R. 6851</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231219">December 19, 2023</action-date><action-desc><sponsor name-id="E000246">Mr. Edwards</sponsor> (for himself and <cosponsor name-id="N000190">Mr. Norman</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit certain funding to sanctuary jurisdictions, and for other purposes.</official-title></form><legis-body id="H5D747614A7E2440DB61CABF66E0B4D33" style="OLC"><section id="H8F6CB28F9D794F80A0F794D0E1579B92" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cooperation with ICE Act</short-title></quote>. </text></section><section id="H275C9BA75DF2438C860281F3F374D814"><enum>2.</enum><header>Prohibition on sanctuary city receipt of SSP funds</header><subsection id="H67C357F0A2EC44F59DB4849D7CBE404B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall revise the eligibility requirements for the Shelter and Services Program (SSP) of the Agency (or any related successor program) to render a sanctuary jurisdiction ineligible to receive Federal funding under such program.</text></subsection><subsection id="HF0E5699E7EFE4BB0805BB038A3A35B40"><enum>(b)</enum><header>Limitation on liability for certain officers and employees who comply with lawful requests made by DHS</header><text>An officer or employee of a sanctuary jurisdiction may not be held liable under Federal, State, or local law, for—</text><paragraph id="H1E931BCFF2744C0CA5ED9F51103EF13C"><enum>(1)</enum><text>sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual; or</text></paragraph><paragraph id="H302FDF197E944E51A4C3E53148499407"><enum>(2)</enum><text>complying with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357) to comply with a detainer for, or notify about the release of, an individual.</text></paragraph></subsection><subsection id="HF7C2F1E852B5435F87428CF9B6453BD8"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>sanctuary jurisdiction</quote> means any State or political subdivision of a State that has in effect a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from—</text><paragraph id="HD25331A062B84F6885082217B85DF0F3"><enum>(1)</enum><text>sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual; or</text></paragraph><paragraph id="HA98C9BAE44D54A0D8F6FDB718A1D4A46"><enum>(2)</enum><text>complying with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357) to comply with a detainer for, or notify about the release of, an individual.</text></paragraph></subsection></section></legis-body></bill>
