<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3284</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231109">November 9, 2023</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to modify the limitation on reimbursement for emergency treatment of amounts owed to a third party or for which the veteran is responsible under a health-plan contract.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Emergency Care Reimbursement Act of 2023</short-title></quote>.</text></section><section id="id01A526B1ED9E43F19FD36FB24E4A9F6F"><enum>2.</enum><header>Modification of limitation on reimbursement for emergency treatment of amounts owed to a third party or for which the veteran is responsible under a health-plan contract</header><subsection id="id845A44FCA19F4AA7B93EC93A4B14D057"><enum>(a)</enum><header>In general</header><text>Section 1725(c)(4)(D) of title 38, United States Code, is amended—</text><paragraph id="id15A6E414F4814E888EEA130B3EB2F13D"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>(i) The Secretary</quote>;</text></paragraph><paragraph id="idB22DA9EFBBC8487EAEB851C3B6233BBF"><enum>(2)</enum><text>in clause (i), as designated by paragraph (1), by striking <quote>or similar payment</quote> and inserting <quote>of less than $100</quote>; and</text></paragraph><paragraph id="id6F396EFB172C4ADABE17BEB6BCD82187"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id847FF5D888704AF28B8F2B4DA365887A"><clause id="id46BE3BF059824EFFB7D22A689094BF46" indent="up3"><enum>(ii)</enum><text>In this subparagraph, the term <term>copayment</term> means a fixed amount paid by an individual for a covered health service received by the individual and does not include any amount paid for a deductible or coinsurance.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idad3b1f2350f847f59b815954a610af19"><enum>(b)</enum><header>Application of amendment</header><text>The amendments made by subsection (a) shall apply with respect to any reimbursement claim under section 1725 of such title submitted to the Department of Veterans Affairs for emergency treatment furnished on or after February 1, 2010, including any such claim submitted by a member of the certified class seeking relief in Wolfe v. McDonough, No. 18–6091 (U.S. Vet. App.).</text></subsection><subsection id="id42ADE67C9CF24647A87331DE6BB8EDD5"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idCAEA1515F7A84841A247603CF06BBA5C"><enum>(1)</enum><header>Emergency treatment; health-plan contract</header><text>The terms <term>emergency treatment</term> and <term>health-plan contract</term> have the meanings given those terms in section 1725(h) of title 38, United States Code.</text></paragraph><paragraph id="id39ca2025e5464962bfbfb15e46f22ed4"><enum>(2)</enum><header>Reimbursement claim</header><text>The term <term>reimbursement claim</term> includes any claim by a veteran for reimbursement of a copayment, deductible, coinsurance, or any other type of cost share for emergency treatment furnished to the veteran in a non-Department of Veterans Affairs facility and made by a veteran who had coverage under a health-plan contract, including any claim for the reasonable value of emergency treatment that was rejected or denied by the Department of Veterans Affairs, whether the rejection or denial was final or not. </text></paragraph></subsection></section></legis-body></bill>
