<section section-type="section-one" id="H03FB61E33A5C428888EDB74E6A702F73"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intelligence Community Workforce Agility Protection Act of 2023</short-title></quote>.</text></section> <section section-type="subsequent-section" id="HAA423ECF38674086B77A7BBBB0C2CA9B"><enum>2.</enum><header>Expansion of treatment of moving expenses</header> <subsection id="HDF21D9EE5E7443A68ADFAB26FD8A8A70"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to facilitate the movement of members of the intelligence community to meet mission critical needs and to reduce unintended tax burdens imposed on public servants in relocating duty stations.</text></subsection>
<subsection id="H7B8D74CA90C24055B696B7C88859D4AD"><enum>(b)</enum><header>Deduction</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/217">Section 217(k)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>or an employee or new appointee of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) (other than a member of the Armed Forces of the United States) who moves pursuant to a change in assignment that requires relocation</quote> after <quote>to whom subsection (g) applies</quote>. </text></subsection> <subsection id="H9F18D200B0F940D39B5E7A4CAEE4FE76"><enum>(c)</enum><header>Exclusion for qualified moving expense reimbursements</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/132">Section 132(g)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>, or an employee or new appointee of the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)) (other than a member of the Armed Forces of the United States) who moves pursuant to a change in assignment that requires relocation</quote> after <quote>change of station</quote>.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H8372B22BE8774258AE70D4AE685BCA57"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2019.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="HB257141BE3274986A068DB6C5A73738E"><enum>3.</enum><header>Traveling expenses</header> <subsection commented="no" display-inline="no-display-inline" id="H0B4E31F1AB934E678AE4815C9CBC456B"><enum>(a)</enum><header>In general</header><text>The last sentence of subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/162">section 162</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>, or is certified by the Director of National Intelligence (or designee thereof) as traveling on behalf of the United States in temporary duty status in furtherance of an authorized intelligence activity</quote> after <quote>a Federal crime</quote>.</text></subsection>
<subsection id="H25487ABB34EA4FCC8C8C40841A0AD014"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2019.</text></subsection></section> </legis-body></bill>
