<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 1170</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To reauthorize and update the Project Safe Childhood program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="id2323551d-ef25-4cd7-8b7a-80985783b240" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Project Safe Childhood Act</short-title></quote>.</text></section><section id="idecac0eff-2c29-45f4-80a1-eb7e02c6aec0" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Project Safe Childhood modernization</header><text display-inline="no-display-inline">Section 143 of the Adam Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/34/20942">34 U.S.C. 20942</external-xref>) is amended to read as follows:</text><quoted-block id="ida896817b-0917-4f15-8b35-3c5f816a6275" display-inline="no-display-inline" style="OLC" changed="not-changed"><section id="id8139da20-b560-491c-a489-fb0369019475" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>143.</enum><header display-inline="yes-display-inline">Project Safe Childhood</header><subsection id="idbf2fe7ab-c03f-42c9-8131-c168ed886310" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id619d508e-f08e-45c4-a045-59f3d1ac560f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Child sexual abuse material</header><text display-inline="yes-display-inline">The term <term>child sexual abuse material</term> has the meaning given the term <term>child pornography</term> in section 2256 of title 18, United States Code.</text></paragraph><paragraph id="idd662c0d4-f192-46dc-a338-6a0c0a40cd48" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Child sexual exploitation offense</header><text display-inline="yes-display-inline">The term <term>child sexual exploitation offense</term> means—</text><subparagraph id="id169ee141-042a-4293-a23a-eab46fc4bb70" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id7bac08ce-fb69-4217-bae8-ec4a44d8759e" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">an offense involving a minor under section 1591 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/117">chapter 117</external-xref> of title 18, United States Code;</text></clause><clause id="idb607fbe7-f537-4ea2-a13d-667b85c191ab" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">an offense under subsection (a), (b), or (c) of section 2251 of title 18, United States Code;</text></clause><clause id="id161ae994-86e8-4226-9a48-b35152385534" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">an offense under section 2251A or 2252A(g) of title 18, United States Code; or</text></clause><clause id="id73dd96c8-76a4-4c57-a06f-b7486822da1e" indent="up1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">any attempt or conspiracy to commit an offense described in clause (i) or (ii); or</text></clause></subparagraph><subparagraph id="id94571152-18af-4f35-a5de-5bb2551475d9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an offense involving a minor under a State or Tribal statute that is similar to a provision described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id4d2bda13-f6c8-4561-8756-5a061b28e510" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Circle of trust offender</header><text display-inline="yes-display-inline">The term <term>circle of trust offender</term> means an offender who is related to, or in a position of trust, authority, or supervisory control with respect to, a child.</text></paragraph><paragraph id="id1a2126d7-dc1a-4308-a747-60e80daba461" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Computer</header><text display-inline="yes-display-inline">The term <term>computer</term> has the meaning given the term in section 1030 of title 18, United States Code.</text></paragraph><paragraph id="idce046358-c21f-491c-8a0b-85a36725e92b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Contact sexual offense</header><text display-inline="yes-display-inline">The term <term>contact sexual offense</term> means—</text><subparagraph id="idd0d95f93-2b31-41fc-a892-e1d7bc6efc24" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an offense involving a minor under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/109A">chapter 109A</external-xref> of title 18, United States Code, or any attempt or conspiracy to commit such an offense; or</text></subparagraph><subparagraph id="id9b0e9dc9-1282-4755-902d-be456bdf9bec" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an offense involving a minor under a State or Tribal statute that is similar to a provision described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id97757a4b-fa97-4444-9c3e-e37818445a92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Dual offender</header><text display-inline="yes-display-inline">The term <term>dual offender</term> means—</text><subparagraph id="id3adc86dd-d038-4bcb-a1be-3947a2d8249a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a person who commits—</text><clause id="id7222973c-70d5-4fbe-bab7-a0b66a2b3f91" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a technology-facilitated child sexual exploitation offense or an offense involving child sexual abuse material; and</text></clause><clause id="id505d5ad3-9b86-4fa8-bf26-14117203fc0e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a contact sexual offense; and</text></clause></subparagraph><subparagraph id="id6dc05134-dc76-401f-8806-c54f37e21d65" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">without regard to whether the offenses described in clauses (i) and (ii) of subparagraph (A)—</text><clause id="idb196301a-7f70-4875-abd2-fc60244c2471" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">are committed as part of the same course of conduct; or</text></clause><clause id="id942c6426-df1c-4597-9595-79f9a35aefe2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">involve the same victim.</text></clause></subparagraph></paragraph><paragraph id="id211aea3d-ace4-444b-a6ae-c0e729c60423" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Facilitator</header><text display-inline="yes-display-inline">The term <term>facilitator</term> means an individual who facilitates the commission by another individual of—</text><subparagraph id="id87b2aff0-9a63-4f26-981e-5f9418fdd58e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a technology-facilitated child sexual exploitation offense or an offense involving child sexual abuse material; or</text></subparagraph><subparagraph id="idd6009840-89ab-422e-a4db-13638b2a0e1d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a contact sexual offense.</text></subparagraph></paragraph><paragraph id="id2ba0a22c-86f4-42d1-9a32-a8989a730074" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">ICAC affiliate partner</header><text display-inline="yes-display-inline">The term <term>ICAC affiliate partner</term> means a law enforcement agency that has entered into a formal operating agreement with the ICAC Task Force Program.</text></paragraph><paragraph id="id417b26a0-2fdb-4792-9792-1ff0944427ae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">ICAC task force</header><text display-inline="yes-display-inline">The term <term>ICAC task force</term> means a task force that is part of the ICAC Task Force Program.</text></paragraph><paragraph id="id35d8953f-d56f-4295-b24d-3e6f1666b775" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">ICAC Task Force Program</header><text display-inline="yes-display-inline">The term <term>ICAC Task Force Program</term> means the National Internet Crimes Against Children Task Force Program established under section 102 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21112">34 U.S.C. 21112</external-xref>).</text></paragraph><paragraph id="idada4e7d8-48f4-4e9b-9f36-76e5e37ab2db" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Offense involving child sexual abuse material</header><text display-inline="yes-display-inline">The term <term>offense involving child sexual abuse material</term> means—</text><subparagraph id="id02a5e8ad-d98e-430c-a041-44bafba979e6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an offense under section 2251(d), section 2252, or paragraphs (1) through (6) of section 2252A(a) of title 18, United States Code, or any attempt or conspiracy to commit such an offense; or</text></subparagraph><subparagraph id="idc6c68714-c516-4207-a42f-2af75785f16f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an offense under a State or Tribal statute that is similar to a provision described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idcfe55712-72c3-4a38-815c-50e371a9c5d2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header display-inline="yes-display-inline">Serious offender</header><text display-inline="yes-display-inline">The term <term>serious offender</term> means—</text><subparagraph id="ida8e93c92-4732-4778-803b-638819f6b4d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an offender who has committed a contact sexual offense or child sexual exploitation offense;</text></subparagraph><subparagraph id="idda166f5f-6710-4aed-bb9b-c1129b7e4529" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a dual offender, circle of trust offender, or facilitator; or</text></subparagraph><subparagraph id="id53a4dec4-198f-4c1f-ab17-77bca219b8b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">an offender with a prior conviction for a contact sexual offense, a child sexual exploitation offense, or an offense involving child sexual abuse material.</text></subparagraph></paragraph><paragraph id="id66bd67bb-cb6b-4143-b7fd-47d057ee2c73" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="id17fc9cb0-8dc3-409d-a770-e5d4fe396f7b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header display-inline="yes-display-inline">Technology-facilitated</header><text display-inline="yes-display-inline">The term <term>technology-facilitated</term>, with respect to an offense, means an offense that is committed through the use of a computer, even if the use of a computer is not an element of the offense.</text></paragraph></subsection><subsection id="idf0c5c33c-2e86-48dd-8f37-1b1387dbd71d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment of program</header><text display-inline="yes-display-inline">The Attorney General shall create and maintain a nationwide initiative to align Federal, State, and local entities to combat the growing epidemic of online child sexual exploitation and abuse, to be known as the <quote>Project Safe Childhood program</quote>, in accordance with this section.</text></subsection><subsection id="idd2781485-247f-4e14-bb32-d083798e01d6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Best practices</header><text display-inline="yes-display-inline">The Attorney General, in coordination with the Child Exploitation and Obscenity Section of the Criminal Division of the Department of Justice and the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice, and in consultation with training and technical assistance providers under the ICAC Task Force Program who are funded by the Attorney General and with appropriate nongovernmental organizations, shall—</text><paragraph id="id3fcf3815-e587-406c-887a-79b2c4e0f643" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">develop best practices to adopt a balanced approach to the investigation of suspect leads involving contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material, and the prosecution of those offenses, prioritizing when feasible the identification of a child victim or a serious offender, which approach shall incorporate the use of—</text><subparagraph id="id73002d23-b4cc-4488-9493-16cd2461002c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">proactively generated leads, including leads generated by current and emerging technology;</text></subparagraph><subparagraph id="idc978bf08-5b4a-4259-a593-abd3d666bbb5" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in-district investigative referrals; and</text></subparagraph><subparagraph id="idab40f226-a374-4cb4-85d5-6c638690dd21" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">CyberTipline reports from the National Center for Missing and Exploited Children;</text></subparagraph></paragraph><paragraph id="id483d6e2d-ce46-4bd5-9c63-6017f61923a8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">develop best practices to be used by each United States Attorney and ICAC task force to assess the likelihood that an individual could be a serious offender or that a child victim may be identified;</text></paragraph><paragraph id="idf4d5caad-dff7-4db7-b185-2dffd16a7007" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">develop and implement a tracking and communication system for Federal, State, and local law enforcement agencies and prosecutor’s offices to report successful cases of victim identification and child rescue to the Department of Justice and the public; and</text></paragraph><paragraph id="idf0e3c263-2f8e-48e9-9408-5366932e8680" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">encourage the submission of all lawfully seized visual depictions to the Child Victim Identification Program of the National Center for Missing and Exploited Children.</text></paragraph></subsection><subsection id="idd1613412-09ac-43cd-ba35-0560335b9b9d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Except as authorized under subsection (e), funds authorized under this section may only be used for the following 4 purposes:</text><paragraph id="idcfd1ba3c-e5ee-4d2b-9cb9-bef96b20cbcf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Integrated Federal, State, and local efforts to investigate and prosecute contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material, including—</text><subparagraph id="ideacafb00-8c0a-4259-a7d9-11ff0a23dc3d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the partnership by each United States Attorney with each Internet Crimes Against Children Task Force within the district of such attorney;</text></subparagraph><subparagraph id="id1802c812-d213-44ea-9bd4-136b2027be99" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">training of Federal, State, and local law enforcement officers and prosecutors through—</text><clause id="id461ba3e5-8601-4d51-a731-ed84639e782b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">programs facilitated by the ICAC Task Force Program;</text></clause><clause id="idf4e9c6ca-78cf-42e3-84eb-afd20477e22e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">ICAC training programs supported by the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice;</text></clause><clause id="ida0635805-d1f1-4603-a7f7-76f6f9f4da5f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">programs facilitated by appropriate nongovernmental organizations with subject matter expertise, technical skill, or technological tools to assist in the identification of and response to serious offenders, contact sexual offenses, child sexual exploitation offenses, or offenses involving child sexual abuse material; and</text></clause><clause id="id0bc8841e-452f-4f0e-b90a-893dc4be567c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">any other program that provides training—</text><subclause id="id936f2e54-b8a1-4cbe-8d7e-98e80431ee3b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">on the investigation and identification of serious offenders or victims of contact sexual offenses, child sexual exploitation offenses, or offenses involving child sexual abuse material; or</text></subclause><subclause id="id8f54065d-bfdb-4127-b583-b49a355c36c5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">that specifically addresses the use of existing and emerging technologies to commit or facilitate contact sexual offenses, child sexual exploitation offenses, or offenses involving child sexual abuse material;</text></subclause></clause></subparagraph><subparagraph id="ida4eb7458-87c3-4161-a864-67245242b357" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the development by each United States Attorney of a district-specific strategic plan to coordinate with State and local law enforcement agencies and prosecutor’s offices, including ICAC task forces and their ICAC affiliate partners, on the investigation of suspect leads involving serious offenders, contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material, and the prosecution of those offenders and offenses, which plan—</text><clause id="id124e5f0c-c963-4450-a4f5-41aa0f821fd2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">shall include—</text><subclause id="idbd3470de-7f9e-455d-80f3-9c2acf0a87c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the use of the best practices developed under paragraphs (1) and (2) of subsection (c);</text></subclause><subclause id="idfb3242e2-9e67-4a29-9d05-5b3e8a8781b3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the development of plans and protocols to target and rapidly investigate cases involving potential serious offenders or the identification and rescue of a victim of a contact sexual offense, a child sexual exploitation offense, or an offense involving child sexual abuse material; </text></subclause><subclause id="idb1f0726a-dc18-4339-9316-8b7ded85a24e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the use of training and technical assistance programs to incorporate victim-centered, trauma-informed practices in cases involving victims of contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material, which may include the use of child protective services, children’s advocacy centers, victim support specialists, or other supportive services;</text></subclause><subclause id="id9b6ec721-ce1b-42ff-9507-68cf01fa8a33" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">the development of plans to track, report, and clearly communicate successful cases of victim identification and child rescue to the Department of Justice and the public;</text></subclause><subclause id="idac2ad58c-9892-4055-a79d-aa4942c644cc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">an analysis of the investigative and forensic capacity of law enforcement agencies and prosecutor’s offices within the district, and goals for improving capacity and effectiveness;</text></subclause><subclause id="iddd6329da-720d-4b19-b24b-ee64834a7a61" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VI)</enum><text display-inline="yes-display-inline">a written policy describing the criteria for referrals for prosecution from Federal, State, or local law enforcement agencies, particularly when the investigation may involve a potential serious offender or the identification or rescue of a child victim;</text></subclause><subclause id="idca5f3c9a-31e0-4cdb-a195-ca8819aa08d3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VII)</enum><text display-inline="yes-display-inline">plans and budgets for training of relevant personnel on contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material;</text></subclause><subclause id="ida2c3e6ea-5ffd-4dda-946d-71a138f35ba5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VIII)</enum><text display-inline="yes-display-inline">plans for coordination and cooperation with State, local, and Tribal law enforcement agencies and prosecutorial offices; and</text></subclause><subclause id="id93d1e4a1-889c-4433-9932-0558913387a5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IX)</enum><text display-inline="yes-display-inline">evidence-based programs that educate the public about and increase awareness of such offenses; and</text></subclause></clause><clause id="id51167570-a9f9-4446-9536-fe64010cd5f5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be developed in consultation, as appropriate, with—</text><subclause id="idd2516620-b475-4ca8-92c6-2b42fa2e2c08" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the local ICAC task force;</text></subclause><subclause id="id78436233-06ee-480d-88bb-f9efce43edaa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the United States Marshals Service Sex Offender Targeting Center;</text></subclause><subclause id="idc5b63865-5bd5-4627-9b13-869c4f0cb8c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">training and technical assistance providers under the ICAC Task Force Program who are funded by the Attorney General;</text></subclause><subclause id="idd90f535e-baa9-4010-93ef-b4a86e23397f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">nongovernmental organizations with subject matter expertise, technical skill, or technological tools to assist in the identification of and response to contact sexual offenses, child sexual exploitation offenses, or offenses involving child sexual abuse material;</text></subclause><subclause id="id41d46400-c8bf-4bbd-82f4-d967e6067901" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">any relevant component of Homeland Security Investigations;</text></subclause><subclause id="id37502f49-57da-4908-8d9c-f5b4dcfbab92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VI)</enum><text display-inline="yes-display-inline">any relevant component of the Federal Bureau of Investigation;</text></subclause><subclause id="id57e82676-5602-446a-9d8f-b8340ffad490" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VII)</enum><text display-inline="yes-display-inline">the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice;</text></subclause><subclause id="iddf24c3f1-c901-4c59-b5a2-f7353855eb72" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(VIII)</enum><text display-inline="yes-display-inline">the Child Exploitation and Obscenity Section of the Criminal Division of the Department of Justice;</text></subclause><subclause id="id59162a9d-8a14-4ef7-bb26-59bd1e257cd1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(IX)</enum><text display-inline="yes-display-inline">the United States Postal Inspection Service;</text></subclause><subclause id="id86d12f22-9461-4b14-b23e-ab73459d8705" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(X)</enum><text display-inline="yes-display-inline">the United States Secret Service; and</text></subclause><subclause id="id0f0aaa53-867d-4033-a2b7-03a4d01ed1b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(XI)</enum><text display-inline="yes-display-inline">each military criminal investigation organization of the Department of Defense; and</text></subclause></clause></subparagraph><subparagraph id="id7c17ff0a-8b56-43fb-8c85-f4204ebbfaec" commented="no" changed="not-changed" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">a quadrennial assessment by each United States Attorney of the investigations within the district of such attorney of contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material—</text><clause commented="no" id="id2da724bf-577a-465c-b134-2fea9f6cdb7e" changed="not-changed" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">with consideration of—</text><subclause commented="no" id="iddfbbea49-629d-48c1-b536-f9d6a22d8141" changed="not-changed" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the variety of sources for leads;</text></subclause><subclause commented="no" id="ide4049d7c-3860-496b-a42a-ff835f8e3924" changed="not-changed" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the proportion of work involving proactive or undercover law enforcement investigations;</text></subclause><subclause commented="no" id="id4f7cf5bc-4cc6-4f8e-ba1f-2c92f0b5f900" changed="not-changed" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the number of serious offenders identified and prosecuted; and</text></subclause><subclause commented="no" id="ida0c0b9e6-f84c-4394-bd1e-98c9bf123158" changed="not-changed" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">the number of children identified or rescued; and</text></subclause></clause><clause commented="no" id="id9ef41039-35c2-4d9f-8334-d82d91b64866" changed="not-changed" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">information from which may be used by the United States Attorney, as appropriate, to revise the plan described in subparagraph (C).</text></clause></subparagraph></paragraph><paragraph id="id7b1abbbf-6c55-4e62-88b1-d6d042a47ebf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Major case coordination by the Department of Justice (or other Federal agencies as appropriate), including specific cooperation, as appropriate, with—</text><subparagraph id="id446684f7-8ebe-4283-8dd7-f9379334e034" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Child Exploitation and Obscenity Section of the Criminal Division of the Department of Justice;</text></subparagraph><subparagraph id="id0106437a-6b9f-4c0f-9a1b-dc51c2192fa5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any relevant component of Homeland Security Investigations;</text></subparagraph><subparagraph id="id68f2110c-b434-4734-8ee5-4d4b8507249e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any relevant component of the Federal Bureau of Investigation;</text></subparagraph><subparagraph id="id7a79a556-58f3-45b9-a191-773896d759b5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the ICAC task forces and ICAC affiliate partners;</text></subparagraph><subparagraph id="id365c1505-33ff-476a-a9af-9d678051a951" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the United States Marshals Service, including the Sex Offender Targeting Center;</text></subparagraph><subparagraph id="id9023b338-578f-4d26-a28b-19ec9ebb8fe2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the United States Postal Inspection Service;</text></subparagraph><subparagraph id="id76f07b8d-f327-43a7-a650-cc4a83aafe7a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the United States Secret Service;</text></subparagraph><subparagraph id="id50f395dd-7b1d-40e0-baaa-cb2ed4e02dd2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">each Military Criminal Investigation Organization of the Department of Defense; and</text></subparagraph><subparagraph id="id6ec4dcbd-5624-43c6-ac43-0a90f516a06c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">any task forces established in connection with the Project Safe Childhood program set forth under subsection (b).</text></subparagraph></paragraph><paragraph id="id195da7e2-b0bc-40ab-892c-0d7bf68dbe28" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Increased Federal involvement in, and commitment to, the prevention and prosecution of technology-facilitated child sexual exploitation offenses or offenses involving child sexual abuse material by—</text><subparagraph id="idfc359033-74e6-4eb6-9d0a-7eae1606ebf9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">using technology to identify victims and serious offenders;</text></subparagraph><subparagraph id="idf2309b5d-3b14-4463-ace0-699663cdf080" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">developing processes and tools to identify victims and offenders; and</text></subparagraph><subparagraph id="idab366905-9c52-423f-94c7-8f0148015b98" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">taking measures to improve information sharing among Federal law enforcement agencies, including for the purposes of implementing the plans and protocols described in paragraph (1)(C)(i)(II) to identify and rescue—</text><clause id="idc6fe5170-ce00-496d-a25e-e23c4a804525" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">victims of contact sexual offenses, child sexual exploitation offenses, and offenses involving child sexual abuse material; or</text></clause><clause id="id0b10566e-4806-48ca-8841-7314799a03ce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">victims of serious offenders.</text></clause></subparagraph></paragraph><paragraph id="id6ef299ff-c51f-44bf-895c-22bd03ccc3a1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">The establishment, development, and implementation of a nationally coordinated <quote>Safer Internet Day</quote> every year developed in collaboration with the Department of Education, national and local internet safety organizations, parent organizations, social media companies, and schools to provide—</text><subparagraph id="id20bb242a-5742-4048-a959-96a346f7465a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">national public awareness and evidence-based educational programs about the threats posed by circle of trust offenders and the threat of contact sexual offenses, child sexual exploitation offenses, or offenses involving child sexual abuse material, and the use of technology to facilitate those offenses;</text></subparagraph><subparagraph id="id5e3d53fd-492f-48b6-ba8a-7e86863013d5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">information to parents and children about how to avoid or prevent technology-facilitated child sexual exploitation offenses; and</text></subparagraph><subparagraph id="id17039c2d-6ec6-4843-ad7f-27bd27ba8997" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">information about how to report possible technology-facilitated child sexual exploitation offenses or offenses involving child sexual abuse material through—</text><clause id="id14a45408-4c74-4d2f-a521-64ec46228fce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the National Center for Missing and Exploited Children;</text></clause><clause id="id25c0f9e9-b601-406b-a489-6ca505921a89" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the ICAC Task Force Program; and</text></clause><clause id="idf529e7e9-310b-4df2-a4d3-aee27c5f23e5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">any other program that—</text><subclause id="id11cd67cc-d634-4795-abd8-4a34ccec5f80" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">raises national awareness about the threat of technology-facilitated child sexual exploitation offenses or offenses involving child sexual abuse material; and</text></subclause><subclause id="idc0aba0f3-c5e9-490e-ab30-d0bcf0c2745a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">provides information to parents and children seeking to report possible violations of technology-facilitated child sexual exploitation offenses or offenses involving child sexual abuse material.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id9da3d72f-772b-4c1c-99f4-c78010f6afc0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Expansion of Project Safe Childhood</header><text display-inline="yes-display-inline">Notwithstanding subsection (d), funds authorized under this section may be also be used for the following purposes:</text><paragraph id="id84c0eff1-b30e-4d46-b027-4271f173b2c3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The addition of not less than 20 Assistant United States Attorneys at the Department of Justice, relative to the number of such positions as of the day before the date of enactment of the <short-title>Project Safe Childhood Act</short-title>, who shall be—</text><subparagraph id="idb85bdc02-5c1e-47de-9980-d6747f3bae06" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">dedicated to the prosecution of cases in connection with the Project Safe Childhood program set forth under subsection (b); and</text></subparagraph><subparagraph id="id4db992f3-8b98-49ec-b4d2-a56779f40a1d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">responsible for assisting and coordinating the plans and protocols of each district under subsection (d)(1)(C)(i)(II).</text></subparagraph></paragraph><paragraph id="id7ec80783-5bfa-4a07-a2e4-820ae263ae8b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Such other additional and related purposes as the Attorney General determines appropriate.</text></paragraph></subsection><subsection id="id4679aa95-2a63-44f0-8726-2dfc13b50229" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph id="id55c6c5b3-38ed-45dd-ae8b-3403fc48e793" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the purpose of carrying out this section, there are authorized to be appropriated—</text><subparagraph id="id8cc34fb0-a33f-49c9-8884-4a5ab5da48f5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">for the activities described under paragraphs (1), (2), and (3) of subsection (d), $28,550,000 for each of fiscal years 2023 through 2028;</text></subparagraph><subparagraph id="id7d467432-837f-4512-b7d5-15d78edcb5c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">for the activities described under subsection (d)(4), $4,000,000 for each of fiscal years 2023 through 2028; and</text></subparagraph><subparagraph id="iddb9f98e4-3ac2-4093-8ca7-14646f69b814" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">for the activities described under subsection (e), $29,100,000 for each of fiscal years 2023 through 2028.</text></subparagraph></paragraph><paragraph id="id46963d33-fe57-4ed6-8fd0-2213cbf28d72" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Amounts made available to State and local agencies, programs, and services under this section shall supplement, and not supplant, other Federal, State, or local funds made available for those agencies, programs, and services.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestation-date date="20231024" chamber="Senate">Passed the Senate October 24, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
