<section id="H2BB7A1EC2EB743BE8183CE6FD17AC3DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Books Save Lives Act</short-title></quote>.</text></section> <section id="H1B08B41E62DC4212A36F84164D031905"><enum>2.</enum><header>Access to libraries and diverse books</header> <subsection id="H49772401267042BBBC966E66D0F1F434"><enum>(a)</enum><header>Access to school libraries</header><text display-inline="yes-display-inline">A covered school shall maintain a library that is staffed by a trained librarian. </text></subsection> 
<subsection id="HE691C2B64922435DBB0C4B8C73190936"><enum>(b)</enum><header>Library book selection</header><text display-inline="yes-display-inline">Each public library receiving Federal financial assistance and each library of a covered school shall maintain a diverse collection of books, including—</text> <paragraph id="H161FD77EEBEB4D6A846C83449D9579E8"><enum>(1)</enum><text>books written or illustrated by an individual who is a member of an underrepresented community; and</text></paragraph> 
<paragraph id="H438B231742FD41ABBACBF69802C48466"><enum>(2)</enum><text>books about an underrepresented community.</text></paragraph></subsection> <subsection id="HE8E3410C6E374125A902A21DAEE0D780"><enum>(c)</enum><header>Civil rights enforcement</header><text display-inline="yes-display-inline">Proof that the exclusion of books from a covered school or library receiving Federal financial assistance has had a disparate impact on covered books shall constitute prima facie evidence of discrimination against a protected class in violation of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701 et seq.</external-xref>), or the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1651">20 U.S.C. 1651 et seq.</external-xref>), as appropriate.</text></subsection> </section> 
<section id="H21EACE70F1EF49F09AB989A320A4C105"><enum>3.</enum><header>Report on book ban campaigns</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall begin the creation of a report on the effect that recent campaigns to ban books in public libraries and public schools have had on underrepresented communities.</text></section> <section id="H3F24450C2FB54CB5B44CBBECE2BF7C2A"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H7CA110C088AF4D42A64DD1D173C50390"><enum>(1)</enum><header>Covered book</header><text>The term <quote>covered book</quote> means a book or an item of educational media written by, illustrated by, or about an individual who is a member of an underrepresented community.</text> </paragraph> <paragraph id="HCCBAB387F8504D5785BEC33442892611"><enum>(2)</enum><header>Covered school</header><text>The term <quote>covered school</quote> means an elementary school or secondary school that is controlled or directed by a local educational agency receiving Federal financial assistance.</text></paragraph> 
<paragraph id="HF8224E2441744DCA9D2288621CE0B3B0"><enum>(3)</enum><header>Elementary school, local educational agency, and secondary school</header><text display-inline="yes-display-inline">The terms <quote>elementary school</quote>, <quote>local educational agency</quote>, and <quote>secondary school</quote> have the meaning given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="H39F2BA16E935471380AA3A7D28758F9C"><enum>(4)</enum><header>Underrepresented community</header><text display-inline="yes-display-inline">The term <quote>underrepresented community</quote> means a group of individuals that share a common identity or characteristic, in cases in which discrimination based on such characteristic is prohibited by the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701 et seq.</external-xref>), or the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1651">20 U.S.C. 1651 et seq.</external-xref>), including a group of individuals who—</text> 
<subparagraph id="H2888445B427249599E413BDD4D251A3E"><enum>(A)</enum><text display-inline="yes-display-inline">are members of a racial or ethnic minority group;</text></subparagraph> <subparagraph id="HBD9D4EF7956548E5927FEAED665F22D9"><enum>(B)</enum><text>are lesbian, gay, bisexual, transgender, queer, intersex, or nonbinary;</text></subparagraph> 
<subparagraph id="H5AD45D56DFF94C3DB18E41079D3FC1DD"><enum>(C)</enum><text display-inline="yes-display-inline">are members of a religious minority group; or</text></subparagraph> <subparagraph id="H066D435AC8BF42668A4399063422DAF3"><enum>(D)</enum><text display-inline="yes-display-inline">have a disability.</text></subparagraph> </paragraph> </section>
