R. 6635</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231206">December 6, 2023</action-date><action-desc><sponsor name-id="M001211">Mrs. Miller of Illinois</sponsor> (for herself, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, and <cosponsor name-id="B000825">Ms. Boebert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Department of Health and Human Services from treating pregnancy as an illness for purposes of approving abortion drugs.</official-title></form><legis-body id="HF2A9AEB4D5064E4C87FA25C2E5FD9245" style="OLC"><section id="H8E4AAD08EC37432EBD7A038ED07A47D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnancy Is Not an Illness Act of 2023</short-title></quote>.</text></section><section id="H4BC552BAAB254039B8AAF4C742F75300"><enum>2.</enum><header>Prohibition against treating pregnancy as illness for purposes of approving abortion drugs</header><subsection id="HE1463A00E8574B58853C6001A3E1D05B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Department of Health and Human Services, including the Food and Drug Administration, shall not treat pregnancy as an illness for purposes of—</text><paragraph id="H0681C0F8976241EDA992195913CD2994"><enum>(1)</enum><text>approving any abortion drug under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>); or</text></paragraph><paragraph id="H6169BAFDAB724D978D3528548BEF152D"><enum>(2)</enum><text>imposing or maintaining any risk evaluation and mitigation strategy for an abortion drug under section 505–1 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>).</text></paragraph></subsection><subsection id="H69FB246F34E0455DA08EBC4F7FFB9B22"><enum>(b)</enum><header>Nullification of approvals in effect</header><paragraph id="H26B6CB5D721F46ED93DE22E64AA67E9D"><enum>(1)</enum><header>In general</header><text>Any prohibited approval of an abortion drug is hereby nullified.</text></paragraph><paragraph id="HEE133DA968AE484FB454A29FBE206611"><enum>(2)</enum><header>Prohibited approval defined</header><text>In this subsection, the term <term>prohibited approval of an abortion drug</term>—</text><subparagraph id="H0149F86FEADD4898A94A31E253804733"><enum>(A)</enum><text>means any approval of an abortion drug under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) that relied in whole or in part on the treatment of pregnancy as illness; and</text></subparagraph><subparagraph id="HB190F5DF3A05444B917BC5641DE48C24"><enum>(B)</enum><text>includes the approval of mifepristone in effect under such section 505 on the day before the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
