which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to streamline applications from farmers to be vendors under certain nutrition programs, and for other purposes.</official-title></form><legis-body><section id="idb495f7ee416c4f67a44e31cd6580acee" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enabling Farmers to Benefit from Processing Nutrition Programs Act of 2023</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Streamlining applications for farmers</header><subsection commented="no" display-inline="no-display-inline" id="id68874e68bfc14d51928d1b2854435ad5"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd2e3dce22fff458dab3d7aad452c724a"><enum>(1)</enum><header>Covered nutrition program</header><text>The term <quote>covered nutrition program</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcac2e0326c144c7abac87f3a4a276eff"><enum>(A)</enum><text display-inline="yes-display-inline">the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide750c06d6c9247939636ebe050634fdc"><enum>(B)</enum><text display-inline="yes-display-inline">the senior farmers’ market nutrition program established under section 4402 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfcf78ad18dc412a8f092fdabaf4ca6b"><enum>(C)</enum><text display-inline="yes-display-inline">the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>), including the farmers' market nutrition program under that program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddcddca979c0b4ebb8fdde533561abf69"><enum>(D)</enum><text display-inline="yes-display-inline">the Gus Schumacher Nutrition Incentive Program established under section 4405 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/7517">7 U.S.C. 7517</external-xref>), as practicable with respect to the activities carried out by the Secretary under subsections (b) and (c).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f6f2a00a0ad4b898bb80e700e42db8a"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id642641cea8a146f0baccb74aea88cd2f"><enum>(b)</enum><header display-inline="yes-display-inline">Streamlined application process</header><paragraph commented="no" display-inline="no-display-inline" id="idd7e9f5e5c96d44f6a6bcb89b1c89392d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a streamlined application process—</text><subparagraph commented="no" display-inline="no-display-inline" id="id827f8ed705a4495b96f865f906ae4f63"><enum>(A)</enum><text display-inline="yes-display-inline">for direct marketing farmers and ranchers to apply to be vendors under each of the covered nutrition programs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17a0d2dd6bbd45d1a847b41b2a5d5986"><enum>(B)</enum><text display-inline="yes-display-inline">by—</text><clause id="id18cda69e179e4b29b6b8a1f2306eaf8a" commented="no"><enum>(i)</enum><text>developing a single application that a direct marketing farmer or rancher may use to apply to each of the covered nutrition programs; or</text></clause><clause id="id7e717523fa3d43e4bf8ceb5a2b4f7640" commented="no"><enum>(ii)</enum><text>developing an information sharing system that—</text><subclause commented="no" display-inline="no-display-inline" id="ida69f9d3dde4540aa8df48f41ea502c69"><enum>(I)</enum><text display-inline="yes-display-inline">shares the information of a direct marketing farmer or rancher who is approved as an authorized vendor under a covered nutrition program with each of the other covered nutrition programs; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idab61c5ec59c24286ba466c3039213865"><enum>(II)</enum><text display-inline="yes-display-inline">deems that direct marketing farmer or rancher as a prequalified eligible vendor for those other covered nutrition programs.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id810818f34b7048d4b5013f1020cc9485"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing progress made in carrying out paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc8c380c80ed848f2bf9b1b517ef95801"><enum>(c)</enum><header>Streamlined processing of benefits</header><text display-inline="yes-display-inline">The Secretary shall establish a streamlined process for direct marketing farmers and ranchers that are vendors under any of the covered nutrition programs to process benefits under those programs through the use of standardized technology, such as a single piece of equipment or a mobile application.</text></subsection></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id4bba10a9f7a747fab45cf46540f1ca49"><enum>3.</enum><header display-inline="yes-display-inline">Support for wireless and mobile equipment for certain entities</header><text display-inline="no-display-inline">Section 7(f)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(f)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcbcf94cf0c5b404b90b56f4d71c223bf"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D); and</text></paragraph><paragraph id="id488debeef524434c8a1c097956d5f9a6"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7ffa3c30ff6b4b91859ee1c1e16d80ab"><subparagraph id="idfce824b54d404e8b8b8912cf2336fdef"><enum>(C)</enum><header>Requirement</header><text>The Secretary shall ensure that equipment or systems made available to entities described in clauses (i) and (ii) of subparagraph (B) by a State agency or an implementing partner of a State agency is appropriate for the entity, including, with respect to farmers markets and other direct-to-consumer markets, wireless or mobile processing equipment and technology systems.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
