which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce to establish the Sea Turtle Rescue Assistance Grant Program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H32F50287D0A741A4B5D8BE2D6EE79DA4"><section section-type="section-one" id="H1975A8630FAF475386141D6EFEBDE212"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sea Turtle Rescue Assistance Act of 2023</short-title></quote>. </text></section><section id="H0ACF6D07EC7342B3AE31C7DB99ED569A"><enum>2.</enum><header>Sea Turtle Rescue Assistance Grant program</header><subsection id="H9E8031C3614D43C1BCC71DE7BAC7C1FB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program to be known as the <quote>Sea Turtle Rescue Assistance Grant Program</quote>, to encourage and facilitate coordinated rapid response and rescue by awarding grants for the purposes described in subsection (c).</text></subsection><subsection id="H95E9DCFB5F904C1FA49211434293B9A9"><enum>(b)</enum><header>Designation of stranding regions</header><text>The Secretary shall designate geographic regions of the United States as stranding regions for the purposes of carrying out this section.</text></subsection><subsection id="H3AB0742727D84FF28CB462B22BBA0866"><enum>(c)</enum><header>Purposes</header><text>The purposes of the Program are to provide for—</text><paragraph id="H8CDA928CBEB9436FB13D92DEB75F5A3C"><enum>(1)</enum><text>the recovery, short- or long-term care, transportation, and treatment of stranded marine turtles;</text></paragraph><paragraph id="id57db8c700b8b4e07946c364855f11c7d"><enum>(2)</enum><text>the release of rescued and recovered marine turtles;</text></paragraph><paragraph id="id1602e982e9824c458ab3a9fac52cf7d3"><enum>(3)</enum><text>the collection of data and samples, including tagging information, from stranded marine turtles for scientific research or assessments, or both, that inform the understanding of causes of mortality; and</text></paragraph><paragraph id="H1667313D4C84459797E2E7D679DAFEC4"><enum>(4)</enum><text>facility operation costs that are directly related to activities described in paragraphs (1), (2), and (3).</text></paragraph></subsection><subsection id="H9C9FE8C084FA4F0DB1CACE37D03BA691"><enum>(d)</enum><header>Equitable distribution of funds</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent practicable, that funds awarded under this section are distributed equitably among stranding regions, taking into account—</text><paragraph id="H35C350CF47AA40A89FEA71F534441215"><enum>(1)</enum><text>the number of strandings that occurred in each stranding region in the preceding 5 years;</text></paragraph><paragraph id="HC15A73731F564901A7AAB27E2B95186F"><enum>(2)</enum><text>region-specific factors that increase risks of strandings; and</text></paragraph><paragraph id="HB693B5EF849F4419AA697A026253E98D"><enum>(3)</enum><text>the conservation priorities and recovery needs of species of marine turtles that are threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id181df6b9b66e4a219f118964e12384ce"><enum>(e)</enum><header>Applications</header><paragraph id="id2ca7de1987c543b3861addec5f690b18"><enum>(1)</enum><header>In general</header><text>An applicant for a grant under this section that is an eligible applicant described in paragraph (2) shall submit an application in such form and manner as the Secretary shall prescribe.</text></paragraph><paragraph id="id00c19d078f424bfdbc2e064f3c50c9fc"><enum>(2)</enum><header>Eligible applicants</header><text>An entity is an eligible applicant if the entity is—</text><subparagraph id="idd50a4bd2f8f64eb6b0a8f4e8a8d86545"><enum>(A)</enum><text>a nonprofit member of the Sea Turtle Stranding and Salvage Network;</text></subparagraph><subparagraph id="id79678da909834664a6a68ce6d964afce"><enum>(B)</enum><text>an Indian Tribe;</text></subparagraph><subparagraph id="idcf373baa0c8045dd8d2f9d282ba51d55"><enum>(C)</enum><text>an institution of higher education; or</text></subparagraph><subparagraph id="id04a90b0a90404451b11ea2f33598b58d"><enum>(D)</enum><text>another public or private organization with an established record in the rescue, recovery, rehabilitation, transportation, or release of stranded marine turtles.</text></subparagraph></paragraph></subsection><subsection id="H15E64D68967A4D24952B585798618985"><enum>(f)</enum><header>Grant criteria</header><paragraph id="H3D49B3CD78EA4AD18ADA3ED11851BE47"><enum>(1)</enum><header>Development of criteria</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, develop criteria for awarding grants under this section and provide such criteria for formal public notice and comment. </text></paragraph><paragraph id="id8b962c1cc1f543c0bd43a0a01dd513cb"><enum>(2)</enum><header>Stakeholder engagement</header><text>As part of the process for developing and finalizing criteria under paragraph (1), the Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, provide opportunities for engagement with representatives from—</text><subparagraph commented="no" display-inline="no-display-inline" id="idea0505fa4f80484d9f476a4bcd7cd91d"><enum>(A)</enum><text display-inline="yes-display-inline">stranding regions; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcef9f77ef7ba4127b9ebafe84d38ae54"><enum>(B)</enum><text display-inline="yes-display-inline">Indian Tribes;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63e62a504776460eb7b0d0ae578f5849"><enum>(C)</enum><text display-inline="yes-display-inline">institutions of higher education; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id40c4d1682dd0449dadae122e56f43ca8"><enum>(D)</enum><text display-inline="yes-display-inline">public or private organizations with an established record in—</text><clause commented="no" display-inline="no-display-inline" id="idc50f9136c21241e1bbb2e2881659f995"><enum>(i)</enum><text display-inline="yes-display-inline">the rescue, recovery, rehabilitation, transportation, or release of stranded marine turtles; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id611ad536cffe4c41b45a2b1903bcc219"><enum>(ii)</enum><text display-inline="yes-display-inline">scientific research, marine conservation, or forensic science, with respect to stranded marine turtles.</text></clause></subparagraph></paragraph><paragraph id="id257574be9def44ac91247b648163f98f"><enum>(3)</enum><header>Required criteria</header><text>In developing criteria under paragraph (1), the Secretary shall prioritize awarding grants to applicants with an established record of rescuing, recovering, rehabilitating, transporting, or releasing stranded marine turtles or conducting scientific research pertinent to the causes of strandings.</text></paragraph></subsection><subsection id="idA0359E2CE99A4E398E7D0F5E45B46AA3"><enum>(g)</enum><header>Acceptance of donations</header><text>For the purposes of carrying out this section, the Secretary may solicit, accept, receive, hold, administer, and use gifts, devises, and bequests without any further approval or administrative action.</text></subsection><subsection id="idb7561303c463420db88b15fead69f118"><enum>(h)</enum><header>Liability waiver</header><paragraph commented="no" id="id80C8957ADE9343619541A8464DE25937"><enum>(1)</enum><header>In general</header><text>A person who is acting under the authority of an entity awarded a grant under this section is deemed to be an employee of the government for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, with respect to actions of the person that—</text><subparagraph id="idd6e9741ddcec4261b19eed14da2d0d06"><enum>(A)</enum><text>are in support of rescue, recovery, rehabilitation, transportation, or release efforts;</text></subparagraph><subparagraph commented="no" id="id5def1d699d8947c4a6498c88c81e7a13"><enum>(B)</enum><text>are in accordance with the purposes of subsection (c); and</text></subparagraph><subparagraph commented="no" id="id6349834ea10e43a9b3901ff760067663"><enum>(C)</enum><text>reflect sound professional judgment and are consistent with the directions of any on-site coordinator or incident commander.</text></subparagraph></paragraph><paragraph commented="no" id="id02511ee57bbd40d6a249e8734d6cc1e2"><enum>(2)</enum><header>Limitation</header><text>Paragraph (1) does not apply to actions of a person described in that paragraph that are grossly negligent or that constitute willful misconduct.</text></paragraph></subsection><subsection id="H05FB617592F64371B4126C7C634600D5"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out this section $5,000,000 for each of fiscal years 2024 through 2029 to remain available until expended.</text></subsection><subsection id="H814AFF0D7D50490EB0A212307D23B7BA"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd22a802e674940c784c7d3cf33426243"><enum>(1)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="ida6d6116a694f411c8edb9ccb779e1f41" commented="no"><enum>(2)</enum><header>Institution of higher education</header><subparagraph commented="no" display-inline="no-display-inline" id="id5cba32e93f9840d98ab3fa6e254fc5a7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> means an educational institution in any State, district, commonwealth, territory, or possession of the United States, which—</text><clause id="id454260abd5eb4eaaa711cffdf40fe8b6" commented="no"><enum>(i)</enum><text>admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate;</text></clause><clause id="id5ec0d24cf0ce4c0cb4fb240e59ae0b0e" commented="no"><enum>(ii)</enum><text>is legally authorized within such State, district, commonwealth, territory, or possession to provide a program of education beyond secondary education;</text></clause><clause id="id7231aaa814164679812f699c09fd3e0c" commented="no"><enum>(iii)</enum><text>provides an educational program for which a bachelor's degree or any other higher degree is awarded;</text></clause><clause id="ide2a5eba777d64bcf9ac1a635dd5cb1f2" commented="no"><enum>(iv)</enum><text>is a public or other nonprofit institution; and</text></clause><clause id="id0cb2b7b76d5d4c7bb0c7edc4855a6121" commented="no"><enum>(v)</enum><text>is accredited by a nationally recognized accrediting agency or association.</text></clause></subparagraph><subparagraph id="id481d6b5ac59144ac86a2a9f87b92a6d8"><enum>(B)</enum><header>Inclusions</header><text>The term <term>institution of higher education</term> includes a research foundation maintained by an institution of higher education described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="HF2F42F6D46704E14AD2B80949BF17CD7"><enum>(3)</enum><header>Marine turtle</header><text>The term <term>marine turtle</term> means any member of the family Cheloniidae or Dermochelyidae.</text></paragraph><paragraph id="HE7D21EC2ECA542F6BC9E661512BB05FC"><enum>(4)</enum><header>Program</header><text>The term <term>Program</term> means the Sea Turtle Rescue Assistance Grant Program established under subsection (a).</text></paragraph><paragraph id="H5D717AEBB71D457084E9205D63716F41"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="id8078fd8d9062440b920790c73cbce0cf"><enum>(6)</enum><header>Stranding</header><text>The term <term>stranding</term> means an event in which—</text><subparagraph id="id84986bc5c52d4266b1b15f19a7ad8d76"><enum>(A)</enum><text>a marine turtle is dead and is—</text><clause id="id3bbd0ce4ebce48a6ad4e34ed37a6ae1b"><enum>(i)</enum><text>on a beach or shore of the United States;</text></clause><clause id="id907c4275d3934d5a8220c6192c77017f"><enum>(ii)</enum><text>in State, district, commonwealth, territory, or possession, or Federal, waters of the United States; or </text></clause><clause id="idbbf52b0caee046ca9634f4237f4af2e1"><enum>(iii)</enum><text>outside of its natural habitat and is in the United States; or</text></clause></subparagraph><subparagraph id="id412b91c2d40045419bf9e71639afc6be"><enum>(B)</enum><text>a marine turtle is alive and is—</text><clause id="idae6c00ec8d184d248e4832358123bed0"><enum>(i)</enum><text>on a beach or shore of the United States and in need of medical attention or other necessary intervention to aid its likelihood of survival;</text></clause><clause id="id39eaf5d55d1243fa80ca95b0375364b5"><enum>(ii)</enum><text>in State, district, commonwealth, territory, or possession, or Federal, waters of the United States and in need of medical attention or other necessary intervention to aid its likelihood of survival; or</text></clause><clause id="ida0e2d6a0098d4ec38e1aebf632b20aee"><enum>(iii)</enum><text>outside of its natural habitat, is unable to return unassisted, and is in the United States.</text></clause></subparagraph></paragraph><paragraph id="HD51D63143D13486C9D396739F85043D2"><enum>(7)</enum><header>Stranding region</header><text>The term <term>stranding region</term> means a geographic region designated by the Secretary under subsection (b).</text></paragraph><paragraph id="id9248e157dea74a5ba2e7668a91ca57fd"><enum>(8)</enum><header>United States</header><text>The term <term>United States</term> means any land or water of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, and any other commonwealth, territory, or possession over which the United States has jurisdiction, including internal waters, State waters, the territorial sea, and the exclusive economic zone of the United States. </text></paragraph></subsection></section></legis-body></bill>
