which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to modify the authority of the Secretary of each military department to replace damaged or destroyed facilities to include replacement of certain facilities in failing condition, and for other purposes.</official-title></form><legis-body><section id="ided6d0eca6bfd4ce6a8d5e5e22c379c3b" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Facilities Upgrades Act</short-title></quote>.</text></section><section id="idC7263ACF6BA44B8F995203528F8D40C5"><enum>2.</enum><header>Modification of authority to replace damaged or destroyed facilities to include certain facilities in failing condition</header><subsection id="idcfa135b18cfe443a8f060270dc548943"><enum>(a)</enum><header>In general</header><text>Section 2854 of title 10, United States Code, is amended—</text><paragraph id="idca91e6d4ca7a4dd6994365ba30fbde46"><enum>(1)</enum><text>by striking subsection (a) and inserting the following new subsection (a):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8FAE39E1C336438087C9B833A1598F0B"><subsection id="idc79e8bc0984c45748e13948fb9ac5c14"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5f0e6d0419144bf7a70daafcd867446a"><enum>(1)</enum><text>Subject to subsection (b), the Secretary concerned may replace a facility under the jurisdiction of the Secretary concerned, including a family housing facility—</text><subparagraph id="id3d9b408283eb4225a2293fa44073351d" indent="up1"><enum>(A)</enum><text>that has been damaged or destroyed; or </text></subparagraph><subparagraph id="idE8240B42BBBA4EE4901A8BF9496FE8A4" indent="up1"><enum>(B)</enum><text>that is a facility described in paragraph (2) in failing condition, if—</text><clause id="idd474d54be14f4e968e26311ffe09cf87"><enum>(i)</enum><text>replacement is more cost-effective than repair;</text></clause><clause id="ide97017998a90495685595d3f0cd14e14"><enum>(ii)</enum><text>the replacement facility supports an existing mission of the Department of Defense; and</text></clause><clause id="id8a441bb2e23c4b65b894d2928b9a246b"><enum>(iii)</enum><text>the replacement facility does not exceed the total square footage of the replaced facility. </text></clause></subparagraph></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="id028c2569b5d94a18a1992daf5f70d184"><enum>(2)</enum><text>A facility described in this paragraph is any of the following facilities of the Department of Defense or an armed force:</text><subparagraph id="idda86b9fb769a42e5803563ae0201cb7b"><enum>(A)</enum><text>Any barracks, housing, or dormitory facility.</text></subparagraph><subparagraph id="id5286dc759ebd4c5ba620017fc4e8a808"><enum>(B)</enum><text>A child development center.</text></subparagraph><subparagraph id="ida7722cd3a958456ea60eff4143d7bbe1"><enum>(C)</enum><text>Any other quality of life facility, including a fitness center, recreation facility, dining facility, or commissary facility.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4364d14fb1604965951daebcc84aaffd"><enum>(2)</enum><text>in subsection (b), by striking <quote>repair, restoration, or</quote>;</text></paragraph><paragraph id="ida0637460c837454abfa17a8f34c2c1c4"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="id77498e985de846519e5436ed8f244924"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)(A)</quote>; and</text></subparagraph><subparagraph id="idf4ca0846791c4d80b99c25adef131f4f"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idfd1a9525b0ed4839a078d01266581abf"><enum>(i)</enum><text>by striking <quote>this subsection</quote> and inserting <quote>paragraph (1)</quote>; and</text></clause><clause id="id460ea964e64d491c99b74ad0ac011bf2"><enum>(ii)</enum><text>by striking <quote>described in paragraph (1)</quote> and inserting <quote>described in paragraph (1)(B)</quote>;</text></clause></subparagraph></paragraph><paragraph id="idd373b736ea3c442c8efdccae6aa84ffc"><enum>(4)</enum><text>by redesignating paragraph (3) as paragraph (4);</text></paragraph><paragraph id="id6e7b124f68e8469ba42170a7f4781330"><enum>(5)</enum><text>by inserting after paragraph (2) the following new paragraph (3):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99ADD9F9127241739C309594AA95F002"><paragraph id="id9e4e0d9f0fd14147be7faf5d9055b06f" indent="up1"><enum>(3)</enum><text>In using the authority described in subsection (a)(1)(B) to carry out a military construction project to replace a facility, including a family housing facility, that is in failing condition, the Secretary concerned may use appropriations available for operation and maintenance.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="iddf32358e6dda4c8b95efcdb7db01b8be"><enum>(6)</enum><text>in paragraph (4), as redesignated by paragraph (4) of this subsection, by inserting <quote>per armed force</quote> before <quote>in any fiscal year</quote>.</text></paragraph></subsection><subsection id="id80cd26f99f884b178141f99ff70558fd"><enum>(b)</enum><header>Conforming and clerical amendments</header><paragraph id="id476ca5e7efe946aa846fbc7678231714"><enum>(1)</enum><header>Heading amendment</header><text>The heading for section 2854 of such title is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="idB2369262B1564B438741DFEC92FF3099"><section id="idC9888C5AA0B449AC966A5806F726C83D"><enum>2854.</enum><header>Replacement of damaged, destroyed, or failing facilities</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id5a7e1db4da744b31b61a560987de0feb"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of subchapter III of chapter 169 of such title is amended by striking the item relating to section 2854 and inserting the following new item:</text><quoted-block style="USC" id="id285bb567-5647-4cd8-a8f7-019e30628c3b"><toc><toc-entry level="section" idref="idC9888C5AA0B449AC966A5806F726C83D">2854.
