which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize and improve the pilot program to support State medical stockpiles, to ensure that State, local, Tribal, and territorial public health departments or officials are consulted by the Public Health Emergency Medical Countermeasures Enterprise, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Strategic Stockpile Act of 2023</short-title></quote>.</text></section><section id="ida11837cb2f2a4dbb9c6d36b57c1e6c58"><enum>2.</enum><header>Pilot program to support State medical stockpiles</header><subsection commented="no" display-inline="no-display-inline" id="id63db2e09e451449c8949764388ec145f"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 319F–2(i) of the Public Health Service Act (42 U.S.C. 247d–6b(i)) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf06df698891f47d5bbaf44ef0cf93879"><enum>(1)</enum><text>in paragraph (2)(B)(i)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id28bdc5b77c4e4411aabdbc8d910b5884"><enum>(A)</enum><text>in subclause (I), by striking <quote>and 2024</quote> and inserting <quote>through 2025</quote>; and</text></subparagraph><subparagraph id="ide1b0f1d7622242b5b836a902ea7f8f31"><enum>(B)</enum><text>in subclause (II), by striking <quote>2025</quote> and inserting <quote>2026</quote>; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e77eacd2e6c4592a28a2294497684c0"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4)(H), by striking <quote>State efforts</quote> and inserting <quote>State or regional efforts</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide1a337342f4547e3b8be5332886486fa"><enum>(3)</enum><text>by redesignating paragraphs (5) through (9) as paragraphs (6) through (10), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d018b40438648d39061f018c1368828"><enum>(4)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id83FB57BE5EF74657B8D64901BED54D43"><paragraph id="id31c242249e364a1287432312affc6d11"><enum>(5)</enum><header>Coordination</header><text>An entity in receipt of an award under paragraph (1) shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="idc27a5d4e48d649e2adaca3da518d9250"><enum>(A)</enum><text display-inline="yes-display-inline">carry out activities under this section in coordination with health care entities, health officials, and emergency management officials within the jurisdiction of such State or States, as appropriate; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfab6f7576e6045e4a8e00a874fe41420"><enum>(B)</enum><text display-inline="yes-display-inline">identify opportunities to coordinate with other States in receipt of an award under paragraph (1) to facilitate the sharing of best practices between such States or with other States related to establishing and maintaining a stockpile of medical products.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ide7931e573db84257beedb6e813495085"><enum>(5)</enum><text>in paragraph (10), as so redesignated, by striking <quote>$3,500,000,000 for each of fiscal years 2023 and 2024</quote> and inserting <quote>such sums as may be necessary for each of fiscal years 2024 through 2028</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide03df67c445741a48b0bac35e26f483c"><enum>(b)</enum><header>GAO report</header><text>Section 2409(b) of the PREVENT Pandemics Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8ee163e2c67b4977b764fa3dc83dda41"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58f7f53f39a14bf18c238db793b5c465"><enum>(2)</enum><text>in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id060ec20c0eec459f84ccd6ed1c5e6150"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5F32139EB6F4454CB7899D599B889262"><paragraph id="id0f725fad9b0f4c459d2a0fabb78e5c8c"><enum>(4)</enum><text>the impact of any regional stockpiling approaches carried out under such subsection (i)(1) of section 319F–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6b">42 U.S.C. 247d–6b</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idf1af41f5e80a4d4d971707262acb1ccb"><enum>3.</enum><header>Public health emergency medical countermeasures enterprise</header><text display-inline="no-display-inline">Section 2811–1(c)(2) of the Public Health Service Act (42 U.S.C. 300hh–10a(c)(2)) is amended by striking <quote>, as appropriate</quote>.</text></section></legis-body></bill>
