GAO study.</toc-entry></toc></subsection></section><section id="id182e8d94-da4a-418d-ad08-4d92c8ce83ca" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>Definitions</header><subsection id="id13c52eb3-2af5-4448-8493-9275efcd5f8c"><enum>(a)</enum><header>In general</header><text>In this Act:</text><paragraph id="idb9198c15-41dd-44e9-a687-19e5ea049930"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id2AD802D35EF14089B1856BD215ECE39A"><enum>(2)</enum><header>Standards</header><text>The term <term>standards</term> means benchmarks, guidelines, best practices, methodologies, procedures, and processes.</text></paragraph></subsection><subsection id="ide9fd6dc9-50a6-49a2-af36-4fff58fe6f45"><enum>(b)</enum><header>Other definitions</header><text>The definitions set forth in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>), as amended by section 3(a) of this Act, shall apply in this Act, except to the extent the Commission provides otherwise by regulations issued under section 553 of title 5, United States Code.</text></subsection></section><section id="idf2cbf97b-a4bf-431a-b181-fbd480cd952a" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>3.</enum><header>Online collection, use, and disclosure of personal information of children and teens</header><subsection id="idd5ca3410-f00e-451d-bc62-7a2e513d692c"><enum>(a)</enum><header>Definitions</header><text>Section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) is amended—</text><paragraph id="id293aaa90-c464-47a4-90bf-2e7d750b511f"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1f97cb54-2289-448d-b5dd-e96b5d5acb35" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="idf0cca189-0165-4562-8ed7-890ac14dce6f"><enum>(2)</enum><header>Operator</header><text>The term <term>operator</term>—</text><subparagraph id="id821f701e-23c6-4e11-a3cd-b7d2f57a2286"><enum>(A)</enum><text>means any person—</text><clause id="id4cbaca2c-65ef-4a42-84ff-28ff677ebaa8"><enum>(i)</enum><text>who, for commercial purposes, in interstate or foreign commerce operates or provides a website on the internet, an online service, an online application, a mobile application, or a connected device; and</text></clause><clause id="idd0c6ef35-e15e-4506-a932-f7979edf3e16"><enum>(ii)</enum><text>who—</text><subclause id="idd785afe0-81cb-4e01-a860-538d38af834c"><enum>(I)</enum><text>collects or maintains, either directly or through a service provider, personal information from or about the users of that website, service, application, or connected device;</text></subclause><subclause id="id3314732f-ee41-4108-9f27-5e179e1466d1"><enum>(II)</enum><text>allows another person to collect personal information directly from users of that website, service, application, or connected device (in which case, the operator is deemed to have collected the information); or</text></subclause><subclause id="idd08ca87c-afcd-47c0-9e14-a3ddaeb8b2cf"><enum>(III)</enum><text>allows users of that website, service, application, or connected device to publicly disclose personal information (in which case, the operator is deemed to have collected the information); and</text></subclause></clause></subparagraph><subparagraph id="idb75faca1-777a-4a27-b550-b5aefb57cc48"><enum>(B)</enum><text>does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idd6fd63c5-a63e-4327-93e2-241db611a3d7"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph id="idd447be6c-96cd-4ce0-aeca-13cfea574589"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id97cafbbc-9fa4-4001-8dab-417943e51fd7" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subparagraph id="id48e001f9-7fe2-4042-b9de-574e45db4a79"><enum>(A)</enum><text>the release of personal information collected from a child or teen for any purpose, except where the personal information is provided to a person other than an operator who—</text><clause id="id7453f046-d6cb-47a7-837d-c0ce4c682175"><enum>(i)</enum><text>provides support for the internal operations of the website, online service, online application, mobile application, or connected device of the operator, excluding any activity relating to targeted marketing directed to children, teens, or connected devices; and</text></clause><clause id="id16731b7a-b759-4e88-83cd-9c7783a89267"><enum>(ii)</enum><text>does not disclose or use that personal information for any other purpose; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id919de1dc-84fb-4b6e-83c7-5beb730d3865"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="idf34d1989-2cdd-4556-91a8-50be3584e6a7"><enum>(i)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></clause><clause id="id9ff6f5d3-e158-45b4-a8d7-013cf32d931b"><enum>(ii)</enum><text>by inserting <quote>or teens</quote> after <quote>children</quote>; and</text></clause><clause id="id0e56188d-b85d-482e-b670-85ec77a4ad28"><enum>(iii)</enum><text>by striking <quote>website or online service</quote> and inserting <quote>website, online service, online application, mobile application, or connected device</quote>;</text></clause></subparagraph></paragraph><paragraph id="id1c692709-5df8-45e5-b872-e4b166d82ac9"><enum>(3)</enum><text>in paragraph (8), by striking subparagraphs (F) and (G) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id253ef436-bac8-4ba7-bc16-d88bedbec810" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subparagraph id="id418b10c4-a5b9-4775-a63a-422ef4cb2c87"><enum>(F)</enum><text>geolocation information;</text></subparagraph><subparagraph id="id4268c70e-85b3-4664-a3d0-f29e63c05973"><enum>(G)</enum><text>information generated from the measurement or technological processing of an individual's biological, physical, or physiological characteristics, including—</text><clause id="id7271065a5d8040498fc9219de006d02d"><enum>(i)</enum><text>fingerprints;</text></clause><clause id="ide95cd795944c49599359fbb47d52ac6f"><enum>(ii)</enum><text>voice prints;</text></clause><clause id="id9ac18313677d486cbebb0097ce8a09f9"><enum>(iii)</enum><text>iris or retina imagery scans;</text></clause><clause id="id4a73df94c4be42a3ad2db8cd9c656f2c"><enum>(iv)</enum><text>facial imagery or templates;</text></clause><clause id="id520cb0714215477a941ea9955128ed02"><enum>(v)</enum><text>deoxyribonucleic acid (DNA) information; or</text></clause><clause id="idda8c47c1f40c4f10a390e36ac418f589"><enum>(vi)</enum><text>gait;</text></clause></subparagraph><subparagraph id="idccfa2466-546d-4de8-8950-bc6038407216"><enum>(H)</enum><text>information reasonably associated with or attributed to a child or teen;</text></subparagraph><subparagraph id="id557f6dbb-3c45-4577-ac29-a34958cca1f9"><enum>(I)</enum><text>information (including an internet protocol address) that permits the identification of—</text><clause id="ide8212a9b-bb91-4e17-b961-1c6a554c3126"><enum>(i)</enum><text>an individual; or</text></clause><clause id="idd28f749a-4529-4707-b827-7b40ab5c832c"><enum>(ii)</enum><text>any device used by an individual to directly or indirectly access the internet or an online service, online application, mobile application, or connected device; or</text></clause></subparagraph><subparagraph id="id10637d3e-f46c-4343-960e-15c36081b9f8"><enum>(J)</enum><text>information concerning a child or teen or the parents of that child or teen (including any unique or substantially unique identifier, such as a customer number) that an operator collects online from the child or teen and combines with an identifier described in this paragraph.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id72476bf2-1c35-4df6-a07c-2370bde0c983"><enum>(4)</enum><text>by amending paragraph (9) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd4efa296-b806-4ed2-b20d-b1718ce395c6" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="id03134003-a791-4d51-9369-d7f4442e1c0a"><enum>(9)</enum><header>Verifiable consent</header><text>The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology), including a request for authorization for future collection, use, and disclosure described in the notice, to ensure that, in the case of a child, a parent of the child, or, in the case of a teen, the teen—</text><subparagraph id="id9fadcc13-86e1-4b24-94f9-ddbb7a7f13f3"><enum>(A)</enum><text>receives specific notice of the personal information collection, use, and disclosure practices of the operator; and</text></subparagraph><subparagraph id="id1dd15135-bce3-417e-b3dd-42a6c809c6bd"><enum>(B)</enum><text>before the personal information of the child or teen is collected, freely and unambiguously authorizes—</text><clause id="id7bdf36ae-d3f7-4353-8729-5863a4152e54"><enum>(i)</enum><text>the collection, use, and disclosure, as applicable, of that personal information; and</text></clause><clause id="idd25b6790-5ecd-4fa6-bf0a-4652241426fe"><enum>(ii)</enum><text>any subsequent use of that personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id737a1259-46f8-4c4b-8a18-3e1d331062c0"><enum>(5)</enum><text>by striking paragraph (10) and redesignating paragraphs (11) and (12) as paragraphs (10) and (11), respectively; and</text></paragraph><paragraph id="id3ef91a08-352e-4333-b514-fa0d7e4a9651"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf8ecb65a-2a09-4e57-8bf6-1a1a19b7dbdf" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="id3813f0c0-e3cc-452c-8505-fbeca61f5fa0"><enum>(12)</enum><header>Connected device</header><text>The term <term>connected device</term> means a device that is capable of connecting to the internet, directly or indirectly, or to another connected device.</text></paragraph><paragraph id="idb2769d01-0139-4dc3-91c9-07938be05451"><enum>(13)</enum><header>Online application</header><text>The term <quote>online application</quote>—</text><subparagraph id="idd28dd537-7468-48e9-a92c-929e9b4d171f"><enum>(A)</enum><text>means an internet-connected software program; and</text></subparagraph><subparagraph id="idd32f4658-0990-480b-8de9-8c5e55ced3ac"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="id983d955b-e98e-4527-a091-ec344383b644"><enum>(14)</enum><header>Online service</header><subparagraph id="id775282E8A679419E94FF5DF94F7019C4"><enum>(A)</enum><header>In general</header><text>The term <term>online service</term> means a mass-market retail service by wire or radio that provides the capability to transmit data and receive data from all or substantially all Internet endpoints, including any capabilities that are incidental to and enable the operation of a communications service, but excluding dial-up Internet service. </text></subparagraph><subparagraph id="id75EBE3DDB9F24D9F855C8E7C40411065"><enum>(B)</enum><header>Scope</header><text>Such term includes— </text><clause id="idCF7305933D604910B38833D3503987D9"><enum>(i)</enum><text>any service that the Federal Communications Commission finds to be providing a functionally equivalent service to a service described in subparagraph (A); and</text></clause><clause id="idD117C1E600354D0BB319E0D3E94861A4"><enum>(ii)</enum><text>a service or application offered via a connected device.</text></clause></subparagraph></paragraph><paragraph id="id0eda908f-6e5c-4784-8274-c741729feab5"><enum>(15)</enum><header>Directed to children or teens</header><subparagraph id="id540bacf5-5a8e-4351-858c-499c99ed2523"><enum>(A)</enum><header>In general</header><text>The terms <term>directed to children</term>, <term>directed to teens</term>, and <term>directed to children or teens</term> mean, with respect to a website, online service, online application, mobile application, or connected device, that the website, online service, online application, mobile application, or connected device, or a portion thereof, is targeted to children or teens, as the case may be, as demonstrated by—</text><clause id="id169728a4-cfca-446d-8c69-fd457d880c08"><enum>(i)</enum><text>the subject matter of the website, online service, online application, mobile application, or connected device;</text></clause><clause id="idcafb9862-2a8d-41ab-a380-54b16d7f5b54"><enum>(ii)</enum><text>the visual content of the website, online service, online application, mobile application, or connected device;</text></clause><clause id="id780e1223-29c4-45f9-8e40-c4aa047113d5"><enum>(iii)</enum><text>the use of animated characters or child-oriented activities for children, or the use of teen-oriented characters or teen-oriented activities for teens, and related incentives on the website, online service, online application, mobile application, or connected device;</text></clause><clause id="id0616059a-afa3-4a45-b8e1-33f9df9bc34b"><enum>(iv)</enum><text>the music or other audio content on the website, online service, online application, mobile application, or connected device;</text></clause><clause id="id0ef31f5a-5e0f-42ad-8309-6336aa7288e5"><enum>(v)</enum><text>the age of models on the website, online service, online application, mobile application, or connected device;</text></clause><clause id="id8f258a6c-e46c-447e-97c5-50d6b322f28f"><enum>(vi)</enum><text>the presence, on the website, online service, online application, mobile application, or connected device, of—</text><subclause id="id3c4d806d-adc9-44aa-b07a-ed5ef5d8aa6f"><enum>(I)</enum><text>child celebrities;</text></subclause><subclause id="idc7a3021b-cb79-4c4e-b157-fc92b21e2b7c"><enum>(II)</enum><text>celebrities who appeal to children;</text></subclause><subclause id="id1fc8127e-5777-44f6-867d-a4331cf3d788"><enum>(III)</enum><text>teen celebrities; or</text></subclause><subclause id="idfd51a38c-a503-4fa1-9f61-475e0759f4ab"><enum>(IV)</enum><text>celebrities who appeal to teens;</text></subclause></clause><clause id="id5f0e1f06-9aa6-463a-8f7b-0cdf45278bd2"><enum>(vii)</enum><text>the language used on the website, online service, online application, mobile application, or connected device;</text></clause><clause id="ide392ad04-46f5-4d38-8ab7-c4c23c3fb062"><enum>(viii)</enum><text>advertising content used on, or used to advertise, the website, online service, online application, mobile application, or connected device; or</text></clause><clause id="id0f1f329f-ae4f-4211-9665-73ccb1a9ffbd"><enum>(ix)</enum><text>reliable empirical evidence relating to—</text><subclause id="id0e571804-3cad-4a72-8a81-aa4fb186f976"><enum>(I)</enum><text>the composition of the audience of the website, online service, online application, mobile application, or connected device; and</text></subclause><subclause id="id0e3a499f-a5f4-4fa1-8856-283bc3295032"><enum>(II)</enum><text>the intended audience of the website, online service, online application, mobile application, or connected device.</text></subclause></clause></subparagraph><subparagraph id="id0bc73611-fbb0-42af-bfde-94443b344a87"><enum>(B)</enum><header>Rules of construction</header><clause id="id888af603-a725-4861-a84e-f2e5f6819645"><enum>(i)</enum><header>Services deemed directed to children or teens</header><text>For the purposes of this title, a website, online service, online application, mobile application, or connected device, or a portion thereof, shall be deemed to be directed to children or teens if it collects personal information directly from users of any other website, online service, online application, mobile application, or connected device that is— </text><subclause id="id58937438AEE9477EAAFD476E50C15696"><enum>(I)</enum><text>directed to children or teens under the criteria described in subparagraph (A); or</text></subclause><subclause id="idA3C365518A784B47B51B135588EEABDD"><enum>(II)</enum><text>used or reasonably likely to be used by children or teens.</text></subclause></clause><clause id="ide02c3280-df76-414a-a63a-104c1e253b5c"><enum>(ii)</enum><header>Services deemed directed to mixed audiences</header><subclause id="id6b5bbf2f-a837-44df-82b2-90920cbbe94d"><enum>(I)</enum><header>In general</header><text>A website, online service, online application, mobile application, or connected device that is directed to children or teens under the criteria described in subparagraph (A), but that does not target children or teens as the primary audience of the website, online service, online application, mobile application, or connected device shall not be deemed to be directed to children or teens for purposes of this title if the website, online service, online application, mobile application, or connected device—</text><item id="id9b9f60d2-6e09-4a53-9892-92a8fc290ed5"><enum>(aa)</enum><text>does not collect personal information from any user of the website, online service, online application, mobile application, or connected device before verifying age information of the user; and</text></item><item id="id942d4a42-5803-4c38-b0a6-d3c5b29196f0"><enum>(bb)</enum><text>does not, without first complying with any relevant notice and consent provision under this title, collect, use, or disclose personal information of any user who identifies themselves to the website, online service, online application, mobile application, or connected device as an individual who is age 16 or younger.</text></item></subclause><subclause id="id1b78b663-2851-42ed-90e2-48255aa59f75"><enum>(II)</enum><header>Use of certain tools</header><text>For purposes of this title, a website, online service, online application, mobile application, or connected device, shall not be deemed directed to children or teens solely because the website, online service, online application, mobile application, or connected device refers or links to any other website, online service, online application, mobile application, or connected device directed to children or teens by using information location tools, including—</text><item id="id58d1e05b-c6db-4405-8140-732e3beeaa59"><enum>(aa)</enum><text>a directory;</text></item><item id="id75d37a06-6052-418e-bca9-4097db8cdda0"><enum>(bb)</enum><text>an index;</text></item><item id="idb38f6793-3da8-4a67-8459-67e9bd13a141"><enum>(cc)</enum><text>a reference;</text></item><item id="id0fcbc534-40df-4327-a4c1-e05cc85e7752"><enum>(dd)</enum><text>a pointer; or</text></item><item id="id710154ae-37c7-4297-a6b6-0818f6eee5dd"><enum>(ee)</enum><text>a hypertext link.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="id3a59bbb5-4c74-4cea-aad3-58b7bc2c6709"><enum>(16)</enum><header>Mobile application</header><text>The term <quote>mobile application</quote>—</text><subparagraph id="id5725f3de-ec27-4862-803c-372503f4a4ea"><enum>(A)</enum><text>means a software program that runs on the operating system of—</text><clause id="id61e410fe-5739-43f1-abaa-e75c40a35401"><enum>(i)</enum><text>a cellular telephone;</text></clause><clause id="id10de3472-19e0-44fd-be41-341fd1b4091f"><enum>(ii)</enum><text>a tablet computer; or</text></clause><clause id="id4b3688de-d9d6-494f-b344-4d3de155e4a1"><enum>(iii)</enum><text>a similar portable computing device that transmits data over a wireless connection; and</text></clause></subparagraph><subparagraph id="iddd1e859f-0b08-4856-bc29-6ab595e7de71"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="id6c257023-6e10-4769-882c-d9409bd2cb2f"><enum>(17)</enum><header>Geolocation information</header><text>The term <term>geolocation information</term> means information sufficient to identify a street name and name of a city or town.</text></paragraph><paragraph id="iddb304d11-d34a-4ff5-bd7f-e796df6d88ae"><enum>(18)</enum><header>Teen</header><text>The term <term>teen</term> means an individual over the age of 12 and under the age of 17.</text></paragraph><paragraph id="id56479df9-7989-4edb-9a7e-c28cb550f9bf"><enum>(19)</enum><header>Targeted marketing</header><subparagraph id="id7AFE331CAE2848BAA705CC2C2613A9F2"><enum>(A)</enum><header>In general</header><text>The term <term>targeted marketing</term> means advertising or any other effort to market a product or service that is directed to a specific individual or device—</text><clause id="idb5a9c0af-7966-4036-8ad7-250d74a7af5f"><enum>(i)</enum><text>based on—</text><subclause id="idead6acac-b9f6-47f4-a4da-49b41804b94b"><enum>(I)</enum><text>the personal information of—</text><item id="id3afac56f-a251-48a4-8004-047e78a2681a"><enum>(aa)</enum><text>the individual; or</text></item><item id="idaa5a7ed6-0cfa-4bf6-a930-6d926f7eec5a"><enum>(bb)</enum><text>a group of individuals who are similar in gender, age, income level, race, or ethnicity to the specific individual to whom the product or service is marketed;</text></item></subclause><subclause id="idf9af217f-21b3-4cbc-be39-30800555bd74"><enum>(II)</enum><text>psychological profiling of an individual or group of individuals; or</text></subclause><subclause id="id1a2149be-4769-4a32-acd1-d005a883b282"><enum>(III)</enum><text>a unique identifier of the device; or</text></subclause></clause><clause id="id96e91937-0d9f-41d1-827a-ec8f6ec48806"><enum>(ii)</enum><text>as a result of use by the individual, access by any device of the individual, or use by a group of individuals who are similar to the specific individual, of more than a single—</text><subclause id="idc680143c-fd8a-4d12-ad53-f52b2f187de0"><enum>(I)</enum><text>website;</text></subclause><subclause id="ided571de4-94e9-4c96-9604-06d1395c46fd"><enum>(II)</enum><text>online service;</text></subclause><subclause id="id94076aaf-6a29-43f6-adb2-5f33428cd795"><enum>(III)</enum><text>online application;</text></subclause><subclause id="id1acbd304-4fb3-444a-8dd6-1040429eafb4"><enum>(IV)</enum><text>mobile application; </text></subclause><subclause id="id4C9C8B6C7D89430790336DE7D0A4962B"><enum>(V)</enum><text>connected device; or</text></subclause><subclause id="id517da146-c149-4658-9946-2d9f75e57b77"><enum>(VI)</enum><text>operating system.</text></subclause></clause></subparagraph><subparagraph id="idE414C20DB91A4E98AE2EAE0A1123DAF5"><enum>(B)</enum><header>Exclusions</header><text>The term <term>targeted marketing</term> shall not include—</text><clause id="idad82c0b3b4c149f0a347d500aac06f65"><enum>(i)</enum><text>advertising or marketing to an individual or the device of an individual in response to the individual’s specific request for information or feedback;</text></clause><clause id="id8815caeeec2844a9920e6c3d294a5946"><enum>(ii)</enum><text>contextual advertising, such as when an advertisement is displayed based on the context in which the advertisement appears and does not vary based on who is viewing the advertisement; or</text></clause><clause id="id57a589e6646c4d648f013d6ace31fa97"><enum>(iii)</enum><text>processing personal information solely for measuring or reporting advertising or content performance, reach, or frequency, including independent measurement.</text></clause></subparagraph><subparagraph id="idC1EBFB59D34A44BB9E1437CB544F0923"><enum>(C)</enum><header>Authority to further define</header><text>The Commission may promulgate rules under section 553 of title 5, United State Code, to further define the term <term>targeted marketing</term> but only as necessary to address changes to or innovations of technology, changes in how personal information is used or transferred, changes to the means and manners by which children or teens interact with a website, online service, online application, mobile application, or connected device, or evolving concerns regarding the privacy of children or teens. </text></subparagraph></paragraph><paragraph id="id824C11298E76477AAE0EB200E3A14B88"><enum>(20)</enum><header>Reasonably likely to be used</header><text>The Commission may promulgate rules under section 553 of title 5, United States Code, or issue guidance to establish factors that should be considered in applying the term <term>reasonably likely to be used</term> for the purposes of this title.</text></paragraph><paragraph id="id8dd6dad3eaee465380cb855b57f4e3c5"><enum>(21)</enum><header>Reasonably likely to be a child or teen</header><text>The Commission may promulgate rules under section 553 of title 5, United States Code, or issue guidance to establish factors that should be considered in applying the term <term>reasonably likely to be a child or teen</term> for the purposes of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfd228d3a-6824-404a-ab9e-47e003ba200f"><enum>(b)</enum><header>Online collection, use, and disclosure of personal information of children and teens</header><text>Section 1303 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text><paragraph id="id57024c29-0dda-42ec-b091-f3941a19df30"><enum>(1)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="section" style="OLC">Online collection, use, and disclosure of personal information of children and teens.</header-in-text></quote>;</text></paragraph><paragraph id="id679cbcc1-d3fd-445f-bd11-69d6b8105f00"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id28d7ba9b-a0ad-4975-9055-2c839377fb62"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbc5a22b3-b01e-417b-af02-b92d90405f0f" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="id5507649e-7bfd-4e77-9448-9511c94a067d"><enum>(1)</enum><header>In general</header><text>It is unlawful for an operator of a website, online service, online application, mobile application, or connected device that is directed to children or teens or is used or reasonably likely to be used by children or teens in a manner that involves the collection of personal information, to collect personal information from a child or teen in a manner that violates the regulations prescribed under subsection (b).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idd32cdaaf-22d3-4e21-889e-8cc5e6bb7d6b"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idc24d492f-cd0d-425f-ab4e-a33ad5618e7e"><enum>(i)</enum><text>by striking <quote>of such a website or online service</quote>; and</text></clause><clause id="idbfdb34a9-62a8-4824-bcf9-cef55ecc9987"><enum>(ii)</enum><text>by striking <quote>subsection (b)(1)(B)(iii) to the parent of a child</quote> and inserting <quote>subsection (b)(1)(A)(iii) to the parent of a child or under subsection (b)(1)(A)(iv) to a teen</quote>; and</text></item><item id="id33A8D5698A1F4FCD9733C5C609EB3DD7"><enum>(dd)</enum><text>by striking <quote>; and</quote> and inserting <quote>, and the procedures or mechanisms the operator uses to ensure that personal information is not collected from children or teens except in accordance with the regulations promulgated under this paragraph;</quote>; and</text></item></subclause><subclause id="id9FFF4F05B8EB46FCAE846F3DF061953F"><enum>(III)</enum><text>in clause (ii)— </text><item id="idA5BB1500C1014579AE414D4B34F3930F" commented="no"><enum>(aa)</enum><text>by striking <quote>parental</quote>; and</text></subclause><subclause id="id1A709339E08E49BCB7B246287AF19038" commented="no"><enum>(III)</enum><text>in clause (iii), by inserting <quote>, if such information is available to the operator at the time the parent makes the request</quote> before the semicolon;</text></subclause></clause><clause commented="no" id="id10452D1FBCA8477D8250481D1D9D116B"><enum>(iv)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text></clause><clause commented="no" id="id3C3159C684CE4735BD857C88644DBC2D"><enum>(v)</enum><text>by inserting after subparagraph (B) the following new subparagraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id9773C10EB9EE4F5C8A6E3211CF0C5EFF" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subparagraph id="id329BA88C068546D886BC1B304157CDBC"><enum>(C)</enum><text>require the operator to provide, upon the request of a teen under this subparagraph who has provided personal information to the operator, upon proper identification of that teen—</text><clause id="idB12BFA759AB2408683A0E67D055F9022"><enum>(i)</enum><text>a description of the specific types of personal information collected from the teen by the operator;</text></clause><clause id="idC1D1C809BADD405B8F95857A886CCC69"><enum>(ii)</enum><text>the opportunity at any time to delete personal information collected from the teen and refuse further use or collection of personal information from the teen; and</text></clause><clause id="id0ACC5ED7142340A6BD57685F2E4CF32E"><enum>(iii)</enum><text>a means that is reasonable under the circumstances for the teen to obtain any personal information collected from the teen, if such information is available to the operator at the time the teen makes the request;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" id="id95C5371D7CC144DA90CC42445347AA19"><enum>(vi)</enum><text>in subparagraph (D), as so redesignated, by striking <quote>conditioning</quote> and all that follows through <quote>such activity</quote> and inserting the following: <quote>the collection from a child or teen of more personal information that is reasonably required to use the website, online service, online application, mobile application, or connected device</quote>; </text></clause><clause commented="no" id="idC3111BDE1A554BEC869A049AAB47FE90"><enum>(vii)</enum><text>in subparagraph (E), as so redesignated—</text><subclause commented="no" id="id66534A3596C844948A1640D944A79D3B"><enum>(I)</enum><text>by striking <quote>of such a website or online service</quote>; and</text></item><item id="id48e6789b-ec68-4741-9625-614bba0ea522"><enum>(bb)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote>; and</text></item></subclause></clause></subparagraph><subparagraph id="idb046b554-3977-46d2-b19e-2efff0150f2d"><enum>(C)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf5860ef4-3cd6-4507-903a-830325999bd1" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="id7b37ceb8-3e7d-478d-9f27-48c49fe1f94a"><enum>(3)</enum><header>Continuation of service</header><text>The regulations shall prohibit an operator from discontinuing service provided to a child or teen on the basis of a request by the parent of the child or by the teen, under the regulations prescribed under subparagraph (B) or (C) of paragraph (1), respectively, to delete personal information collected from the child or teen, to the extent that the operator is capable of providing such service without such information.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id340b47e9-9296-4f96-984f-1f4b5cb72d27"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text><paragraph id="id054d427e-7187-40d4-9eaf-38666f2420ab"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and teens</quote> after <quote>children</quote>; and</text></paragraph><paragraph id="id5c674850-9518-4963-a6fc-8493d77b9f6f"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9c01a050-4a49-4519-8423-c09a4c16658f" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subsection id="idbec8ffe3-91f2-41c7-96e8-8a694a3cee7e"><enum>(d)</enum><header>Publication</header><paragraph id="id6907AA16250142BC8897FFD7515DB0C3"><enum>(1)</enum><header>In general</header><text>The Commission shall publish on the internet website of the Commission any report or documentation required by regulation to be submitted to the Commission to carry out this section.</text></paragraph><paragraph id="id891296CAE3B3409D8AB7F37A1350F053"><enum>(2)</enum><header>Restrictions on publication</header><text>The restrictions described in subsection (f) of section 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(f)</external-xref>) applicable to the publication of information obtained by the Commission through investigations conducted under such section shall apply in same manner to the publication under this subsection of information obtained by the Commission from a report or documentation described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id50a4a6ee-1d9c-47db-b4b9-a85c0f712058"><enum>(d)</enum><header>Administration and applicability of Act</header><text>Section 1306 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6505">15 U.S.C. 6505</external-xref>) is amended—</text><paragraph id="idf458c27c-a13a-4f5a-9c5a-2d055df41a0c"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id5aa47715-c6e1-4203-912c-826db6b86b83"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, in the case of</quote> and all that follows through <quote>the Board of Directors of the Federal Deposit Insurance Corporation;</quote> and inserting the following: <quote>by the appropriate Federal banking agency, with respect to any insured depository institution (as those terms are defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>));</quote>; and</text></subparagraph></paragraph><paragraph id="id07f47931-44d8-492f-aaa8-48cdf2ebcf30"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id72a82fa8-c691-4eec-a889-398c3fb97c85" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subsection id="id42e774ef-fde2-4b7b-9a79-33ea1966f30f"><enum>(f)</enum><header>Telecommunications carriers and cable operators</header><paragraph id="idab262100-064d-4613-ae97-73d8cd5bd7c6"><enum>(1)</enum><header>Enforcement by commission</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46), or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act and the regulations promulgated under this Act, in the same manner provided in subsection (d), with respect to common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and Acts amendatory thereof and supplementary thereto.</text></paragraph><paragraph id="id8ac4a4e9-d635-4547-a4b7-b6dff59ce575"><enum>(2)</enum><header>Relationship to other law</header><text>To the extent that section 222, 338(i), or 631 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>, 338(i), 551) is inconsistent with this title, this title controls.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idbe96b743-010a-4a69-ac6f-818e2428bb00" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>4.</enum><header>Fair Information Practices Principles</header><subsection id="id95DDC0D3E2104BC6A9426D8D3E62C64F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Information Practices Principles described in this section are the following:</text><paragraph id="id0c8dad15-241d-4446-a7e2-7dc4bc32cc0b"><enum>(1)</enum><header>Collection limitation principle</header><text>Except as provided in paragraph (3), personal information should be collected from a child or teen only when collection of the personal information is—</text><subparagraph id="id68826d8f-3217-4173-af18-847babda930a"><enum>(A)</enum><text>consistent with the context of a particular transaction or service or the relationship of the child or teen with the operator, including collection necessary to fulfill a transaction or provide a service requested by the child or teen; or</text></subparagraph><subparagraph id="ide77f9820-0e75-411b-a5a2-86c3b81ebc70"><enum>(B)</enum><text>required or specifically authorized by law.</text></subparagraph></paragraph><paragraph id="ide5080944-5de1-4676-b7d7-a14170629a78"><enum>(2)</enum><header>Data quality principle</header><text>The personal information of a child or teen should be accurate, complete, and kept up-to-date to the extent necessary to fulfill the purposes described in subparagraphs (A) through (D) of paragraph (3).</text></paragraph><paragraph id="id15a6273e-5b39-48bd-84f9-edd29b870245"><enum>(3)</enum><header>Purpose specification principle</header><text>The purposes for which personal information is collected and used should be specified to the parent of a child or to a teen not later than at the time of the collection of the information. The subsequent use or disclosure of the information should be limited to—</text><subparagraph id="idc76134f2-a563-4bed-bc3d-6a424faffa48"><enum>(A)</enum><text>fulfillment of the transaction or service requested by the teen or parent of the child;</text></subparagraph><subparagraph id="id2841032d-b830-49e2-828d-24b90ced11da"><enum>(B)</enum><text>support for the internal operations of the website, service, or application, as described in section 312.2 of title 16, Code of Federal Regulations (as in effect on the date of enactment of this Act), excluding any activity relating to targeted marketing directed to children, teens, or a device of a child or teen if the support for internal operations in consistent with the interest of the child or teen; </text></subparagraph><subparagraph id="ida4d3e372-882d-44c2-8e42-7d9ddd88ef04"><enum>(C)</enum><text>compliance with legal process or other purposes expressly authorized under specific legal authority; or</text></subparagraph><subparagraph id="idea71f2c0-ce46-4901-8551-82f941943152"><enum>(D)</enum><text>other purposes—</text><clause id="idf85be668-7ecc-4ed5-8d7a-e117db21c820"><enum>(i)</enum><text>that are specified in a notice to the teen or parent of the child; and</text></clause><clause id="idde4871fe-2c14-47d0-bcd9-fc894bd64fc7"><enum>(ii)</enum><text>to which the teen or parent of the child has consented under paragraph (7) before the information is used or disclosed for such other purposes.</text></clause></subparagraph></paragraph><paragraph id="idef39080c-7413-405c-ab55-05f05625f141"><enum>(4)</enum><header>Retention limitation principle</header><subparagraph id="id39a01a74-6cfb-4c00-b2aa-f8bc0eba73f4"><enum>(A)</enum><header>In general</header><text>The personal information of a child or teen should not be retained for longer than is necessary to fulfill a transaction or provide a service requested by the child or teen or such other purposes specified in subparagraphs (A) through (D) of paragraph (3).</text></subparagraph><subparagraph id="id7eac9d15-5069-4abf-af83-4d17c6e7a0db"><enum>(B)</enum><header>Data disposal</header><text>The operator should implement a reasonable and appropriate data disposal policy based on the nature and sensitivity of personal information described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id1bb51a15-6d56-426a-8e49-d4b470fcef8c"><enum>(5)</enum><header>Security safeguards principle</header><text>The personal information of a child or teen should be protected by reasonable and appropriate security safeguards against risks such as loss or unauthorized access, destruction, use, modification, or disclosure.</text></paragraph><paragraph id="idb5899c56-6820-4c95-b7fe-52145e966a24"><enum>(6)</enum><header>Transparency principle</header><subparagraph id="id7113c066-5e8f-49f6-8b0b-f71913140274"><enum>(A)</enum><header>General principle</header><text>The operator should be transparent about developments, practices, and policies with respect to the personal information of a child or teen.</text></subparagraph><subparagraph id="id439c7346-c97d-4170-b77b-b8cf5b79c723"><enum>(B)</enum><header>Provision of information</header><text>The operator should provide to each parent of a child, or to each teen, using the website, online service, online application, mobile application, or connected device of the operator with a clear and prominent means—</text><clause id="id7272ca8c-9eac-4b2e-9ab9-a8e6f23414a6"><enum>(i)</enum><text>to identify and contact the operator, by, at a minimum, disclosing, clearly and prominently, the identity of the operator and—</text><subclause id="ida415b5e8-638d-49ad-9ece-cd984665d9a9"><enum>(I)</enum><text>in the case of an operator who is an individual, the address of the principal residence (but not a personal residence) of the operator and an email address or online contact form and telephone number for the operator; or</text></subclause><subclause id="id907cb40d-8b95-4b46-a3b4-9063754b606a"><enum>(II)</enum><text>in the case of any other operator, the address of the principal place of business of the operator and an email address or online contact form and telephone number for the operator;</text></subclause></clause><clause id="id7af3bbde-35b5-4709-9038-308006005379"><enum>(ii)</enum><text>to determine whether the operator possesses any personal information of the child or teen, the nature of any such information, and the purposes for which the information was collected and is being retained;</text></clause><clause id="id9e77fb06-382a-462a-9e33-e9193bb3a075"><enum>(iii)</enum><text>to obtain any personal information of the child or teen that is in the possession of the operator from the operator, or from a person specified by the operator, within a reasonable time after making a request, at a charge (if any) that is not excessive, in a reasonable manner, and in a form that is readily intelligible to the child or teen;</text></clause><clause id="idedc8309f-0685-46b3-94d0-dba0c50d601b"><enum>(iv)</enum><text>to challenge the accuracy of personal information of the child or teen that is in the possession of the operator;</text></clause><clause id="id299bb5ef-2abb-4b0a-b23b-f06f7032ef53"><enum>(v)</enum><text>to determine if the child or teen has established the inaccuracy of personal information in a challenge under clause (iv) in order to have such information erased, corrected, completed, or otherwise amended; and</text></clause><clause id="id22ee26c2-2b3f-4342-b4b8-c15c5e99df7e"><enum>(vi)</enum><text>to determine the method by which the operator obtains data relevant to the child or teen.</text></clause></subparagraph><subparagraph id="idca678a07-40b9-415e-878c-86219de91eda"><enum>(C)</enum><header>Limitation</header><text>Nothing in this paragraph shall be construed to permit an operator to erase or otherwise modify personal information requested by a law enforcement agency pursuant to legal authority.</text></subparagraph></paragraph><paragraph id="id5864e2fd-b075-4b11-bc2f-0ae70c9a2ecd"><enum>(7)</enum><header>Individual participation principle</header><text>The operator should—</text><subparagraph id="id9886f372-52f1-408e-8baf-4fa76c4e3dfa"><enum>(A)</enum><text>obtain consent from a parent of a child or from a teen before using or disclosing the personal information of the child or teen for any purpose other than the purposes described in subparagraph (A) of paragraph (3); and</text></subparagraph><subparagraph id="ida066c8e1-2e95-400e-88b3-4541810a7d1c"><enum>(B)</enum><text>obtain affirmative express consent from a parent of a child or from a teen before using or disclosing previously collected personal information of the child or teen for purposes that constitute a material change in practice from the original purposes specified to the child or teen under paragraph (3).</text></subparagraph></paragraph><paragraph id="id90bac30a-4faf-4769-8116-7f3ff85a2ef4"><enum>(8)</enum><header>Racial and socioeconomic profiling</header><text>The personal information of a child or teen shall not be used to direct content to the child or teen, or a group of individuals similar to the child or teen, on the basis of race, socioeconomic factors, or any proxy thereof.</text></paragraph></subsection><subsection id="id4b7cd16d7ea249c1bee908bd035aaaf6"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section, including compliance with the Fair Information Principles, shall be construed to permit an operator to avoid compliance with other requirements set forth in this Act or the Children's Online Privacy Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>).</text></subsection></section><section id="id935087fe-aa17-4525-b2c7-6ce27c442075" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>5.</enum><header>Digital Marketing Bill of Rights for Teens</header><subsection id="idb6f62ce3-f0c4-4439-b81e-298662afdcde"><enum>(a)</enum><header>Acts prohibited</header><paragraph id="id17db499c-bdba-46f5-bc19-7ddfec9d2d1f"><enum>(1)</enum><header>Prohibition</header><subparagraph id="id4096010e-9c0f-4357-a7a6-e148370a7ff6"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), it shall be unlawful for an operator of a website, online service, online application, mobile application, or connected device to collect personal information from a user if—</text><clause id="id933A1993DF4B4406A010B16B8F027716"><enum>(i)</enum><text>the user is reasonably likely to be a teen; or</text></clause><clause id="ide7879861-f2fa-4e4b-a3c1-d68d0c1913b7"><enum>(ii)</enum><text>the website, online service, online application, mobile application, or connected device is directed to teens.</text></clause></subparagraph><subparagraph id="ide3cb9279-fbf4-4eb6-b981-6816c816cf09"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to an operator that has adopted and complies with a Digital Marketing Bill of Rights for Teens that meets the Fair Information Practices Principles described in section 4.</text></subparagraph></paragraph><paragraph id="id5185eea3-bcf5-43c2-a427-05c812d070ff"><enum>(2)</enum><header>Effective date</header><text>This subsection shall take effect on the date that is 180 days after the promulgation of regulations under subsection (b).</text></paragraph></subsection><subsection id="id90ce8346-c984-4632-acd6-b2a176e630c2"><enum>(b)</enum><header>Regulations</header><paragraph id="id5abcc04c-a5c0-40dc-a87a-bd500226a253"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to implement this section, including regulations further defining the Fair Information Practices Principles described in section 4.</text></paragraph><paragraph id="ida38de653-d33d-43de-80b0-8aea4ffacd88"><enum>(2)</enum><header>Updates</header><text>Not less frequently than once every 4 years after the date on which regulations are promulgated under paragraph (1), the Commission shall review and update those regulations as necessary.</text></paragraph></subsection></section><section id="id98a03d2a-7995-44fa-b6ef-f86970ffe305" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>6.</enum><header>Targeted marketing to children and teens</header><subsection id="id9cf77c87-a729-4795-894f-de94fd8d0be9"><enum>(a)</enum><header>Prohibited acts with respect to children and teens</header><text>It shall be unlawful for an operator of a website, online service, online application, mobile application, or connected device to collect, use, disclose to third parties, or compile personal information of a user for purposes of targeted marketing (or to allow another person to collect, use, disclose, or compile such information for such purpose) if—</text><paragraph id="idD3A0DE8DA00A436488110766CD66C749"><enum>(1)</enum><text>such use, disclosure, or compiling of personal information involves or is reasonably likely to involve collection of personal information from a child or teen; or</text></paragraph><paragraph id="id0ed30be3-4212-4221-8067-12b4ad6f564e"><enum>(2)</enum><text>the website, online service, online application, mobile application, or connected device is directed to children or teens.</text></paragraph></subsection><subsection id="idbbf4f9b3-9c2d-4772-9d2e-40f41dfd7896" commented="no"><enum>(b)</enum><header>Effective date</header><text>This section shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subsection></section><section id="id9518272d-5b2c-44c0-9fc8-a1179f880335" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>7.</enum><header>Removal of content</header><subsection id="idb7a0e552-224c-4beb-986e-86f8a036b558"><enum>(a)</enum><header>Acts prohibited</header><text>It is unlawful for an operator to make, or enable a child or teen to make, publicly available through a website, online service, online application, mobile application, or connected device content or information that contains or displays personal information of children or teens in a manner that violates subsection (b).</text></subsection><subsection id="id2ed6330b-e0d8-4073-b4c6-cf2ff39adbd7"><enum>(b)</enum><header>Requirement</header><paragraph id="id9ad6c11e-6708-4a32-b95f-698f6cbf120b"><enum>(1)</enum><header>In general</header><text>An operator, to the extent technologically feasible, shall—</text><subparagraph id="id1f23e2bc-2c78-42b5-b61a-79452e37dbe8"><enum>(A)</enum><text>implement mechanisms that permit a user of the website, online service, online application, mobile application, or connected device of the operator (and, in the case of a user that is a child, a parent of that user) to erase or otherwise eliminate content or information that is—</text><clause id="id7443b319-4875-4544-99c8-c33af7eceb84"><enum>(i)</enum><text>submitted to the website, online service, online application, mobile application, or connected device by that user;</text></clause><clause id="idfaecb4bc-5024-498c-ba50-a68b40a84f25"><enum>(ii)</enum><text>publicly available through the website, online service, online application, mobile application, or connected device; and</text></clause><clause id="id8396dc3f-c5c9-4187-8689-e805359b6de8"><enum>(iii)</enum><text>contains or displays personal information of children or teens; and</text></clause></subparagraph><subparagraph id="idb965a005-711e-4601-a566-e5da8293c86a"><enum>(B)</enum><text>take appropriate steps to—</text><clause id="id628f1111-0e20-45ac-b84b-a0b115f039cf"><enum>(i)</enum><text>make users and parents of users who are children aware of the mechanisms described in subparagraph (A); and</text></clause><clause id="idac542855-03b6-4399-adfb-1f1569d1460f"><enum>(ii)</enum><text>provide notice to users and parents of users who are children that the mechanisms described in subparagraph (A) do not necessarily provide comprehensive removal of the content or information submitted by users.</text></clause></subparagraph></paragraph><paragraph id="id672d40a3-48b4-4293-8784-a29cf7d9014f"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not be construed to require an operator or third party to erase or otherwise eliminate content or information that—</text><subparagraph id="id36fe7198-15c1-47cc-8162-6f7d3749f6f4"><enum>(A)</enum><text>any other provision of Federal or State law requires the operator or third party to maintain; or</text></subparagraph><subparagraph id="id1a828708-4734-4092-b099-3954a771fbf3"><enum>(B)</enum><text>was submitted to the website, online service, online application, mobile application, or connected device of the operator by any person other than the user who is attempting to erase or otherwise eliminate the content or information, including content or information submitted by the user that was republished or resubmitted by another person.</text></subparagraph></paragraph></subsection><subsection id="id7ed6d0ec-99ea-48c7-9485-d239e3da3817"><enum>(c)</enum><header>Limitation</header><text>Nothing in this section shall be construed to limit the authority of a law enforcement agency to obtain any content or information from an operator as authorized by law or pursuant to an order of a court of competent jurisdiction.</text></subsection><subsection id="id15ca79d6-fda8-4b16-97f4-47c6c729b95f"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subsection></section><section id="id4e666b66-0ac5-4abe-8ac5-79528f843404" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>8.</enum><header>Rule for treatment of users of websites, services, and applications directed to children or teens</header><text display-inline="no-display-inline">For the purposes of this Act, an operator of a website, online service, online application, mobile application, or connected device that is directed to children or teens shall treat each user of that website, online service, online application, mobile application, or connected device as a child or teen, except as permitted by the Commission pursuant to a regulation promulgated under this Act, and except to the extent the website, online service, online application, mobile application, or connected device is deemed directed to mixed audiences.</text></section><section id="id809439dd-f904-415d-9171-5d62f9283934" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>9.</enum><header>Study of mobile and online application oversight</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Commission shall submit to each committee of the Senate and each committee of the House of Representatives that has jurisdiction over the Commission a report on the processes of platforms that offer mobile and online applications for ensuring that, of those applications that are directed to children or teens, the applications operate in accordance with—</text><paragraph id="id52bd96f3-aa11-4cc3-9bd7-0ef45734080f"><enum>(1)</enum><text>this Act, the amendments made by this Act, and rules promulgated under this Act; and</text></paragraph><paragraph id="idfe354ba2-31f9-4a62-a7dc-e5302ff746fa"><enum>(2)</enum><text>rules promulgated by the Commission under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) relating to unfair or deceptive acts or practices in marketing.</text></paragraph></section><section id="id7e92491d-a5d5-4864-a262-af3f2a41d54c" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>10.</enum><header>Youth Privacy and Marketing Division</header><subsection id="idad3ca62a-2bf8-4d61-8e15-ce31571f583a"><enum>(a)</enum><header>Establishment</header><text>There is established within the Commission a division to be known as the Youth Privacy and Marketing Division.</text></subsection><subsection id="id22a34d23-ef2a-4b02-8b67-adfc708cd08a"><enum>(b)</enum><header>Director</header><text>The Youth Privacy and Marketing Division shall be headed by a Director.</text></subsection><subsection id="id207fe03e-db8a-412e-bdf1-50bf4be89000"><enum>(c)</enum><header>Duties</header><text>The Youth Privacy and Marketing Division established under subsection (a) shall be responsible for assisting the Commission to address, as it relates to this Act and the amendments made by this Act—</text><paragraph id="ida9501d08-9408-492e-abf8-94a8926d910c"><enum>(1)</enum><text>the privacy of children and teens; and</text></paragraph><paragraph id="id40332e1c-6e6d-4381-982d-a3ed899d05be"><enum>(2)</enum><text>marketing directed at children and teens.</text></paragraph></subsection><subsection id="id17557b28-9d88-4f81-800a-164ac42d7c8a"><enum>(d)</enum><header>Staff</header><text>The Director of the Youth Privacy and Marketing Division shall hire adequate staff to carry out the duties under subsection (c), including individuals who are experts in data protection, digital advertising, data analytics, and youth development.</text></subsection><subsection id="id6080f540-d3dd-4680-ba6e-cd9a08bbd390"><enum>(e)</enum><header>Reports</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Director of the Youth and Privacy Marketing Division shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes—</text><paragraph id="id7aaa5af2-a17f-45fc-8059-40e2e1199399"><enum>(1)</enum><text>a description of the work of the Youth Privacy and Marketing Division on emerging concerns relating to youth privacy and marketing practices; and</text></paragraph><paragraph id="id54588d63-dfc8-4b11-8777-913e4c648ff5"><enum>(2)</enum><text>an assessment of how effectively the Commission has, during the period for which the report is submitted, addressed youth privacy and marketing practices.</text></paragraph></subsection></section><section id="idcdb08df7-f37a-4cd0-b5d3-071bc8d991c9" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>11.</enum><header>Enforcement and applicability</header><subsection id="id7e99fe35-22fe-4491-820e-a94e2764221a"><enum>(a)</enum><header>Enforcement by the Commission</header><paragraph id="idd1fed6d9-fa6a-4eb9-b885-9520d85d8d2f"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided, this Act and the regulations prescribed under this Act shall be enforced by the Commission under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph><paragraph id="id93724448-3cef-4cee-8702-5a9dfea758f4"><enum>(2)</enum><header>Unfair or deceptive acts or practices</header><text>Subject to subsection (b), a violation of this Act or a regulation prescribed under this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id16311335-07bb-4480-b5fb-7996eca6380e"><enum>(3)</enum><header>Actions by the Commission</header><subparagraph id="id4eff2bcc-f105-48e8-9bb3-505453f4bc86"><enum>(A)</enum><header>In general</header><text>Subject to subsection (b), and except as provided in subsection (d)(1), the Commission shall prevent any person from violating this Act or a regulation prescribed under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act, and any person who violates this Act or such regulation shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph><subparagraph id="id6b31dac3-0385-48ca-aa09-60d933369a05"><enum>(B)</enum><header>Violations</header><text>Notwithstanding section 5(m) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(m)</external-xref>), a civil penalty recovered for a violation of this Act or a regulation prescribed under this Act may be in excess of the amounts provided for in that section as the court finds appropriate to deter violations of this Act and regulations prescribed under this Act.</text></subparagraph></paragraph></subsection><subsection id="id17c6387e-bc6a-41d3-99f1-5cfbc2b3e740"><enum>(b)</enum><header>Enforcement by certain other agencies</header><text>Notwithstanding subsection (a), compliance with the requirements imposed under this Act shall be enforced as follows:</text><paragraph id="ide42f3458-3c64-45ae-8afc-4ecced29c01a"><enum>(1)</enum><text>Under section 8 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1818">12 U.S.C. 1818</external-xref>) by the appropriate Federal banking agency, with respect to an insured depository institution (as such terms are defined in section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)).</text></paragraph><paragraph id="id43d8c496-743a-48f1-8c3d-5f8fdf6df5a3"><enum>(2)</enum><text>Under the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1751">12 U.S.C. 1751 et seq.</external-xref>) by the National Credit Union Administration Board, with respect to any Federal credit union.</text></paragraph><paragraph id="ida27df95b-3377-48db-a0a1-2f6925b36178"><enum>(3)</enum><text>Under part A of subtitle VII of title 49, United States Code, by the Secretary of Transportation, with respect to any air carrier or foreign air carrier subject to such part.</text></paragraph><paragraph id="id7b60bce4-f43a-4212-a42e-c6874a2ceaea"><enum>(4)</enum><text>Under the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/181">7 U.S.C. 181 et seq.</external-xref>) (except as provided in section 406 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/226">7 U.S.C. 226</external-xref>, 227)) by the Secretary of Agriculture, with respect to any activities subject to that Act.</text></paragraph><paragraph id="idd4fcfcf7-3987-40b4-8863-b82a26f3fbae"><enum>(5)</enum><text>Under the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2001">12 U.S.C. 2001 et seq.</external-xref>) by the Farm Credit Administration, with respect to any Federal land bank, Federal land bank association, Federal intermediate credit bank, or production credit association.</text></paragraph></subsection><subsection id="idefedb4af-524c-4302-bceb-fa0e77811849"><enum>(c)</enum><header>Enforcement by State attorneys general</header><paragraph id="ide894a4fc-c716-4e7c-bdaa-b1c5caf689a6"><enum>(1)</enum><header>In general</header><subparagraph id="id3f44ce86-a31d-4607-9e95-77e356b1e873"><enum>(A)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act or a regulation prescribed under this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States of appropriate jurisdiction to—</text><clause id="id6ff2f7b5-0e18-4f08-97a8-6d1cec53729b"><enum>(i)</enum><text>enjoin that practice;</text></clause><clause id="id343db776-cf11-474a-b518-09f894459bc8"><enum>(ii)</enum><text>enforce compliance with this Act or such regulation;</text></clause><clause id="idaf0796f7-83ea-4b0f-970c-f5c5583799f1"><enum>(iii)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></clause><clause id="id68e63f08-48ba-4ee6-8c8e-ccb5aedb6d91"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></clause></subparagraph><subparagraph id="id1c6a6cf9-b197-4174-a8d3-1fdcb3440f19"><enum>(B)</enum><header>Notice</header><clause id="ideb209bee-8ab2-4ed4-a7fb-9dfac6e1b3f9"><enum>(i)</enum><header>In general</header><text>Before filing an action under subparagraph (A), the attorney general of the State involved shall provide to the Commission—</text><subclause id="idea4ff37a-efcd-4ea7-a8b6-19b7cb41a58b"><enum>(I)</enum><text>written notice of that action; and</text></subclause><subclause id="id6b024864-d2e6-46e6-b515-f501cebf5e70"><enum>(II)</enum><text>a copy of the complaint for that action.</text></subclause></clause><clause id="id83dcbc22-dac1-4921-9eaf-e5c2b644c39a"><enum>(ii)</enum><header>Exemption</header><subclause id="idfebb1b79-3030-4500-a8a3-d8b5ec19f59b"><enum>(I)</enum><header>In general</header><text>Clause (i) shall not apply with respect to the filing of an action by an attorney general of a State under this paragraph if the attorney general of the State determines that it is not feasible to provide the notice described in that clause before the filing of the action.</text></subclause><subclause id="idd86917dc-1c8c-4f4f-a056-983ce0a4dba7"><enum>(II)</enum><header>Notification</header><text>In an action described in subclause (I), the attorney general of a State shall provide notice and a copy of the complaint to the Commission at the same time as the attorney general files the action.</text></subclause></clause></subparagraph></paragraph><paragraph id="id5a29949e-8ec6-46bc-8092-e5ea3dac6a92"><enum>(2)</enum><header>Intervention</header><subparagraph id="id56cb62f9-1e59-46c6-8369-1e6e95a86ba2"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (1)(B), the Commission shall have the right to intervene in the action that is the subject of the notice.</text></subparagraph><subparagraph id="id202ff9da-b620-4bb6-b556-004c60c1b669"><enum>(B)</enum><header>Effect of intervention</header><text>If the Commission intervenes in an action under paragraph (1), it shall have the right—</text><clause id="id59be8788-9e49-43ad-99f3-e8dc019033ca"><enum>(i)</enum><text>to be heard with respect to any matter that arises in that action; and</text></clause><clause id="id5f3241f2-44ce-46d7-8570-5d25b84f7ad9"><enum>(ii)</enum><text>to file a petition for appeal.</text></clause></subparagraph></paragraph><paragraph id="idd78fe817-b0dd-40e2-ac5a-5e8e0cdc9dc6"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text><subparagraph id="id33e13492-69d4-4859-b017-a1b77631ee3e"><enum>(A)</enum><text>conduct investigations;</text></subparagraph><subparagraph id="idd2fa6f01-0058-422c-910a-737110dd4051"><enum>(B)</enum><text>administer oaths or affirmations; or</text></subparagraph><subparagraph id="id5ce1d70e-6a05-4fb4-acd7-ec9f14a30955"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary and other evidence.</text></subparagraph></paragraph><paragraph id="idbaa067e0-5458-4a20-918f-66ae90084c1e"><enum>(4)</enum><header>Actions by the Commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for violation of this Act or a regulation prescribed under this Act, no State may, during the pendency of that action, institute a separate action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the Commission for that violation.</text></paragraph><paragraph id="id5d2218ef-415a-43f5-a2d4-94b0e27993ec"><enum>(5)</enum><header>Venue; service of process</header><subparagraph id="id780d7f98-a431-4ce7-85fa-2e8db700895a"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code.</text></subparagraph><subparagraph id="id287c5f58-a29c-465d-b9fe-2a05dd5e85d2"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause id="id045c7c69-7351-4aab-a9d4-7b5010191bb2"><enum>(i)</enum><text>is an inhabitant; or</text></clause><clause id="id9194f5d7-f8d3-4bba-9747-8fe268b79790"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph></subsection><subsection id="iddd69cc4d-32bd-47dc-8090-3528311abd74"><enum>(d)</enum><header>Telecommunications carriers and cable operators</header><paragraph id="ide758f42d-a194-4183-b010-f7fa2506d6b2"><enum>(1)</enum><header>Enforcement by Commission</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act and regulations promulgated under this Act, in the same manner provided in paragraph (a), with respect to common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and Acts amendatory thereof and supplementary thereto.</text></paragraph><paragraph id="idc77ece04-3250-4e81-bee7-f13db7e79c76"><enum>(2)</enum><header>Relationship to other laws</header><text>To the extent that section 222, 338(i), or 631 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>, 338(i), 551) is inconsistent with this Act, this Act controls.</text></paragraph></subsection><subsection id="ida5befc0c-de37-4864-a38b-2bedbc06b367"><enum>(e)</enum><header>Safe harbors</header><paragraph id="ida22b0566-7eee-4d0c-9755-caca0886745b"><enum>(1)</enum><header>Definition</header><text>In this subsection—</text><subparagraph id="id631ff6d4-cffa-4d7f-8fdb-fd20e2d20b6b"><enum>(A)</enum><text>the term <term>applicable section</term> means section 5, 6, 7, or 8 of this Act;</text></subparagraph><subparagraph id="id582ef288-32ee-47b3-a218-a7bddd699e41"><enum>(B)</enum><text>the term <term>covered operator</term> means an operator subject to guidelines approved under paragraph (2);</text></subparagraph><subparagraph id="id0e7fa59e-8973-4753-906c-9ddb36f49f8f"><enum>(C)</enum><text>the term <term>requesting entity</term> means an entity that submits a safe harbor request to the Commission; and</text></subparagraph><subparagraph id="id28ff05b6-f8c6-4cf5-8b00-dd363790e999"><enum>(D)</enum><text>the term <term>safe harbor request</term> means a request to have self-regulatory guidelines described in paragraph (2)(A) approved under that paragraph.</text></subparagraph></paragraph><paragraph id="ida17caa86-1f7a-4c8e-a66a-3cb73d1c083c"><enum>(2)</enum><header>Guidelines</header><subparagraph id="id8aa54b7a-11bb-4187-b35a-01a07b16b3f7"><enum>(A)</enum><header>In general</header><text>An operator may satisfy the requirements of regulations issued under an applicable section by following a set of self-regulatory guidelines, issued by representatives of the marketing or online industries, or by other persons, that, after notice and an opportunity for comment, are approved by the Commission upon making a determination that the guidelines meet the requirements of the regulations issued under that applicable section.</text></subparagraph><subparagraph id="id3fca65b7-b4ae-43fd-8ac9-d0b9d0a1133d"><enum>(B)</enum><header>Expedited response to requests</header><text>Not later than 180 days after the date on which a safe harbor request is filed under subparagraph (A), the Commission shall act upon the request set forth in writing the conclusions of the Commission with regard to the request.</text></subparagraph><subparagraph id="id179c953b-131f-4348-a69b-0594265218ed"><enum>(C)</enum><header>Appeals</header><text>A requesting entity may appeal the final action of the Commission under subparagraph (B), or a failure by the Commission to act in the period described in that paragraph, to a district court of the United States of appropriate jurisdiction, as provided for in section 706 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="id241d29a0-1ff9-41bc-9711-3fa4924a0857"><enum>(3)</enum><header>Incentives</header><subparagraph id="idbd9d6da2-5d00-46c9-9adf-336c9a2189e4"><enum>(A)</enum><header>Self-regulatory incentives</header><text>In prescribing regulations under an applicable section, the Commission shall provide incentives for self-regulation by covered operators to implement the protections afforded children and teens, as applicable, under the regulatory requirements described in those sections.</text></subparagraph><subparagraph id="idcf8845ce-3aff-4e2c-a16d-421e5a1aabd8"><enum>(B)</enum><header>Deemed compliance</header><text>The incentives under subparagraph (A) shall include provisions for ensuring that a covered operator will be deemed to be in compliance with the requirements of the regulations under an applicable section if that person complies with guidelines approved under paragraph (2).</text></subparagraph></paragraph><paragraph id="id6420ae4894694003917d07196a6d10fd"><enum>(4)</enum><header>Regulations</header><subparagraph id="id88F61BB088074C018B85347B9EAFACAE"><enum>(A)</enum><header>In general</header><text>In prescribing regulations relating to safe harbor guidelines under an applicable section, the Commission shall—</text><clause id="id91a2606c38024016be296465f9a6f162"><enum>(i)</enum><text>establish criteria for the approval of guidelines that will ensure that a covered operator provides substantially the same or greater protections for children and teens, as applicable, as those contained in the regulations issued under the applicable section; and</text></clause><clause id="idc693e0d3430444bb9228b53e898d919f"><enum>(ii)</enum><text>subject to subsection (B), require that any report or documentation required to be submitted to the Commission by a covered operator or requesting entity will be published on the internet website of the Commission.</text></clause></subparagraph><subparagraph id="idA4E7E05BD30D46A09F4423CA41045015" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Restrictions on publication</header><text display-inline="yes-display-inline">The restrictions described in subsection (f) of section 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(f)</external-xref>) applicable to the publication of information obtained by the Commission through investigations conducted under such section shall apply in same manner to the publication under this paragraph of information included in a report or documentation described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="id542eaa74-bd8c-43d3-8fa3-b5580beca27a"><enum>(5)</enum><header>Report by the Inspector General</header><subparagraph id="id6be6ea8e-63c7-4fcd-84fa-be8e21d04b57"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and once each 2 years thereafter, the Inspector General of the Commission shall submit to the Commission and each committee of the Senate and each committee of the House of Representatives that has jurisdiction over the Commission a report regarding the safe harbor provisions under this subparagraph, which shall include—</text><clause id="id009e06f5-62bb-4f95-b7f8-b84bb52f500d"><enum>(i)</enum><text>an analysis of whether the safe harbor provisions are—</text><subclause id="idd7787bd0-fd75-4ec5-a0e0-74ac7de8179b"><enum>(I)</enum><text>operating fairly and effectively; and</text></subclause><subclause id="idfb7f44d7-48ff-44d4-8524-b026309d2182"><enum>(II)</enum><text>effectively protecting the interests of children and teens; and</text></subclause></clause><clause id="id1de3ebde-8b86-4147-b41c-2e9f5785ebd7"><enum>(ii)</enum><text>proposals for policy changes that would improve the effectiveness of the safe harbor provisions.</text></clause></subparagraph><subparagraph id="id7aa743d4-18cb-4e69-84fb-8629173b38f1"><enum>(B)</enum><header>Publication</header><text>Not later than 10 days after the date on which a report under subparagraph (A) is submitted, the Commission shall publish the report on the internet website of the Commission.</text></subparagraph></paragraph></subsection><subsection id="id0e33e090-b959-4ac3-89bd-c6bb6ade4b61" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Effective date</header><text>This section shall take effect on the date that is 90 days after the date of enactment of this Act.</text></subsection><subsection id="id3D1838E0CACD4E239C0F191619E9F6CE"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to authorize any action by the Commission that would violate section 18(h) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(h)</external-xref>). </text></subsection></section><section id="idE1DBE4BAE9014897837B0791ADC71EB3" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>12.</enum><header>GAO study</header><subsection id="id3096900f74be4913ab0525ba4dbe4a94"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study on the privacy of teens who use financial technology products. Such study shall—</text><paragraph id="id4FD8D173913745239668FEF5AA6005F4"><enum>(1)</enum><text>identify the type of financial technology products that teens are using;</text></paragraph><paragraph id="idB6CCA52C3CA946B5B59DB45C88ACF057"><enum>(2)</enum><text>identify the potential risks to teens' privacy from using such financial technology products; and</text></paragraph><paragraph id="id829EBD3B456D4CA59775DB1076F28F29"><enum>(3)</enum><text>determine whether existing laws are sufficient to address such risks to teens' privacy.</text></paragraph></subsection><subsection id="id2ecbf47820e64f0db9f327d53f617d77" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Comptroller General shall submit to Congress a report containing the results of the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate. </text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="ide31a7695-19b7-425b-b347-3c1ce63a13db" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title; table of contents</header><subsection id="idb6510084-c08f-4ccc-84b8-80a0c26d97be"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Children and Teens’ Online Privacy Protection Act</short-title></quote>.</text></subsection><subsection id="ide9ca22c9-fded-46c2-86be-a8c49b930360"><enum>(b)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents for this Act is as follows: </text><toc changed="added" reported-display-style="italic" committee-id="SSCM00"><toc-entry level="section" idref="id4904b1f5-5f36-492d-93c6-d2ae9ae45529">Sec. 1. and</text></clause><clause id="id6cc8394a-2053-4b90-aa32-9d0be5d73acb"><enum>(ii)</enum><text>who—</text><subclause id="id5592ab2c-9f0e-49af-b394-e6f802cb351a"><enum>(I)</enum><text>collects or maintains, either directly or through a service provider, personal information from or about the users of that website, service, or application;</text></subclause><subclause id="idbe2a18ae-627a-4a08-a29c-d4ec9b492cb6"><enum>(II)</enum><text>allows another person to collect personal information directly from users of that website, service, or application (in which case, the operator is deemed to have collected the information); or</text></subclause><subclause id="id88cc9f81-281c-4aa1-afb5-7e8e822fae48"><enum>(III)</enum><text>allows users of that website, service, or application to publicly disclose personal information (in which case, the operator is deemed to have collected the information); and</text></subclause></clause></subparagraph><subparagraph id="idd8aebbae-fab3-4610-a18b-dc40ff582a8c"><enum>(B)</enum><text>does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ida55fd46f-ec0c-45e0-8e01-52bdd80fb31f"><enum>(2)</enum><text>in paragraph (4)—</text><subparagraph id="id312bb945-0316-4cfe-94a9-4b041815e17b"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id549fd425-14ba-456c-9825-6655f94f3ace" changed="added" reported-display-style="italic" committee-id="SSCM00"><subparagraph id="id5f1e7ff6-d118-400e-b77e-68eb4e6b1bb7"><enum>(A)</enum><text>the release of personal information collected from a child or teen by an operator for any purpose, except where the personal information is provided to a person other than an operator who—</text><clause id="id19dacc2d-faae-40b5-892b-f8ae8d32eb83"><enum>(i)</enum><text>provides support for the internal operations of the website, online service, online application, or mobile application of the operator, excluding any activity relating to individual-specific advertising to children or teens; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id316f1ef4-da80-4baa-9632-808409b01ec1"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id023900ec-0a99-4273-84fa-012eb5343852"><enum>(i)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears; and</text></clause><clause id="id24588653-af8b-483a-ab5d-610932a6b8b8"><enum>(ii)</enum><text>by striking <quote>website or online service</quote> and inserting <quote>website, online service, online application, or mobile application</quote>;</text></clause></subparagraph></paragraph><paragraph id="id3ff23c7d-7bb4-4c6e-bc47-57c8735d87ad"><enum>(3)</enum><text>by striking paragraph (8) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idca2a94e9-d8fe-4474-8313-0560ca7eb490" changed="added" reported-display-style="italic" committee-id="SSCM00"><paragraph commented="no" display-inline="no-display-inline" id="id9ed1b208545c4586b7a7b6d416af6ba2"><enum>(8)</enum><header>Personal information</header><subparagraph commented="no" display-inline="no-display-inline" id="idccef27dcbdee4ee7b7a3c8be819c9e15"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>personal information</term> means individually identifiable information about an individual collected online, including—</text><clause commented="no" display-inline="no-display-inline" id="id9EFBDE9FCC614693A5048E4433C65745"><enum>(i)</enum><text>a first and last name;</text></clause><clause commented="no" display-inline="no-display-inline" id="id26FC927B974B47009EBFBAECB7714A62"><enum>(ii)</enum><text>a home or other physical address including street name and name of a city or town;</text></clause><clause commented="no" display-inline="no-display-inline" id="idDFDB53B940F44139AF3345BB13634775"><enum>(iii)</enum><text>an e-mail address;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9F37629422774509BC112BCD355DDB7A"><enum>(iv)</enum><text>a telephone number;</text></clause><clause commented="no" display-inline="no-display-inline" id="id72534536058B4BC6ACB874176F4E7121"><enum>(v)</enum><text>a Social Security number;</text></clause><clause commented="no" display-inline="no-display-inline" id="idF5A7149A75D74160AC1E997AB7D546B1"><enum>(vi)</enum><text>any other identifier that the Commission determines permits the physical or online contacting of a specific individual;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4363c791c0cb4e27b85cb3df8be56930"><enum>(vii)</enum><text display-inline="yes-display-inline"> geolocation information;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3da5d6cf6f954b1da6814c38c91722a6"><enum>(viii)</enum><text>information generated from the measurement or technological processing of an individual's biological, physical, or physiological characteristics that is used to identify an individual, including—</text><subclause commented="no" display-inline="no-display-inline" id="id6bf250168e33447b894fc2eaacd89370"><enum>(I)</enum><text display-inline="yes-display-inline">fingerprints;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc2490df217824c618fcbe95ecaba8b46"><enum>(II)</enum><text display-inline="yes-display-inline">voice prints;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8b67e53b9568491793325cfe5117bbf3"><enum>(III)</enum><text>iris or retina imagery scans;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc8a1ea30233f4872afed1776fb122c6b"><enum>(IV)</enum><text>facial templates;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0e00a32e16c54257ad5678671d5501d3"><enum>(V)</enum><text>deoxyribonucleic acid (DNA) information; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id43731c0473274a15a34f76028ed14c42"><enum>(VI)</enum><text>gait;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7126a02465184085baa87b7d6537564f"><enum>(ix)</enum><text>information linked or reasonably linkable to a child or teen; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6a32080d7b6544d1a3043f432574889d"><enum>(x)</enum><text display-inline="yes-display-inline">information linked or reasonably linkable to a child or teen or the parents of that child or teen (including any unique identifier) that an operator collects online from the child or teen and combines with an identifier described in this subparagraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d6d816b65c64f1e89e16247e85eaf0f"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>personal information</term> shall not include an audio file that contains a child’s or teen’s voice so long as the operator—</text><clause commented="no" display-inline="no-display-inline" id="id5268afc8f66f42c4b6c664a604dcfcf3"><enum>(i)</enum><text display-inline="yes-display-inline">does not request information via voice that would otherwise be considered personal information under this paragraph;</text></clause><clause commented="no" display-inline="no-display-inline" id="id18840cad9f27401188879e9ca572a34c"><enum>(ii)</enum><text display-inline="yes-display-inline">provides clear notice of its collection and use of the audio file and its deletion policy in its privacy policy;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb476888c3a8a4016a4d50f5caf95f986"><enum>(iii)</enum><text display-inline="yes-display-inline">only uses the voice within the audio file solely as a replacement for written words, to perform a task, or engage with a website, online service, online application, or mobile application, such as to perform a search or fulfill a verbal instruction or request; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id60d6f5133ce44a89abbb7a7f628f4b64"><enum>(iv)</enum><text display-inline="yes-display-inline">only maintains the audio file long enough to complete the stated purpose and then immediately deletes the audio file and does not make any other use of the audio file prior to deletion.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id973b3ad4-6800-4456-b57d-c4070de57bf6"><enum>(4)</enum><text>by amending paragraph (9) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7d5669ae-37c5-4c07-82ad-1b7d5da8f537" changed="added" reported-display-style="italic" committee-id="SSCM00"><paragraph id="idcd6918d3-9670-4553-8c43-b1dbb99bf970"><enum>(9)</enum><header>Verifiable consent</header><text>The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology), including a request for authorization for future collection, use, and disclosure described in the notice, to ensure that, in the case of a child, a parent of the child, or, in the case of a teen, the teen—</text><subparagraph id="idb0044369-fa48-466b-8598-03d738fcbf14"><enum>(A)</enum><text>receives specific notice of the personal information collection, use, and disclosure practices of the operator; and</text></subparagraph><subparagraph id="idec0ef9fa-722e-4c73-aab3-a6d537589ab2"><enum>(B)</enum><text>before the personal information of the child or teen is collected, freely and unambiguously authorizes—</text><clause id="idcc0d69da-4b07-46d2-8ffd-cff2f8fedcd1"><enum>(i)</enum><text>the collection, use, and disclosure, as applicable, of that personal information; and</text></clause><clause id="id63b626f0-98d5-41bb-a345-c29cb2d731b4"><enum>(ii)</enum><text>any subsequent use of that personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4fbdfc21-7c56-4481-be19-544e5c99ca65"><enum>(5)</enum><text>in paragraph (10)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id546bf6dab22c424f824f1521bf740d27"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph header, by striking <quote><header-in-text style="OLC" level="paragraph">Website or online service directed to children</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Website, online service, online application, or mobile application directed to children</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde81ac2d73924212a4f24e90d151ad99"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>website or online service</quote> each place it appears and inserting <quote>website, online service, online application, or mobile application</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf200c8e55a46420bb5c95217b88fbf3e"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7FCB8B3B1A584CA09EA2290383AF8FBA" changed="added" reported-display-style="italic" committee-id="SSCM00"><subparagraph id="id85ca46bea3f2482fa64de27642840675"><enum>(C)</enum><header>Rule of construction</header><text>In considering whether a website, online service, online application, or mobile application is directed to children, the Commission shall, using competent and reliable empirical evidence, apply a totality of circumstances test to consider the intended audience of the website, online service, online application, or mobile application, as a whole.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idec26f1dd-6249-4518-a92c-d14323264731"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0cec6928-e388-4e9b-8e45-acab825ec472" changed="added" reported-display-style="italic" committee-id="SSCM00"><paragraph id="idfb77a601-3021-4898-9e56-e1f2c8500dc3"><enum>(13)</enum><header>Connected device</header><text>The term <term>connected device</term> means a device that is capable of connecting to the internet, directly or indirectly, or to another connected device.</text></paragraph><paragraph id="id066c7bd8-ca29-461d-acf8-ed42b88e3d61"><enum>(14)</enum><header>Online application</header><text>The term <term>online application</term>—</text><subparagraph id="id5e21c5b0-876a-48b7-9233-ac3e751c01e0"><enum>(A)</enum><text>means an internet-connected software program; and</text></subparagraph><subparagraph id="id2172dfc6-7239-4453-a533-55642be02ed6"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="idadd87f99-4dd7-40b8-afbe-ef1255c7cf95"><enum>(15)</enum><header>Mobile application</header><text>The term <term>mobile application</term>—</text><subparagraph id="idd2af4f4f-dfef-41c9-9300-a0896240cf74"><enum>(A)</enum><text>means a software program that runs on the operating system of—</text><clause id="idbd3768cb-a8db-4d76-acf9-937da0f98af2"><enum>(i)</enum><text>a cellular telephone;</text></clause><clause id="id8bdedf1d-54c5-4795-aa41-6f74bb71eed7"><enum>(ii)</enum><text>a tablet computer; or</text></clause><clause id="id20ca23b9-53b5-46fe-a692-7b04f61e12f3"><enum>(iii)</enum><text>a similar portable computing device that transmits data over a wireless connection; and</text></clause></subparagraph><subparagraph id="id2511c2f9-384b-4ba2-a7b4-6a22975baf79"><enum>(B)</enum><text>includes a service or application offered via a connected device.</text></subparagraph></paragraph><paragraph id="id754e3a63-dadb-4c0a-97fb-b14642e81d1f"><enum>(16)</enum><header>Geolocation information</header><text>The term <term>geolocation information</term> means information sufficient to identify a street name and name of a city or town.</text></paragraph><paragraph id="idcbe821b8-12ca-44f8-9a9f-5c524867bb87"><enum>(17)</enum><header>Teen</header><text>The term <term>teen</term> means an individual over the age of 12 and under the age of 17.</text></paragraph><paragraph id="id9f9183fe-1fa4-4200-85bb-ee95a6a836a1" commented="no"><enum>(18)</enum><header>Individual-specific advertising to children or teens</header><subparagraph id="idb6e15a49-323c-4752-95f2-3afa39789922" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>individual-specific advertising to children or teens</term> means advertising or any other effort to market a product or service that is directed to a specific child or teen or a device that is linked or reasonably linkable to a child or teen—</text><clause id="idbfd769d2-63f5-441c-895a-5720e9676319" commented="no"><enum>(i)</enum><text>based on—</text><subclause id="ide6cf89dd-65b5-40db-bcfe-cdaaa98f1ef9" commented="no"><enum>(I)</enum><text>the personal information of—</text><item id="id66780002-08e5-4f9c-9db3-d79773a5262f" commented="no"><enum>(aa)</enum><text>the child or teen; or</text></item><item id="idc9a443e2-cebd-40fb-acae-3e56ff19daae" commented="no"><enum>(bb)</enum><text>a group of children or teens who are similar in sex, age, income level, race, or ethnicity to the specific child or teen to whom the product or service is marketed;</text></item></subclause><subclause id="idb85bb69b-89e7-4792-8f86-60db4a701207" commented="no"><enum>(II)</enum><text>psychological profiling of a child or teen or group of children or teens; or</text></subclause><subclause id="idca3f20ed-0be8-4ab1-9333-76e4b574f587" commented="no"><enum>(III)</enum><text>a unique identifier of the device; or</text></subclause></clause><clause id="idcaa38af2-d76d-470a-84f6-28bdb791740c" commented="no"><enum>(ii)</enum><text>as a result of use by the child or teen, access by any device of the child or teen, or use by a group of children or teens who are similar to the specific child or teen, of more than a single—</text><subclause id="id3540ff88-1d16-4ac0-96b6-020b235839f4" commented="no"><enum>(I)</enum><text>website;</text></subclause><subclause id="ida54bfd41-8493-45fa-b1e6-f2938f1d9a8b" commented="no"><enum>(II)</enum><text>online service;</text></subclause><subclause id="id57a6d77d-2504-4629-9035-4d087570ee80" commented="no"><enum>(III)</enum><text>online application;</text></subclause><subclause id="id75c15d46-45d4-4b8a-81a5-7985c4c5b408" commented="no"><enum>(IV)</enum><text>mobile application; or</text></subclause><subclause id="ida09e40883c4f4937bc68ea1ad86199bb"><enum>(V)</enum><text>connected device.</text></subclause></clause></subparagraph><subparagraph id="id1911d5ff-f873-45d6-94e8-28389288ea8b" commented="no"><enum>(B)</enum><header>Exclusions</header><text>The term <term>individual-specific advertising to children or teens</term> shall not include—</text><clause id="id384ac05d-0976-4ef2-a251-8ab193dfb7c7" commented="no"><enum>(i)</enum><text>advertising or marketing to an individual or the device of an individual in response to the individual’s specific request for information or feedback, such as a child's or teen's current search query;</text></clause><clause id="id396de51c-f10d-4034-be92-5208e38dc8b3" commented="no"><enum>(ii)</enum><text>contextual advertising, such as when an advertisement is displayed based on the content of the website, online service, online application, mobile application, or connected device in which the advertisement appears and does not vary based on personal information related to the viewer; or</text></clause><clause id="iddb4884e4-46f5-4760-80a3-a3279027ef0b" commented="no"><enum>(iii)</enum><text>processing personal information solely for measuring or reporting advertising or content performance, reach, or frequency, including independent measurement.</text></clause></subparagraph><subparagraph id="id78893508-5a4f-4f05-bd00-adbfd17f9171"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to prohibit an operator with actual knowledge or knowledge fairly implied on the basis of objective circumstances that an individual is under the age of 17 from delivering advertising or marketing that is age-appropriate and intended for a child or teen audience, so long as the operator does not use any personal information other than whether the user is under the age of 17.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida108766b-7f5b-4e12-8b11-7cc186510236"><enum>(b)</enum><header>Online collection, use, disclosure, and deletion of personal information of children and teens</header><text>Section 1303 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text><paragraph id="idc22f6c29-4cb9-48a4-9e01-c26e71ec2a30"><enum>(1)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="section" style="OLC">Online collection, use, disclosure, and deletion of personal information of children and teens.</header-in-text></quote>;</text></paragraph><paragraph id="idb7f3857e-1604-41c0-85b8-53f4705ec89a"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id880b6593-4d24-44bf-a026-c0bb0dff4173"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6b5989da-4bc3-44b4-be11-5c9e6a6536d9" changed="added" reported-display-style="italic" committee-id="SSCM00"><paragraph id="id510569c7-d601-4d62-a723-13370f0c4dea"><enum>(1)</enum><header>In general</header><text>It is unlawful for an operator of a website, online service, online application, or mobile application directed to children or for any operator of a website, online service, online application, or mobile application with actual knowledge or knowledge fairly implied on the basis of objective circumstances—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3ab5f753f9654248b9639e2d0838af5e"><enum>(A)</enum><text display-inline="yes-display-inline">to collect personal information from a child or teen in a manner that violates the regulations prescribed under subsection (b);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a96bb6ba71646b4bbd6feeceac25e67"><enum>(B)</enum><text display-inline="yes-display-inline">to collect, use, disclose to third parties, or compile personal information of a child or teen for purposes of individual-specific advertising to children or teens (or to allow another person to collect, use, disclose, or compile such information for such purpose);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3b750a2017a4e1881e9c6a35bbbfc96"><enum>(C)</enum><text display-inline="yes-display-inline">to collect the personal information of a child or teen except when the collection of the personal information is—</text><clause id="id4f6dcb50898a4102a482fda01208d7c2"><enum>(i)</enum><text>consistent with the context of a particular or service or the relationship of the child or teen with the operator, including collection necessary to fulfill a transaction or provide a product or service requested by the child or teen; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idd1495a32299b4f18b502c0bce27b3c9c"><enum>(ii)</enum><text display-inline="yes-display-inline">required or specifically authorized by Federal or State law; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6789bd68af124f28aa3d21980113d400"><enum>(D)</enum><text display-inline="yes-display-inline">to store or transfer the personal information of a child or teen outside of the United States unless the operator discloses to the child or teen involved that their personal information is being stored or transferred outside of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66d6148f05754eff83a21086be464399"><enum>(E)</enum><text display-inline="yes-display-inline">to retain the personal information of a child or teen for longer than is reasonably necessary to fulfill a transaction or provide a service requested by the child or teen except as required or specifically authorized by Federal or State law.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0cde7243-5c63-4124-a6c9-6ad01af77b76"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idbb3664e8-7b38-4d53-a1dd-31d86a948f27"><enum>(i)</enum><text>by striking <quote>Notwithstanding paragraph (1)</quote> and inserting <quote>Notwithstanding paragraph (1)(A)</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd6c8bef5b0384eaaa189ae78bca886fe"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>of such a website or online service</quote>; and</text></clause><clause id="idbc546e7a-77f4-4f00-9f3e-5552d138371d"><enum>(iii)</enum><text>by striking <quote>subsection (b)(1)(B)(iii) to the parent of a child</quote> and inserting <quote>subsection (b)(1)(B)(iii) to the parent of a child or under subsection (b)(1)(C)(iii) to a teen</quote>;</text></clause></subparagraph></paragraph><paragraph id="id29f5130a-f4d4-4d72-ae5c-77998d49fa98"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="id67eb8517-090f-460d-836a-fef88804983b"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id359e82f6-07f3-4f5b-bdb5-b6fdc03f4f62"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="ida3bd587c-4c42-49b0-a387-07a8c0803f4c"><enum>(I)</enum><text>by striking <quote>operator of any website</quote> and all that follows through <quote>from a child</quote> and inserting <quote>operator of a website, online service, online application, or mobile application directed to children or that has actual knowledge or knowledge fairly implied on the basis of objective circumstances that it is collecting personal information from children or teens</quote>;</text></subclause><subclause id="idbff79a84-8427-4c6f-9784-86b7f64d8bcc"><enum>(II)</enum><text>in clause (i)— </text><item id="id9cfc6683-78b3-407b-b3fc-7d49c47fea83"><enum>(aa)</enum><text>by striking <quote>notice on the website</quote> and inserting <quote>clear and conspicuous notice</quote>;</text></item><item id="id6e1b6914-a374-46c9-ab77-b02a217b4572"><enum>(bb)</enum><text>by inserting <quote>or teens</quote> after <quote>children</quote>;</text></item><item id="ida7823601-d393-499b-8022-885f9bb1fbb9"><enum>(cc)</enum><text>by striking <quote>, and the operator's</quote> and inserting <quote>, the operator's</quote>; and</text></item><item id="id3aa2fcaf-ce89-4e02-b849-4385f211a944"><enum>(dd)</enum><text>by striking <quote>; and</quote> and inserting <quote>, the rights and opportunities available to the parent of the child or teen under subparagraphs (B) and (C), and the procedures or mechanisms the operator uses to ensure that personal information is not collected from children or teens except in accordance with the regulations promulgated under this paragraph;</quote>;</text></item></subclause><subclause id="id07d420e7-41df-4e11-a54c-0ca25888ac2f"><enum>(III)</enum><text>in clause (ii)— </text><item id="idf4283174-369b-4500-b1ea-b00a93d4092d" commented="no"><enum>(aa)</enum><text>by striking <quote>parental</quote>;</text></item><item id="id1835abfd-6b27-468f-a2ec-0513aab697dd"><enum>(bb)</enum><text>by inserting <quote>or teens</quote> after <quote>children</quote>;</text></item><item commented="no" display-inline="no-display-inline" id="id37c4b0aee93a49bdae7f17b64ffaeb2d"><enum>(cc)</enum><text display-inline="yes-display-inline">by striking the semicolon at the end and inserting <quote>; and</quote>; and</text></item></subclause><subclause id="id879564d1aea3442dae40d9b67b0338cc"><enum>(IV)</enum><text>by inserting after clause (ii) the following new clause:</text><quoted-block id="id86AF340A09CD4001AA39FC316F053CD2" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSCM00"><clause id="id87A3A528E6FF4A9991207DAAACCC9DFA"><enum>(iii)</enum><text>to obtain verifiable consent from a parent of a child or a teen before using or disclosing personal information of the child or teen for any purpose that is a material change from the original purposes and disclosure practices specified to the parent of the child or the teen under clause (i);</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id243b2bd1-2e8a-4fc6-ae09-c7feaf17530f"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="iddc5e816c-8393-43ef-99c1-0afbc1715412"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>website or online service</quote> and inserting <quote>operator</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idac87eec083954773984471e24ff6647e"><enum>(II)</enum><text>in clause (i), by inserting <quote>and the method by which the operator obtained the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information</quote> before the semicolon; </text></subclause><subclause id="idbe5d038c-928a-4553-abbd-567f5fa86723"><enum>(III)</enum><text>in clause (ii)—</text><item commented="no" display-inline="no-display-inline" id="id6ae09cd5e5b240708898e3f1e1a6c449"><enum>(aa)</enum><text display-inline="yes-display-inline">by inserting <quote>to delete personal information collected from the child or content or information submitted by the child to a website, online service, online application, or mobile application and</quote> after <quote>the opportunity at any time</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="id3df3ee9c65d647cd8a28ea4c43f25ed7"><enum>(bb)</enum><text>by striking <quote>; and</quote> and inserting a semicolon;</text></item></subclause><subclause id="id55e5b920-1562-403c-8cd1-a636972c800a" commented="no"><enum>(IV)</enum><text>by redesignating clause (iii) as clause (iv) and inserting after clause (ii) the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE5CBBFE0EEC4AEB9515B031EC1E0F4D" changed="added" reported-display-style="italic" committee-id="SSCM00"><clause commented="no" display-inline="no-display-inline" id="id8564456388274624b8022a94ef7e4b0f"><enum>(iii)</enum><text>the opportunity to challenge the accuracy of the personal information and, if the parent of the child establishes the inaccuracy of the personal information, to have the inaccurate personal information corrected;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="id762de141d0bc4def9dd7c016240c1965"><enum>(V)</enum><text display-inline="yes-display-inline">in clause (iv), as so redesignated, by inserting <quote>, if such information is available to the operator at the time the parent makes the request</quote> before the semicolon;</text></subclause></clause><clause commented="no" id="id1a354254-39ac-478a-85c5-e78d9de6dbe1"><enum>(iii)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively;</text></clause><clause commented="no" id="id1a70c254-1cb6-472a-b646-abcd4e734ea9"><enum>(iv)</enum><text>by inserting after subparagraph (B) the following new subparagraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d595478-aa64-4851-8757-326c72934d8b" changed="added" reported-display-style="italic" committee-id="SSCM00"><subparagraph id="idffd66478-0b73-4791-8468-3ec5b31dc00f"><enum>(C)</enum><text>require the operator to provide, upon the request of a teen under this subparagraph who has provided personal information to the operator, upon proper identification of that teen—</text><clause id="id5efde241-7403-433c-9235-bb565e62f32e"><enum>(i)</enum><text>a description of the specific types of personal information collected from the teen by the operator, the method by which the operator obtained the personal information, and the purposes for which the operator collects, uses, discloses, and retains the personal information;</text></clause><clause id="id0551c3b3-c036-4a9f-b72c-60cae0f66b96"><enum>(ii)</enum><text>the opportunity at any time to delete personal information collected from the teen or content or information submitted by the teen to a website, online service, online application, or mobile application and to refuse further use or collection of personal information from the teen;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide8280ff92efa4083a6c10c8c62eafff0"><enum>(iii)</enum><text display-inline="yes-display-inline">the opportunity to challenge the accuracy of the personal information and, if the parent of the child establishes the inaccuracy of the personal information, to have the inaccurate personal information corrected; and</text></clause><clause id="id38d5b9ea-3989-4f8c-b4e8-45e106caaef9"><enum>(iv)</enum><text>a means that is reasonable under the circumstances for the teen to obtain any personal information collected from the teen, if such information is available to the operator at the time the teen makes the request;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" id="id3ed77111-1b47-4f0d-ab3c-11b4e626af4c"><enum>(v)</enum><text>by amending subparagraph (E), as so redesignated, to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb9031cb9d9244df2a64e7ada4623c0f9" changed="added" reported-display-style="italic" committee-id="SSCM00"><subparagraph id="id04fec9155ae54cb2be6fbbb71e40418a"><enum>(E)</enum><text>require the operator to establish, implement, and maintain reasonable security practices to protect the confidentiality, integrity, and accessibility of personal information of children or teens collected by the operator, and to protect such personal information against unauthorized access.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idea90cab1-53d6-4443-988e-fe9ce859d62a"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="ide9754f69-0b66-474f-9f77-1673e486125d"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>verifiable parental consent</quote> and inserting <quote>verifiable consent</quote>;</text></clause><clause id="iddb9c95ca-d1ac-47e0-9cbd-f619a4ead768"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="idc5752a6d-8e14-453f-a036-089dcd760aca"><enum>(I)</enum><text>by inserting <quote>or teen</quote> after <quote>collected from a child</quote>;</text></subclause><subclause id="idb6d0c8f8-8cf8-4c73-95c8-cf8a6726a8b9"><enum>(II)</enum><text>by inserting <quote>or teen</quote> after <quote>request from the child</quote>; and</text></subclause><subclause id="id000f450c-00e6-4d11-9b62-50f352b67e2b"><enum>(III)</enum><text>by inserting <quote>or teen or to contact another child or teen</quote> after <quote>to recontact the child</quote>;</text></subclause></clause><clause id="idd9de484e-b867-4686-a607-7eb608760a3d"><enum>(iii)</enum><text>in subparagraph (B)—</text><subclause id="idf51403a6-6d27-41b2-ab9c-8e2e7e9a24a4"><enum>(I)</enum><text>by striking <quote>parent or child</quote> and inserting <quote>parent or teen</quote>; and</text></subclause><subclause id="id5cfa2045-5575-4d92-b3af-3433a659d4a0"><enum>(II)</enum><text>by striking <quote>parental consent</quote> each place the term appears and inserting <quote>verifiable consent</quote>;</text></subclause></clause><clause id="idd0ecf3a7-6c4a-41f5-9f8b-a8abd95a7880"><enum>(iv)</enum><text>in subparagraph (C)—</text><subclause id="id1063e99f-ea97-4d46-957d-c849ad0c3980"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></subclause><subclause id="id044cb261-1e43-4b5e-8900-52d1062467d6"><enum>(II)</enum><text>in clause (i)—</text><item id="idef6dc2b9-24c1-48a2-bf9a-7dd97e9de95e"><enum>(aa)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears; and</text></item><item id="idc43cddb9-456c-48de-93fd-8903366cedf8"><enum>(bb)</enum><text>by inserting <quote>or teen, as applicable,</quote> after <quote>parent</quote> each place the term appears; and</text></item></subclause><subclause id="id93fa43a5-7dfd-4bf7-90d6-4a3c129c6d64"><enum>(III)</enum><text>in clause (ii), by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears; and</text></subclause></clause><clause id="id390084d2-ad99-4088-951f-18a605c46e7d"><enum>(v)</enum><text>in subparagraph (D)—</text><subclause id="id4c4fc1ac-3052-42f0-9e5f-5c155a9e62ee"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>or teen</quote> after <quote>child</quote> each place the term appears;</text></subclause><subclause id="id73667dea-7485-4394-9ca6-2f559a8c0d62"><enum>(II)</enum><text>in clause (ii), by inserting <quote>or teen</quote> after <quote>child</quote>; and</text></subclause><subclause id="id0273c52d-f105-49a3-b6d6-da54b6afada7"><enum>(III)</enum><text>in the flush text following clause (iii)—</text><item id="id76bdc4ce-51fe-4749-916a-60b41732a100"><enum>(aa)</enum><text>by inserting <quote>or teen, as applicable,</quote> after <quote>parent</quote> each place the term appears; and</text></item><item id="id13ec7cab-0d2b-4da3-8755-23a4968a6cea"><enum>(bb)</enum><text>by inserting <quote>or teen</quote> after <quote>child</quote>; and</text></item></subclause></clause></subparagraph><subparagraph id="id77b9d994-af2f-448c-b7eb-2d5e4379cca2"><enum>(C)</enum><text>by adding after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02174ae1-5c98-4608-8fc5-9dd147c5933c" changed="added" reported-display-style="italic" committee-id="SSCM00"><paragraph id="id34cf7a8a-e254-46f4-8a73-42ae429efaaf" commented="no"><enum>(4)</enum><header>Continuation of service</header><text>The regulations shall prohibit an operator from discontinuing service provided to a child or teen on the basis of a request by the parent of the child or by the teen, under the regulations prescribed under subparagraph (B) or (C) of paragraph (1), respectively, to delete personal information collected from the child or teen, to the extent that the operator is capable of providing such service without such information.</text></paragraph><paragraph id="idda71d739b0e04e2694fe766506eedca6"><enum>(5)</enum><header>Rule of construction</header><text>A request made pursuant to subparagraph (B) or (C) of paragraph (1) to delete personal information of a child or teen shall not be construed—</text><subparagraph id="id1fb18b81cb004b0695f6587334ddb1d1"><enum>(A)</enum><text>to limit the authority of a law enforcement agency to obtain any content or information from an operator pursuant to a lawfully executed warrant or an order of a court of competent jurisdiction;</text></subparagraph><subparagraph id="id7be2cb93437c48b692aa627740ca1c80"><enum>(B)</enum><text>to require an operator or third party delete information that—</text><clause id="idbeb3661ee4584effbd63bd9c790dc4dc"><enum>(i)</enum><text>any other provision of Federal or State law requires the operator or third party to maintain; or</text></clause><clause id="id827e9bad0bf740b79734144b81140038"><enum>(ii)</enum><text>was submitted to the website, online service, online application, or mobile application of the operator by any person other than the user who is attempting to erase or otherwise eliminate the content or information, including content or information submitted by the user that was republished or resubmitted by another person; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9389ffd6ca7d4702b60e250690f6856c"><enum>(C)</enum><text display-inline="yes-display-inline">prohibit an operator from—</text><clause commented="no" display-inline="no-display-inline" id="ide25e39c85f364db2bf825aa7c7ca9b99"><enum>(i)</enum><text display-inline="yes-display-inline">retaining a record of the deletion request and the minimum information necessary for the purposes of ensuring compliance with a request made pursuant to subparagraph (B) or (C); or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5b879580ed54e86bdfd083bc0790101"><enum>(ii)</enum><text display-inline="yes-display-inline">ensuring that the child or teen's information remains deleted.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3a1170a509a34b909f17a4679ff2cde3"><enum>(4)</enum><text>in subsection (c), by striking <quote>a regulation prescribed under subsection (a)</quote> and inserting <quote>subparagraph (B), (C), (D), or (E) of subsection (a)(1), or a of a regulation prescribed under subparagraph (A) of such subsection,</quote>.</text></paragraph></subsection><subsection id="idf4c2ee78-27cb-405c-8e65-7f0fb1fb8219"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text><paragraph id="id825a416e-d28b-43fc-a66f-082c52079116"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and teens</quote> after <quote>children</quote>; and</text></paragraph><paragraph id="idef7296cd-607b-4329-8d03-359c743bd3c8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id916b9fe7-8c11-4eaf-afcc-04a59fe23d7c" changed="added" reported-display-style="italic" committee-id="SSCM00"><subsection id="id32e3775e-8956-4b0c-967f-29477e0d8db8"><enum>(d)</enum><header>Publication</header><paragraph id="id7f999122-fe26-4805-bb47-41429ec8b06e"><enum>(1)</enum><header>In general</header><text>The Commission shall publish on the internet website of the Commission any report or documentation required by regulation to be submitted to the Commission to carry out this section.</text></paragraph><paragraph id="id545a2ecd-74ba-4b0c-b116-787de7647182"><enum>(2)</enum><header>Restrictions on publication</header><text>The restrictions described in subsection (f) of section 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/46">15 U.S.C. 46(f)</external-xref>) applicable to the publication of information obtained by the Commission through investigations conducted under such section shall apply in same manner to the publication under this subsection of information obtained by the Commission from a report or documentation described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2f66b7c6-7c53-4888-8bac-945105ab7727"><enum>(d)</enum><header>Administration and applicability of Act</header><text>Section 1306 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6505">15 U.S.C. 6505</external-xref>) is amended—</text><paragraph id="id8e8646db-6641-4149-893a-fde7b77fd7e3"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id6fc86d4f-6adf-4e28-afd5-d27d80f796d2"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, in the case of</quote> and all that follows through <quote>the Board of Directors of the Federal Deposit Insurance Corporation;</quote> and inserting the following: <quote>by the appropriate Federal banking agency, with respect to any insured depository institution (as those terms are defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>));</quote>; and</text></subparagraph><subparagraph id="id933c34a5-1e88-4aaf-9587-e88ab8eeb00a"><enum>(B)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (6) as paragraphs (2) through (5), respectively; and</text></subparagraph></paragraph><paragraph id="id701b4b3f-954b-41fb-8616-79e8452b69ff"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id873559390A014A10B85E7814AE5E28EE" changed="added" reported-display-style="italic" committee-id="SSCM00"><subsection id="id817f9e94e50d43dca08c364b12b1a6d3"><enum>(f)</enum><header>Determination of whether an operator has knowledge fairly implied on the basis of objective circumstances</header><paragraph id="idc7b673703fc84141bab03ad2c2e29810"><enum>(1)</enum><header>Rule of construction</header><text>For purposes of enforcing this Act or a regulation promulgated under this Act, in making a determination as to whether an operator has knowledge fairly implied on the basis of objective circumstances that a user is a child or teen, the Commission shall rely on competent and reliable empirical evidence, taking into account the totality of the circumstances, including consideration of whether the operator, using available technology, exercised reasonable care.</text></paragraph><paragraph id="id27a3eda096244e678d7f7c0c9db46b03"><enum>(2)</enum><header>Protections for privacy</header><text>Nothing in the Commission’s determination under paragraph (1) shall be construed to require an operator to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaad93a373fd84e0d9f8fd74a860b1cc3"><enum>(A)</enum><text>affirmatively collect any personal information with respect to the age of a child or teen that an operator is not already collecting in the normal course of business; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id236ec3a4428c43a2bf112d640edaa9a4"><enum>(B)</enum><text>implement an age gating or age verification functionality.</text></subparagraph></paragraph><paragraph id="id0dccab47a1a149e4a0dad4f9e99a572e"><enum>(3)</enum><header>Commission guidance</header><subparagraph commented="no" display-inline="no-display-inline" id="idbd7db0cee2374776a4301f2bc2cc7afe"><enum>(A)</enum><header>In general</header><text>Within 180 days of enactment, the Commission shall issue guidance to provide information, including best practices and examples for operators to understand the Commission’s determination of whether an operator has knowledge fairly implied on the basis of objective circumstances.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc0967ccbde247dc8072b1d5149b8b8b"><enum>(B)</enum><header>Limitation</header><text>No guidance issued by the Commission with respect to this Act shall confer any rights on any person, State, or locality, nor shall operate to bind the Commission or any person to the approach recommended in such guidance. In any enforcement action brought pursuant to this Act, the Commission shall allege a specific violation of a provision of this Act. The Commission may not base an enforcement action on, or execute a consent order based on, practices that are alleged to be inconsistent with any such guidance, unless the practices allegedly violate this Act.</text></subparagraph></paragraph></subsection><subsection id="ide5045297538247198782568dffc821e9"><enum>(g)</enum><header>Additional requirement</header><text>Any regulations issued under this Act shall include a description and analysis of the impact of proposed and final Rules on small entities per the Regulatory Flexibility Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601 et seq.</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idc9829a83-1ea2-497c-a6d6-104857548209" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>3.</enum><header>Study and reports of mobile and online application oversight and enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idb8cbeb26dc9e4973988abbc2c1456513"><enum>(a)</enum><header display-inline="yes-display-inline">Oversight report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the processes of platforms that offer mobile and online applications for ensuring that, of those applications that are websites, online services, online applications, or mobile applications directed to children, the applications operate in accordance with—</text><paragraph id="id5fdfcdf4-f8e0-4770-9d01-6b890870e287"><enum>(1)</enum><text>this Act, the amendments made by this Act, and rules promulgated under this Act; and</text></paragraph><paragraph id="id87afbc84-1d92-4a7f-a0e0-07044c44568e"><enum>(2)</enum><text>rules promulgated by the Commission under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) relating to unfair or deceptive acts or practices in marketing.</text></paragraph></subsection><subsection id="id7bb3e4a01dfa4d47816de4c63ed1656c"><enum>(b)</enum><header>Enforcement report</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Federal Trade Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that addresses, at a minimum—</text><paragraph id="idcb9a46b2f3c949cfb0f80005db8bfbd0"><enum>(1)</enum><text>the number of actions brought by the Commission during the reporting year to enforce the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) (referred to in this subsection as the <term>Act</term>) and the outcome of each such action;</text></paragraph><paragraph id="id726cac6970e54b02bdc6168c5b30cf9a"><enum>(2)</enum><text>the total number of investigations or inquiries into potential violations of the Act; during the reporting year;</text></paragraph><paragraph id="idfcce35a3cf4847d1af7f8da08a2ae880"><enum>(3)</enum><text>the total number of open investigations or inquiries into potential violations of the Act as of the time the report is submitted;</text></paragraph><paragraph id="id730858880c8b4d308ca9c195664fe95a"><enum>(4)</enum><text>the number and nature of complaints received by the Commission relating to an allegation of a violation of the Act during the reporting year; and</text></paragraph><paragraph id="id26f5cf56dccf4cee887613cca1a072c2"><enum>(5)</enum><text>policy or legislative recommendations to strengthen online protections for children and teens. </text></paragraph></subsection></section><section id="id829a3662-af72-497d-b94f-ec86837fed91" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>4.</enum><header>GAO study</header><subsection id="idf4a12f62-94cb-41f6-b61e-f96d90da8ef0"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <term>Comptroller General</term>) shall conduct a study on the privacy of teens who use financial technology products. Such study shall—</text><paragraph id="idc02dd7ab-e374-4d7e-bca2-65502df4caa8"><enum>(1)</enum><text>identify the type of financial technology products that teens are using;</text></paragraph><paragraph id="ida10778f8-85cb-4b53-9fa4-f4691b70ead6"><enum>(2)</enum><text>identify the potential risks to teens' privacy from using such financial technology products; and</text></paragraph><paragraph id="idf445c2f5-f131-4cb3-9b95-00d187454f89"><enum>(3)</enum><text>determine whether existing laws are sufficient to address such risks to teens' privacy.</text></paragraph></subsection><subsection id="idaa96650a-e270-4a87-b83e-13c3b757ae18" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Comptroller General shall submit to Congress a report containing the results of the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate. </text></subsection></section></legis-body><endorsement><action-date>December 13, 2023</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
