which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to eliminate the requirement for cost-benefit analyses in the establishment of minimum safety standards for pipeline transportation and pipeline facilities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Penalizing and Improving Prevention of Emergencies Act of 2023</short-title></quote> or the <quote><short-title>PIPE Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd8f82a56c53749cda7c464dbc9dfdd63"><enum>2.</enum><header>Cost-benefit analyses</header><subsection commented="no" display-inline="no-display-inline" id="id34ea2120b4364e79b0b0cd5096902f11"><enum>(a)</enum><header>In general</header><text>Section 60102(b) of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id34893d5aa0b14b63b2bf088aa0309b65"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4c92e7106c594356baf94b9abf350b7c"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraphs (D) and (E); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd11bc262ce5144b3a6fa4e2fd248f2d1"><enum>(B)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (D) and (E), respectively; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd19f36e601894cfb8929ba1e541dae44"><enum>(2)</enum><text>by striking paragraphs (3) through (7).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9bf52278c70f4f8cb5752efdc8258dff"><enum>(b)</enum><header>Technical and safety standards committees</header><text>Section 60115 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2bf943c1053a4cfabf130df7cfe9da42"><enum>(1)</enum><text>in subsection (a), by striking the third sentence;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81cab8b46b9744848b65d78cebc9a681"><enum>(2)</enum><text>in subsection (b)(4)(C), by striking the second sentence; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd925f9cd936442b2ba2e2f669527966b"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b8cf7fb179e4bdc8c27b3e24f0f2773"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id920c319546d847dc852fedf0644a62fd"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>Committee each standard proposed under this chapter for transporting gas and for gas pipeline facilities including the risk assessment information and other analyses supporting each proposed standard;</quote> and inserting the following: “Committee—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id815E9FBF70B747DEA47D91D6B45CF478"><clause commented="no" display-inline="no-display-inline" id="id9260df33db7d4818b4139acc07708f59" indent="up1"><enum>(i)</enum><text>each standard proposed under this chapter for—</text><subclause commented="no" display-inline="no-display-inline" id="id9f63f3e827814341a8ed13d9c41611af"><enum>(I)</enum><text>transporting gas; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5addd9e87c9344a3831cfac2a4b03b16"><enum>(II)</enum><text>gas pipeline facilities; and</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id52a31bceb4464a5b89b5d9e54b33034b"><enum>(ii)</enum><text>analyses supporting each proposed standard described in clause (i);</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="ideb1b4a691e4748d083b063e3a308499a"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>Committee each standard proposed under this chapter for transporting hazardous liquid and for hazardous liquid pipeline facilities including the risk assessment information and other analyses supporting each proposed standard.</quote> and inserting the following: “Committee—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBB84AED0A62843E288DB35DE87BF10E8"><clause commented="no" display-inline="no-display-inline" id="id936322213ebc429e931af97aa2d6291b" indent="up1"><enum>(i)</enum><text>each standard proposed under this chapter for—</text><subclause commented="no" display-inline="no-display-inline" id="ida8bbdfb3126746af8b3062930ca02d23"><enum>(I)</enum><text>transporting hazardous liquid; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id56cbcfd675b040289e402fa509783b5d"><enum>(II)</enum><text>hazardous liquid pipeline facilities; and</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idc39e479371f74fe198e394d5a45245ea"><enum>(ii)</enum><text>analyses supporting each proposed standard described in clause (i).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf8e6e46ce0444fa989593fa33273d35"><enum>(B)</enum><text>in paragraph (2), by striking <quote>cost-effectiveness,</quote>.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id55003ac952f54cb0bb68b22ff30fee58"><enum>3.</enum><header>Elimination of nonapplication clause for existing pipelines</header><subsection commented="no" display-inline="no-display-inline" id="id9f7a0a77ba774edebc0c1b7c6d63d65a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 60104 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9acb82e508194c6c9c5fabd940ceca08"><enum>(1)</enum><text>by striking subsection (b); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe83cf488a514022bcfb3ea89117ade2"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (b) through (d), respectively.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15a89d46c088411a9af0be0bcb0cb49e"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id21317ae70d514f8cac5b3c6f8314dfca"><enum>(1)</enum><text>Section 60106(b)(1) of title 49, United States Code, is amended, in the third sentence, by striking <quote>section 60104(c)</quote> and inserting <quote>section 60104(b)</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc57500678a3847e099b1f429cfb9dbbb"><enum>(2)</enum><text>Section 60109(c) of title 49, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaf1bdc5838b148daa013bcc76ea6e48b"><enum>(A)</enum><text>by striking paragraph (11); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99d4394dbaa1441fbadafbfdb5ece05b"><enum>(B)</enum><text>by redesignating paragraph (12) as paragraph (11).</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id33091ab88eb64da9aebc2aafc4d43ced"><enum>4.</enum><header>Prohibition against releases</header><text display-inline="no-display-inline">Section 60118(a) of title 49, United States Code, is amended—</text><paragraph id="idc9b83fb8826a4bb1b8aa97d9ca4b6451"><enum>(1)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>;</text></paragraph><paragraph id="id0513ce12bef8413a80c22aaca6d9d220"><enum>(2)</enum><text>by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and indenting appropriately;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b4cde08f09d4a3a83f15e6f645a06eb"><enum>(3)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>facility shall—</quote> and inserting the following: “facility—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC7D6AC8F9942424EB643370A146A2F30"><paragraph commented="no" display-inline="no-display-inline" id="id57acdeefadfe43c0849e2f41c7a7cf26"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id904c633d53304826b458d617618528ba"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5CC4FF9FE4D4328B1D2F4E5710CF37F"><paragraph commented="no" display-inline="no-display-inline" id="idedab0ca85a654b548036d9f30e0358c7"><enum>(2)</enum><text>shall not release gas or hazardous liquid from a pipeline facility in a quantity that would require the reporting of an incident or accident under a regulation prescribed under this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="iddc5595684a0e4f9488e6ed329d5e8260"><enum>5.</enum><header>Penalties</header><subsection commented="no" display-inline="no-display-inline" id="id97ee1005d1954b51b235356b32ec3abb"><enum>(a)</enum><header display-inline="yes-display-inline">Maximum civil penalty for a related series of violations</header><paragraph commented="no" display-inline="no-display-inline" id="id10f32db3cfbc483caa95b5f51e2fdab3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 60122(a)(1) of title 49, United States Code, is amended by striking the third sentence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04b8db79c7dd4af08b0a37493f8dcc78"><enum>(2)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation, acting through the Administrator of the Pipeline and Hazardous Materials Safety Administration, shall revise subpart B of part 190 of title 49, Code of Federal Regulations, in accordance with the amendment made by paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3c1364ed5ac14a45851966fbef35d5cc"><enum>(b)</enum><header>Scienter requirement for criminal penalties</header><text>Section 60123(a) of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id021c491fb27341c2acaa8c39fc5d7b83"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>knowingly and willfully</quote> and inserting <quote>knowingly, willfully, or recklessly</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55f5b19c9e6445d6b8fa6ae5d8e37833"><enum>(2)</enum><text>by striking <quote>A person</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4D3BF62D5FD949A18B29CDDDCA3E45E3"><paragraph commented="no" display-inline="no-display-inline" id="id4eee17bdfca5480caa2237260a95974a"><enum>(1)</enum><header>In general</header><text>A person</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0fffec02232b4e159ccc95f56c68d21f"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idADA673DC41394619A47BF858F7034006"><paragraph commented="no" display-inline="no-display-inline" id="id81e8051d5e5c4e3192ad5082cecdb310"><enum>(2)</enum><header>Meaning of terms</header><subparagraph commented="no" display-inline="no-display-inline" id="id53f3f8b3bd504284a243c688ab622358"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idcb592a17043440e0acab694abca53fb2"><enum>(i)</enum><text display-inline="yes-display-inline">a person acts knowingly when—</text><subclause id="id795abf6901604d29a58759b23804ada7" commented="no"><enum>(I)</enum><text>the person has actual knowledge of the facts giving rise to the violation; or</text></subclause><subclause id="id133f1481790d47d4bcc35a116e356342" commented="no"><enum>(II)</enum><text>a reasonable person acting in the circumstances and exercising reasonable care would have that knowledge;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf05923a8bb4345ea86653be5e2699599"><enum>(ii)</enum><text>a person acts willfully when—</text><subclause id="id84db32721a444ee694c43fd6ae52c848" commented="no"><enum>(I)</enum><text>the person has knowledge of the facts giving rise to the violation; and</text></subclause><subclause id="ideb26c44136a947bd86d66608798304b1" commented="no"><enum>(II)</enum><text>the person has knowledge that the conduct was unlawful; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idff07aa2dbb604e53b18b6df9ad0fb2f1"><enum>(iii)</enum><text>a person acts recklessly when the person displays a deliberate indifference or conscious disregard to the consequences of that person’s conduct.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2780834a1fe4488d9712875af6bde6f9"><enum>(B)</enum><header>Knowledge</header><text>For purposes of paragraph (1), knowledge of the existence of a statutory provision, or a regulation or requirement of the Secretary, is not an element of an offense under that paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
