which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20231212">December 12, 2023</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of the Interior to convey certain land to La Paz County, Arizona, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>La Paz County Solar Energy and Job Creation Act</short-title></quote>.</text></section><section id="id3806304a1d1b42f2b93f215f3f18cac9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id170ad1058c4047d4bd7955626c0d3e26"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means La Paz County, Arizona.</text></paragraph><paragraph id="id297a8486dae7479a905937d85cfa8f7e"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately <deleted-phrase reported-display-style="strikethrough">4,800</deleted-phrase><added-phrase reported-display-style="italic">3,400</added-phrase> acres of land managed by the Bureau of Land Management and designated as <quote>Federal Land To Be Conveyed</quote> on the map.</text></paragraph><paragraph id="idd8993e609a5b4fbc8be62b7e3afd83be" changed="deleted" reported-display-style="strikethrough"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map prepared by the Bureau of Land Management entitled <quote>La Paz County Land Conveyance Map</quote> and dated September 1, 2020.</text></paragraph><paragraph id="idc9852e16e10e4d4da01953a866fb61e5" changed="added" reported-display-style="italic"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>BLM Arizona—La Paz County Land Conveyance Map, Bureau of Land Management—Colorado River District, Yuma Field Office</quote> and dated June 29, 2023. </text></paragraph><paragraph id="id292D65410C63479387728B0C92A7F09A"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="id70d6f9654ff94d31a362d78712fa15b3"><enum>3.</enum><header>Conveyance to La Paz County, Arizona</header><subsection id="idef8f8aa8669545f1b29983c1277c8d88"><enum>(a)</enum><header>In general</header><text>Notwithstanding the planning requirement of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713) and in accordance with this section and other applicable law, as soon as practicable after receiving a request from the County to convey the Federal land, the Secretary shall convey the Federal land to the County.</text></subsection><subsection id="id246214de79cd4e2fa114dfcfa66b124e"><enum>(b)</enum><header>Restrictions on conveyance</header><paragraph id="idf5e8e46ca6034e178fbf7bb8408662cb"><enum>(1)</enum><header>In general</header><text>The conveyance under subsection (a) shall be subject to—</text><subparagraph id="id20bde75e5858485fa63d068026918103"><enum>(A)</enum><text>valid existing rights; and</text></subparagraph><subparagraph id="id426b3ef61c9449acacaed4e414e4648f"><enum>(B)</enum><text>such terms and conditions as the Secretary determines to be necessary.</text></subparagraph></paragraph><paragraph id="idc373c68ad8554f6aa32f55ae06b54b75"><enum>(2)</enum><header>Exclusion</header><text>The Secretary shall exclude from the conveyance under subsection (a) any Federal land that contains significant cultural, environmental, wildlife, or recreational resources.</text></paragraph></subsection><subsection id="id8a911fac3fa942b8ba9746825b2da076"><enum>(c)</enum><header>Payment of fair market value</header><text>The conveyance under subsection (a) shall be for the fair market value of the Federal land to be conveyed, as determined—</text><paragraph id="ide415eaf0425a4a4c8e6abade4c7578fa"><enum>(1)</enum><text>in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph><paragraph id="id0947d44f67b441408ad65e6b2ebbce57"><enum>(2)</enum><text>based on an appraisal that is conducted in accordance with—</text><subparagraph id="id1477761949ba4fb88ca28054ee8588b3"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="id9ff5df2a293048108aab07902cc2d2ac"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph></subsection><subsection id="id0b3f5a0e61534c6cbd8a5c44249cda53"><enum>(d)</enum><header>Protection of tribal cultural artifacts</header><text>As a condition of the conveyance under subsection (a), the County shall, and as a condition of any subsequent conveyance, any subsequent owner shall—</text><paragraph id="id43e665e8c29f4173a9693a20275db503"><enum>(1)</enum><text>make good faith efforts to avoid disturbing Tribal artifacts;</text></paragraph><paragraph id="idd398e2d7dc904236a2bf524f9b72c35c"><enum>(2)</enum><text>minimize impacts on Tribal artifacts if the artifacts are disturbed;</text></paragraph><paragraph id="id1520b1af7c1148a0aaa72b14b9e5ea7e"><enum>(3)</enum><text>coordinate with the Colorado River Indian Tribes Tribal Historic Preservation Office to identify artifacts of cultural and historic significance; and</text></paragraph><paragraph id="id3dcfa50348574a639a572eeb782333a9"><enum>(4)</enum><text>allow Tribal representatives to rebury unearthed artifacts at or near where the artifacts were discovered.</text></paragraph></subsection><subsection id="iddf6bca3078924c49808215c0116ee69c"><enum>(e)</enum><header>Availability of map</header><paragraph id="id3cdbab9cd53e47f19f6b9e0b0a3d0f36"><enum>(1)</enum><header>In general</header><text>The map shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph><paragraph id="id1f03d8c19bf74f6b9c95887c97a626d8"><enum>(2)</enum><header>Corrections</header><text>The Secretary and the County may, by mutual agreement—</text><subparagraph id="id1585edda962f4a3abf77634d5ab20c40"><enum>(A)</enum><text>make minor boundary adjustments to the Federal land to be conveyed under subsection (a); and</text></subparagraph><subparagraph id="id7582ee2164d24f6598915029cce2b670"><enum>(B)</enum><text>correct any minor errors in the map, an acreage estimate, or the description of the Federal land.</text></subparagraph></paragraph></subsection><subsection id="id32856d161c1f4deda040165e521fe7d5"><enum>(f)</enum><header>Withdrawal</header><text>The Federal land is withdrawn from the operation of the mining and mineral leasing laws of the United States.</text></subsection><subsection id="id29a4434b87f842d09ccd7acea464a4d4"><enum>(g)</enum><header>Costs</header><text>As a condition of the conveyance of the Federal land under subsection (a), the County shall pay—</text><paragraph id="idd71b01b4fdd1412ab1b149990fa31e60"><enum>(1)</enum><text>an amount equal to the appraised value determined in accordance with subsection (c)(2); and</text></paragraph><paragraph id="id1f1ae1f1f11047b1b7abbca246166e80"><enum>(2)</enum><text>all costs related to the conveyance, including all surveys, appraisals, and other administrative costs associated with the conveyance of the Federal land to the County under subsection (a).</text></paragraph></subsection><subsection id="id1f9d8467c79e4c00879603c0b18badae"><enum>(h)</enum><header>Proceeds from the sale of land</header><text>The proceeds from the sale of land under this section shall be—</text><paragraph id="id473d62425f62477288088157fc38c435"><enum>(1)</enum><text>deposited in the Federal Land Disposal Account established by section 206(a) of the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2305">43 U.S.C. 2305(a)</external-xref>); and</text></paragraph><paragraph id="id6f2cdf72b9a44305aea82eeb242912a6"><enum>(2)</enum><text>used in accordance with that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2301">43 U.S.C. 2301 et seq.</external-xref>). </text></paragraph></subsection></section></legis-body><endorsement><action-date date="20231212">December 12, 2023</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
