which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 11, 2023</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To improve the effectiveness and performance of certain Federal financial assistance programs, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Streamlining Federal Grants Act of 2023</short-title></quote>.</text></section><section id="id0351eb6a4894422f86fe3de8dc9f6651" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="id2d67fcf11f9e482085a6d4d814dd675c"><enum>(1)</enum><text>improve the effectiveness and performance of Federal grant and cooperative agreement programs;</text></paragraph><paragraph id="id11a06232c18e4a2ea9ca75036ae90548"><enum>(2)</enum><text>simplify the application and reporting requirements of Federal grant and cooperative agreement programs;</text></paragraph><paragraph id="idf8df2a7421e24c2bb5d487d9c10e9584"><enum>(3)</enum><text>improve the delivery of services to the public, particularly services to communities and organizations that historically have not received Federal grants or cooperative agreements; and</text></paragraph><paragraph id="idc06b7b4be80f42619973e2d88710f04e"><enum>(4)</enum><text>facilitate greater coordination among agencies that award Federal grants and non-Federal entities responsible for delivering services to the public.</text></paragraph></section><section id="id03bc473871b141e88b2765c46e38ff1c" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id5b90d7f54e46405f977bb842386978ad"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="id4d03340fcb594de6a5a423626c21ce11"><enum>(2)</enum><header>Agency co-chair</header><text>The term <term>agency co-chair</term> means the agency designated by the Director or the Council under section 5(e)(1). </text></paragraph><paragraph id="idc4de7212bb3745fb9e89bf3176565f75"><enum>(3)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="idfd309f1f4f994c2b90ae8a74e0a0da7b"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="ide369405207f440b3999b244234ec46dc"><enum>(B)</enum><text>the Committee on Oversight and Accountability of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e9fcdb6f7b044e5ab4668852981bf71"><enum>(4)</enum><header>Consultation with non-Federal entities</header><text>The term <term>consultation with non-Federal entities</term> means regular and ongoing engagement with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5BA303877EA74820B4885FE6BC9FE1FF"><enum>(A)</enum><text display-inline="yes-display-inline">recipients and potential recipients of grants or cooperative agreements and entities that represent those recipients and potential recipients; and</text></subparagraph><subparagraph id="idE86B11ED6FCB4391B64C09D4D21DA6B7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">particular attention to the recipients and potential recipients described in subparagraph (A) that have not historically received grants or cooperative agreements. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8d0f6884ef94739a3a4ae308743dd57"><enum>(5)</enum><header>Cooperative agreement</header><text>The term <term>cooperative agreement</term> has the meaning given the term in section 6302 of title 31, United States Code.</text></paragraph><paragraph id="id23e4963ab1b444d18e3c7c285cdc0f0a"><enum>(6)</enum><header>Council</header><text>The term <term>Council</term> means the Grants Council established under section 5(a).</text></paragraph><paragraph id="id3ecda1a0bd8b4596b2fe1bed984aa685"><enum>(7)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="ide8a4a72c402e4a1fb7fa4bc51711827a"><enum>(8)</enum><header>Federal financial assistance</header><text>The term <term>Federal financial assistance</term> has the meaning given the term in section 7501 of title 31, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida87d011df8654d558bf4ac5f9335c013"><enum>(9)</enum><header>Grant</header><text>The term <term>grant</term> has the meaning given the term <quote>grant agreement</quote> in section 6302 of title 31, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id710a33d77f7d404eb5e95b74c852f7ed"><enum>(10)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35e909c091354fad85c4f3c9cc1ed198"><enum>(11)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="id994e9128879f463da567b0b2664a4272"><enum>(12)</enum><header>Local government</header><text>The term <term>local government</term> means any unit of government within a State, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbfb105aeb9364a8fa5fd64bfb098905f"><enum>(A)</enum><text display-inline="yes-display-inline">a county;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide73a33f08b4d47e5a1ef62ff39d74b69"><enum>(B)</enum><text>a borough;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0d53f16352fc410481033a390e385ac1"><enum>(C)</enum><text>a municipality;</text></subparagraph><subparagraph id="idca26ea1daaac4a38a1861924957113dd"><enum>(D)</enum><text>a city;</text></subparagraph><subparagraph id="id12c78985a9ae4de1bbdeb3692217cb6c"><enum>(E)</enum><text>a town;</text></subparagraph><subparagraph id="id407d66fd51404ed3a8f427d90f3d0399"><enum>(F)</enum><text>a township;</text></subparagraph><subparagraph id="idae04c585dade4affaa30c28ba57b13ed"><enum>(G)</enum><text>a parish;</text></subparagraph><subparagraph id="idfd0e7f78f43542658e806d7c3de71d4d"><enum>(H)</enum><text>a local public authority, including any public housing agency (as defined in section 2(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437(b)</external-xref>));</text></subparagraph><subparagraph id="idf9298a99425d483cb0ee67df414da722"><enum>(I)</enum><text>a special district;</text></subparagraph><subparagraph id="idf4aa5b19a0c946af8fd717c0aca82a17"><enum>(J)</enum><text>a school district;</text></subparagraph><subparagraph id="idb8c2fba7aaf047a3909eda561e784e0b"><enum>(K)</enum><text>an intrastate district;</text></subparagraph><subparagraph id="idf9019d835e3e4e27a7ad1bcc8557f553"><enum>(L)</enum><text>a council of governments, whether or not incorporated as a nonprofit corporation under State law; and</text></subparagraph><subparagraph id="idf43b186dce9a4a1e90b71c520788dcbb"><enum>(M)</enum><text>any other agency or instrumentality of a multi-State, regional, or intra-State or local government. </text></subparagraph></paragraph><paragraph id="id75861e9517c64148b77ce1a825b5b63f"><enum>(13)</enum><header>Non-federal entity</header><text>The term <term>non-Federal entity</term> means a State, local government, Indian Tribe, institution of higher education, or nonprofit organization.</text></paragraph><paragraph id="id424a422f577a4f21b2473848f8da3cae"><enum>(14)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means any corporation, trust, association, cooperative, or other organization that—</text><subparagraph id="ide46bb4e980b645e997f544aa6c33b7b6"><enum>(A)</enum><text>is operated primarily for scientific, educational, service, charitable, or similar purposes in the public interest;</text></subparagraph><subparagraph id="idadf868c69c4c4d6ca3f68fa6fdbe63d3"><enum>(B)</enum><text>is not organized primarily for profit;</text></subparagraph><subparagraph id="id497c45e5b75443c8b6405f137988950c"><enum>(C)</enum><text>uses net proceeds to maintain, improve, or expand the operations of the organization; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7bba29bb4e364dd0a99d410a7a2f0ae6"><enum>(D)</enum><text>is not an institution of higher education.</text></subparagraph></paragraph><paragraph id="idb8b700030d2e45c2a0244ec61f7d782d"><enum>(15)</enum><header>Senior agency official for grants</header><text>The term <term>senior agency official for grants</term> means an agency official designated under section 4(a).</text></paragraph><paragraph id="id2d1546b5924d44bb9ae4d67552c27eb4"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Trust Territory of the Pacific Islands, any instrumentality thereof, and any multi-State, regional, or interstate entity that has governmental functions.</text></paragraph></section><section id="id4d018927955841f5b20d3bd99b18c366" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>4.</enum><header>Senior agency officials for grants</header><subsection id="id05b0deb6297b452bb21f7c4a4ef348cd"><enum>(a)</enum><header>Senior agency official for grants</header><text>Not later than 60 days after the date of enactment of this Act, the head of each agency shall—</text><paragraph id="id648172a53de049fd9d37e73b1c17a866"><enum>(1)</enum><text>designate a senior official of the agency to be responsible for—</text><subparagraph id="idae35794f1f1a47a790a453eb9afadd08"><enum>(A)</enum><text>agency-wide grant and cooperative agreement policy, management, strategic planning, and implementation; and</text></subparagraph><subparagraph id="id06d18287a455472ca5d928d7c7790971"><enum>(B)</enum><text>the responsibilities of the agency under this Act; and</text></subparagraph></paragraph><paragraph id="ida0933d6fa8234511b33adddb5826292a"><enum>(2)</enum><text>notify the Director of the designation under paragraph (1).</text></paragraph></subsection><subsection id="id09e08569f9fb406097b201777f1b2410"><enum>(b)</enum><header>List</header><text>The Director shall—</text><paragraph id="id4527c08a73ed42d5a5c570fa96a94b07"><enum>(1)</enum><text>maintain a list of senior agency officials for grants; and</text></paragraph><paragraph id="id8bbfe33c210d4c4f8a37a764534b682e"><enum>(2)</enum><text>not later than 90 days after the date of enactment of this Act, make the list maintained under paragraph (1) available to the public on the website of the Office of Management and Budget. </text></paragraph></subsection></section><section id="idac194f4ea7724a4fa3f150d78f7320f1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>5.</enum><header>Grants council</header><subsection id="id71037f3e7c26437d8fb6a60bda3b1eb8"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Director shall establish a council to be known as the Grants Council.</text></subsection><subsection id="ida80280438d344e2db6779aaf1febc882"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of—</text><paragraph id="id9bb4811e5c154621bc97a5b5f0be6a58"><enum>(1)</enum><text>the Controller of the Office of Federal Financial Management of the Office of Management and Budget, who shall act as the Chair of the Council;</text></paragraph><paragraph id="id376a4ad34bff4ae694ecf26ca099055d"><enum>(2)</enum><text>with respect to each agency that distributes grants or enters into cooperative agreements, the senior agency official for grants of the agency; and</text></paragraph><paragraph id="id9d2ddff790fc4a2784337ce945855660"><enum>(3)</enum><text>other relevant agency officials, as determined necessary by the Chair.</text></paragraph></subsection><subsection id="ide4c7a14476764e74a94341793b6a3972"><enum>(c)</enum><header>Administrative support</header><text>The Administrator of General Services shall provide administrative support for the Council.</text></subsection><subsection id="idfe030972969a4c7185025eb39c80e313"><enum>(d)</enum><header>Solicitation of feedback</header><text>The Director shall—</text><paragraph id="id1cce8e585fc24403941c40aa22ff1c4c"><enum>(1)</enum><text>consistently and regularly solicit input and collect feedback and user experience information with respect to the application, administration, and reporting of grants and cooperative agreements, including from non-Federal entities; and</text></paragraph><paragraph id="idc043b04b6a5d475d8f0d7bcc8bb0bbf1"><enum>(2)</enum><text>incorporate the information collected under paragraph (1) into the work of the Council.</text></paragraph></subsection><subsection id="idcd950457189f44bab67fe065e1dbaf71"><enum>(e)</enum><header>Implementation assistance</header><paragraph id="idd6f5abe54202408cab54ffee04a5849e"><enum>(1)</enum><header>Agency co-chair</header><subparagraph id="ida13494e0ed9f43eda822900be5afb3b4"><enum>(A)</enum><header>In general</header><text>The Director shall designate an agency with representation on the Council to serve as the agency co-chair to assist the Director in carrying out the responsibilities under this section.</text></subparagraph><subparagraph id="id9ead09090693401fb8e100f27d32feb8"><enum>(B)</enum><header>Term</header><text>The term of service of the agency co-chair shall be 2 years.</text></subparagraph><subparagraph id="id96f6ffac90ae453bb4942e0ccda201d7"><enum>(C)</enum><header>Renewal</header><text>At the discretion of the Council, an agency may serve as the agency co-chair for not more than 2 consecutive terms.</text></subparagraph><subparagraph id="id317c449c2d2f41dda9f9b5377ccf8ec7"><enum>(D)</enum><header>Successor</header><text>Upon the expiration of a term of service of an agency co-chair, the members of the Council shall designate a successor agency co-chair.</text></subparagraph></paragraph><paragraph id="id13bab803113b429584d60e9d604b344d"><enum>(2)</enum><header>Interagency working groups</header><text>The Director may use interagency working groups to assist in carrying out the responsibilities under this section.</text></paragraph></subsection><subsection id="id29222ccf6f9a4b48ac7600e393d52bde"><enum>(f)</enum><header>Interagency duties</header><text>The Director, in consultation with the Council, shall direct, coordinate, and assist agencies in—</text><paragraph id="id6e9a57f8a1684f6f962d870be5ca3260"><enum>(1)</enum><text>designing and implementing common data standards under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/64">chapter 64</external-xref> of title 31, United States Code;</text></paragraph><paragraph id="ida8bafc2c08b54288b51150b7be757b87"><enum>(2)</enum><text>creating guidelines for simplified notice of funding opportunities that improve the user experience for grants and cooperative agreements;</text></paragraph><paragraph id="idfa4c9d8c4ff74754972902f2d2625ae2"><enum>(3)</enum><text>improving interagency and intergovernmental coordination of information collection and data sharing relating to grant and cooperative agreement programs, including for the purpose of performance management and program evaluation;</text></paragraph><paragraph id="ide3dadbf5b4ab47c0ab7b8beaaee02492"><enum>(4)</enum><text>improving the timeliness, completeness, and quality of information received by agencies from recipients of grants and cooperative agreements;</text></paragraph><paragraph id="idf0b8eb5d4c554b00be6d0e794129b2a1"><enum>(5)</enum><text>ensuring the consistent application and interpretation of governmentwide Federal financial assistance policy, oversight, and management;</text></paragraph><paragraph id="ide1b8757eb17f4ec6b8b0fd70c6fb2939"><enum>(6)</enum><text>supporting the development of the Federal financial assistance workforce; and</text></paragraph><paragraph id="id3dd795a1581e47e889bc612818900a46"><enum>(7)</enum><text>identifying and improving other procedures and policies relating to the application, administration, and reporting of grants and cooperative agreements, as identified by the Council.</text></paragraph></subsection><subsection id="id5c42fd427a1a479485aba10c2647671b"><enum>(g)</enum><header>Report on improvements</header><text>Not later than 1 year after the date of enactment of this Act, and every 2 years thereafter until the date that is 15 years after the date of enactment of this Act, the Director, in consultation with the Council, shall submit to the appropriate congressional committees a report relating to the implementation of this Act.</text></subsection><subsection id="id2c20d007e6314230a1c01828ff7a1120"><enum>(h)</enum><header>Report on recommended changes in law</header><text>Not later than 4 years after the date of enactment of this Act, the Director, in consultation with the Council, shall submit to the appropriate congressional committees a report containing recommendations for changes in law to improve the effectiveness, performance, and coordination of grant and cooperative agreement programs.</text></subsection></section><section id="id665a4867cf3340c89a6b215d81ddac6d" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>6.</enum><header>Agency grant improvement plans</header><subsection id="id5b0058d3c8c84fe1ac6ccf6c64751366"><enum>(a)</enum><header>Agency guidance</header><text>Not later than 270 days after the date of enactment of this Act, the Director, in consultation with the Council, shall issue guidance for the development of agency plans to—</text><paragraph id="idd8023cf4d5474714b6a8de92d8c22b88"><enum>(1)</enum><text>streamline and simplify the application, administrative, and reporting procedures for each grant and cooperative agreement program administered by the agency;</text></paragraph><paragraph id="id99b32940088b413d8b1afee74c5ad344"><enum>(2)</enum><text>simplify and improve user experience with respect to notices of funding opportunity, including by implementing—</text><subparagraph id="id68c8928765154bf99d46d774f5f08ee9"><enum>(A)</enum><text>the use of plain language;</text></subparagraph><subparagraph id="id449ee8afc9e34533b9f5f90931388344"><enum>(B)</enum><text>the listing of the availability of, and contact information for, training and assistance relating to applying for, administering, and reporting on grants and cooperative agreements; and</text></subparagraph><subparagraph id="id5ca30abc516d466da5d97fdd5fff6505"><enum>(C)</enum><text>the inclusion of a summary of the funding opportunity of not more than 500 words;</text></subparagraph></paragraph><paragraph id="id9f5348a1305149239a699088426f7fa2"><enum>(3)</enum><text>demonstrate active participation by the agency in the Council;</text></paragraph><paragraph id="id7401d738706e485ab1c0878a0ca3f163"><enum>(4)</enum><text>demonstrate appropriate coordination with the Grants Quality Service Management Office, or any successor organization, with respect to the adoption by the agency, or plans for adoption by the agency, of grant management solutions or services that meet usability and modernization standards established by the Director;</text></paragraph><paragraph id="id430dbd98f525499f96a717153ace576f"><enum>(5)</enum><text>ensure potential applicants for grant and cooperative agreement programs have opportunities to receive training and assistance;</text></paragraph><paragraph id="id10feae8e324d4ef29d2d121fbda1793b"><enum>(6)</enum><text>improve the abilities of recipients of grants and cooperative agreements to provide timely, complete, and high-quality information in response to Federal reporting requirements; and</text></paragraph><paragraph id="id1896ffac5220422bb2da5c42dbcdcdf1"><enum>(7)</enum><text>establish specific annual goals and objectives to further the purposes of this Act and measure annual performance in achieving those goals and objectives.</text></paragraph></subsection><subsection id="id7151ab2e43aa4cb29678b98ce9da431d"><enum>(b)</enum><header>Review of plans and reports</header><text>Upon request by the Director, the head of each agency shall submit to the Director information and reporting relating to the implementation of this Act by the agency.</text></subsection><subsection id="idfdcdedf23838461188a05d4c0ca9427a"><enum>(c)</enum><header>Exemptions</header><paragraph id="id6832d2c65b24420689f3db86db55ba3d"><enum>(1)</enum><header>In general</header><text>The Director may exempt an agency, a component of an agency, or a particular grant or cooperative agreement program of an agency from the requirements of this Act if the Director determines that the agency does not administer a significant number of grant and cooperative agreement programs.</text></paragraph><paragraph id="id5ddb09c31e234be58d618180d4496d3f"><enum>(2)</enum><header>List of exempted agencies</header><text>The Director shall—</text><subparagraph id="id64362084d7b04b5abd067b2be885370c"><enum>(A)</enum><text>maintain a list of agencies, components of agencies, and grant and cooperative agreement programs exempted under paragraph (1); and</text></subparagraph><subparagraph id="ida7a3f166cddf4e0abb3ee3934fa8bfa6"><enum>(B)</enum><text>make the list maintained under subparagraph (A) available to the public on the website of the Office of Management and Budget.</text></subparagraph></paragraph></subsection><subsection id="idf975fc18e0de466eb2f777f63ad41fab"><enum>(d)</enum><header>Agency plans</header><text>Subject to subsection (e), not later than the earlier of 1 year after the date on which the Director issues guidance under subsection (a) and 635 days after the date of enactment of this Act, the head of each agency shall develop, implement, and submit to the Director and the appropriate congressional committees a plan in response to the guidance.</text></subsection><subsection id="id7cfb7c72c6bc4772973375732843df95"><enum>(e)</enum><header>Extension</header><text>If the head of an agency is unable to comply with the deadline established under subsection (d) to develop and implement a plan, the Director may extend the period during which the agency may develop and implement the plan by not more than 1 year.</text></subsection><subsection id="id9d482e03a72e413a8421c9d0f25b8fd2"><enum>(f)</enum><header>Comment and consultation on agency plans</header><paragraph id="idd4e321515b4c444599f5b1965ac5c538"><enum>(1)</enum><header>Comment</header><subparagraph id="ided16b864b9274976ab85b7d8ab44ce4f"><enum>(A)</enum><header>In general</header><text>The head of each agency shall publish the plan developed in accordance with the guidance issued under subsection (a) in the Federal Register.</text></subparagraph><subparagraph id="id0c9ff907d058476bb9a73c02e3b82622"><enum>(B)</enum><header>Public comment</header><text>With respect to a plan published in the Federal Register by the head of an agency in accordance with subparagraph (A)—</text><clause id="id4ff6a23e8ef94f52a3439c5156fcb914"><enum>(i)</enum><text>the head of the agency shall review public comments on the plan submitted through the Federal Register and by other means; and</text></clause><clause id="id39aa69d9a1ff4a0cac09bb84deb1ac24"><enum>(ii)</enum><text>to the maximum extent practicable, the head of the agency shall hold a public forum on the plan.</text></clause></subparagraph></paragraph><paragraph id="id13594c35f71049648bfa8e0bf34a4dfc"><enum>(2)</enum><header>Consultation</header><text>The senior agency official for grants of each agency shall participate in consultation with non-Federal entities during the development and implementation of the plan developed in accordance with the guidance issued under subsection (a).</text></paragraph></subsection><subsection id="id39b4226dc7a44223893aafe4cd98a3a4"><enum>(g)</enum><header>Annual report</header><paragraph id="ida44e7cbd5d4e48c492dee6aa8cc1053e"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the submission of the plan of an agency under subsection (d), and annually thereafter, the senior agency official for grants of the agency or the head of the agency, as applicable, shall submit to the Director and the appropriate congressional committees a report on—</text><subparagraph id="id280acadd2e19467db536f0dbe64e279b"><enum>(A)</enum><text>the implementation of the plan; and</text></subparagraph><subparagraph id="id0ee4c448de654ecfbd757dbb638da90d"><enum>(B)</enum><text>the performance of the agency in meeting the goals and objectives described in subsection (a)(7).</text></subparagraph></paragraph><paragraph id="idd92db037cf384e3fbaa10be6bc06d1b8"><enum>(2)</enum><header>Inclusion in other reports</header><text>Effective on the date on which the head of an agency submits a plan under subsection (d), the head of the agency shall update and include the goals and objectives described in subsection (a)(7) in each performance plan of the agency required under section 1115 of title 31, United States Code.</text></paragraph></subsection></section><section id="id379836bf6a9b41f4899400e897a283b6" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>7.</enum><header>Grants.gov</header><subsection id="id6c83805b786343f89a225508e3d7894f"><enum>(a)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in coordination with the Secretary of Health and Human Services, shall submit to the appropriate congressional committees a report that—</text><paragraph id="id18e3d1290b1b4d7b9b8cf58294036a06"><enum>(1)</enum><text>contains findings from a study on the accessibility and user experience of Grants.gov, or any successor website; and</text></paragraph><paragraph id="id455ea2f6e3834d2597e3ee7b97dc2860"><enum>(2)</enum><text>provides recommendations based on the findings described in paragraph (1) to improve the access to the function of Grants.gov, or any successor website.</text></paragraph></subsection><subsection id="id268ed84f786845db92ed9dbec077c07d"><enum>(b)</enum><header>Improvements</header><text>Not later than 3 years after the date of enactment of this Act, the Director, in coordination with the Secretary of Health and Human Services, shall implement the recommendations described in subsection (a)(2).</text></subsection></section><section id="idd4eecb366dff4240918566ca97e7368b" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>8.</enum><header>Evaluation</header><subsection id="idfbb74f48ac5a43b091daf97f1ea93307"><enum>(a)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States, in consultation with non-Federal entities, shall submit to the appropriate congressional committees an evaluation of the effectiveness of this Act.</text></subsection><subsection id="idb1c41c34fed442a091184fe30615f595"><enum>(b)</enum><header>Contents</header><text>The evaluation under subsection (a) shall—</text><paragraph id="ide913b0ab233349be9c33fc4ccf3cfcd2"><enum>(1)</enum><text>assess the implementation of this Act and the extent to which the implementation meets the purposes of this Act;</text></paragraph><paragraph id="id8948fe2e93894830991a4f42fd1bb87c"><enum>(2)</enum><text>make specific recommendations to further the implementation of this Act;</text></paragraph><paragraph id="id506931fc6e8848269e479e735c3e0c8b"><enum>(3)</enum><text>evaluate the actual performance of each agency in achieving the goals and objectives stated in the plan of the agency developed in accordance with the guidance issued under section 6(a); and</text></paragraph><paragraph id="ida1caf1b0ff924c8d8e8521f81c31ddbd"><enum>(4)</enum><text>assess the level of coordination among the Director and non-Federal entities in implementing this Act.</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id089d8eb2-9fb9-4019-af67-4e05e001ac14" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Streamlining Federal Grants Act of 2023</short-title></quote>.</text></section><section id="idf88f829a-36b8-4f40-8765-ce645b4a2fa3" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="idff0d7640-b005-4baf-b868-fbbf4a70c780"><enum>(1)</enum><text>improve the effectiveness and performance of Federal grant and cooperative agreement programs;</text></paragraph><paragraph id="id769234f5-8edd-4e46-8538-bfd5fb50b06c"><enum>(2)</enum><text>simplify the application and reporting requirements of Federal grant and cooperative agreement programs;</text></paragraph><paragraph id="id35e2bfdb-5469-4d78-a03f-993b7ea13b32"><enum>(3)</enum><text>improve the delivery of services to the public, particularly services to communities and organizations that historically have not received Federal grants or cooperative agreements; and</text></paragraph><paragraph id="id8f7869cd-706e-4b93-a1a4-338045860d8b"><enum>(4)</enum><text>facilitate greater coordination among agencies that award Federal grants and non-Federal entities responsible for delivering services to the public.</text></paragraph></section><section id="id6064e911-c9fb-42bc-9be5-4dde5853b0e7" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id7d6c30eb-d027-4722-a05e-03eba107d31d"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="id017d58cf-b139-4835-bcd5-609b3fbf5518"><enum>(2)</enum><header>Agency co-chair</header><text>The term <term>agency co-chair</term> means the agency designated by the Director or the Council under section 5(e)(1). </text></paragraph><paragraph id="ida07c5a60-b854-4e59-8365-3ed7112ce55c"><enum>(3)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id5e1e6559-0f54-4c53-8ed6-07164f87fcda"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id386d37fb-4a17-4ff3-87bb-bdbb6ebd7858"><enum>(B)</enum><text>the Committee on Oversight and Accountability of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea6ae42d-1cea-4822-944e-e22152193462"><enum>(4)</enum><header>Consultation with non-Federal entities</header><text>The term <term>consultation with non-Federal entities</term> means regular and ongoing engagement with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbe22a48a-6fc6-456d-a935-7a541c6cac6a"><enum>(A)</enum><text display-inline="yes-display-inline">recipients and potential recipients of grants or cooperative agreements and entities that represent those recipients and potential recipients; and</text></subparagraph><subparagraph id="id5ae3bc39-29f4-45d3-b3cb-ec193eac4756" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">particular attention to the recipients and potential recipients described in subparagraph (A) that have not historically received grants or cooperative agreements. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id929d25cd-1503-4ee9-887d-d428afbb9b72"><enum>(5)</enum><header>Cooperative agreement</header><text>The term <term>cooperative agreement</term> has the meaning given the term in section 6302 of title 31, United States Code.</text></paragraph><paragraph id="id64e91ab7-fd35-43e3-a7ad-d492edd5730c"><enum>(6)</enum><header>Council</header><text>The term <term>Council</term> means the Grants Council established under section 5(a).</text></paragraph><paragraph id="id71ef5168-b4dc-43fe-b153-64186edb4ac4"><enum>(7)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="id181b9855-753d-4bd0-8319-19cfc02d260e"><enum>(8)</enum><header>Federal financial assistance</header><text>The term <term>Federal financial assistance</term> has the meaning given the term in section 7501 of title 31, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id375de185-38cb-4e79-bf89-17a1f1c5b613"><enum>(9)</enum><header>Grant</header><text>The term <term>grant</term> has the meaning given the term <quote>grant agreement</quote> in section 6302 of title 31, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc14984b1-2037-4b95-bc0b-9532e76c3265"><enum>(10)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b28f4da-7433-4c00-a3bd-a77ebe0d683d"><enum>(11)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="idee4d588c-5ca3-4cf0-8567-7dba3a386e9d"><enum>(12)</enum><header>Local government</header><text>The term <term>local government</term> means any unit of government within a State, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id96e4bf76-144d-476c-ac0a-22e8fa2407b5"><enum>(A)</enum><text display-inline="yes-display-inline">a county;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id675188d9-9b4e-4709-a653-83a5187e5c56"><enum>(B)</enum><text>a borough;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id106704a2-be5c-44f9-a59c-c25c3b976a9c"><enum>(C)</enum><text>a municipality;</text></subparagraph><subparagraph id="id2c5e10c8-b673-464b-895c-331864ba7e29"><enum>(D)</enum><text>a city;</text></subparagraph><subparagraph id="id31dbb01b-ee41-413e-9d76-4a6aad826bf0"><enum>(E)</enum><text>a town;</text></subparagraph><subparagraph id="id8f603b85-0df8-47d7-a881-2161ac723b96"><enum>(F)</enum><text>a township;</text></subparagraph><subparagraph id="ided8f911c-b591-4012-8f78-caa4778b7f5a"><enum>(G)</enum><text>a parish;</text></subparagraph><subparagraph id="id3c4a094f-4281-4872-8139-cbe49ac331e4"><enum>(H)</enum><text>a local public authority, including any public housing agency (as defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437(b)</external-xref>);</text></subparagraph><subparagraph id="id1c079014-8440-4128-913a-6e9498991c14"><enum>(I)</enum><text>a special district;</text></subparagraph><subparagraph id="ide6b786ad-eec6-45c9-889f-ac86d6c10128"><enum>(J)</enum><text>a school district;</text></subparagraph><subparagraph id="idcc4db2e5-6a73-4887-932d-9d6d7c6ee17d"><enum>(K)</enum><text>an intrastate district;</text></subparagraph><subparagraph id="ida5fe8670-d426-4661-b854-eebf9b90f3d8"><enum>(L)</enum><text>a council of governments, whether or not incorporated as a nonprofit corporation under State law; and</text></subparagraph><subparagraph id="id4a73bc46-07aa-4ad3-b7ae-c406fc6537f8"><enum>(M)</enum><text>any other agency or instrumentality of a multi-State, regional, or intra-State or local government.</text></subparagraph></paragraph><paragraph id="id01948267-3e37-4fc5-9787-148bb834bde9"><enum>(13)</enum><header>Non-federal entity</header><text>The term <term>non-Federal entity</term> means a State, local government, Indian Tribe, institution of higher education, or nonprofit organization.</text></paragraph><paragraph id="id9d17996e-782a-472e-a96e-5e5f10fd17ea"><enum>(14)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf04d40d53bc64ce6808f73a7ad096bcf"><enum>(A)</enum><text display-inline="yes-display-inline">means any corporation, trust, association, cooperative, or other organization that—</text><clause id="id1e1ced36-bb76-4e7b-a896-7abd61822ac3"><enum>(i)</enum><text>is operated primarily for scientific, educational, service, charitable, or similar purposes in the public interest;</text></clause><clause id="id4d4fb9e7-2980-4498-aed5-3f8afc09aee6"><enum>(ii)</enum><text>is not organized primarily for profit;</text></clause><clause id="id99e66251-6001-4396-a04b-93d7aab0952f"><enum>(iii)</enum><text>uses net proceeds to maintain, improve, or expand the operations of the organization; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd4d392d7-5133-4403-8c20-237427e772de"><enum>(iv)</enum><text>is not an institution of higher education; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddebc8a5ebc7c4406bd03067604956329"><enum>(B)</enum><text>includes faith-based and community-based organizations.</text></subparagraph></paragraph><paragraph id="id9ac5e371-f260-4071-987b-63194f7f34fa"><enum>(15)</enum><header>Senior agency official for grants</header><text>The term <term>senior agency official for grants</term> means an agency official designated under section 4(a).</text></paragraph><paragraph id="ided60d3ef-369d-4b27-bde6-aff76aa45681"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Trust Territory of the Pacific Islands, any instrumentality thereof, and any multi-State, regional, or interstate entity that has governmental functions.</text></paragraph></section><section id="id309c7b92-e36d-41b6-99dd-4424a8a6656c" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Senior agency officials for grants</header><subsection id="id9cc77d4b-5849-4b8f-a88c-86fba3ebc53f"><enum>(a)</enum><header>Senior agency official for grants</header><text>Not later than 60 days after the date of enactment of this Act, the head of each agency shall—</text><paragraph id="id4c2c3a5a-0a6b-48ff-bb2b-6960370ff423"><enum>(1)</enum><text>designate a senior official of the agency to be responsible for—</text><subparagraph id="idca543bc8-f8d0-4ea2-b93a-481f4c8c4e9a"><enum>(A)</enum><text>agency-wide grant and cooperative agreement policy, management, strategic planning, and implementation; and</text></subparagraph><subparagraph id="idaea11f56-c571-494b-ac51-eaf9845e9e72"><enum>(B)</enum><text>the responsibilities of the agency under this Act; and</text></subparagraph></paragraph><paragraph id="ida2c8a94e-8c84-41e0-9197-f2ebfea4b923"><enum>(2)</enum><text>notify the Director of the designation under paragraph (1).</text></paragraph></subsection><subsection id="idaa471fb6-5490-4489-91d4-7f72a1fc2c7d"><enum>(b)</enum><header>List</header><text>The Director shall—</text><paragraph id="ida2a63b54-1e83-4265-bd26-459365fccc8e"><enum>(1)</enum><text>maintain a list of senior agency officials for grants; and</text></paragraph><paragraph id="idd52f97e8-8e4d-46dc-99c0-cf8c8055147e"><enum>(2)</enum><text>not later than 90 days after the date of enactment of this Act, make the list maintained under paragraph (1) available to the public on the website of the Office of Management and Budget. </text></paragraph></subsection></section><section id="id4a790c61-5c37-49b3-aeaa-3bbc314acbed" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>5.</enum><header>Grants council</header><subsection id="id30dd3601-c0c0-4dcf-8dc7-0e8225a66a4d"><enum>(a)</enum><header>In general</header><text>Not later than 80 days after the date of enactment of this Act, the Director shall establish a council to be known as the Grants Council.</text></subsection><subsection id="id4f2a047b-2e47-4f21-b9dd-247f4d02e1cd"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of—</text><paragraph id="id5f4b26f1-9246-4491-8a52-b3383ba05961"><enum>(1)</enum><text>the Controller of the Office of Federal Financial Management of the Office of Management and Budget, who shall act as the Chair of the Council;</text></paragraph><paragraph id="idf2ee4f30-24ae-4cc1-929c-3c6e63c060f8"><enum>(2)</enum><text>with respect to each agency that distributes grants or enters into cooperative agreements, the senior agency official for grants of the agency; and</text></paragraph><paragraph id="idccde2d47-c6e2-4841-936c-618a972ed1b2"><enum>(3)</enum><text>other relevant agency officials, as determined necessary by the Chair.</text></paragraph></subsection><subsection id="ida92e0e23-3eda-4aa1-b964-22b252484d23"><enum>(c)</enum><header>Administrative support</header><text>The Administrator of General Services shall provide administrative support for the Council.</text></subsection><subsection id="id6bdef60a-91c9-498d-97a8-e45fcde74e13"><enum>(d)</enum><header>Solicitation of feedback</header><text>The Director shall—</text><paragraph id="id6654e19e-784b-40d3-b1de-243de23c94e6"><enum>(1)</enum><text>consistently and regularly solicit input and collect feedback and user experience information with respect to the application, administration, and reporting of grants and cooperative agreements, including from non-Federal entities; and</text></paragraph><paragraph id="id62ae35f8-3208-4122-985a-b34c26044d6a"><enum>(2)</enum><text>incorporate the information collected under paragraph (1) into the work of the Council.</text></paragraph></subsection><subsection id="id3691f406-7149-44b4-837d-ef56e4cb88d3"><enum>(e)</enum><header>Implementation assistance</header><paragraph id="ide20042bd-7d5e-4331-a463-ef4a5e9060b7"><enum>(1)</enum><header>Agency co-chair</header><subparagraph id="idc9b96715-0848-4285-8bd5-e0e617c070b6"><enum>(A)</enum><header>In general</header><text>The Director shall designate an agency with representation on the Council to serve as the agency co-chair to assist the Director in carrying out the responsibilities under this section.</text></subparagraph><subparagraph id="idb1c9b614-e4ae-4c02-a096-7b58dd47735f"><enum>(B)</enum><header>Term</header><text>The term of service of the agency co-chair shall be 2 years.</text></subparagraph><subparagraph id="id76faf131-2d8b-4d4c-b82d-3b436578e3ce"><enum>(C)</enum><header>Renewal</header><text>At the discretion of the Council, an agency may serve as the agency co-chair for not more than 2 consecutive terms.</text></subparagraph><subparagraph id="ide7a82d71-29c9-426a-8171-e05aa419033e"><enum>(D)</enum><header>Successor</header><text>Upon the expiration of a term of service of an agency co-chair, the members of the Council shall designate a successor agency co-chair.</text></subparagraph></paragraph><paragraph id="id51302301-4cd4-45d9-97d3-fcabb1bb2a1b"><enum>(2)</enum><header>Interagency working groups</header><text>The Director may use interagency working groups to assist in carrying out the responsibilities under this section.</text></paragraph></subsection><subsection id="idf6fa471c-a35f-4731-8e6a-ccef91188aff"><enum>(f)</enum><header>Interagency duties</header><text>The Director, in consultation with the Council, shall direct, coordinate, and assist agencies in—</text><paragraph id="idd36f2810-6b5b-4722-b237-f18374ba8c8a"><enum>(1)</enum><text>designing and implementing common data standards under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/64">chapter 64</external-xref> of title 31, United States Code;</text></paragraph><paragraph id="idf39ee7ac-bf95-45c5-9e5b-b188359b0d18"><enum>(2)</enum><text>creating guidelines for simplified notice of funding opportunities that improve the user experience for grants and cooperative agreements;</text></paragraph><paragraph id="id18d677a5-c025-4d62-9f83-9317f90a024f"><enum>(3)</enum><text>improving interagency and intergovernmental coordination of information collection and data sharing relating to grant and cooperative agreement programs, including for the purpose of performance management and program evaluation;</text></paragraph><paragraph id="idf712ae59-9f23-4a29-a858-40f079d7e6de"><enum>(4)</enum><text>improving the timeliness, completeness, and quality of information received by agencies from recipients of grants and cooperative agreements;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb928029d0fb42ceb742985013640d15"><enum>(5)</enum><text>improving the performance of grants and cooperative agreements;</text></paragraph><paragraph id="id62e1edcd-d036-4d07-94fb-85a5d13ffd29"><enum>(6)</enum><text>ensuring the consistent application and interpretation of Governmentwide Federal financial assistance policy, oversight, and management;</text></paragraph><paragraph id="id25d60271-4238-44db-9d13-15e9d5666a93"><enum>(7)</enum><text>supporting the development of the Federal financial assistance workforce;</text></paragraph><paragraph id="id1b0c22b177c44eb3a529e6a7f0d74ecc"><enum>(8)</enum><text>establishing policies and guidelines to prohibit conflicts of interest by officials involved in determining grant awards and grant recipients; and</text></paragraph><paragraph id="idbd6059b1-c2d7-4d6a-a10a-30323d5f9271"><enum>(9)</enum><text>identifying and improving other procedures and policies relating to the application, administration, and reporting of grants and cooperative agreements, as identified by the Council.</text></paragraph></subsection><subsection id="id91a33c43-d3bf-4fe7-839c-9060198f2af2"><enum>(g)</enum><header>Report on improvements</header><text>Not later than 1 year after the date of enactment of this Act, and every 2 years thereafter until the date that is 15 years after the date of enactment of this Act, the Director, in consultation with the Council, shall submit to the appropriate congressional committees a report relating to the implementation of this Act.</text></subsection><subsection id="id889a7976-3356-47be-935c-26783d790b18"><enum>(h)</enum><header>Report on recommended changes in law and regulations</header><text>Not later than 4 years after the date of enactment of this Act, the Director, in consultation with the Council, shall submit to the appropriate congressional committees a report containing recommendations for changes in law and regulations to improve the effectiveness, performance, and coordination of grant and cooperative agreement programs.</text></subsection></section><section id="id7ee28ae2-7b4b-4dc2-b3ae-0b1bf9228368" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>6.</enum><header>Agency grant improvement plans</header><subsection id="id49373232-d593-4f8e-8e8f-5c3bdb148315"><enum>(a)</enum><header>Agency guidance</header><text>Not later than 270 days after the date of enactment of this Act, the Director, in consultation with the Council, shall issue guidance for the development of agency plans to—</text><paragraph id="idb98e244b-778b-4a86-9c0a-e8e558a3b0ae"><enum>(1)</enum><text>streamline and simplify the application, administrative, and reporting procedures for each grant and cooperative agreement program administered by the agency;</text></paragraph><paragraph id="id66f78ea0-85bf-418d-96fd-bc306a2e5c60"><enum>(2)</enum><text>simplify and improve user experience with respect to notices of funding opportunity, including by implementing—</text><subparagraph id="id63c7e221-eb16-499a-8a53-92b1d6df16bc"><enum>(A)</enum><text>the use of plain language;</text></subparagraph><subparagraph id="idcca38051-e6c9-4e6f-9097-7ec6b8f27b63"><enum>(B)</enum><text>the listing of the availability of, and contact information for, training and assistance relating to applying for, administering, and reporting on grants and cooperative agreements; and</text></subparagraph><subparagraph id="idb5082577-256e-4e86-bd24-353d25e3fea6"><enum>(C)</enum><text>the inclusion of a summary of the funding opportunity of not more than 500 words;</text></subparagraph></paragraph><paragraph id="id44bb5b66-88b7-4f96-abb8-5d60ce93404d"><enum>(3)</enum><text>demonstrate active participation by the agency in the Council;</text></paragraph><paragraph id="id0b7b17db-dcd4-4297-9f91-f214a36399bf"><enum>(4)</enum><text>demonstrate appropriate coordination with the Grants Quality Service Management Office, or any successor organization, with respect to the adoption by the agency, or plans for adoption by the agency, of grant management solutions or services that meet usability and modernization standards established by the Director;</text></paragraph><paragraph id="id7838273b-a90a-46c7-97bf-13c7ebd1ad59"><enum>(5)</enum><text>ensure potential applicants for grant and cooperative agreement programs have opportunities to receive training and assistance;</text></paragraph><paragraph id="id7199ee5c-89e7-4dea-9b5e-8aa2b37644f9"><enum>(6)</enum><text>improve the abilities of recipients of grants and cooperative agreements to provide timely, complete, and high-quality information in response to Federal reporting requirements;</text></paragraph><paragraph id="id73420d8af2e3428ebe722400be4abb10"><enum>(7)</enum><text>ensure that individuals with limited English proficiency can meaningfully access information relating to grants and cooperative agreements consistent with, and without unduly burdening, the mission of the agency;</text></paragraph><paragraph id="ida8c8101a624e44f8902dd57d4de8b630"><enum>(8)</enum><text>improve the abilities of recipients of grants and cooperative agreements to provide meaningful access to applicants and beneficiaries of the grants and cooperative agreements who are individuals with limited English proficiency; and </text></paragraph><paragraph id="idcf4696ba-fc66-4a58-9e33-b9bb59ba94ed"><enum>(9)</enum><text>establish specific annual goals and objectives to further the purposes of this Act and measure annual performance in achieving those goals and objectives.</text></paragraph></subsection><subsection id="ide2291d0b-3749-4409-9a0f-3f0d6b68387e"><enum>(b)</enum><header>Review of plans and reports</header><text>Upon request by the Director, the head of each agency shall submit to the Director information and reporting relating to the implementation of this Act by the agency.</text></subsection><subsection id="idb0d484ec-4ec2-4229-8624-286658681b45"><enum>(c)</enum><header>Exemptions</header><paragraph id="id68b55a50-8e45-4ac9-aed7-db08d9035e06"><enum>(1)</enum><header>In general</header><text>The Director may exempt an agency, a component of an agency, or a particular grant or cooperative agreement program of an agency from the requirements of this Act if the Director determines that the agency does not administer a significant number of grant and cooperative agreement programs.</text></paragraph><paragraph id="idff204962-e062-4179-9b07-e038d1c83136"><enum>(2)</enum><header>List of exempted agencies</header><text>The Director shall—</text><subparagraph id="id44dfb802-2cc1-489f-a50c-68e3ed3a73c4"><enum>(A)</enum><text>maintain a list of agencies, components of agencies, and grant and cooperative agreement programs exempted under paragraph (1); and</text></subparagraph><subparagraph id="id356cca36-e6dd-4130-bc61-3cdaccecf42c"><enum>(B)</enum><text>make the list maintained under subparagraph (A) available to the public on the website of the Office of Management and Budget.</text></subparagraph></paragraph></subsection><subsection id="idebac336b-53f8-401e-9d19-d78959f6f7a4"><enum>(d)</enum><header>Agency plans</header><text>Subject to subsection (e), not later than the earlier of 1 year after the date on which the Director issues guidance under subsection (a) and 635 days after the date of enactment of this Act, the head of each agency shall develop, implement, and submit to the Director and the appropriate congressional committees a plan in response to the guidance.</text></subsection><subsection id="id492f1185-7007-423a-aa97-d46e4e20f5b8"><enum>(e)</enum><header>Extension</header><text>If the head of an agency is unable to comply with the deadline established under subsection (d) to develop and implement a plan, the Director may extend the period during which the agency may develop and implement the plan by not more than 1 year.</text></subsection><subsection id="id233da962-47ad-4065-9c19-a70b06fa73cb"><enum>(f)</enum><header>Comment and consultation on agency plans</header><paragraph id="id6e7a4b44-0676-4548-937c-2d89d8fcb9a2"><enum>(1)</enum><header>Comment</header><subparagraph id="idb982f4ce-0da7-4392-a57c-ed5d196a7a95"><enum>(A)</enum><header>In general</header><text>The head of each agency shall publish the plan developed in accordance with the guidance issued under subsection (a) in the Federal Register.</text></subparagraph><subparagraph id="id374c7ca8-fd78-4ef4-b807-e8fe616294d0"><enum>(B)</enum><header>Public comment</header><text>With respect to a plan published in the Federal Register by the head of an agency in accordance with subparagraph (A)—</text><clause id="idb47593cb-48e6-4bb9-9a36-1459cad47741"><enum>(i)</enum><text>the head of the agency shall review public comments on the plan submitted through the Federal Register and by other means; and</text></clause><clause id="id2457398f-2263-4edf-9100-860d2a789197"><enum>(ii)</enum><text>to the maximum extent practicable, the head of the agency shall hold a public forum on the plan.</text></clause></subparagraph></paragraph><paragraph id="idfe67b9b5-793c-4b3f-bb9c-2099a88ad79e"><enum>(2)</enum><header>Consultation</header><text>The senior agency official for grants of each agency shall participate in consultation with non-Federal entities during the development and implementation of the plan developed in accordance with the guidance issued under subsection (a).</text></paragraph></subsection><subsection id="id88c14dad-2403-4a8c-aeea-7a68fabe4607"><enum>(g)</enum><header>Annual report</header><paragraph id="idc83f5882-81de-46c9-965a-6f472963c25b"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the submission of the plan of an agency under subsection (d), and annually thereafter, the senior agency official for grants of the agency or the head of the agency, as applicable, shall submit to the Director and the appropriate congressional committees a report on—</text><subparagraph id="id2ab01856-57d0-479e-abd6-e6ce86fd00b4"><enum>(A)</enum><text>the implementation of the plan; and</text></subparagraph><subparagraph id="id144de3c9-eeee-4d9f-9489-4eda3a046b3f"><enum>(B)</enum><text>the performance of the agency in meeting the goals and objectives described in subsection (a)(9).</text></subparagraph></paragraph><paragraph id="idf04a5a6a-4527-4745-b727-d7f57daa4676"><enum>(2)</enum><header>Inclusion in other reports</header><text>Effective on the date on which the head of an agency submits a plan under subsection (d), the head of the agency shall update and include the goals and objectives described in subsection (a)(9) in each performance plan of the agency required under section 1115 of title 31, United States Code.</text></paragraph></subsection></section><section id="id8129e6c2-3cf1-49cc-ad08-9af13ee71929" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>7.</enum><header>Grants.gov</header><subsection id="id15d1911f-f85a-4849-ad16-e42a43b022e5"><enum>(a)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Director, in coordination with the Secretary of Health and Human Services, shall submit to the appropriate congressional committees a report that—</text><paragraph id="idd05a2b02-654a-4390-8193-a7f1cebb1ddb"><enum>(1)</enum><text>contains findings from a study on the accessibility and user experience of Grants.gov, or any successor website; and</text></paragraph><paragraph id="id03a891f6-782a-4940-844e-adce80194993"><enum>(2)</enum><text>provides recommendations based on the findings described in paragraph (1) to improve the access to the function of Grants.gov, or any successor website.</text></paragraph></subsection><subsection id="ida7d54389-9ed7-46d8-9ba6-29fc2e3d717f"><enum>(b)</enum><header>Improvements</header><text>Not later than 3 years after the date of enactment of this Act, the Director, in coordination with the Secretary of Health and Human Services, shall implement the recommendations described in subsection (a)(2).</text></subsection></section><section id="idcc0b7ada308b4d448954f52ff35f2391" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>8.</enum><header>Analysis of access to Federal grants</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="id7a70ed1f45594b459fdb21be798bb475"><enum>(1)</enum><text display-inline="yes-display-inline">identifies challenges experienced by non-Federal entities, including by faith-based and community-based organizations, rural communities, and small communities, in applying for, accessing, administering, and reporting on grants and cooperative agreements;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe28ce7c925a435ea749284df40ef9b8"><enum>(2)</enum><text display-inline="yes-display-inline">identifies the reasons that the entities described in paragraph (1) elect not to participate in grants and cooperative agreements;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21066fe7656f4c6480546dc71dc609e8"><enum>(3)</enum><text display-inline="yes-display-inline">includes options to improve access to grants and cooperative agreements for the entities described in paragraph (1);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e15fa79edba4e399af7ff49b2b59e3c"><enum>(4)</enum><text display-inline="yes-display-inline">analyzes the extent to which agencies that award grants collect information on the number and characteristics, including the geographic distribution, of applicants for competitive grants and cooperative agreements; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1dc7a1677984a7d95b3ea9ee0cc2340"><enum>(5)</enum><text display-inline="yes-display-inline">if the information described in paragraph (4) is available, analyzes the information. </text></paragraph></section><section id="id2de5abf9-d408-45fa-b24a-b1cab77d2ea2" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>9.</enum><header>Evaluation</header><subsection id="ida59f0c8b-fc9a-4d0e-8377-b66066ed1b66"><enum>(a)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States, in consultation with non-Federal entities, shall submit to the appropriate congressional committees an evaluation of the effectiveness of this Act.</text></subsection><subsection id="ideb66752b-5399-47b8-84b1-c70e53f91fb9"><enum>(b)</enum><header>Contents</header><text>The evaluation under subsection (a) shall—</text><paragraph id="ida6f561ff-2610-4e45-848f-f2c40b948c81"><enum>(1)</enum><text>assess the implementation of this Act and the extent to which the implementation meets the purposes of this Act;</text></paragraph><paragraph id="idf3aff440-932c-48e8-908a-5430e776a8b8"><enum>(2)</enum><text>make specific recommendations to further the implementation of this Act;</text></paragraph><paragraph id="ide0816cd0-31f7-4b09-b433-600f32dbd75a"><enum>(3)</enum><text>evaluate the actual performance of each agency in achieving the goals and objectives stated in the plan of the agency developed in accordance with the guidance issued under section 6(a); and</text></paragraph><paragraph id="id14fa2160-9f47-40d6-8b96-bc94caf70273"><enum>(4)</enum><text>assess the level of coordination among the Director and non-Federal entities in implementing this Act.</text></paragraph></subsection></section></legis-body><endorsement><action-date>December 11, 2023</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
