wyoming State line, to be administered by the Secretary of Agriculture as a wild river.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9ab087f4878448a49cadc9ee88d35062"><enum>(b)</enum><header>Consent of owner of land required</header><text>No land or interest in land located within the boundary of a covered segment may be acquired by the Secretary concerned without the consent of the owner of the land or interest in land.</text></subsection><subsection id="id1edd74c479444477851be5601fe6c2e0"><enum>(c)</enum><header>Effect of designations on water rights</header><text>Nothing in this Act or an amendment made by this Act affects valid existing rights, including—</text><paragraph id="idb64083e71fc7472cb7361764e4fa5cb7"><enum>(1)</enum><text>Federal, Tribal, and interstate water compacts in existence on the date of enactment of this Act (including full development of any apportionment made in accordance with the compacts);</text></paragraph><paragraph id="ideddf1fa4b5cd423abe5ef40af6d90181"><enum>(2)</enum><text>water rights in the State; and</text></paragraph><paragraph id="id5bbd8cc9b14b4dd89fc10373d15b32a6"><enum>(3)</enum><text>water rights held by the United States.</text></paragraph></subsection><subsection id="ida063133b6e0f43f49976e430851e2426"><enum>(d)</enum><header>Effect of designations on Hebgen and Madison Developments</header><text>The designation of a covered segment by section 4(a) shall not—</text><paragraph id="idc27c1dc4a6754fecb2181ff895440ef2"><enum>(1)</enum><text>prohibit, preempt, or abridge the licensing by the Federal Energy Regulatory Commission as a current or future federally licensed hydroelectric generation project under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) of any hydroelectric project (including any aspect of existing or future facilities, operations, and transmission lines of the hydroelectric project) constructed on the Madison River as of the date of enactment of this Act; </text></paragraph><paragraph id="id6c04c67e26c94a169b954a87c0358c21"><enum>(2)</enum><text>prohibit, preempt, or abridge the licensing or development by the Federal Energy Regulatory Commission as a federally licensed generation project under part I of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/792">16 U.S.C. 792 et seq.</external-xref>) of any future hydroelectric generation that might be added to the Hebgen and Madison Developments (Federal Energy Commission project number 2188) (including any aspect of existing or future facilities, operations, and transmission lines); or</text></paragraph><paragraph id="idb2b519f593524262a6bf918794dcc8e7"><enum>(3)</enum><text>affect the operation of, or impose any, flow release requirements at the Hebgen and Madison Developments described in paragraph (2) that are intended to satisfy current or future—</text><subparagraph commented="no" display-inline="no-display-inline" id="id397b45a303424e459a251e7d998d0ae0"><enum>(A)</enum><text display-inline="yes-display-inline">Federal Energy Regulatory Commission license conditions; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50a52d428f424877ab1f3a6d34e2d005"><enum>(B)</enum><text display-inline="yes-display-inline">compliance or management plans approved by the Federal Energy Regulatory Commission. </text></subparagraph></paragraph></subsection><subsection id="id1cd628241abd4b7eb8cd793ce1854bfe"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this Act (including the amendments made by this Act). </text></subsection></section></legis-body></bill>
