referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to modify certain rules applicable to qualified small issue manufacturing bonds, to expand certain exceptions to the private activity bond rules for first-time farmers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6F4925CF61C5435DAE527A8AC200228D"><section section-type="section-one" id="HBFBFC8C37A4B45DBAF509B5B9878F687"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Agricultural and Manufacturing Bonds Act</short-title></quote>.</text></section><section id="H23D0CDE28B8E455C9D51B397C4EDA7C1"><enum>2.</enum><header>Modifications to qualified small issue bonds</header><subsection id="H173A95631AE745C0B2E0E553B7A7AB9F"><enum>(a)</enum><header>Manufacturing Facilities To Include Production of Intangible Property and Functionally Related Facilities</header><text>Subparagraph (C) of <external-xref legal-doc="usc" parsable-cite="usc/26/144">section 144(a)(12)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8D1C7AB48B60479498DF3CCDADC4F79F"><subparagraph id="H71FFC4BC01EA4C028B5ACEF3DEF26A59"><enum>(C)</enum><header>Manufacturing facility</header><text>For purposes of this paragraph—</text><clause id="HE348152A12174467AB31E7C275414F7C"><enum>(i)</enum><header>In general</header><text>The term <term>manufacturing facility</term> means any facility which—</text><subclause id="H3DC94BFAC82F4852946EC6196D12D119"><enum>(I)</enum><text>is used in the manufacturing or production of tangible personal property (including the processing resulting in a change in the condition of such property),</text></subclause><subclause id="H599A0D9F0E7546B4BFA95916DBAE2B29"><enum>(II)</enum><text>is used in the creation or production of intangible property which is described in section 197(d)(1)(C)(iii), or</text></subclause><subclause id="H00AAF411064F4733BB7D7CC3A8E9FF03"><enum>(III)</enum><text>is functionally related and subordinate to a facility described in subclause (I) or (II) if such facility is located on the same site as the facility described in subclause (I) or (II).</text></subclause></clause><clause id="H850C4F49D1ED409598F613658B481E5E"><enum>(ii)</enum><header>Certain facilities included</header><text>The term <quote>manufacturing facility</quote> includes facilities that are directly related and ancillary to a manufacturing facility (determined without regard to this clause) if—</text><subclause id="HD098A4878D464E02BF0DF403C9AEC020"><enum>(I)</enum><text>those facilities are located on the same site as the manufacturing facility, and</text></subclause><subclause id="HC6EFB3D000854088AD5F470377E7796E"><enum>(II)</enum><text>not more than 25 percent of the net proceeds of the issue are used to provide those facilities.</text></subclause></clause><clause id="H9620639113B94ACA83D1639272A88883"><enum>(iii)</enum><header>Limitation on office space</header><text>A rule similar to the rule of section 142(b)(2) shall apply for purposes of clause (i).</text></clause><clause id="HECEE6DA146254C3589C695E8B0D5AE73"><enum>(iv)</enum><header>Limitation on refundings for certain property</header><text>Subclauses (II) and (III) of clause (i) shall not apply to any bond issued on or before the date of the enactment of the <short-title>Modernizing Agricultural and Manufacturing Bonds Act</short-title>, or to any bond issued to refund a bond issued on or before such date (other than a bond to which clause (iii) of this subparagraph (as in effect before the date of the enactment of the <short-title>Modernizing Agricultural and Manufacturing Bonds Act</short-title> applies)), either directly or in a series of refundings.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFBA6110EB4E2426D82E7A15FBDF744CF"><enum>(b)</enum><header>Increase in limitations</header><paragraph commented="no" display-inline="no-display-inline" id="idd1878d4ec34e4ac5b26728ef016dff9d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 144(a)(4) of such Code is amended—</text><subparagraph id="HF07583EDD6CF4DBD803DB45BAE8CE198"><enum>(A)</enum><text>in subparagraph (A)(i), by striking <quote>$10,000,000</quote> and inserting <quote>$30,000,000</quote>, and</text></subparagraph><subparagraph id="H1E8C31CBA4B248219DC659BC37DAC13B"><enum>(B)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="tax">$10,000,000</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="tax">$30,000,000</header-in-text></quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id819b3f94110443bdb1c4b69cace5b729"><enum>(2)</enum><header>Increase in additional capital expenditures not taken into account</header><text>Section 144(a)(4)(G) of such Code is amended by inserting <quote>$30,000,000, in the case of bonds issued after the date of the enactment of the <short-title>Modernizing Agricultural and Manufacturing Bonds Act</short-title></quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b611d4e4d4b47d789d8f0048c5b06b0"><enum>(3)</enum><header>Increase in aggregate limit per taxpayer</header><text>Section 144(a)(10)(A) of such Code is amended by striking <quote>$40,000,000</quote> and inserting <quote>$120,000,000</quote>.</text></paragraph><paragraph id="HDCABCF821AD44DC299D8AE98A56859EC"><enum>(4)</enum><header>Adjustment for inflation</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/144">Section 144(a)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H16FA5AC3BC704CF7AC4DF25D6F64EA1E"><paragraph id="H7743A5579B294B7AA410B5D33BBD7EC5"><enum>(13)</enum><header>Adjustment for inflation</header><text>In the case of any calendar year after 2023, the $30,000,000 amounts in paragraph (4)(A), the $30,000,000 amount in paragraph (4)(G), and the $120,000,000 amount in paragraph (10)(A) shall each be increased by an amount equal to—</text><subparagraph id="H2B4FA898DD334513B69171B1B2E3A260"><enum>(A)</enum><text>such dollar amount, multiplied by</text></subparagraph><subparagraph id="H25F7D7C27D2C489DB51B0BEC76A282FF"><enum>(B)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year, determined by substituting <quote>calendar year 2022</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph><continuation-text continuation-text-level="paragraph">If any amount as increased under the preceding sentence is not a multiple of $100,000, such amount shall be rounded to the nearest multiple of $100,000.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5a7912fc65cf448ba499c8ed18f75c0a"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to obligations issued after the date of the enactment of this Act.</text></subsection></section><section id="H52F9D59C87C845B787199A5A056B06BD"><enum>3.</enum><header>Expansion of certain exceptions to the private activity bond rules for first-time farmers</header><subsection id="H4A4EFBB3A8C04B0792CC89CB5DCB3269"><enum>(a)</enum><header>Increase in dollar limitation</header><paragraph id="H84BA909633484DB5967FF85596AF26FE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/147">Section 147(c)(2)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$450,000</quote> and inserting <quote>$1,000,000</quote>.</text></paragraph><paragraph id="HD5D201A967364A149BD654F7299F0D13" commented="no"><enum>(2)</enum><header>Repeal of separate lower dollar limitation on used farm equipment</header><text display-inline="yes-display-inline">Section 147(c)(2) of such Code is amended by striking subparagraph (F) and by redesignating subparagraphs (G) and (H) as subparagraphs (F) and (G), respectively.</text></paragraph><paragraph id="H9BC9E9C7F4AD4FB69B6B94E35473A4BC"><enum>(3)</enum><header>Qualified small issue bond limitation conformed to increased dollar limitation</header><text>Section 144(a)(11)(A) of such Code is amended by striking <quote>$250,000</quote> and inserting <quote>$1,000,000</quote>.</text></paragraph><paragraph id="H52E6EB3084D040A8B4FC3D508F81BF93"><enum>(4)</enum><header>Inflation adjustment</header><subparagraph id="HBA35F141B4C34673BB61705E9A8507DF"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 147(c)(2)(G) of such Code, as redesignated by paragraph (2), is amended—</text><clause id="HE19B6825A2184799BF467DECA3D7E185"><enum>(i)</enum><text>by striking <quote>after 2008, the dollar amount in subparagraph (A) shall be increased</quote> and inserting <quote>after 2023, the dollar amounts in subparagraph (A) and section 144(a)(11)(A) shall each be increased</quote>, </text></clause><clause id="H06DEC9D273D64C17B9E77E791369D440"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>2007</quote> and inserting <quote>2022</quote>, and</text></clause><clause id="id4dc8e5b1937f4900a7b6aa45ba3bf300"><enum>(iii)</enum><text>in the last sentence, by striking <quote>$100</quote> each place it appears and inserting <quote>$10,000</quote>.</text></clause></subparagraph><subparagraph id="H8C4265CF7742446982EA5AAB8E359FE8"><enum>(B)</enum><header>Cross-reference</header><text>Section 144(a)(11) of such Code is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDEEF80D59F74450F8B235C8B7AF890D3"><subparagraph id="H71B3F646F4C1474585901F56E6C6B203"><enum>(D)</enum><header>Inflation adjustment</header><text display-inline="yes-display-inline">For inflation adjustment of dollar amount contained in subparagraph (A), see section 147(c)(2)(G).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HD7EA6216E68C4B14B1FAA6AF580E2FDA"><enum>(b)</enum><header>Substantial farmland determined on basis of average rather than median farm size</header><text>Section 147(c)(2)(E) of such Code is amended by striking <quote>median</quote> and inserting <quote>average</quote>.</text></subsection><subsection id="H3ECBFC8D45D74B89B7BECB9A94AC8643"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to bonds issued after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
