<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 2228</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 to clarify the scope of a major Federal action under the National Environmental Policy Act of 1969 with respect to certain projects relating to the production of semiconductors, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="idc1ddfdc3f61f43e2b1d7108289e2b0b4" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building Chips in America Act of 2023</short-title></quote>.</text></section><section id="id9BA5FFBA7A014DAEA3D24C43C428C656" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Semiconductor program</header><text display-inline="no-display-inline">Title XCIX of division H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651 et seq.</external-xref>) is amended— </text><paragraph commented="no" display-inline="no-display-inline" id="id0158cb37b7034540a2748067db1d7746"><enum>(1)</enum><text display-inline="yes-display-inline">in section 9902 (<external-xref legal-doc="usc" parsable-cite="usc/15/4652">15 U.S.C. 4652</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf8ed752598054b8d994cbeb3cb83f88a"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsections (h) and (i) as subsections (i) and (j), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf27a48b21e1c43329bd5bc117a5cee0c"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4A48079AC944AEC8283FB2CC5D1EDD1"><subsection id="idd594e6951a8a4fb3a2a25ae55e195387" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Authority relating to environmental review</header><paragraph id="id5440570f025442d9a346871fb9e5a519" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the provision by the Secretary of Federal financial assistance for a project described in this section that satisfies the requirements under subsection (a)(2)(C)(i) of this section shall not be considered to be a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) (referred to in this subsection as <quote>NEPA</quote>) or an undertaking for the purposes of division A of subtitle III of title 54, United States Code, if—</text><subparagraph id="id2b92441420a644c2859d56568010cb31" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the activity described in the application for that project has commenced not later than December 31, 2024;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50029131fbfd4521be4c022554dc86aa"><enum>(B)</enum><text display-inline="yes-display-inline">the Federal financial assistance provided is in the form of a loan or loan guarantee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc620e17f1ce44f7abd9d09cab79b3514"><enum>(C)</enum><text display-inline="yes-display-inline">the Federal financial assistance provided, excluding any loan or loan guarantee, comprises not more than 10 percent of the total estimated cost of the project.</text></subparagraph></paragraph><paragraph id="idf9e2e45d8fa941809908a8108b4ad926" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Savings clause</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed as altering whether an activity described in subparagraph (A), (B), or (C) of paragraph (1) is considered to be a major Federal action under NEPA, or an undertaking under division A of subtitle III of title 54, United States Code, for a reason other than that the activity is eligible for Federal financial assistance provided under this section.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36f567e2c99c459087b663cc558a132f"><enum>(2)</enum><text display-inline="yes-display-inline">in section 9909 (<external-xref legal-doc="usc" parsable-cite="usc/15/4659">15 U.S.C. 4659</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67456e4c6b684147be6ec4addff3390c"><subsection commented="no" display-inline="no-display-inline" id="idf38172a1a26d480494cb1c6dfc6f3a8e"><enum>(c)</enum><header display-inline="yes-display-inline">Lead Federal agency and cooperating agencies</header><paragraph commented="no" display-inline="no-display-inline" id="id398cd765ab9844af82b8393c283b6761"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>lead agency</term> has the meaning given the term in section 111 of NEPA (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac1ecb2ba5984808bc4fc01a4fa23c92"><enum>(2)</enum><header display-inline="yes-display-inline">Option to serve as lead agency</header><text display-inline="yes-display-inline">With respect to a covered activity that is a major Federal action under NEPA, and with respect to which the Department of Commerce is authorized or required by law to issue an authorization or take action for or relating to that covered activity, the Department of Commerce shall have the first right to serve as the lead agency with respect to that covered activity under NEPA.</text></paragraph></subsection><subsection id="id2c1b75cde5944f619ee09a8373c05c36" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Categorical exclusions</header><paragraph commented="no" display-inline="no-display-inline" id="id90339d6cf27547d6a92e55512df68fe4"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of categorical exclusions</header><text display-inline="yes-display-inline">Each of the following categorical exclusions is established for the National Institute of Standards and Technology with respect to a covered activity and, beginning on the date of enactment of this subsection, is available for use by the Secretary with respect to a covered activity:</text><subparagraph commented="no" display-inline="no-display-inline" id="id7ab0a56dc3114f558e1dac7e43d2b1ef"><enum>(A)</enum><text display-inline="yes-display-inline">Categorical exclusion 17.04.d (relating to the acquisition of machinery and equipment) in the document entitled <quote>EDA Program to Implement the National Environmental Policy Act of 1969 and Other Federal Environmental Mandates As Required</quote> (Directive No. 17.02–2; effective date October 14, 1992).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb34ab3424ea34931bb2094060d46310f"><enum>(B)</enum><text display-inline="yes-display-inline">Categorical exclusion A9 in Appendix A to subpart D of part 1021 of title 10, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbc9cb25099c4f0ca8ce1392afdf8ab0"><enum>(C)</enum><text display-inline="yes-display-inline">Categorical exclusions B1.24, B1.31, B2.5, and B5.1 in Appendix B to subpart D of part 1021 of title 10, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63bc1b5a0478430f8656227e0ceed603"><enum>(D)</enum><text display-inline="yes-display-inline">The categorical exclusions described in paragraphs (4) and (13) of section 50.19(b) of title 24, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb3e74707ba34d28a713a4e6538f7455"><enum>(E)</enum><text display-inline="yes-display-inline">Categorical exclusion (c)(1) in Appendix B to part 651 of title 32, Code of Federal Regulations, or any successor regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddb49c0b122234b87bb6200e2355f0bab"><enum>(F)</enum><text display-inline="yes-display-inline">Categorical exclusions A2.3.8 and A2.3.14 in Appendix B to part 989 of title 32, Code of Federal Regulations, or any successor regulation. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38382465e7ba4d22bf5d6d9282d6c84b"><enum>(2)</enum><header display-inline="yes-display-inline">Additional categorical exclusions</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, each of the following shall be treated as a category of action categorically excluded from the requirements relating to environmental assessments and environmental impact statements under section 1501.4 of title 40, Code of Federal Regulations, or any successor regulation:</text><subparagraph commented="no" display-inline="no-display-inline" id="id92d3c5ecb0d241b7a63f2c27166a9031"><enum>(A)</enum><text display-inline="yes-display-inline">The provision by the Secretary of any Federal financial assistance for a project described in section 9902, if the facility that is the subject of the project is on or adjacent to a site—</text><clause commented="no" display-inline="no-display-inline" id="idca387081d28f4af99c02fd6d88bb3c90"><enum>(i)</enum><text display-inline="yes-display-inline">that is owned or leased by the covered entity to which Federal financial assistance is provided for that project; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idae059b4fae344e5c8ae72496c0024f53"><enum>(ii)</enum><text display-inline="yes-display-inline">on which, as of the date on which the Secretary provides that Federal financial assistance, substantially similar construction, expansion, or modernization is being or has been carried out, such that the facility would not more than double existing developed acreage or on-site supporting infrastructure.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26349786bd1b4a57a2340e568297abe6"><enum>(B)</enum><text display-inline="yes-display-inline">The provision by the Secretary of Defense of any Federal financial assistance relating to—</text><clause commented="no" display-inline="no-display-inline" id="ida8900494f5734dddbb8013ef5acc9cbb"><enum>(i)</enum><text display-inline="yes-display-inline">the creation, expansion, or modernization of one or more facilities described in the second sentence of section 9903(a)(1); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id16c3e5d34a164b86a7547079b91808f6"><enum>(ii)</enum><text display-inline="yes-display-inline">carrying out section 9903(b), as in effect on the date of enactment of this subsection.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d075fbe0cbd443189a18b908f074d1d"><enum>(C)</enum><text display-inline="yes-display-inline">Any activity undertaken by the Secretary relating to carrying out section 9906, as in effect on the date of enactment of this subsection.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id66fd97d808614693926f617dab67d58e"><enum>(e)</enum><header display-inline="yes-display-inline">Incorporation of prior planning decisions</header><paragraph commented="no" display-inline="no-display-inline" id="idf2bf7cf92cec4d648dd3b73398687b49"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>prior studies and decisions</term> means baseline data, planning documents, studies, analyses, decisions, and documentation that a Federal agency has completed for a project (or that have been completed under the laws and procedures of a State or Indian Tribe), including for determining the reasonable range of alternatives for that project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ebff5bb9410420dbddb38b87a071640"><enum>(2)</enum><header display-inline="yes-display-inline">Reliance on prior studies and decisions</header><text display-inline="yes-display-inline">In completing an environmental review under NEPA for a covered activity, the Secretary may consider and, as appropriate, rely on or adopt prior studies and decisions, if the Secretary determines that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd96497f530cb48ffa0ada17407d871d9"><enum>(A)</enum><text display-inline="yes-display-inline">those prior studies and decisions meet the standards for an adequate statement, assessment, or determination under applicable procedures of the Department of Commerce implementing the requirements of NEPA;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5ade363fc9147969deb1c2925d19a70"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of prior studies and decisions completed under the laws and procedures of a State or Indian Tribe, those laws and procedures are of equal or greater rigor than those of each applicable Federal law, including NEPA, implementing procedures of the Department of Commerce; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4af2f9d635644a55a08ee28ef9c650c8"><enum>(C)</enum><text display-inline="yes-display-inline">if applicable, the prior studies and decisions are informed by other analysis or documentation that would have been prepared if the prior studies and decisions were prepared by the Secretary under NEPA.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4945cd4818794251bd8b9e581cf392d5"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id49e00b131896434cba3234fc73c6b960"><enum>(1)</enum><header display-inline="yes-display-inline">Covered activity</header><text display-inline="yes-display-inline">The term <term>covered activity</term> means any activity relating to the construction, expansion, or modernization of a facility, the investment in which is eligible for Federal financial assistance under section 9902 or 9906.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01f3ecb2558149998c02e97ffa27b327"><enum>(2)</enum><header display-inline="yes-display-inline">NEPA</header><text display-inline="yes-display-inline">The term <term>NEPA</term> means the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20231214" chamber="Senate">Passed the Senate December 14, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
