<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 2948</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230927" legis-day="20230922">September 27 (legislative day, September 22), 2023</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Labor to issue guidance and regulations regarding opioid overdose reversal medication and employee training. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD7F9B2D5E7054A2EBFF69AD9E658F083"><section section-type="section-one" id="H370C77019D8F4500B90452FDF7780E67"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workplace Overdose Reversal Kits to Save Lives Act</short-title></quote> or the <quote><short-title>WORK to Save Lives Act</short-title></quote>.</text></section><section id="HB7BE563741F649C2BB8418BC50F05610"><enum>2.</enum><header>Non-mandatory guidance for employers concerning opioid overdose reversal medication</header><subsection id="HA816B744AEC74F038F58131BCC0FB94B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary of Labor, acting through the Occupational Safety and Health Administration, shall issue nonmandatory guidance to employers on—</text><paragraph id="H0406175824114FF4B0C6CF54500500B5"><enum>(1)</enum><text>acquiring and maintaining opioid overdose reversal medication; and</text></paragraph><paragraph id="HFAE2F1EA13C84CD49671CC31D4DE706F"><enum>(2)</enum><text>training employees on an annual basis on the usage of such medication.</text></paragraph></subsection><subsection id="H1D204F0F0E9D4860B846D3A8EB3484BB"><enum>(b)</enum><header>Employer defined</header><text display-inline="yes-display-inline">In this section, the term <term>employer</term> has the meaning given such term in section 3 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/652">29 U.S.C. 652</external-xref>), except that such term does not include the United States Postal Service.</text></subsection></section><section id="H26F3BD84AC174093AE3B0BAD34F233A6"><enum>3.</enum><header>Mandatory regulations for Federal agencies concerning opioid overdose reversal medication</header><subsection id="HFA081FC98B5F478F991056D567616C1F"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary of Labor, acting through the Occupational Safety and Health Administration, shall issue regulations to require each Federal agency to—</text><paragraph id="H6CE862CC64B34DBAAE995437FE79B849"><enum>(1)</enum><text>acquire and maintain opioid overdose reversal medication; and</text></paragraph><paragraph id="H6FE997853CD345F8A0FD35D6D82C7C8C"><enum>(2)</enum><text>train employees on an annual basis on the usage of such medication.</text></paragraph></subsection><subsection id="HE40C77B2C1DA4B49819DC6AB3AE3464F"><enum>(b)</enum><header>Federal agency defined</header><text>In this section, the term <term>Federal agency</term> means any agency or instrumentality of the Federal Government, including the Veterans Health Administration, notwithstanding section 7425(b) of title 38, United States Code.</text></subsection></section></legis-body></bill>
