actions necessary and appropriate to promote the competitiveness of the United States related to the deployment, use, application, and competitiveness of blockchain technology or other distributed ledger technology, and for other purposes.</official-title></form><legis-body id="H7904214CED2E40ECB1E2ED8173BE0C6C" style="OLC"><section id="H1B310C6250C340CA908918C81A161716" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deploying American Blockchains Act of 2023</short-title></quote>.</text></section><section id="HFACAA66B4FBE4E51B0C67724E965E112"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H6CC829E4E4634E38B9B547637ABB2C98"><enum>(1)</enum><header>Blockchain technology or other distributed ledger technology</header><text>The term <quote>blockchain technology or other distributed ledger technology</quote> means a decentralized digital database where data is—</text><subparagraph id="H4ABE658DB32243A8BF503F4CA3A2C84B"><enum>(A)</enum><text>shared across a network of computers to create a ledger of verified information among network participants;</text></subparagraph><subparagraph id="HB91029BA46BA45A18236BA4418C700BF"><enum>(B)</enum><text>linked using cryptography to maintain the integrity of the ledger and to execute other functions; and</text></subparagraph><subparagraph id="HB44A6EC0818748BD8B4D12742E9AE19B"><enum>(C)</enum><text>distributed among network participants in an automated fashion to concurrently update network participants on the state of the ledger and other functions.</text></subparagraph></paragraph><paragraph id="H0B84F3B134214DD79B57EBA2FF102E4A"><enum>(2)</enum><header>Non-governmental organization</header><text>The term <quote>non-governmental organization</quote> means organizations described in section 2155(b) of title 19 of United States Code, excluding non-Federal governments.</text></paragraph><paragraph id="HF69DF9C8F10949B69D976C009387A419"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph><paragraph id="HEDD671D5FEF74BA99C0E82CDB7986D97"><enum>(4)</enum><header>State</header><text>The term <quote>State</quote> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H215E9D0BF96C4809A04FFA30090D19C8"><enum>(5)</enum><header>Token</header><text>The term <quote>token</quote> means a transferrable, digital representation of information recorded on blockchain technology or other distributed ledger technology.</text></paragraph><paragraph id="H8EB020B891CC4E96A1BD1B6956180D30"><enum>(6)</enum><header>Tokenization</header><text>The term <quote>tokenization</quote> means the process of creating a token.</text></paragraph></section><section id="H9EC5212F0FEB44EDACB6DA796BEB939D"><enum>3.</enum><header>Department of commerce leadership on blockchain</header><subsection id="HD089A624FA6845FCB6BC13A14EA76FF6"><enum>(a)</enum><header>Functions of secretary</header><text>The Secretary shall serve as the principal advisor to the President for policy pertaining to the deployment, use, application, and competitiveness of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization.</text></subsection><subsection id="H069978F45DCC48118EFAF2934C6FABED"><enum>(b)</enum><header>Activities</header><text>The Secretary shall take actions necessary and appropriate to promote the competitiveness of the United States related to the deployment, use, application, and competitiveness of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization including by—</text><paragraph id="H1E702ECF8C7F44F2AB8511B7AD2FCF11"><enum>(1)</enum><text display-inline="yes-display-inline">establishing best practices described in subsection (3) to assist the private sector, the public sector, and public-private partnerships in the deployment of technologies needed to advance the capabilities of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H65C55C6EE98E41AAB48B2AE7942520A7"><enum>(2)</enum><text display-inline="yes-display-inline">developing policies and recommendations on issues and risks pertaining to the deployment, use, application, and competitiveness of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization, including the issues of decentralized identity, cybersecurity, key storage and security systems, artificial intelligence, fraud reduction, regulatory compliance, e-commerce, health care applications, and supply chain resiliency;</text></paragraph><paragraph id="H95BE4F39690143FCB6A81CA0451EBB0F"><enum>(3)</enum><text display-inline="yes-display-inline">supporting and promoting the stability, maintenance, improvement, and security of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H2053DA437BCC44ED9661F7D209CEEF8C"><enum>(4)</enum><text display-inline="yes-display-inline">helping to promote the leadership of the United States with respect to the use of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H73CDA62383F646C38E01A29FD862F9F2"><enum>(5)</enum><text display-inline="yes-display-inline">promoting the national security and economic security of the United States with respect to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H15248148398541C781F22F0297B96265"><enum>(6)</enum><text display-inline="yes-display-inline">supporting engagement with the public to promote best practices described in subsection (3);</text></paragraph><paragraph id="H2A19D7E4E73F4C7AAC3FAEA0E2DCF64B"><enum>(7)</enum><text display-inline="yes-display-inline">considering policies or programs to encourage and improve coordination among Federal agencies with respect to the deployment of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="HE935A877A3AC41AFA32A285CB42FACC9"><enum>(8)</enum><text display-inline="yes-display-inline">examining—</text><subparagraph id="H25280D378D1D4341BA406D9D6EB644DF"><enum>(A)</enum><text display-inline="yes-display-inline">how Federal agencies can benefit from utilizing blockchain technology or other distributed ledger technology applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></subparagraph><subparagraph id="HFDD73A4770F744E1AE63C996A2E1CC50"><enum>(B)</enum><text display-inline="yes-display-inline">the current use by Federal agencies of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></subparagraph><subparagraph id="H511B20FCC06145EE8D577125C239E5A7"><enum>(C)</enum><text display-inline="yes-display-inline">the current and future preparedness and ability of Federal agencies to adopt blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization; and</text></subparagraph><subparagraph id="H08D381AA82A84C0DBE84E1D8D5D2B884"><enum>(D)</enum><text display-inline="yes-display-inline">additional security measures Federal agencies may need to take to—</text><clause id="H7F5AC0CB1E3A409DB3E4E895DEE20A89"><enum>(i)</enum><text display-inline="yes-display-inline">safely and securely use blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization, including to ensure the security of critical infrastructure; and</text></clause><clause id="HEB8C1DA24C4F4790A89A728266FE4AAC"><enum>(ii)</enum><text display-inline="yes-display-inline">enhance the resiliency of Federal systems against cyber threats to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></clause></subparagraph></paragraph><paragraph id="H78217387CE214045AF3FC1702832F505"><enum>(9)</enum><text display-inline="yes-display-inline">support the coordination of current and future activities of the Federal government related to the security of blockchain technology and other distributed technologies, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="HFCBCC91F690F497EBE92EB2F2A702CC9"><enum>(10)</enum><text display-inline="yes-display-inline">establishing a Blockchain Deployment Program to support American leadership in the deployment and use of blockchain technology and other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization; and</text></paragraph><paragraph id="HAB092F9FA49740CEB7C7B846BF83CEE8"><enum>(11)</enum><text display-inline="yes-display-inline">establishing advisory committees, not later than 180 days after the date of the enactment of this Act, to support the adoption of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization, membership of which shall include—</text><subparagraph id="H070B948112AF441BB6A2249AEF5C9808"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary;</text></subparagraph><subparagraph id="H6711F86062FD447683600496611C4BDB"><enum>(B)</enum><text display-inline="yes-display-inline">representatives of Federal agencies (as determined necessary by the Secretary); and</text></subparagraph><subparagraph id="H0FFDE627329D4C23B0DFDBD3E3F661BA"><enum>(C)</enum><text display-inline="yes-display-inline">nongovernmental stakeholders with expertise related to blockchain technology or other distributed ledger technology, including representatives of—</text><clause id="H9F3BBDD27FC74E1D8A027B5AD7AED1D3"><enum>(i)</enum><text display-inline="yes-display-inline">blockchain technology or other distributed ledger technology infrastructure operators, suppliers, service providers, and vendors;</text></clause><clause id="HFD445CAF96E9473188F37E2C562EEEF3"><enum>(ii)</enum><text display-inline="yes-display-inline">application developers building on blockchain technology or other distributed ledger technology;</text></clause><clause id="HD4CFA72C277F4F41BB29096A9AE3F859"><enum>(iii)</enum><text display-inline="yes-display-inline">developers and organizations supporting the advancement and deployment of public blockchain technology or other distributed ledger technology;</text></clause><clause id="HE963BE71A456448BAEB581D168B45174"><enum>(iv)</enum><text display-inline="yes-display-inline">subject matter experts representing industrial sectors that can benefit from blockchain technology or other distributed ledger technology;</text></clause><clause id="H043A5C1AD5784F7DB3459927B23B74EA"><enum>(v)</enum><text display-inline="yes-display-inline">small, medium, and large businesses;</text></clause><clause id="HB2CE4501EAB84405AB46CCFE417E0D33"><enum>(vi)</enum><text display-inline="yes-display-inline">think tanks and academia;</text></clause><clause id="H1AB8C2BCDB4644BFA6C4AB7720726BB3"><enum>(vii)</enum><text display-inline="yes-display-inline">nonprofit organizations and consumer groups;</text></clause><clause id="HCEB2A417759A4B5EAD69C78859CFFE6A"><enum>(viii)</enum><text display-inline="yes-display-inline">cybersecurity experts;</text></clause><clause id="H016C7645F3B84C25A640243D260909EB"><enum>(ix)</enum><text display-inline="yes-display-inline">rural stakeholders;</text></clause><clause id="HB1D54BDEE2AE492DB3FC9F2D12288294"><enum>(x)</enum><text display-inline="yes-display-inline">Non-governmental organizations;</text></clause><clause id="HFC50D59EBC7F4264862F987133D87121"><enum>(xi)</enum><text display-inline="yes-display-inline">artists and the content creator community; and</text></clause><clause id="H2DC85AF8CA84486986AA448CC498305A"><enum>(xii)</enum><text display-inline="yes-display-inline">other stakeholders with relevant expertise (as determined necessary by the Secretary).</text></clause></subparagraph></paragraph></subsection><subsection id="H8611A20BB91E4D5B9A335A896AF0718D"><enum>(c)</enum><header>Best practices</header><text display-inline="yes-display-inline">The Secretary, shall, on an ongoing basis, facilitate and support the development and dissemination of best practices with respect to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization that—</text><paragraph id="H8CE6CF39C48647B3B5B2373AFDF60FFE"><enum>(1)</enum><text display-inline="yes-display-inline">support interoperability of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="HAA384C0D074C4157AB8CE74D768546CE"><enum>(2)</enum><text display-inline="yes-display-inline">support operations, including hashing and key storage and security systems, that form the foundation of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H27CAB8E98E7B4D0F97EEE815BDAC62DA"><enum>(3)</enum><text display-inline="yes-display-inline">reduce cybersecurity and other risks that may compromise blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H210BD0050B234D2FA3FB1AC7CF2A5A43"><enum>(4)</enum><text display-inline="yes-display-inline">reduce uncertainty risks in the use of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization; and</text></paragraph><paragraph id="HBACDE2E3234246C194B8C279F3A9193C"><enum>(5)</enum><text display-inline="yes-display-inline">quantify the value and potential cost savings associated with adoption of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization, including through comparative analyses of competing and existing technologies within specific industry applications.</text></paragraph></subsection><subsection id="HBE5531E4ED4849B38BCEFB916C684F87"><enum>(d)</enum><header>Additional requirements</header><text display-inline="yes-display-inline">In carrying out subsection (3), the Secretary shall—</text><paragraph id="H42B4ACD702624544990EA6B4105ED5EE"><enum>(1)</enum><text display-inline="yes-display-inline">consult closely and regularly with stakeholders, including private sector individuals and entities, and incorporate industry expertise;</text></paragraph><paragraph id="H44434C79F2BB4C8E9CD1C318EED99D05"><enum>(2)</enum><text display-inline="yes-display-inline">collaborate with private sector stakeholders to identify prioritized, flexible, repeatable, performance-based, and cost-effective approaches to the deployment of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="HF104D0145E524D14BFAF192200091D89"><enum>(3)</enum><text display-inline="yes-display-inline">disseminate research and information pertaining to the use of, and marketplace for, blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="HC09935949E0C4266A128BCAB092F6995"><enum>(4)</enum><text display-inline="yes-display-inline">develop standardized terminology, and promote common understanding of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H83A4AF0739CD4B57880DDAAF7D5C5EAD"><enum>(5)</enum><text display-inline="yes-display-inline">ensure the best practices described in paragraph (3) facilitate the ease of use of blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization;</text></paragraph><paragraph id="H55DE019CB33F413993CBF1FCBF3F8232"><enum>(6)</enum><text display-inline="yes-display-inline">support open-source infrastructure, data management, and authentication activities with respect to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization; and</text></paragraph><paragraph id="HBA3378AB2D71450C8A9121BDDBC0D3A5"><enum>(7)</enum><text display-inline="yes-display-inline">consider the needs and interests of both the private and public sector, including small businesses and Federal, State, and local governments.</text></paragraph></subsection><subsection id="HA68AD5C2958B4A6D8501D7EB27F100B7"><enum>(e)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to—</text><paragraph id="H40395393D266485096ECD316BD68E788"><enum>(1)</enum><text display-inline="yes-display-inline">require a private entity to share information with the Secretary;</text></paragraph><paragraph id="H06EA00341A9D4721B0AC15A5B5F4F684"><enum>(2)</enum><text display-inline="yes-display-inline">require a private entity to request assistance from the Secretary;</text></paragraph><paragraph id="H56F69C6426BD4CC8A3A87FB815F479BB"><enum>(3)</enum><text display-inline="yes-display-inline">require a private entity to implement any measure or recommendation suggested by the Secretary in response to a request by the private entity; or</text></paragraph><paragraph id="H775E0E1D59184A51A672DACDD6BB9A49"><enum>(4)</enum><text display-inline="yes-display-inline">require the adoption of the best practices described in paragraph (3).</text></paragraph></subsection><subsection id="HF432DDDED6D44DC68B639F3F8322862C"><enum>(f)</enum><header>Consultation</header><text display-inline="yes-display-inline">In implementing this section, the Secretary may, as appropriate, consult with the heads of relevant Federal agencies.</text></subsection><subsection id="H27EA7A7AEB1D4AA19DF9599629E03003"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">The Blockchain Deployment Program established subsection (J) by shall terminate on the date that is 7 years after the date of the enactment of this Act.</text></subsection></section><section id="HC5BE2B4A7D0D4E3AAB10646BAC2B9745"><enum>4.</enum><header>Report to congress</header><text display-inline="no-display-inline">Not later than 2 years after the date of the enactment of this Act, and annually thereafter, the Secretary shall make public on the website of the Department of Commerce and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that includes—</text><paragraph id="H7BCEA9F697D241B7A1F065F610597419"><enum>(1)</enum><text>a description of the activities of the Secretary under this Act during the preceding year;</text></paragraph><paragraph id="HA3D1E740D5A7416C9E01863DDDEDF7D5"><enum>(2)</enum><text>any recommendations by the Secretary for additional legislation to strengthen the competitiveness of the United States with respect to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization; and</text></paragraph><paragraph id="H30312306BBEF4E709612B521C86E4F05"><enum>(3)</enum><text>a description of any emerging risks and long-term trends with respect to blockchain technology or other distributed ledger technology, applications built on blockchain technology or other distributed ledger technology, tokens, and tokenization.</text></paragraph></section></legis-body></bill>
