which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish requirements for quality and discard dates that are voluntarily declared on the food label.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7BCB1CB3452E45D3AEFDD266FB55C491"><section section-type="section-one" id="H42BFDBF4B1934DEF9F0E5FFE24778617"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Date Labeling Act of 2023</short-title></quote>.</text></section><section id="H22D1E6C24AFF42438234666351CB9F47"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7F1D2F9735024A4EBC7FEC8A18F7D4C1"><enum>(1)</enum><header>Administering Secretaries</header><text display-inline="yes-display-inline">The term <term>administering Secretaries</term> means—</text><subparagraph id="HD459C089851D4A41BAF05BEDCC6FEC74"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to any product that is—</text><clause id="id8C07AD85586347B1A4856A5A9AD768EA"><enum>(i)</enum><text display-inline="yes-display-inline">under the jurisdiction of the Secretary of Agriculture; and</text></clause><clause id="HDAB42596325E4AD5B01B1FC6E796CC00"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idA5D7A6323FEA4229BA99894E14FA198D"><enum>(I)</enum><text>a poultry product (as defined in section 4 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453</external-xref>));</text></subclause><subclause id="id83545803A3394BCBBA0DF37AAF55292E" indent="up1"><enum>(II)</enum><text>a meat food product (as defined in section 1 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref>)); or</text></subclause><subclause id="idE999E93CD35647528B184E421E1EAA8A" indent="up1"><enum>(III)</enum><text>an egg product (as defined in section 4 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1033">21 U.S.C. 1033</external-xref>)); and</text></subclause></clause></subparagraph><subparagraph id="HE7708E095AFF48B68BFC7DA1AC1CD063"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services, with respect to any product that is—</text><clause id="id128BB4C72BFB42E29E7F33AA07685832"><enum>(i)</enum><text display-inline="yes-display-inline">under the jurisdiction of the Secretary of Health and Human Services; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idE04E78C6EB4B495995FEA65EBAEBE73C"><enum>(ii)</enum><text display-inline="yes-display-inline">a food (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>)). </text></clause></subparagraph></paragraph><paragraph id="H339E2807BE3945B18E1337BEB06FEEE4"><enum>(2)</enum><header>Discard date</header><text display-inline="yes-display-inline">The term <term>discard date</term> means a date voluntarily printed on a food label that signifies the end of the estimated period of shelf life under any stated storage conditions, after which the entity responsible for the food label advises the product not be consumed.</text></paragraph><paragraph id="HC9A66034F83047818B257EFF7E2171B9"><enum>(3)</enum><header>Quality date</header><text display-inline="yes-display-inline">The term <term>quality date</term> means a date voluntarily printed on a food label that is intended to communicate to consumers the date after which—</text><subparagraph id="HD24185256B6E49B984638818C6EC4BAD"><enum>(A)</enum><text>the quality of the product may begin to deteriorate; but</text></subparagraph><subparagraph id="HF65E8D82D0BC433D9E133322E85812E4"><enum>(B)</enum><text>the product remains apparently wholesome food (as defined in subsection (b) of the Bill Emerson Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>)).</text></subparagraph></paragraph></section><section id="H61B010B85459417BA6A4E003CF96E66D"><enum>3.</enum><header>Quality dates and discard dates</header><subsection id="H22E9E557F9B14C2595B8EB2592C49E00"><enum>(a)</enum><header>Quality dates</header><paragraph id="H73387C4CDD394E299583B46FBD726962"><enum>(1)</enum><header>In general</header><text>If a quality date is used on a food label, such quality date shall be immediately proceeded by the uniform quality date label phrase under paragraph (2).</text></paragraph><paragraph id="H266B79DD21D34FEDBC2CFF218BF59AE8"><enum>(2)</enum><header>Uniform phrase</header><text display-inline="yes-display-inline">The uniform quality date label phrase under this paragraph shall be <quote>BEST If Used By</quote> or, if permissible under subsection (c)(3), the standard abbreviation of <quote>BB</quote>, unless and until the administering Secretaries, acting in coordination, specify through rulemaking another uniform phrase to be used for purposes of complying with paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide73e3621db8945e2be1934f02a03b5ca"><enum>(3)</enum><header>Option of the entity responsible for the food label</header><text display-inline="yes-display-inline">The decisions of whether to include a quality date on food packaging and which foods should be so labeled shall be at the discretion of the entity responsible for the food label. </text></paragraph></subsection><subsection id="HFA15E832F2844BD68E4287E573D5327C"><enum>(b)</enum><header>Discard dates</header><paragraph id="H2414787DC11E451D83012B80BF779B66"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a discard date is used on a food label, such discard date shall be immediately proceeded by the uniform discard date label phrase under paragraph (2).</text></paragraph><paragraph id="HB785F89B0FA74D6182175D0CC8BFAF2E"><enum>(2)</enum><header>Uniform phrase</header><text display-inline="yes-display-inline">The uniform discard date label phrase under this paragraph shall be <quote>USE By</quote> or, if permissible under subsection (c)(3), the standard abbreviation of <quote>UB</quote>, unless and until the administering Secretaries, acting in coordination, specify through rulemaking another uniform phrase to be used for purposes of complying with paragraph (1). </text></paragraph><paragraph id="iddeca46717e3a467fbfbf6475b875013a"><enum>(3)</enum><header>Option of the entity responsible for the food label</header><text>The decisions of whether to include a discard date on food packaging and which foods should be so labeled shall be at the discretion of the entity responsible for the food label.</text></paragraph></subsection><subsection id="H190954B57EAE473DAB1A06C8B75551CF"><enum>(c)</enum><header>Quality date and discard date labeling</header><paragraph id="HA987992D4EC640B2A9444DEED561B057"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The quality date or discard date, as applicable, and immediately adjacent uniform quality date label phrase or discard date label phrase shall be—</text><subparagraph id="H80F36106806D40FC834489963AFA0A24"><enum>(A)</enum><text>in single easy-to-read type style; and</text></subparagraph><subparagraph id="H56603391D0284FD1BA4F96BA7BFA5275"><enum>(B)</enum><text display-inline="yes-display-inline">located in a conspicuous place on the food label or elsewhere on the package.</text></subparagraph></paragraph><paragraph id="H0251C846C7E84F6C99884C156E061217"><enum>(2)</enum><header>Date format</header><text display-inline="yes-display-inline">Each quality date and discard date shall be stated in terms of month and year or, as appropriate, month, day, and year.</text></paragraph><paragraph id="HD9F960177C104492A10B5A7BD9D3627E"><enum>(3)</enum><header>Abbreviations</header><text display-inline="yes-display-inline">A standard abbreviation of <quote>BB</quote> and <quote>UB</quote> for the quality date and discard date, respectively, may be used only if the food label is too small to include the uniform phrase described in subsection (a)(2) or (b)(2), as applicable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ec9729365844b3baeca38b505622ece"><enum>(4)</enum><header>Freeze by</header><text>A food labeler may add <quote>or freeze by</quote> following a uniform quality date label phrase or discard date label phrase. </text></paragraph></subsection><subsection id="H62AF58D0D12A48789E582C1F677EB62B"><enum>(d)</enum><header>Education</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the administering Secretaries, acting in coordination, shall provide consumer education and outreach on the meaning of quality dates and discard dates on food labels.</text></subsection><subsection id="HA107A32A62A0404894A0B2E097CDAD2F"><enum>(e)</enum><header>Effect; preemption</header><paragraph id="H32B063558C6A4B5B967023A279ED080F"><enum>(1)</enum><header>Effect on sale or donation of foods</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act prohibits any State or political subdivision of a State from establishing or continuing in effect any requirement that prohibits the sale or donation of foods based on passage of the discard date.</text></paragraph><paragraph id="H753E9C085353407AB400FEFE7E53F483"><enum>(2)</enum><header>Effect on infant formula</header><text>Nothing in this Act or an amendment made by this Act—</text><subparagraph id="HEF3BF7B6C1A8429082D2BB52C8367177"><enum>(A)</enum><text>applies with respect to infant formula (as defined in section 201(z) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(z)</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H428E15F2252246DEB900C1584A80F573"><enum>(B)</enum><text>affects the requirements relating to infant formula under section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>) or any other applicable provision of law. </text></subparagraph></paragraph><paragraph id="H8A46AC88821F416C8620166106528EB2"><enum>(3)</enum><header>Preemption</header><text display-inline="yes-display-inline">No State or political subdivision of a State may establish or continue in effect any requirement that—</text><subparagraph id="H33514D57BA7E42C2908E7F151DE4FBC8"><enum>(A)</enum><text display-inline="yes-display-inline">relates to the inclusion in food labeling of a quality date or a discard date that is different from or in addition to, or that is otherwise not identical with, the requirements of this Act and the amendments made by this Act; or</text></subparagraph><subparagraph id="H2034399EB34A43F9A49DFE07C87F2EA5"><enum>(B)</enum><text display-inline="yes-display-inline">prohibits the sale or donation of foods based on passage of the quality date.</text></subparagraph></paragraph><paragraph id="H3949044FB1FC420A924FEA8A6CFC17D5"><enum>(4)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The administering Secretaries, acting in coordination with the Federal Trade Commission, shall ensure that the uniform quality date label phrase and uniform discard date label phrase are standardized across all food products.</text></paragraph><paragraph id="H9AEF7734C4EC4300A45995A1A0961F9D"><enum>(5)</enum><header>Savings</header><text display-inline="yes-display-inline">Notwithstanding paragraph (3), nothing in this Act, any amendment made by this Act, or any standard or requirement imposed pursuant to this Act preempts, displaces, or supplants any State or Federal common law rights or any State or Federal statute creating a remedy for civil relief, including a remedy for civil damage, or a penalty for criminal conduct.</text></paragraph></subsection><subsection id="H0391D3E2B0CB41CF96451AEA053E8268"><enum>(f)</enum><header>Time temperature indicator labels</header><text display-inline="yes-display-inline">Nothing in this Act or an amendment made by this Act prohibits or restricts the use of time-temperature indicator labels or similar technology that is in addition to or in lieu of any uniform quality date label phrase under subsection (a)(2) or uniform discard date label phrase under subsection (b)(2).</text></subsection></section><section id="HF925FA82D28B43E5A63FCA4E419B5302"><enum>4.</enum><header>Misbranding</header><subsection commented="no" id="HE1581EFCB1D14F2499CD56EF3E35F3B0"><enum>(a)</enum><header>FDA violations</header><text display-inline="yes-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4F26933413004576BAC4DFAD15AF5708"><subsection commented="no" id="H7184A400247E428C9EFA8451B483EE4B"><enum>(z)</enum><text display-inline="yes-display-inline">If the label bears a quality date or discard date that fails to comply with the requirements as specified in sections 3(a) and 3(b) of the <short-title>Food Date Labeling Act of 2023</short-title>, or that fails to meet the requirements as specified in section 3(c) of such Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H45C8C6DED9FA4DED9A0AEEDE1597237B"><enum>(b)</enum><header>Poultry products</header><text display-inline="yes-display-inline">Section 4(h) of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/453">21 U.S.C. 453(h)</external-xref>) is amended—</text><paragraph id="H9861C72759F14FB5B9297F99072C7303"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H710B5F5BD2A24A228750F84199201016"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HA1EA5759583949E4B4C1E8B83A720DD9"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H36D5E48B66CA473FAC1B5C8CFB0C0FCB"><paragraph id="H1E7135291E6C45A7A727BFC37F6AB938"><enum>(13)</enum><text display-inline="yes-display-inline">if its labeling is in violation of section 3 of the <short-title>Food Date Labeling Act of 2023</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB99BA4D0B54F4A8784F40F184FFBDBC1"><enum>(c)</enum><header>Meat products</header><text display-inline="yes-display-inline">Section 1(n) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601(n)</external-xref>) is amended—</text><paragraph id="H5A9DC587BF9F46DC9ED9EAC9D24DCEE2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H736A09C4738549CDB67B9C5EC5F3CE5A"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H888F4523E9A244DA808328318FE8DF47"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H63780D67898B4C45A0D9259C2D71645D"><paragraph id="H084276BDCFAA49BE98843BDB184B7026"><enum>(13)</enum><text display-inline="yes-display-inline">if its labeling is in violation of section 3 of the <short-title>Food Date Labeling Act of 2023</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H82DD0E7E4341474DAABD53EA5020AE8F"><enum>(d)</enum><header>Egg products</header><text display-inline="yes-display-inline">Section 7(b) of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1036">21 U.S.C. 1036(b)</external-xref>) is amended in the first sentence by inserting <quote>or if its labeling is in violation of section 3 of the <short-title>Food Date Labeling Act of 2023</short-title></quote> before the period at the end.</text></subsection></section><section id="H26DB264833D84096AC1418DD24F4AB4B"><enum>5.</enum><header>Delayed applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall apply only with respect to food products that are labeled on or after the date that is 2 years after the date of enactment of this Act.</text></section></legis-body></bill>
