<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 1809</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230606">June 6, 2023</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Department of Agriculture Reorganization Act of 1994 to establish an Office of Small Farms, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Office of Small Farms Establishment Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id11c9d7bccf274679a1421c12cae2eb55"><enum>2.</enum><header>Office of Small Farms</header><subsection commented="no" display-inline="no-display-inline" id="id97dd1f2b3e7d4b94a64afd0ebe3f6839"><enum>(a)</enum><header>In general</header><text>Subtitle B of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6931">7 U.S.C. 6931 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8BA85E9F270444F7BFDB654B71E9E1AF"><section id="id093883090c5c4fe2acbbd84e20cb4ef8"><enum>229.</enum><header>Office of Small Farms</header><subsection id="idD86D39CB3C0D46AD88802460788176B6" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of small farm, ranch, or forest operation</header><text display-inline="yes-display-inline">In this section, the term <term>small farm, ranch, or forest operation</term> means a farm, ranch, or forest operation that—</text><paragraph commented="no" display-inline="no-display-inline" id="id49eaaa2b56c244f9bb031dc1b24cfc5e"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6b8a878e4f354884b8f733722d182bd4"><enum>(A)</enum><text display-inline="yes-display-inline">is less than 180 acres; or</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id5a506cc3ab0444a4a2e5982a4f513b67"><enum>(B)</enum><text>meets another acreage-based definition of <quote>small</quote>, as determined by the Secretary, that takes into consideration—</text><clause commented="no" display-inline="no-display-inline" id="idf2f3b0ccb06b48ee9df2b20f70c839a5"><enum>(i)</enum><text display-inline="yes-display-inline">the State or region in which the farm, ranch, or forest operation is located;</text></clause><clause commented="no" display-inline="no-display-inline" id="id50724a384d5142b182edff005eb6e849"><enum>(ii)</enum><text>the production system of the farm, ranch, or forest operation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idabe78679dec54cc19a6e2b7b5d774c0d"><enum>(iii)</enum><text>both; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c6cb778b8324d858968ed0751b81251"><enum>(2)</enum><text>has an annual gross cash farm income of less than $350,000.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcb15e22349dc4963974f90f4c14941ba"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="idfd4b0cfe621d414f9ebad8857b3bc814"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish within the farm production and conservation mission area the Office of Small Farms.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50755d73cf4e41f394b55275b8bc764d"><enum>(2)</enum><header>Director</header><text>The Secretary shall appoint a Director of the Office of Small Farms (referred to in this section as the <term>Director</term>). A senior official within the farm production and conservation mission area may be appointed to serve as the Director.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ee00a91a1784d5d95df2afe3f74ab1e"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Director shall—</text><paragraph id="id3689239da4824792911dadd70f32d21f"><enum>(1)</enum><text>coordinate efforts to improve support for small farms, ranches, and forest operations across all Department agencies and offices;</text></paragraph><paragraph id="id075e82330ddd44b58f72b9de17a75038"><enum>(2)</enum><text>review Department programs and policies and identify statutory, regulatory, and administrative provisions, policies, and guidance that disadvantage small farm, ranch, or forest operation participation, and recommend changes to ensure that those programs and policies adequately serve small farms, ranches, and forest operations; </text></paragraph><paragraph id="id8a88594c9aca4e70942b249d41f050ad"><enum>(3)</enum><text>develop recommendations for new initiatives, including financing mechanisms and technical assistance opportunities, to specifically serve small farms, ranches, and forest operations relating to production, conservation, business planning, land access, and other issues, as determined by the Secretary; </text></paragraph><paragraph id="id38f9bf84969c4ef88b8a2543b336fd77"><enum>(4)</enum><text>make recommendations to Department agencies and offices and other Federal agencies on tracking small farm, ranch, or forest operation data, including demographics and program participation rates;</text></paragraph><paragraph id="id10d7873919cd48e2ad8519a3b0f91816"><enum>(5)</enum><text>propose research agendas on topics that are of special interest to small farms, ranches, and forest operations;</text></paragraph><paragraph id="id79ead43caf1347e397ad59960c179459"><enum>(6)</enum><text>provide or coordinate technical assistance through the Department or through cooperative agreements with other entities to operators of small farms, ranches, and forest operations to enable those operators to access the full complement of Department grant, cost-share, and loan programs;</text></paragraph><paragraph id="id47ab2b7d3b3944ce95dafc24bd47dc1c"><enum>(7)</enum><text>implement program directly or through cooperative agreements with other entities to provide grants of not more than $25,000 to operators of small farms, ranches, and forest operations for—</text><subparagraph id="id3246695b549d4b19a3484080f632bd63"><enum>(A)</enum><text>equipment and infrastructure repairs and upgrades;</text></subparagraph><subparagraph id="idbe093408f7f24578800bb1c9714b4bb9"><enum>(B)</enum><text>uninsured losses; </text></subparagraph><subparagraph id="ide762eecc38c44911a6785d03f6d55a27"><enum>(C)</enum><text>business planning and market development assistance;</text></subparagraph><subparagraph id="id28f5103aaa96419ab33ea1d54eb0d73e"><enum>(D)</enum><text>conservation practice adoption;</text></subparagraph><subparagraph id="idd1bccc6266994161b9f653ead79e543a"><enum>(E)</enum><text>down payments for land acquisition; and</text></subparagraph><subparagraph id="id7444894ab5044f9c8dfdbde0d7751f05"><enum>(F)</enum><text>such other purposes as the Secretary determines to be appropriate; </text></subparagraph></paragraph><paragraph id="id34a9d6ec3d41469d801af06ff9259e89"><enum>(8)</enum><text>operate a hotline through which operators of small farms, ranches, and forest operations can anonymously report problems that the operators encounter in attempts to access Department programs; and</text></paragraph><paragraph id="ida35d1b10cede4db3978471e621dc8b35"><enum>(9)</enum><text>advise other Federal agencies on how to effectively reach and serve small farms, ranches, and forest operations. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id30011805091f4fbe871ab94a48659985"><enum>(d)</enum><header>Liaisons</header><text display-inline="yes-display-inline">The following officials shall appoint, from among the officers and employees under the respective official, a liaison to the Office of Small Farms:</text><paragraph commented="no" display-inline="no-display-inline" id="id4e42378255e04d6487369cd137c975e3"><enum>(1)</enum><text>The Chief of the Natural Resources Conservation Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79bb04e60a474b87ae50b3368bf781bc"><enum>(2)</enum><text>The Administrator of the Farm Service Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9b16eb669c54a7b8c5f749e16500001"><enum>(3)</enum><text>The Administrator of the Risk Management Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a4d7adcc31a4024b75c5bc032fd9451"><enum>(4)</enum><text>The Under Secretary of Agriculture for Rural Development.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa9f3269870941158cb7a95fba2b7270"><enum>(5)</enum><text>The Director of the National Institute of Food and Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida60c56e6e3e34724a2b6ea54d9244807"><enum>(6)</enum><text>The Administrator of the Agricultural Marketing Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf631ddd0bdf44df383ffdffb1ad7f61e"><enum>(7)</enum><text>The Administrator of the National Agricultural Statistics Service.</text></paragraph><paragraph id="id4d54e49389754dec80949bc8e02cacd7"><enum>(8)</enum><text>The Director of the Office of Partnerships and Public Engagement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c91250c35184adc91f3f23f7f94a138"><enum>(9)</enum><text>The heads of such other agencies, offices, and advisory groups as the Secretary determines to be appropriate, including—</text><subparagraph id="id783980b281914782a93d1bc9a5dc201d"><enum>(A)</enum><text>the Office of Urban Agriculture and Innovative Production; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c84e2f87e1041089ec0d610be5638e7"><enum>(B)</enum><text display-inline="yes-display-inline">the Office of Tribal Relations. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1941d5e4f5074e8e9adecaa22c1790a2"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated—</text><paragraph commented="no" display-inline="no-display-inline" id="idf1d8492e30fa409e9451c5b5f5db5e0c"><enum>(1)</enum><text display-inline="yes-display-inline">$15,000,000 for each of fiscal years 2023 through 2028 for the administration of the Office of Small Farms; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id450b4f3a4e7f4b8f912c5f54ac9daf8b"><enum>(2)</enum><text display-inline="yes-display-inline">$10,000,000 for each fiscal year to provide technical assistance and grants authorized by this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb792cc9fabf14faf824220c2f6d0afd5"><enum>(b)</enum><header>Technical amendment</header><text>The Department of Agriculture Reorganization Act of 1994 is amended by redesignating the first section 225 (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) (relating to the Food Access Liaison) as section 224A.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id45629d8b1b13481fbd0f07fd370272c9"><enum>(c)</enum><header>Conforming amendment</header><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id09E46E2E2E344825A9B3048DEA37BECB"><paragraph commented="no" display-inline="no-display-inline" id="idd9614768d9664df8b132bdf0acfa9749"><enum>(11)</enum><text>The authority of the Secretary to carry out section 229.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
