which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Communications Act of 1934 and title 17, United States Code, to provide greater access to in-State television broadcast programming for cable and satellite subscribers in certain counties.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB901075511B94679883B957CD9B853A0"><section section-type="section-one" id="H92370078969A48F4A605B9EACCFE9528"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Go Pack Go Act of 2023</short-title></quote>.</text></section><section id="H7D374F1766CA482591F803F02FC25B32"><enum>2.</enum><header>Carriage of network station signals in certain counties</header><subsection id="H94BAB7EC3E864914BA97520D160A02CD"><enum>(a)</enum><header>In general</header><text>Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6D0267B81C0B4F079FB1EBED2456AEFE"><section id="H88DF7A900E8D40C48A3E4635D317486B"><enum>346.</enum><header>Carriage of network station signals in certain counties</header><subsection id="HB56997AD643547B285B497D0944BE97B"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H7874702C1FC4431598D4132CFE7F3FC9"><enum>(1)</enum><text>the term <term>cable operator</term> has the meaning given the term in section 602;</text></paragraph><paragraph commented="no" id="HB4D41D6CA2C14334A124F2EEB54CA8D8"><enum>(2)</enum><text display-inline="yes-display-inline">the terms <term>covered county</term> and <term>in-State, adjacent-market network station retransmission</term> have the meanings given those terms in section 119(d) of title 17, United States Code, except that, in the case of a cable operator, any reference to a satellite carrier or a subscriber of a satellite carrier shall be considered to be a reference to a cable operator or a subscriber of a cable operator, respectively; </text></paragraph><paragraph id="H8E32A18AB1AF4900ADA9D0D61C91B8AF"><enum>(3)</enum><text>the term <term>local market</term> has the meaning given the term in section 122(j) of title 17, United States Code;</text></paragraph><paragraph id="H0D11258CD3D54CCD8A47FAA2BD748A8E"><enum>(4)</enum><text>the term <term>local network station</term> means, with respect to a subscriber and a television network, the network station—</text><subparagraph id="HE286ED98BEC44BB38E421701F926D8CF"><enum>(A)</enum><text>that is affiliated with the television network; and</text></subparagraph><subparagraph id="H291B973E3F7E453CA0B147255A428DD9"><enum>(B)</enum><text>within the local market in which the subscriber is located; and</text></subparagraph></paragraph><paragraph id="HABD8998D3A704F15911A1C9BBFE4E34C"><enum>(5)</enum><text display-inline="yes-display-inline">the terms <term>network station</term> and <term>satellite carrier</term> have the meanings given those terms in section 119(d) of title 17, United States Code.</text></paragraph></subsection><subsection id="HCCBD302A69054A5B838DC9713A58904C"><enum>(b)</enum><header>Subscriber election</header><text display-inline="yes-display-inline">A cable operator or satellite carrier shall, at the election of a subscriber in a covered county with respect to a television network, provide to the subscriber—</text><paragraph id="HF28818E4DF154B51B7E4D109EDC9D9DF"><enum>(1)</enum><text>retransmission of the signal of any local network station that the operator or carrier is required to retransmit to the subscriber without regard to this section;</text></paragraph><paragraph id="HD7297919DBB84AE989BEC6E3DBBDA890"><enum>(2)</enum><text>an in-State, adjacent-market network station retransmission; or</text></paragraph><paragraph id="H69DCDCF9046C4859AB1E8A75A8949428"><enum>(3)</enum><text>both retransmissions described in paragraphs (1) and (2).</text></paragraph></subsection><subsection id="H23E2B86263114AF688AEE078CE930A26"><enum>(c)</enum><header>Relationship to local signal carriage requirements</header><text>If a subscriber elects to receive only an in-State, adjacent-market network station retransmission under subsection (b)—</text><paragraph id="H5977DDD3E04D43E4AEC99D5BC01E29C4"><enum>(1)</enum><text>the provision of that retransmission to the subscriber shall be deemed to fulfill any obligation of the cable operator or satellite carrier to provide to the subscriber the signal of a local network station under section 338, 614, or 615; and</text></paragraph><paragraph id="H7ACC3A98D9C541A494D7F03078B27ACA"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a satellite carrier that has been recognized as a qualified carrier under section 119(f) of title 17, United States Code, the provision of that retransmission instead of the signal of a local network station shall not affect the status of the satellite carrier as a qualified carrier for purposes of that section and section 342 of this Act.</text></paragraph></subsection><subsection id="H0BDB15B60C7E48B1A85DB07389C65794"><enum>(d)</enum><header>Requirement subject to technical feasibility for satellite carriers</header><text display-inline="yes-display-inline">A satellite carrier shall be required to provide a retransmission under subsection (b) only to the extent that such provision is technically feasible, as determined by the Commission.</text></subsection><subsection id="HD3B772B0D2914CC1B81A37DB70E53D84"><enum>(e)</enum><header>Treatment of in-State, adjacent-Market network station retransmissions by cable operators</header><paragraph id="HB43A0C5F58EB4C6092EB1393EA4E8FAA"><enum>(1)</enum><header>Retransmission consent exception</header><text display-inline="yes-display-inline">Section 325(b) shall not apply to an in-State, adjacent-market network station retransmission by a cable operator to a subscriber residing in a covered county.</text></paragraph><paragraph id="H61818D2610314542BFB6D93982E03360"><enum>(2)</enum><header>Deemed significantly viewed</header><text display-inline="yes-display-inline">In the case of an in-State, adjacent-market network station retransmission by a cable operator to a subscriber residing in a covered county, the signal of the station shall be deemed to be significantly viewed in that county within the meaning of section 76.54 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEDD6C98EFD84438CA13019CD781303E3"><enum>(b)</enum><header>Treatment of in-State, adjacent-Market network station retransmissions by satellite carriers</header><text display-inline="yes-display-inline">Section 339 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339</external-xref>) is amended—</text><paragraph id="HFDDD4B02E6EC4C61A98FC7A7E9FFD770"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HF20B1DAEEBEF44AB9F390D95B350564E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by adding at the end the following: <quote>In-State, adjacent-market network station retransmissions to subscribers residing in covered counties shall not count toward the limit set forth in this subparagraph.</quote>; and</text></subparagraph><subparagraph id="H38138C3B6042484D9E2CB214DAA05320"><enum>(B)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB10635B069E14972973B8D7B0784340F"><subparagraph id="H536C7B962A5B4A028472F65F7E7D73E2"><enum>(I)</enum><header>In-State, adjacent-market network station retransmissions</header><text display-inline="yes-display-inline">Nothing in this paragraph shall apply to or affect in-State, adjacent-market network station retransmissions to subscribers residing in covered counties.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE37BBFFE0CE84698B4EA098A29A8F491"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id377589E4FC334FA19225C88632214391"><enum>(A)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (3) through (7), respectively; and</text></subparagraph><subparagraph id="id9C74BB1675A049EBA6DE92DD5CD27236"><enum>(B)</enum><text>by inserting before paragraph (3), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE306858D8B41404DB3299DF519077A33"><paragraph commented="no" id="H1A2116B5C076497AB8CF97ED6AEA4FBA"><enum>(1)</enum><header>Covered county</header><text display-inline="yes-display-inline">The term <term>covered county</term> has the meaning given the term in section 119(d) of title 17, United States Code.</text></paragraph><paragraph commented="no" id="H4B69561252374D3FAA6C1C53258F5554"><enum>(2)</enum><header>In-State, adjacent-market network station retransmission</header><text display-inline="yes-display-inline">The term <term>in-State, adjacent-market network station retransmission</term> has the meaning given the term in section 119(d) of title 17, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H462461DB13FB40128385629E4BB0BE53"><enum>(c)</enum><header>No effect on ability To receive significantly viewed signals</header><text display-inline="yes-display-inline">Section 340(b)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/340">47 U.S.C. 340(b)(3)</external-xref>) is amended by inserting before the period at the end the following: <quote>or to a subscriber who elects under section 346(b), with respect to the network with which the station whose signal is being retransmitted pursuant to this section is affiliated, to receive an in-State, adjacent-market network station retransmission (as defined in section 119(d) of title 17, United States Code) instead of the signal of a local network station (as defined in section 346)</quote>.</text></subsection></section><section commented="no" id="H776EC7EB82BF4A24BD9F20AB8E5725CA"><enum>3.</enum><header>Availability of copyright license</header><subsection id="H36B2E55EEE9D43079EEF4E81D1FC0310"><enum>(a)</enum><header>Secondary transmissions of distant television programming by satellite</header><text display-inline="yes-display-inline">Section 119 of title 17, United States Code, is amended—</text><paragraph commented="no" id="H27F738A44D2347D09967BEC3A35546AA"><enum>(1)</enum><text>in subsection (a)(2)(B)(i), by adding at the end the following: <quote>In-State, adjacent-market network station retransmissions to subscribers residing in covered counties shall not count toward the limit set forth in this clause.</quote>; and</text></paragraph><paragraph commented="no" id="H838D3C18BF4A4289846918377A499606"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="HE8CE5AE42BEE4A40957DF15459771B11"><enum>(A)</enum><text>in paragraph (10)—</text><clause commented="no" id="H449697A565654CBE837815CA458399F2"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause commented="no" id="HA6D8A27C5A00487C9F28ACAD050149F1"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause commented="no" id="H314DA29078064ED9B1BF26DF7BD6C877"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H87ED91B3041945D1895AD6EA71525578"><subparagraph commented="no" id="H8C8988ADE415454798B96E446F26A1A6"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to an in-State, adjacent-market network station retransmission, is a subscriber residing in a covered county.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="H717DC73D19EA45B69512C0FCD75B00DF"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HD1AE24B22F6E4800A849B1681DEEA02D"><paragraph commented="no" id="H82BB47C0B68B4DAF829FCAC82D27BC5E"><enum>(17)</enum><header>In-State, adjacent-market network station retransmission</header><text display-inline="yes-display-inline">The term <term>in-State, adjacent-market network station retransmission</term> means the secondary transmission by a satellite carrier of the primary transmission of any network station whose community of license is located—</text><subparagraph id="H0CD42A50C78445699D45128C0E4A6982"><enum>(A)</enum><text>in the State of a subscriber; and</text></subparagraph><subparagraph id="H29C58562171142C39DE3B8F4B89E92F7"><enum>(B)</enum><text>in a local market that is adjacent to the local market of the subscriber.</text></subparagraph></paragraph><paragraph commented="no" id="H1A1DE89B84164674A41FD9F6C63A1C9A"><enum>(18)</enum><header>Covered county</header><text display-inline="yes-display-inline">The term <term>covered county</term> means, with respect to an in-State, adjacent-market network station retransmission to a subscriber, any county to which both of the following apply:</text><subparagraph commented="no" id="HEED5B37A1FA24AFF9055B7762CC883D0"><enum>(A)</enum><text display-inline="yes-display-inline">The county is one of the following counties in the State of Wisconsin: Ashland, Barron, Bayfield, Burnett, Douglas, Dunn, Florence, Iron, Pierce, Polk, Sawyer, St. Croix, or Washburn.</text></subparagraph><subparagraph commented="no" id="H4878E4EE6FC147F4A52BEFCF4E3F35F5"><enum>(B)</enum><text>The county is not in the local market of any television broadcast station—</text><clause commented="no" id="id66346F24F8DA48A5BF9264624018129C"><enum>(i)</enum><text>that is affiliated with the same network; and</text></clause><clause commented="no" id="idEFEB9B117CE34E649241BA32A40A281E"><enum>(ii)</enum><text>whose community of license is located in the State of the subscriber.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="HB0D81A5401984211994FCEC7F3C698C3"><enum>(b)</enum><header>Secondary transmissions of local television programming by satellite</header><text display-inline="yes-display-inline">Section 122(a) of title 17, United States Code, is amended—</text><paragraph commented="no" id="H4257E71081E64095A4EBB43BD9972160"><enum>(1)</enum><text>in paragraph (2)(A), by inserting after <quote>under paragraph (1)</quote> the following: <quote>(or in-State, adjacent-market network station retransmissions instead of secondary transmissions under that paragraph, in accordance with an election under section 346(b) of the Communications Act of 1934)</quote>; and</text></paragraph><paragraph commented="no" id="H10A5337A3A47446B95A99F60E8985349"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(A), by inserting after <quote>under paragraph (1)</quote> the following: <quote>(or in-State, adjacent-market network station retransmissions instead of secondary transmissions under that paragraph, in accordance with an election under section 346(b) of the Communications Act of 1934)</quote>.</text></paragraph></subsection></section></legis-body></bill>
