which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Energy Regulatory Commission to reform the interregional transmission planning process, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Interregional Transmission Planning Improvement Act of 2023</short-title></quote>.</text></section><section id="id235f020f347b445d85c596dd09bcd3cd"><enum>2.</enum><header>Increasing effectiveness of interregional transmission planning</header><subsection id="idEA8AA11C5AA344FEB82CE71613D4300B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Energy Regulatory Commission (referred to in this section as the <term>Commission</term>) shall ensure—</text><paragraph id="id60543d1202784193b847429b6ae9377b"><enum>(1)</enum><text>the effectiveness of existing planning processes for identifying interregional transmission projects that provide economic, reliability, and operational benefits, taking into consideration the public interest, the integrity of markets, and the protection of consumers;</text></paragraph><paragraph id="idee279156bfed41beaef433338d8d06ab"><enum>(2)</enum><text>any changes to the processes described in paragraph (1) promote efficient, cost-effective, and broadly beneficial interregional transmission solutions that are selected for cost allocation—</text><subparagraph commented="no" display-inline="no-display-inline" id="id88cb6bd4dac84676ac19bd5762b2851b"><enum>(A)</enum><text display-inline="yes-display-inline">taking into consideration—</text><clause id="id0EFC9F49FA484124B6DB9C35B894F8B9"><enum>(i)</enum><text>the public interest;</text></clause><clause id="id68082B1153004860B2762F39B7E4DE0A"><enum>(ii)</enum><text>the integrity of markets;</text></clause><clause id="idA2F7820074E641BAB08D64AE5B0949F6"><enum>(iii)</enum><text>the protection of consumers;</text></clause><clause id="idf20aa00755a045f4997318a7bbcc57d6"><enum>(iv)</enum><text>the broad range of economic, reliability, and operational benefits;</text></clause><clause id="ide65dd130e4b34f84a981d95b76d38bdf"><enum>(v)</enum><text>the need for single projects to secure approvals based on a comprehensive assessment of the multiple benefits provided;</text></clause><clause id="id8d6f265384104f94bd4b899be0965604"><enum>(vi)</enum><text>that projects that meet interregional benefit criteria should not be subject to subsequent reassessment by transmission planning authorities;</text></clause><clause id="idbbe6c813596d45e6a4ad9bb95043f04a"><enum>(vii)</enum><text>the importance of synchronization of planning processes in neighboring regions, such as using a joint model on a consistent timeline with a single set of needs, input assumptions, and benefit metrics;</text></clause><clause id="id3796ccf259c649e79b4549f7ca5a669a"><enum>(viii)</enum><text>that evaluation of long-term scenarios should align with the expected life of a transmission asset to be not less than 20 years;</text></clause><clause id="id5b8cac81bf5541b1b3c02bba2e85dcd1"><enum>(ix)</enum><text>that transmission planning authorities should allow for the identification and joint evaluation of alternatives proposed by stakeholders;</text></clause><clause id="idc57d02f1b58749b78d17547e62875bbc"><enum>(x)</enum><text>that interregional planning should be done regularly and not less frequently than once every 2 years; and</text></clause><clause id="iddc90239fb8204467ae748e4c62aff803"><enum>(xi)</enum><text>the elimination of arbitrary project voltage, size, or cost requirements for interregional solutions; and</text></clause></subparagraph><subparagraph id="id8a61c03ef59648deab2ef7b246320b05"><enum>(B)</enum><text>regardless of the regulatory or business model of the entity developing the transmission project; and</text></subparagraph></paragraph><paragraph id="id84617b5bd32b44cba428d2b92645391a"><enum>(3)</enum><text>the use of cost allocation methodologies that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id612190f18ca3451e8a00b459e6b90a04"><enum>(A)</enum><text display-inline="yes-display-inline">reflect the multiple benefits provided by interregional transmission solutions, including economic, reliability, resiliency, operational benefits; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fbf139544a148468d741fcce6af7d07"><enum>(B)</enum><text>assign costs broadly to customers based on the multiple benefits described in subparagraph (A) received by customers.</text></subparagraph></paragraph></subsection><subsection id="id856e46f424ed48a08403194da18926cf"><enum>(b)</enum><header>Recovery of costs</header><text>The Commission shall allow a transmission developer of an interregional transmission project that meets the criteria described in subsection (a)(2)(A) to submit to the Commission a request to recover the cost of the project if the transmission developer demonstrates to the satisfaction of the Commission that— </text><paragraph commented="no" display-inline="no-display-inline" id="id75eed2a32971412d9dc16914668bda3e"><enum>(1)</enum><text display-inline="yes-display-inline">the project connects more than 1 planning region;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ebac90a72ae4f9cb21bc10c777e884f"><enum>(2)</enum><text display-inline="yes-display-inline">no interregional plan that meets the criteria described in subsection (a)(2)(A) has been adopted by the connected planning regions; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67a4ed1f8e764355b5333e7e67945721"><enum>(3)</enum><text display-inline="yes-display-inline">the benefits of the project outweigh the costs of the project.</text></paragraph></subsection><subsection id="id73365b8b72bc48ce8b37f72e68ad6ce3"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall promulgate a final rule to implement this section.</text></subsection></section></legis-body></bill>
