which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a critical mineral environmental processing and mining cleanup program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Critical mineral environmental processing and mining cleanup program</header><subsection id="id405F28B24C134243B2A300C24850F46F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4939C671B676475588C2BF219AF9EEA7"><enum>(1)</enum><header>Critical mineral</header><text>The term <term>critical mineral</term> has the meaning given the term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></paragraph><paragraph id="id34FF8A42E2244187929B1290CFFAE41D"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity engaged in or intending to engage in—</text><subparagraph id="id13675e5d731f4e21a523a0898a12b609"><enum>(A)</enum><text>the mining or manufacturing of critical minerals or the reprocessing or recycling of mine tailings, smelter or refinery slags, or residues; or</text></subparagraph><subparagraph id="id07277b91b64d4bd4b371ceabebb4d957"><enum>(B)</enum><text>any other value-added, mining-related, manufacturing-related, or processing-related use of critical minerals undertaken within the United States. </text></subparagraph></paragraph><paragraph id="idf6a9aa0613ff4a7f9e87f6a0bc7114d9"><enum>(3)</enum><header>Eligible mineral</header><text>The term <term>eligible mineral</term> means each of the minerals identified by the Secretary under subsection (b)(2)(A).</text></paragraph><paragraph id="idB0E8C8BCE82D485BA7723B2A8BC289AF"><enum>(4)</enum><header>Manufacture</header><text>The term <term>manufacture</term>, with respect to a mineral, means to process, refine, alloy, separate, smelt, concentrate, or beneficiate the mineral.</text></paragraph><paragraph id="idf45e0ca0d35342c8816cec2f0b49f080"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under subsection (b)(1).</text></paragraph><paragraph id="id01257A2E9FA1481EB5958BDD65825119"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="ida5c24ae555d74a7d9d1c1434e3e8271f"><enum>(b)</enum><header>Program establishment</header><paragraph id="idb70a3f4effbd483380bfc02dfeabb438"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to award competitive grants to eligible entities for the manufacturing of eligible minerals.</text></paragraph><paragraph id="id14effe6312824f8fb13b2a455fbefdf6"><enum>(2)</enum><header>Determination; identification</header><subparagraph id="idcbb606367e134ff1b4f7d5dde4396ff5"><enum>(A)</enum><header>Eligible minerals</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in coordination with the National Economic Council, shall identify as eligible minerals—</text><clause id="id455D6DD8293A43949BA67717DEAC7631"><enum>(i)</enum><text>the 10 critical minerals that are the most critical for manufacturing and energy independence; and</text></clause><clause id="id87E09366FCFA413BA4E8DD5931B49480"><enum>(ii)</enum><text>the 10 minerals that are the most critical to the United States to reduce energy dependence on mineral imports.</text></clause></subparagraph><subparagraph id="idb68ef3abaf5747ab92412fdd3cabb335"><enum>(B)</enum><header>Suitable locations</header><clause id="idA621B695F47344408AD2128922381B66"><enum>(i)</enum><header>In general</header><text>The Secretary shall identify Federal and non-Federal land for which it is economically feasible and environmentally sound to mine the eligible minerals.</text></clause><clause id="id036db324fe014f84b1a27b3204624a93"><enum>(ii)</enum><header>Requirement</header><text>The Secretary shall establish for each suitable location identified under clause (i) a mitigation plan to combat environmental and health risks posed by the mining and manufacturing of eligible minerals to—</text><subclause id="id63bf0e76f2934fe59457d7a3fc1ff4af"><enum>(I)</enum><text>federally recognized Indian Tribes;</text></subclause><subclause id="id35fe4613f95f4e2880d3468007fcdb65"><enum>(II)</enum><text>communities at risk of pollution from mining activities; and</text></subclause><subclause id="idcad0172c466b46c48ac1843b11ac9001"><enum>(III)</enum><text>clean drinking water sources. </text></subclause></clause></subparagraph><subparagraph id="id330F9EE017064AF88B60C45DE78A11F6"><enum>(C)</enum><header>No duplication of efforts</header><text>To the maximum extent practicable, in carrying out subparagraphs (A) and (B), the Secretary shall use existing analyses of the Department of the Interior, including the United States Geological Survey. </text></subparagraph></paragraph><paragraph id="id83eb27f182e6434cbba646a336975218"><enum>(3)</enum><header>Selection</header><subparagraph id="id3fcd02fd92764cd5884f24aa36b44c38"><enum>(A)</enum><header>Applications</header><text>An eligible entity seeking a grant under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph id="idacb6d3f56b2c40549ec95bf79eb15686"><enum>(B)</enum><header>Selection criteria</header><text>In awarding grants under the program, the Secretary shall only award grants to eligible entities that—</text><clause id="idf716b029d5fb4dc1bbca12936b870492"><enum>(i)</enum><text>have documented interests in constructing, expanding, or modernizing facilities that carry out an activity or use described in subparagraph (A) or (B) of subsection (a)(2); and</text></clause><clause id="id3f760c6112df47949d365bade0f60b28"><enum>(ii)</enum><text>demonstrate strong labor protections, including prevailing wage requirements.</text></clause></subparagraph></paragraph><paragraph id="idc163938de6c145f1a5e3f533982ff430"><enum>(4)</enum><header>Use of funds</header><text>A grant under the program may be used for the environmental assessment, processing, mitigation, and cleanup necessary to mine or manufacture eligible minerals on the Federal and non-Federal land identified under paragraph (2)(B)(i).</text></paragraph><paragraph id="id568c9b5f54274abe86fa6cb3e072064e"><enum>(5)</enum><header>Environmental laws</header><text>In carrying out activities using a grant under the program, an eligible entity shall comply with—</text><subparagraph id="id2B6F4F08276C407596BA4A23F2CE5DC5"><enum>(A)</enum><text>all applicable environmental laws (including regulations); and </text></subparagraph><subparagraph id="id3948CA98114841A08D3BB370EAC597D5"><enum>(B)</enum><text>any other environmental standards determined to be necessary by the Secretary.</text></subparagraph></paragraph><paragraph id="id41e02b207ca344ebb6e087568659e057"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the program $10,000,000 for each of fiscal years 2024 through 2029.</text></paragraph></subsection></section></legis-body></bill>
