which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of the Interior and the Secretary of Agriculture to carry out activities to control the movement of aquatic invasive species into, across, and out of Federal land and waters, to provide for financial assistance from the Commissioner of Reclamation to Reclamation States for watercraft inspection and decontamination stations, to amend the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 to make certain technical corrections, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Spread of Invasive Mussels Act of 2023</short-title></quote>.</text></section><section id="id6775178fbd324dc0be860d618b148c15"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id09000687e2544cb893606c48846ce04d"><enum>(1)</enum><header>Aquatic Nuisance Species Task Force</header><text>The term <term>Aquatic Nuisance Species Task Force</term> means the Aquatic Nuisance Species Task Force established by section 1201(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721(a)</external-xref>).</text></paragraph><paragraph id="idb575c1935de8400bbc3ee2e7907d37c8"><enum>(2)</enum><header>Federal land and water</header><text>The term <term>Federal land and water</term> means Federal land and water operated and maintained by the Bureau of Land Management, the Bureau of Reclamation, the National Park Service, or the Forest Service, as applicable.</text></paragraph><paragraph id="idb0f4ac68b27d45878bdbd30ac62c71ed"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id12bfab3bdf8840d98d5fca52daeee365"><enum>(4)</enum><header>Inspection</header><text>The term <term>inspection</term> means an inspection to prevent and respond to biological invasions of an aquatic ecosystem.</text></paragraph><paragraph id="id454aebc8aef94dd09fbb1c5ce513719c"><enum>(5)</enum><header>Partner</header><text>The term <term>partner</term> means—</text><subparagraph id="idD7081CC61E634CEAA2728A53AB7F1927"><enum>(A)</enum><text>a Reclamation State;</text></subparagraph><subparagraph id="idB476F8697089415B84313BBCFD9FFC01"><enum>(B)</enum><text>an Indian Tribe in a Reclamation State;</text></subparagraph><subparagraph id="id9B4D914B29BA42A587F02788174D2D59"><enum>(C)</enum><text>an applicable nonprofit organization in a Reclamation State; or</text></subparagraph><subparagraph id="id5DFD8C3B1002468BA564E577DAAE2B58"><enum>(D)</enum><text>a unit of local government in a Reclamation State.</text></subparagraph></paragraph><paragraph id="id4398e78442094200b16ae81c7100c3cd"><enum>(6)</enum><header>Reclamation State</header><subparagraph id="ide977488da0ac435496dc62e8170bc2b1"><enum>(A)</enum><header>In general</header><text>The term <term>Reclamation State</term> means any State in which a Bureau of Reclamation reservoir is located.</text></subparagraph><subparagraph id="idfb10be0a053a4ef0b3ac49e23f80b07a"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Reclamation State</term> includes any of the States of—</text><clause id="id20961f1dc7c04bb8bd083f19995e0cd0"><enum>(i)</enum><text>Alaska;</text></clause><clause id="id2b4474a645134b3a97dc85ad79aa94d3"><enum>(ii)</enum><text>Arizona;</text></clause><clause id="id71459d5f362b4fdfb5400c7d6ef2786e"><enum>(iii)</enum><text>California;</text></clause><clause id="id54ab2bf67c8345e18f2bbc4abc5dc6b5"><enum>(iv)</enum><text>Colorado;</text></clause><clause id="ide3c748bf5be64041a1103f4af2985926"><enum>(v)</enum><text>Idaho;</text></clause><clause id="idbe3c4964ffa9462b86099fd0fdaee1ff"><enum>(vi)</enum><text>Kansas;</text></clause><clause id="id97cb08dc18b0453b8de4956e90d79dbd"><enum>(vii)</enum><text>Montana;</text></clause><clause id="id567a692b8e5245ad95ce0081501f22d2"><enum>(viii)</enum><text>Nebraska;</text></clause><clause id="id75e3292b0f7146b1b0376b7083519144"><enum>(ix)</enum><text>Nevada;</text></clause><clause id="id055fd2c5ed784bc789aa54075b976fa2"><enum>(x)</enum><text>New Mexico;</text></clause><clause id="idd5f1f5680d3c479bbd6223e931f147f7"><enum>(xi)</enum><text>North Dakota;</text></clause><clause id="id573a48b1683c48d2a48127e822dab6ad"><enum>(xii)</enum><text>Oklahoma;</text></clause><clause id="id4137a2f0823543789347d781bf834c25"><enum>(xiii)</enum><text>Oregon;</text></clause><clause id="id2a42d157cb0b4e0ea3eb05e31a0e72ee"><enum>(xiv)</enum><text>South Dakota;</text></clause><clause id="ide0f1ab2396ed4217b9122404a73231bf"><enum>(xv)</enum><text>Texas;</text></clause><clause id="id52e92a5f1fa1410db0ef33cae00b75b9"><enum>(xvi)</enum><text>Utah;</text></clause><clause id="ide34b4774cb4646efbf0641eb2e853c84"><enum>(xvii)</enum><text>Washington; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id27322eede5474bc8b7795889bad6e2f6"><enum>(xviii)</enum><text>Wyoming. </text></clause></subparagraph></paragraph><paragraph id="id4790727e0ab84a0b8c2df6737ef3c04f"><enum>(7)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text><subparagraph id="id3ba923dd7b07436d8e6e609195db9da8"><enum>(A)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management, the Commissioner of Reclamation, and the Director of the National Park Service; and</text></subparagraph><subparagraph id="ide461a06ebd5142719ed8eecafbde7ef0"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service. </text></subparagraph></paragraph></section><section id="id05807bccf6f64c1db4c5df8c6285e9b0"><enum>3.</enum><header>Federal land and aquatic resource activities assistance</header><subsection id="idf3ed9ead5edf435da77e7e223a89c11a"><enum>(a)</enum><header>Authority of Bureau of Land Management, Bureau of Reclamation, National Park Service, and Forest Service with respect to certain aquatic resource activities on Federal land and water</header><paragraph id="id7d24cd27379549b29666fc29eeb9a24a"><enum>(1)</enum><header>In general</header><text>The Secretaries may inspect and decontaminate watercraft entering and leaving Federal land and water located within a river basin that contains a Bureau of Reclamation water project.</text></paragraph><paragraph id="ida3c29a7116934f798e52c085237b14a4"><enum>(2)</enum><header>Requirements</header><text>The Secretaries shall—</text><subparagraph id="id9142051c39dd42cfb9706f053905153b"><enum>(A)</enum><text>in carrying out an inspection under paragraph (1), coordinate with 1 or more partners; </text></subparagraph><subparagraph id="id9673e8b9a00844db86f47047183f2642"><enum>(B)</enum><text>consult with the Aquatic Nuisance Species Task Force to identify potential improvements in the detection and management of invasive species on Federal land and water; and</text></subparagraph><subparagraph id="idf770d0bc30d940e2aebcd341b17864ab"><enum>(C)</enum><text>to the maximum extent practicable, inspect watercraft in a manner that minimizes disruptions to public access for boating and recreation in noncontaminated watercraft. </text></subparagraph></paragraph><paragraph id="id053bd2facc3948e6998ddd2bafc32ee5"><enum>(3)</enum><header>Partnerships</header><text>The Secretaries may enter into a partnership to provide technical assistance to a partner—</text><subparagraph id="idacebd5d9ab714072b67ae5dc327bf571"><enum>(A)</enum><text>to carry out an inspection or decontamination of watercraft; or</text></subparagraph><subparagraph id="idcaabf277a6c8493e98ab89f6c125c0d5"><enum>(B)</enum><text>to establish an inspection and decontamination station for watercraft.</text></subparagraph></paragraph><paragraph id="id7b6a7106a1df4f558cd75b8b22b74372"><enum>(4)</enum><header>Data sharing</header><text>The Secretaries shall make available to a Reclamation State any data gathered relating to inspections carried out in the Reclamation State under this subsection. </text></paragraph></subsection><subsection id="id7531778a5cca42a7bdd3554cc2600a38"><enum>(b)</enum><header>Grant program for reclamation states for watercraft inspection and decontamination stations</header><paragraph id="id178f1388e77f4c349785af798d699346"><enum>(1)</enum><header>Watercraft inspection in Reclamation States</header><text>Subject to the availability of appropriations, the Secretary of the Interior, acting through the Commissioner of Reclamation (referred to in this subsection as the <quote>Secretary</quote>), shall establish a competitive grant program to provide grants to partners to conduct inspections and decontamination of watercraft in reservoirs operated and maintained by the Secretary, including to purchase, establish, operate, or maintain a watercraft inspection and decontamination station.</text></paragraph><paragraph id="id17d038d2a07d4d0f9b5a63efd81dfbce"><enum>(2)</enum><header>Cost share</header><text>The Federal share of the cost of a grant under paragraph (1), including personnel costs, shall not exceed 75 percent.</text></paragraph><paragraph id="id8a37672201e24247bca7b92a2098558e"><enum>(3)</enum><header>Standards</header><text>Before awarding a grant under paragraph (1), the Secretary shall determine that the project is technically and financially feasible.</text></paragraph><paragraph id="ida53a98998d3947f2b31f269df9aa500c"><enum>(4)</enum><header>Coordination</header><text>In carrying out this subsection, the Secretary shall coordinate with—</text><subparagraph id="id040c051ca6d4479580b828cefbbc7a79"><enum>(A)</enum><text>each of the Reclamation States;</text></subparagraph><subparagraph id="idcba48a415e5d4b91bad4b155d20b9924"><enum>(B)</enum><text>affected Indian Tribes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0112c49103eb49a4839e19b2ec4e6bcd"><enum>(C)</enum><text>the Aquatic Nuisance Species Task Force.</text></subparagraph></paragraph></subsection><subsection id="id05efee86df61404a82c6c3e7252d8090"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for fiscal year 2024 and each fiscal year thereafter. </text></subsection></section><section id="id473e8705df2446daaf44ab94ff70cd30"><enum>4.</enum><header>Technical corrections to the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990</header><subsection id="id0680E5FA15BF49758A3FB9C1942FAF5A"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 1002(b) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4701">16 U.S.C. 4701(b)</external-xref>) is amended—</text><paragraph id="id073718477D0E4C218F6204086B6C2606"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="id09ACC404AD3A4AAC8F26F4BCDA2D2B3C"><enum>(A)</enum><text>by inserting a comma after <quote>prevention</quote>; and</text></subparagraph><subparagraph id="id71EAAD347D15493BA5420E12BC04B410"><enum>(B)</enum><text>by inserting a comma after <quote>dissemination</quote>; and</text></subparagraph></paragraph><paragraph id="id78E7D9DCD0F7433EA056C45FE8D43073"><enum>(2)</enum><text>in paragraph (3), by inserting a comma after <quote>monitor</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3efb367f6feb4237b42785a91e54dc59"><enum>(b)</enum><header>Prevention of Unintentional Introductions</header><text>Section 1301(a)(2) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4741">16 U.S.C. 4741(a)(2)</external-xref>) is amended by striking <quote>1102(a)(2</quote> and inserting <quote>1102(a)(2)</quote>. </text></subsection></section></legis-body></bill>
