which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Under Secretary of Commerce for Oceans and Atmosphere to assess certain offshore oil and gas platforms and pipelines for potential use as artificial reefs, and for other purposes.</official-title></form><legis-body id="H81222F3566E24BABB6D2B7702838F8B8" style="OLC"><section id="H143C11BF46864849BD6E24B40CAEC154" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marine Fisheries Habitat Protection Act</short-title></quote>.</text></section><section id="HF81EF4E8D2064975BAAD392C5F15235A"><enum>2.</enum><header>Use of certain offshore oil and gas platforms and pipelines for artificial reefs</header><subsection id="H5BF8C1A19A794CA79D3F410ED98E91AD"><enum>(a)</enum><header>National Fishing Enhancement Act of 1984</header><text display-inline="yes-display-inline">The National Fishing Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2101">33 U.S.C. 2101 et seq.</external-xref>) is amended—</text><paragraph id="H773FBDE402054D72B8C44968A987EA53"><enum>(1)</enum><text>by amending section 206 (<external-xref legal-doc="usc" parsable-cite="usc/33/2105">33 U.S.C. 2105</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF409B67296BA442F8A927C2B9CCEF4F4"><section id="H2CB41E76A7EF4B3CB9E1B135C0B28A51"><enum>206.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H62BFE9584D95409180E28FD26FB6532A"><enum>(1)</enum><header>Artificial reef</header><text display-inline="yes-display-inline">The term <term>artificial reef</term> means a structure which is constructed or placed in waters covered under this title for the purpose of enhancing fishery resources and commercial and recreational fishing opportunities.</text></paragraph><paragraph id="H066073C0131A4D7F93E2C756ADF0FF93"><enum>(2)</enum><header>Decommissioning</header><text>The term <term>decommissioning</term> mean ending oil, gas, or sulphur operations on an offshore lease, right-of-way, or right-of-use and easement and returning the area subject to such lease, right-of-way, or right-of-use and easement to a condition that complies with applicable law, including by removing caissons and idle structures.</text></paragraph><paragraph id="H0F3181E03635451CBD7158448DDDD9F2"><enum>(3)</enum><header>Established reef ecosystem</header><text>The term <term>established reef ecosystem</term> means an area with identified reef-associated species, including species of corals, crustaceans, or fish that are managed under—</text><subparagraph id="H4DD79BD682A94D96B838598F55DBD852"><enum>(A)</enum><text>a fishery management plan of the National Oceanic and Atmospheric Administration; or</text></subparagraph><subparagraph id="HC311142708F04D0BBB839A75BE6575D2"><enum>(B)</enum><text>a State management plan for reef-associated species.</text></subparagraph></paragraph><paragraph id="H2D1F03582FC84F5C93098F1C264950BC"><enum>(4)</enum><header>Idle structure</header><text>The term <term>idle structure</term> means—</text><subparagraph id="HADDCED9267D64A7385D807782715CADA"><enum>(A)</enum><text>an oil or gas pipeline, and associated equipment and infrastructure, that the Secretary of the Interior has determined is no longer useful for operations; and</text></subparagraph><subparagraph id="H6BFF39BF699E4A8B9B2ED74B19897310"><enum>(B)</enum><text>an offshore oil and gas platform or similar structure, and associated equipment and infrastructure, that is no longer useful for operations, as determined by the Secretary of the Interior.</text></subparagraph></paragraph><paragraph id="H15646BB3D96744A18F0CD135837CEFDB"><enum>(5)</enum><header>Partial removal</header><text>The term <term>partial removal</term> means—</text><subparagraph id="HCF79412FD14B4D6099357D54DDA4231C"><enum>(A)</enum><text>the severance of the top portion of a structure at a level appropriate to maintain navigational safety, as determined by the Secretary of the Interior in consultation with the Commandant of the Coast Guard; and</text></subparagraph><subparagraph id="HE968BB2F6B31428BBC130B445B0F541B"><enum>(B)</enum><text>optionally, the placement of the severed portion of the structure on the sea floor adjacent to the base of the nonsevered portion of the structure.</text></subparagraph></paragraph><paragraph id="H1C6A353DDE4E4DA39B86B5D67F3BAA7E"><enum>(6)</enum><header>Reef in place</header><text>The term <term>reef in place</term> means decommissioning through topple in place or partial removal that—</text><subparagraph id="H0AD9A28CA2CC4DC78FCD315FF62B643D" commented="no"><enum>(A)</enum><text>attempts to maximize habitat for benthic and pelagic species throughout the entirety of the water column; and</text></subparagraph><subparagraph id="HA3EB1DC38860489B9FAF6DA755A0F2BB" commented="no"><enum>(B)</enum><text>is appropriate to maintain navigational safety.</text></subparagraph></paragraph><paragraph id="HCDFE585227E94B269758DC804F85D910"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, American Samoa, Guam, Johnston Island, Midway Island, and Wake Island.</text></paragraph><paragraph id="H397AC357A6314538B588CF72E517BC25"><enum>(8)</enum><header>Topple in place</header><text>The term <term>topple in place</term> means detaching a structure from the seabed and toppling the structure onto its side on the seabed in the same area where the structure was originally attached.</text></paragraph><paragraph id="HCAD8F071435A4780A0B2AC50238CD678"><enum>(9)</enum><header>Waters covered under this title</header><text display-inline="yes-display-inline">The term <term>waters covered under this title</term> means the navigable waters of the United States and the waters superjacent to the Outer Continental Shelf as defined in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>), to the extent such waters exist in or are adjacent to any State.</text></paragraph></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA4A3ADD8D6894D108FEF351CA40EB81B"><enum>(2)</enum><text>by amending section 207 to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDAC5C62651B34292B2590F3F50209E14"><section id="HAFE6B22085DE49E290476E17A43C8C57"><enum>207.</enum><header>Reef in place</header><subsection id="HC34B1146BD1D4865A22C9FA238FB2640"><enum>(a)</enum><header>Reef in place</header><paragraph id="HD48A17995D1B4ECCAC378AEDB2B28D0F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date on which a lessee, right-of-way holder, or owner of an idle structure files a notice of intent under section 5(k)(4) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334(k)(4)</external-xref>) with respect to the idle structure, such lessee, right-of-way holder, or owner may reef in place the idle structure if the Secretary of the Interior determines—</text><subparagraph id="H7A33619371554656B074E5988262C5F2"><enum>(A)</enum><text>the idle structure is sound and secure; and</text></subparagraph><subparagraph id="HF60006AB057D44C8AE79361EB56BC6C1"><enum>(B)</enum><text>the lessee, right-of-way holder, or owner has, with respect to the idle structure—</text><clause id="H928FCF7A2B544C1AAB700E0CBDBF1AB4"><enum>(i)</enum><text>removed all hydrocarbons and other hazardous liquids;</text></clause><clause id="H30AE4A4F21314B57903B640C66B0AD8C"><enum>(ii)</enum><text>if required by law or regulation, installed identifying markers to protect and aid navigation;</text></clause><clause id="HEBE25FD0797548CAAEB185A76C91DC35" commented="no"><enum>(iii)</enum><text>no outstanding responsibility or liability; and</text></clause><clause id="HCA82AC2D3FAD4B67AA11A1ACDA66D947"><enum>(iv)</enum><text>transferred, or has an agreement to transfer, liability to a Federal or State agency.</text></clause></subparagraph></paragraph><paragraph id="HB1BED131572142EDA08733CFA6A0EAFE"><enum>(2)</enum><header>Designation of reef planning areas</header><text>The Administrator of the National Oceanic and Atmospheric Administration—</text><subparagraph id="H11927BEED3FA4AF0813569247ABA8011"><enum>(A)</enum><text>may designate the immediate vicinity of an idle structure that is reefed in place under paragraph (1) as a reef planning area pursuant to the National Artificial Reef Plan published under section 204; and</text></subparagraph><subparagraph id="H152B31D575A34D25A1772F73DEB319CF"><enum>(B)</enum><text display-inline="yes-display-inline">upon the request of the head of a State program to convert idle structures into artificial reefs, may designate the immediate vicinity of an idle structure that is reefed in place under such program as a reef planning area pursuant to the National Artificial Reef Plan published under section 204.</text></subparagraph></paragraph><paragraph id="H2CB3F1E4DDC74D62AFCC83D1989DA871"><enum>(3)</enum><header>Failure to reef in place</header><text display-inline="yes-display-inline">Notwithstanding section 5(k)(4) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334(k)(4)</external-xref>), if a lessee, right-of-way holder, or owner of an idle structure does not reef in place the idle structure within the time period described in paragraph (1) for the idle structure, such lessee, right-of-way holder, or owner shall resume decommissioning the idle structure pursuant to the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) through means other than reefing in place.</text></paragraph></subsection><subsection id="H300AC189D4CF4E37BABE3955A25B787C"><enum>(b)</enum><header>State programs</header><paragraph id="HBFE6D229FFB54EFCA1ACC1BA07A23060" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State that has a program to convert idle structures into artificial reefs may enter into an agreement with any appropriate entity to assume responsibility and liability for an idle structure located in waters covered under this title in exchange for an amount of funds that—</text><subparagraph id="H55DAC6A1229E4E1FBF1255001F70C3F0"><enum>(A)</enum><text>is determined by the State; and</text></subparagraph><subparagraph id="H2613CC58901F4918954C8B8212A00EA3" commented="no"><enum>(B)</enum><text>does not exceed 50 percent of the amount required to remove the idle structure, as determined by the appropriate entity and approved by the State, unless the appropriate entity consents to a greater amount.</text></subparagraph></paragraph><paragraph id="H6851CF54F51A438D8936E2E8D250D613" commented="no"><enum>(2)</enum><header>Liability</header><text display-inline="yes-display-inline">Upon acceptance by a State of an idle structure into a State program described in paragraph (1)—</text><subparagraph id="H320A200534A04983A0AC200210E0BF88" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the appropriate entity shall have no responsibility or liability with respect to the idle structure; and</text></subparagraph><subparagraph id="H22697B9B33B84BC6998D0BE5BF1637FE" commented="no"><enum>(B)</enum><text>the State shall be—</text><clause id="H12BF5E91737B475FA1BA8DF0A5205BFA" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">responsible for the continued maintenance of the idle structure, including maintaining any identifying markers installed to protect and aid navigation; and</text></clause><clause id="HAC091C34C3F142CCBDDC9254AB509462" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">exclusively responsible and liable for the idle structure.</text></clause></subparagraph></paragraph><paragraph id="H9BEE477DC52C4193A24C207E61D9D5A3"><enum>(3)</enum><header>Use of State funds</header><text>Funds received by a State under paragraph (1) may be used by the State for costs associated with—</text><subparagraph id="HAD8C8D42A24044B1B5B5058E3A1B4981"><enum>(A)</enum><text> respect to the idle structure—</text><clause id="HF4EFC8797E7E4697AF573DF35B51420D"><enum>(i)</enum><text>liability coverage;</text></clause><clause id="H6DFB4CFBE4674B65A4AF1F7465611138"><enum>(ii)</enum><text>maintenance and upkeep; and</text></clause><clause id="H27AB7BDFBE2D42FD8AF1C2DB374B3891"><enum>(iii)</enum><text display-inline="yes-display-inline">the installation and operation of passive technologies on the idle structure to monitor the health and size of the corals and fish stocks that use the idle structure as a habitat;</text></clause></subparagraph><subparagraph id="HC4C834EED52E422B84F789243A723660"><enum>(B)</enum><text>coastal restoration projects; and</text></subparagraph><subparagraph id="HE4CE227889694E1AA655AE2B5583EB9B"><enum>(C)</enum><text>coastal enhancement projects.</text></subparagraph></paragraph></subsection><subsection id="H3D1FBBEA9464401694369C9F65E46E6B"><enum>(c)</enum><header>Assessment</header><paragraph id="H7225C2AAB7D64DC5BAFC599C0CF72BEE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the National Oceanic and Atmospheric Administration shall conduct an assessment of each idle structure, which shall, with respect to each idle structure—</text><subparagraph id="HBCE0F06093814CEABCCC170E32E0BD4C"><enum>(A)</enum><text display-inline="yes-display-inline">include an assessment of—</text><clause id="HB0214AC5738948BD89B01E74CF9542F7"><enum>(i)</enum><text>the localized corals and fish species that use the idle structure as a habitat; and</text></clause><clause id="H938481D726DB4D7CAB31C7B32596E929"><enum>(ii)</enum><text>the economic impacts of reefing in place, including a comparison of the benefits afforded by reef-associated species if the idle structure is reefed in place with the costs of lost fishing opportunity if the idle structure is removed; and</text></clause></subparagraph><subparagraph id="HA3302EF736B7452EB39FBFBDF94246DF"><enum>(B)</enum><text display-inline="yes-display-inline">determine whether there is an established reef ecosystem on, under, or in the immediate vicinity of the idle structure.</text></subparagraph></paragraph><paragraph id="H4E61797ACECB485FAD410C7F8CC06994" commented="no"><enum>(2)</enum><header>Determination conducted by other party</header><subparagraph id="H7347CC74793A4674B0B68BFE26EC452C" commented="no"><enum>(A)</enum><header>In general</header><text>Upon the request of a lessee, right-of-way holder, or owner of an idle structure, the Administrator of the National Oceanic and Atmospheric Administration shall enter into an agreement with such lessee, right-of-way holder, or owner under which, subject to the approval of the Administrator under subparagraph (B), such lessee, right-of-way holder, or owner—</text><clause id="H7817743450484AED850780B925145965" commented="no"><enum>(i)</enum><text>makes, or enters into an agreement with another party (including a State) for that party to make, the determination described in paragraph (1)(B) for the idle structure; and</text></clause><clause id="H6F1E32ABA65C49639CF82FA0A7B09E55" commented="no"><enum>(ii)</enum><text>submits such determination to the Administrator.</text></clause></subparagraph><subparagraph id="H5D553AFD7ACD4CECA78F2866E33A58AC" commented="no"><enum>(B)</enum><header>Review of determination</header><text>Not later than 90 days after receipt of a determination under subparagraph (A)(ii), the Administrator of the National Oceanic and Atmospheric Administration shall review and—</text><clause id="H5ED7C848F962459283C57EE04F75F445" commented="no"><enum>(i)</enum><text>approve the determination; or</text></clause><clause id="H3B788C5917F54683AB73E12A5278D171" commented="no"><enum>(ii)</enum><text>reject the determination and provide the party that submitted the determination with a description of the changes, including specific action items, to the rejected determination that are necessary for the Administrator to approve the rejected determination.</text></clause></subparagraph><subparagraph id="H6997DB84A438409A8B38C06778CDC1DD" commented="no"><enum>(C)</enum><header>Default treatment</header><text>If the Administrator of the National Oceanic and Atmospheric Administration does not approve or reject a determination received under subparagraph (A)(ii) within the period described in subparagraph (B), such determination shall be treated as if it was approved by the Administrator under subparagraph (B)(i).</text></subparagraph></paragraph><paragraph id="H4433258E4C0949C486084E86337BBFA6"><enum>(3)</enum><header>Offshore Infrastructure Dashboard information</header><text display-inline="yes-display-inline">Upon the request of the Administrator of the National Oceanic and Atmospheric Administration or a lessee, right-of-way holder, or owner of an idle structure, the Secretary of the Interior shall submit to the requesting party information from the Offshore Infrastructure Dashboard established under section 2(c) of the Marine Fisheries Habitat Protection Act that is relevant to the completion of an assessment or determination for an idle structure under paragraph (1) or (2), respectively.</text></paragraph><paragraph id="H8D84CE86C9E1428385B97F0E01808733"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this subsection, and annually thereafter, the Administrator of the National Oceanic and Atmospheric Administration shall submit to the Secretary of the Interior a report regarding each assessment conducted and determination approved under paragraphs (1) and (2), respectively, which shall include an identification of and map each idle structure that supports an established reef ecosystem, as determined under paragraph (1)(B) or subparagraph (B) or (C) of paragraph (2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE06813EE17AD49E797A5B99E398DB948"><enum>(b)</enum><header>Outer Continental Shelf Lands Act</header><text display-inline="yes-display-inline">Section 5 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H36C82B28EF3A46168687BE96D3F091A9"><subsection id="H06CB5DB641D34AA7A1FC0510BF53219E"><enum>(k)</enum><header>Artificial reefs</header><paragraph id="H14541D59A7824D889FEDE392A8EAF71B"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H26AB7795833B4BAB95694BA16511924E" display-inline="no-display-inline"><enum>(A)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Under Secretary of Commerce for Oceans and Atmosphere in the Under Secretary’s capacity as Administrator of the National Oceanic and Atmospheric Administration.</text></subparagraph><subparagraph id="H07DAB18319EC41CAA483B0893FB7E306"><enum>(B)</enum><header>Decommissioning</header><text>The term <term>decommissioning</term> means ending oil, gas, or sulphur operations on an offshore lease, right-of-way, or right-of-use and easement and returning the area subject to such lease, right-of-way, or right-of-use and easement to a condition that complies with applicable law, including by removing caissons and idle structures.</text></subparagraph><subparagraph id="HC46C5020D9D04E1A9A7609371E061E2C" commented="no"><enum>(C)</enum><header>Established reef ecosystem</header><text>The term <term>established reef ecosystem</term> means an area with identified reef-associated species, including species of corals, crustaceans, or fish that are managed under—</text><clause id="H271D7F14815C4BBFA699E3C0264ED3D7" display-inline="no-display-inline"><enum>(i)</enum><text>a fishery management plan of the National Oceanic and Atmospheric Administration; or</text></clause><clause id="HEE3EDD6FF3DD4F68B6E3DCA6D73074B2"><enum>(ii)</enum><text>a State management plan for reef-associated species.</text></clause></subparagraph><subparagraph id="H3CEDADDB602F4C668C34E4BE718FECE3"><enum>(D)</enum><header>Idle structure</header><text>The term <term>idle structure</term> means—</text><clause id="HA956B8ADC5D248E4AAB107765F30013E"><enum>(i)</enum><text display-inline="yes-display-inline">an oil or gas pipeline, and associated equipment and infrastructure, that the Secretary of the Interior has determined is no longer useful for operations; and</text></clause><clause id="H9793ED14AAB141718DF88FBA4B90ACE2"><enum>(ii)</enum><text>an offshore oil and gas platform or similar structure, and associated equipment and infrastructure, that is no longer useful for operations, as determined by the Secretary of the Interior.</text></clause></subparagraph><subparagraph id="H08CFF7CAB1434FC1B0F67C6C6E22EEB2"><enum>(E)</enum><header>Partial removal</header><text>The term <term>partial removal</term> means—</text><clause id="H5EB2568FE9A0488EB64FF971F3918BAE" display-inline="no-display-inline"><enum>(i)</enum><text>the severance of the top portion of a structure at a level appropriate to maintain navigational safety, as determined by the Secretary of the Interior in consultation with the Commandant of the Coast Guard; and</text></clause><clause id="HE75BCB4E4C1E4266B838541E8F29BBFB" display-inline="no-display-inline"><enum>(ii)</enum><text>optionally, the placement of the severed portion of the structure on the sea floor adjacent to the base of the nonsevered portion of the structure.</text></clause></subparagraph><subparagraph id="HA09CB853B372449BB0F1A4104E2C3258"><enum>(F)</enum><header>Program</header><text>The term <term>Program</term> means the artificial reef program authorized under the National Fishing Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2101">33 U.S.C. 2101 et seq.</external-xref>).</text></subparagraph><subparagraph id="HF389846402DC408ABD82AEA43B8B8433"><enum>(G)</enum><header>Reef in place</header><text>The term <term>reef in place</term> means decommissioning through topple in place or partial removal that—</text><clause id="H7FBAFE20E89040CB8703EA0893927B23" commented="no"><enum>(i)</enum><text>attempts to maximize habitat for benthic and pelagic species throughout the entirety of the water column; and</text></clause><clause id="H9713F5EC1CD14A0B99D34490371A195D" commented="no"><enum>(ii)</enum><text>is appropriate to maintain navigational safety.</text></clause></subparagraph><subparagraph id="H91B1E055D1D44ADAA0FB522E3B11B317"><enum>(H)</enum><header>Topple in place</header><text>The term <term>topple in place</term> means detaching a structure from the seabed and toppling the structure onto its side on the seabed in the same area where the structure was originally attached.</text></subparagraph></paragraph><paragraph id="H7095814220D34D3A9A791296E28C15A7" display-inline="no-display-inline"><enum>(2)</enum><header>Prohibition on removal</header><subparagraph id="HA108ACA84CD74CF88CB0DFFDCF47E7A3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior may not require a lessee, right-of-way holder, or owner of an idle structure to remove the idle structure until the date on which the Administrator submits a report under section 207(c)(4) of the National Fishing Enhancement Act of 1984 with respect to such idle structure.</text></subparagraph><subparagraph id="H90FB04CF9EB6449BAEA2D5C8E2084C85"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) does not apply with respect to an idle structure that the Secretary of the Interior determines poses a substantial threat to—</text><clause id="H943CE5288BFB4BB1BC45F44A926EA363"><enum>(i)</enum><text>navigational safety; or</text></clause><clause id="HC6D01279A4BC49518A33C4B727EC7444"><enum>(ii)</enum><text>the marine environment.</text></clause></subparagraph></paragraph><paragraph id="H3A8889AFD7274C1B83D0DB2B95998D13"><enum>(3)</enum><header>Suspension of removal</header><text display-inline="yes-display-inline">If, during or as the result of an assessment conducted or determination approved under paragraph (1) or (2) of section 207(c) of the National Fishing Enhancement Act of 1984, respectively, the Administrator determines that there is an established reef ecosystem on, under, or in the immediate vicinity of an idle structure, the removal of the idle structure shall be suspended until the date on which the Secretary of the Interior, in consultation with the Administrator, determines whether—</text><subparagraph id="HA8558E7A7CE1426BA88D10800FBAD40D"><enum>(A)</enum><text display-inline="yes-display-inline">the continued presence of the idle structure would benefit the marine environment on, under, or in the immediate vicinity of the idle structure as a habitat for fish, mollusks, or corals or other marine life;</text></subparagraph><subparagraph id="H53E79D1129D244C489BBBD7728ED2AD3"><enum>(B)</enum><text display-inline="yes-display-inline">the removal of the idle structure would harm—</text><clause id="HC371EBD23CDC408DA4D4F77D960B4D0C"><enum>(i)</enum><text>the established reef ecosystem; or</text></clause><clause id="H82362D317F344F7091CA1C4284F0C195"><enum>(ii)</enum><text display-inline="yes-display-inline"> be otherwise detrimental to the biodiversity of the marine environment on, under, or in the immediate vicinity of the idle structure;</text></clause></subparagraph><subparagraph id="H24265F6C0A9D45A1A0A7834FA6A1F9BC"><enum>(C)</enum><text display-inline="yes-display-inline">each oil and gas well associated with the idle structure has been temporarily abandoned through zonal isolation, permanently plugged and abandoned, or otherwise secured and each involved pipeline has been flushed of all hydrocarbons and filled with seawater; and</text></subparagraph><subparagraph id="H441DDE068E9E40C5A29F713177026BFC"><enum>(D)</enum><text display-inline="yes-display-inline">the idle structure poses no risk to the marine environment on, under, or in the immediate vicinity of the idle structure.</text></subparagraph></paragraph><paragraph id="HEEF3ECEC3AD4463D97AFAFA3161CAA5F"><enum>(4)</enum><header>Exemption from removal</header><text display-inline="yes-display-inline">If the Secretary of the Interior, in consultation with the Administrator, makes an affirmative determination under paragraph (3), the Secretary of the Interior may not require a lessee, right-of-way holder, or owner of an idle structure to remove the idle structure associated with such determination if the lessee, right-of-way holder, or owner—</text><subparagraph id="HED5C4DE603BC443FA7649B73E62A06AA"><enum>(A)</enum><text display-inline="yes-display-inline">files a notice of intent with the Bureau of Safety and Environmental Enforcement and the United States Army Corps of Engineers in which the lessee, right-of-way holder, or owner commits to entering the idle structure in the Program;</text></subparagraph><subparagraph id="HFCEC2CB24D8D4E5C94A2673EC022A83D"><enum>(B)</enum><text display-inline="yes-display-inline">initiates discussions with a wildlife and fisheries agency or other regulatory authority of the State of which the extended seaward boundary through the exclusive economic zone includes the idle structure regarding potential sites for the artificial reef, pursuant to the notice of intent filed by the lessee, right-of-way holder, or owner under subparagraph (A);</text></subparagraph><subparagraph id="H1D53AB7CE31A474FBB5B4D6D07417C55"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 2 years after the date the lessee, right-of-way holder, or owner files a notice of intent under subparagraph (A)—</text><clause id="H7B553D4097364AE592D73E4271CC0409"><enum>(i)</enum><text>permanently plugs, abandons, secures, and seals each well associated with the idle structure; and</text></clause><clause id="HECDAA8C3ECE24E1194BA2D2BBEA6DAD6"><enum>(ii)</enum><text>flushes each involved pipeline of all hydrocarbons and fills each such pipeline with seawater; and</text></clause></subparagraph><subparagraph id="H3DB87A92322E4BF7A2B51361C6AA824B" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">agrees to accept all liability with respect to the idle structure until—</text><clause id="HEC623A25F3014D168644D85B8D3ADC23"><enum>(i)</enum><text>the idle structure is reefed in place under section 207(a) of the National Fishing Enhancement Act of 1984; and</text></clause><clause id="H6E583FE35D2948E78340B48C1578B3F4"><enum>(ii)</enum><text>the lessee, right-of-way holder, or owner has transferred liability for the idle structure to a Federal or State agency.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H08A251C0C9D74AD98ACCB54909CAFDB9"><enum>(c)</enum><header>Offshore oil and gas platforms and pipelines database</header><text>The Secretary of the Interior, acting through the Director of the Bureau of Safety and Environmental Enforcement, shall create and maintain an Offshore Infrastructure Dashboard for the Gulf of Mexico region that shall—</text><paragraph id="H3813AB1FD43347F7B9CC277EEE9576C3"><enum>(1)</enum><text>be updated not less frequently than every 6 months;</text></paragraph><paragraph id="HB93ED672D93044D8AD22674BE3F5142E"><enum>(2)</enum><text>be made available to the public; and</text></paragraph><paragraph id="HF7E6453FA8074F97B1B1C6669D92AA02"><enum>(3)</enum><text>contain information regarding the decommissioning of oil and gas platforms and pipelines and the potential of such oil and gas platforms and pipelines for reef in place (as defined in section 5(k)(1) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334(k)(1)</external-xref>), as added by this section) including—</text><subparagraph id="H67CF0CD768594DC0965742D062AD22C5"><enum>(A)</enum><text>the number of oil and gas platforms in the Gulf of Mexico region;</text></subparagraph><subparagraph id="H7A06A5162C6F4005B00C26CCD35859C9" commented="no"><enum>(B)</enum><text>the number and approximate location of each oil and gas platform that—</text><clause id="HFA313BCFF7B0492A809EF462C5914F61" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">is eligible for decommissioning pursuant to the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1301">43 U.S.C. 1301 et seq.</external-xref>); and</text></clause><clause id="H4429FEC7663344CA95DABBFF591CFBEC" commented="no"><enum>(ii)</enum><text>has an approved decommissioning plan and a planned disposition pursuant to such Act, including—</text><subclause id="H63DECAFC21A24FD891873261792BAAD9" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">if the oil and gas platform will be entered into the artificial reef program authorized under the National Fishing Enhancement Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/33/2101">33 U.S.C. 2101 et seq.</external-xref>) (referred to in this section as the <quote>Program</quote>); </text></subclause><subclause id="H762928AC51F04103A3FB30FB1D4691D8" commented="no"><enum>(II)</enum><text>if the oil and gas platform will not be entered into the Program, a reason for not doing so; and </text></subclause><subclause id="HD412E4A32FC54F17A58951040AE69FA8" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">each oil and gas platform granted an exemption from removal under section 5(k)(4) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334(k)(4)</external-xref>), as added by this section; and</text></subclause></clause></subparagraph><subparagraph id="HBCC8E2FD87EE426E82E099AF1F6EC541"><enum>(C)</enum><text display-inline="yes-display-inline">the length in miles and approximate location of each—</text><clause id="H6EE641ED52B44CC290B288A47A9FD24A"><enum>(i)</enum><text display-inline="yes-display-inline">section of oil and gas pipeline that is eligible for decommissioning pursuant to the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1301">43 U.S.C. 1301 et seq.</external-xref>); and</text></clause><clause id="HAAE5135CA5B44589A8D08FA6140A6FF7"><enum>(ii)</enum><text>oil and gas pipeline with an approved decommissioning plan pursuant to such Act.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
