which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Infrastructure Investment and Jobs Act to ensure consideration of affordable housing in the reconnecting communities pilot program, and for other purposes.</official-title></form><legis-body id="H0B8B6679CD7C4469B3A7921AAE9A1932" style="OLC"><section id="H10B99A346A414165897F6B427DECAB08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Housing Affordable in Forgotten Communities Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H055B9CFE46AC408E8335AD4FDBEBA4FB"><enum>2.</enum><header>Reconnecting communities pilot program</header><text display-inline="no-display-inline">Section 11509 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H551E9D53BC7E46A49B427DE271EBA8CA"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFA50CB7FFE09463A807110105715580F"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="HA2A0F8C84E4D4B84AC9A2E67BB1F4707"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting appropriately; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD10DC19502C4A5E85086C49B0B8C3D7"><enum>(ii)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>the term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4C93E104EB1944589CD8739FE319ED87"><subparagraph id="H8103D93D49674187B682F9968AC6135E"><enum>(B)</enum><header>Inclusions</header><text>The term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBC6BC9AD8F5E4BA4A8B4CDBA4D5BDB12"><enum>(B)</enum><text>by striking the subsection designation and heading and all that follows through <quote>the term</quote> in paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H06883F70CC2749FF947EFF3893DEDC7C"><subsection commented="no" display-inline="no-display-inline" id="HE5197571560344A7B310F0593DF7C84A"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HBB7193C0384543E6B392B7A8EB3A1B73"><enum>(1)</enum><header>Community land trust</header><text>The term <term>community land trust</term> means a nonprofit entity or a State or local government or instrumentality of a State or local government that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF0B35C72B518482ABF2532198D592D42"><enum>(A)</enum><text display-inline="yes-display-inline">is not sponsored by a for-profit organization; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2281822EBDD2406B86C2AC7D250FC270"><enum>(B)</enum><text display-inline="yes-display-inline">has as a primary purpose the provision and maintenance of housing that provides long-term affordability for low- and moderate-income persons; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF0E9A3E75F0469598CB6142EC17AFA9"><enum>(C)</enum><text display-inline="yes-display-inline">provides housing described in subparagraph (B) using a ground lease, deed covenant, or other similar legally enforceable measure, as determined by the Secretary, that—</text><clause commented="no" display-inline="no-display-inline" id="H295157370F924E9588939C7B61453AC0"><enum>(i)</enum><text display-inline="yes-display-inline">keeps the housing affordable to low- and moderate-income persons for a period of not less than 30 years; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H4E52FC3288DA4CFE9D964A8F8026F41B"><enum>(ii)</enum><text display-inline="yes-display-inline">enables low- and moderate-income persons to purchase the housing for homeownership; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2F30BD5ED2A6427EB036616C702B1120"><enum>(D)</enum><text display-inline="yes-display-inline">maintains preemptive purchase options to purchase the property so the housing remains affordable to low- and moderate-income persons.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBC1C4725184B4CE4BD01772C92AE3A6D"><enum>(2)</enum><header>Eligible facility</header><subparagraph commented="no" display-inline="no-display-inline" id="H56CF63770F104F96A23611D54FDD8CAD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9D3D3CADD3B4B51B7E33954BEE55386"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC479B4F9022449FE9472BC517BBEB3AE"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>, or to create or preserve long-term affordable housing units around the existing eligible facility</quote> after <quote>facility</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H31549E9230ED4E7FA55A7238E104412F"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>and to enable the creation or preservation of long-term affordable housing units around the existing eligible facility</quote> after <quote>facility</quote>;</text></subparagraph></paragraph><paragraph id="H0B16C37A67A54F16AF6F7348A54B644A"><enum>(3)</enum><text>in subsection (c)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCB3D7E79AD504DECB7BCF42A606FFD2D"><enum>(A)</enum><text>in subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="H2E74294763204564ABB244A5ACEF7515"><enum>(i)</enum><text>in clause (vii), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="HDACACDA60DC744AEB879D504280296F7"><enum>(ii)</enum><text>in clause (viii), by adding <quote>and</quote> after the semicolon at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H6C7217C668D1418F943EA7F224EEC929"><enum>(iii)</enum><text>by adding after clause (viii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCDC8B22364C24B4D9606C8FED3F62E41"><clause commented="no" display-inline="no-display-inline" id="H203A8C85BBAA491A8B43705070E1D70D"><enum>(ix)</enum><text>the impact of the removal, retrofit, or mitigation of the eligible facility on the supply of affordable rental and owner-occupied housing in the surrounding area;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H80A8C260EE864F41B1AB7D101D622421"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H492CDDBC487947ACB55C76AC72E863E0"><enum>(C)</enum><text>redesignating subparagraph (C) as subparagraph (D); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H17CC48C667BE4CF39EDB850CE0D8CBB2"><enum>(D)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0185D37F34B542AC82F2F282DF6C30C1"><subparagraph commented="no" display-inline="no-display-inline" id="HC6283AC342744BA3917DC9C0CFF1E52D"><enum>(C)</enum><text>housing planning activities required in advance of a project to remove, retrofit, or mitigate an existing eligible facility in order to preserve affordable housing around the existing eligible facility, including—</text><clause commented="no" display-inline="no-display-inline" id="H1422FDC7F8CA475FA55DABAADDDE146C"><enum>(i)</enum><text display-inline="yes-display-inline">the incorporation of long-term affordability into such a project or the surrounding area through new or existing—</text><subclause commented="no" display-inline="no-display-inline" id="HB70B0C5DC912429F9183DDC217F8DCC8"><enum>(I)</enum><text display-inline="yes-display-inline">community land trusts;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H79A1F6C4E65244F78DF306E8E888F1C1"><enum>(II)</enum><text display-inline="yes-display-inline">other shared equity homeownership programs that—</text><item commented="no" display-inline="no-display-inline" id="H2639BD0252E8426D9B3BB10B86929245"><enum>(aa)</enum><text display-inline="yes-display-inline">have income requirements;</text></item><item commented="no" display-inline="no-display-inline" id="HCE373E9F20BF4C3A969B3F505E8311DF"><enum>(bb)</enum><text>require a resale formula that limits the price for which the property may be resold; and</text></item><item commented="no" display-inline="no-display-inline" id="HE6D2C178A8864B30A7661D27D5787ECD"><enum>(cc)</enum><text>are managed by a nonprofit affordable housing organization or developer;</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H54975B1F0BA34FA2A9ABCEAE1EF11FD1"><enum>(III)</enum><text display-inline="yes-display-inline">resident-owned communities, including manufactured housing communities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H23C64B9EAC154894972E4F076BE96515"><enum>(IV)</enum><text display-inline="yes-display-inline">housing cooperatives;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8B81FB15AD644AAF8C3DA8E16D76F04D"><enum>(V)</enum><text display-inline="yes-display-inline">Tribal entities; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF97A9A41A4B749D589395B0A96E68270"><enum>(VI)</enum><text display-inline="yes-display-inline">rental housing that will remain affordable for a period of not less than 30 years; </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H82FCABB2132544569071F8F72DF36F1E"><enum>(ii)</enum><text display-inline="yes-display-inline">planning related to the use or purchase of property around the existing eligible facility by a community land trust, nonprofit organization or developer, municipality, or land bank for the purpose of creating affordable housing; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HBC6BFB18382E485DAF920D1B3849934E"><enum>(iii)</enum><text display-inline="yes-display-inline">planning related to the implementation of a land value tax or a tax increment financing district for the purpose of funding affordable housing; and</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14AE26AEAC494D9F82E8EF4415A4D72B"><enum>(4)</enum><text>in subsection (d)(4)(B)(viii)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0070C33373424180B2B48ECE77940005"><enum>(A)</enum><text>in subclause (I), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H24714D79D73440EF8C4A5EC4BEE15D0A"><enum>(B)</enum><text>in subclause (II), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H75B0855CEE984B1DB03F21555C0EFF10"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5DF9C80F71C94A3BB25645C0D94D5B89"><subclause commented="no" display-inline="no-display-inline" id="HEF640D49CA124EED81363DF13C817E0A"><enum>(III)</enum><text>preserving existing affordable housing and preventing displacement of residents.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4CB2CAD170944178EFFDD4841800555"><enum>(5)</enum><text>in subsection (e), by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H613D08CCC7844EFDB97D769A3AAAC9AD"><paragraph id="H3898EFE3DD114307963BF610674DDDE9"><enum>(3)</enum><header>Joint report on affordable housing</header><text>Not later than January 1, 2027, the Secretary and the Secretary of Housing and Urban Development shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that evaluates the program under this section, including—</text><subparagraph id="HCAA02FD085A94D80B4F9F2070FCA2246"><enum>(A)</enum><text>for the recipients of capital construction grants, data on—</text><clause commented="no" display-inline="no-display-inline" id="H936F1445D5314251B8BA316A87FF621F"><enum>(i)</enum><text display-inline="yes-display-inline">rent and homeownership costs during and after the award of a grant under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H472262D3A98F4C5D81C15A4276E7422B"><enum>(ii)</enum><text>demographic changes in the surrounding area after the award of a grant under this section; and</text></clause></subparagraph><subparagraph id="H234EEF713AF547D9A87B44425F272138"><enum>(B)</enum><text>information about partnerships that recipients of grants under this section have entered into with affordable housing organizations, including community land trusts or other shared equity models, to preserve or develop affordable housing.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
