<section id="H215AD5A7D3A445EF9C8A8E7D3F796702" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Southern Border Transparency Act of 2023</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HC847A958F7F24CD2892F21F0458F6761"><enum>2.</enum><header>Monthly publication of parole at ports of entry</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, and monthly thereafter, the Commissioner of U.S. Customs and Border Protection shall publish on the U.S. Customs and Border Protection website, with respect to the applicable reporting period— </text> 
<paragraph id="HECACF3CD6CF14B748CB4B1E2CB1008E6"><enum>(1)</enum><text>the number of aliens granted parole under section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) at each United States port of entry; </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H311274E0770B45DE84667654556632A7"><enum>(2)</enum><text>the number of aliens encountered between land ports of entry who were subsequently granted parole, disaggregated by the U.S. Border Patrol sector; </text></paragraph> 
<paragraph id="HD21624BA303241549E34077100C9CDBF"><enum>(3)</enum><text>the citizenship or nationality of the aliens described in paragraphs (1) and (2); and </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H10ECC9D94E5542B998B0CFCB2FA9E13B"><enum>(4)</enum><text>the demographic category of the aliens described in paragraphs (1) and (2), including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3AF05761B0EE4ABCA8C221BBD5EADA20"><enum>(A)</enum><text display-inline="yes-display-inline">accompanied minors;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2F0312DA93B34CC38D2C3704659AF5CA"><enum>(B)</enum><text display-inline="yes-display-inline">aliens granted parole as part of a family unit;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE5529BA556BA4E1A915DCCF0532BD180"><enum>(C)</enum><text display-inline="yes-display-inline">single adults; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFFB048800F0E4650A39A930B49D75791"><enum>(D)</enum><text display-inline="yes-display-inline">unaccompanied alien children. </text></subparagraph></paragraph></section> 
<section id="H65E187366EE040E9A4F13D78C947F73C"><enum>3.</enum><header>Quarterly report on processing aliens at southern border ports of entry</header> 
<subsection id="H8E7772C9088A4FDAADA799F54F6B7255"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, and quarterly thereafter, the Secretary of Homeland Security shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H0F8CF7B060A44C70BBBADE3ABE67E931"><enum>(1)</enum><text display-inline="yes-display-inline">submit a report containing the information described in subsection (b) to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3360375DBEAE4B359538694DDA050C12"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H77525B5ADA8648BBB51B0BC0195361DE"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HBC572F611FDE48F2AD8E4A6B47AFCB08"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H68F4DA69C61B4689AC393FCD91D1906A"><enum>(D)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and </text></subparagraph></paragraph> 
<paragraph id="H488E0C4495FE4092A95105FA060440C5"><enum>(2)</enum><text>post such report on the Department of Homeland Security website. </text></paragraph></subsection> <subsection id="H38ED3754C68D455EBE7767FFA9B0E50F"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall include, with respect to the applicable reporting period—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4DCC3CDCC87E4FC1BB9CC90001F42F9D"><enum>(1)</enum><text>the number of aliens apprehended or otherwise encountered—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC922A7CECF40467A802CB2546C307A1B"><enum>(A)</enum><text display-inline="yes-display-inline"> at each port of entry along the southern border of the United States; and </text></subparagraph> 
<subparagraph id="H0529A6DDA1D5430288A6EB6D34E7068E"><enum>(B)</enum><text>within each U.S. Border Patrol sector along the southern border of the United States;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF528EF75C08547918D72D7C670A18413"><enum>(2)</enum><text display-inline="yes-display-inline">the number of aliens described in paragraph (1), disaggregated by—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD8DAE4849E174365AB32C404FBB0B4D1"><enum>(A)</enum><text> citizenship or nationality; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5CC111B5BD5B4A0A82CAAEF3C03F9324"><enum>(B)</enum><text> demographic categories, including accompanied minors, aliens granted parole as part of a family unit, single adults, and unaccompanied alien children; </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H47DC0CD4F3A64E82893C9C16DD38BFF1"><enum>(C)</enum><text display-inline="yes-display-inline">those who were granted voluntary departure; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC227B5315AAD4AE3B0278AF544B72E7E"><enum>(D)</enum><text display-inline="yes-display-inline">those who were placed into expedited removal proceedings; and </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H31D212B2D90F4B15B2900F8753EE26E5"><enum>(E)</enum><text display-inline="yes-display-inline">those who entered into a process or outcome not described in subparagraph (C) or (D), including a description of such process or outcome; </text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H64D983C49E2647098EC9F8ABEF51DF44"><enum>(3)</enum><text>the number of aliens described in paragraph (2)(D), disaggregated by the number of such aliens who received a credible fear screening interview pursuant to section 235(b)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)</external-xref>) or a reasonable fear screening interview; </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDFC38AE5F5844E39BEFF110C0186C451"><enum>(4)</enum><text>the number of aliens described in paragraph (3), disaggregated by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H2F74BAA3310F4920A56549E6D5FC07D9"><enum>(A)</enum><text display-inline="yes-display-inline">the number of aliens determined to have a credible fear of persecution or a reasonable fear of persecution; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0D47F59AF8A94651B84DF3FCFA87E27B"><enum>(B)</enum><text>the number of aliens determined not to have a credible fear of persecution or a reasonable fear of persecution; </text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAE7D17085ABF4B01B511161A72E2F817"><enum>(5)</enum><text>the number of aliens described in paragraph (4)(A), disaggregated by the number of aliens detained pursuant to section 235(b)(1)(B)(iii)(IV) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)(iii)(IV)</external-xref>); </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAA052B3BC4F841EB95512C5377A34022"><enum>(6)</enum><text>the number of aliens described in paragraph (4)(B), disaggregated by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H2CA770B5D4574C14BAC4BFD8245EB5E1"><enum>(A)</enum><text display-inline="yes-display-inline">those who were removed from the United States; </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HCA66F85284514DBD81AFD7308B706052"><enum>(B)</enum><text>those who were detained pending removal; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6D03862B40704240886D92422483D4A8"><enum>(C)</enum><text>those who are not described in subparagraph (A) or (B); and</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H838D2DA4D64549E5AF35DDD7E043C886"><enum>(7)</enum><text>a description of any actions taken against the aliens described in paragraph (6)(C).</text></paragraph></subsection></section> <section id="HE69CFB2B39BA497CAA8D3A27CA21C53F"><enum>4.</enum><header>Quarterly report on parole requests processed by U.S. Citizenship and Immigration Services</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, and quarterly thereafter, the Director of U.S. Citizenship and Immigration Services shall publish, on the U.S. Citizenship and Immigrations Services website—</text> 
<paragraph id="H43172193018246A398A3F6978D451296" commented="no"><enum>(1)</enum><text>the number of petitions for parole submitted to U.S. Citizenship and Immigration Services pursuant to section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>); and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2C1173C13F85449A86A45B204773D84F"><enum> (2)</enum><text display-inline="yes-display-inline">the number of such petitions that were granted by U.S. Citizenship and Immigration Services, disaggregated by the nationality of the petitioner.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HEDE08AD67C7148A39422035EB3580498"><enum>5.</enum><header display-inline="yes-display-inline">Annual report on aliens paroled into the United States</header><text display-inline="no-display-inline">Section 602(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref> note) is amended to read as follows: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3C7B7BBB6C554F98A05D77D9B317D8D6"> <subsection id="H96EC79F8BDDC4E61857FC1248690CB2C"><enum>(b)</enum><header>Annual report to Congress</header> <paragraph commented="no" display-inline="no-display-inline" id="HE0177863B0B9475296BD7A275FDA9B48"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 90 days after the end of each fiscal year, the Secretary of Homeland Security shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that identifies the number of aliens paroled into the United States pursuant to section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>), disaggregated by those who are— </text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7BEFBFF3C27540499D2D3BD1DB61A6B1"><enum>(A)</enum><text display-inline="yes-display-inline">of a particular nationality; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1F915921409B41188034D8A8E894708A"><enum>(B)</enum><text>single adults; </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1AD6196ECD4E48C3917F2DD286CC60F8"><enum>(C)</enum><text>traveling in a family group; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H75ADF69BF7BF48599147C1EF97D28E2D"><enum>(D)</enum><text>children accompanied by an adult family member; or </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD7B1588012DD4FC0976A9FABAF07EE75"><enum>(E)</enum><text>unaccompanied alien minors.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA355A9B3D24E4D9194C66639A5E08766"><enum>(2)</enum><header>Contents</header><text>Each report required under paragraph (1) shall include—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA273CCC3D2D84BBB9BC66BF7B2994A59"><enum>(A)</enum><text>the total number of aliens paroled into the United States during the fiscal year immediately preceding the fiscal year in which such report is submitted, disaggregated by—</text> <clause commented="no" display-inline="no-display-inline" id="H61FE2002DBED42EFB5E27633D53ECD96"><enum>(i)</enum><text display-inline="yes-display-inline"> citizenship or nationality; and </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H7E1C50B6E3D64055838E18B877037E7A"><enum>(ii)</enum><text>demographic categories, including accompanied minors, aliens granted parole as part of a family unit, single adults, and unaccompanied alien children; </text></clause></subparagraph> <subparagraph id="HCE93C54CABDA436098B55B77D647D03C"><enum>(B)</enum><text>for each fiscal year for which the Department of Homeland Security reports the information described in subparagraph (A) regarding aliens described in such subparagraph—</text> 
<clause commented="no" display-inline="no-display-inline" id="H1F70E8B7EE7D49E992BA31C9EBEE5EFC"><enum>(i)</enum><text display-inline="yes-display-inline"> the number of such aliens who were granted employment authorization; </text></clause> <clause commented="no" display-inline="no-display-inline" id="HAB42408AE15F42A5AF2D58DF69D1D413"><enum>(ii)</enum><text>the number of aliens described in clause (i) who had valid employment authorization at the end of the previous fiscal year; </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5B669D4A23D44B8D9EDB0BDC658FDFF7"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of such aliens whose parole has not ended, including those who exited the United States during the previous fiscal year; </text></clause> <clause commented="no" display-inline="no-display-inline" id="H567E6D74BB6F4D1C98F2D2E838EAD42A"><enum>(iv)</enum><text>the number of such aliens whose status was adjusted, disaggregated by status type; </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H24717827F82A42359035469C593DF212"><enum>(v)</enum><text>the number of such aliens for whom parole was extended, including those who exited the United States; </text></clause> <clause commented="no" display-inline="no-display-inline" id="HD0DF7C72811544499641C3F066DC5205"><enum>(vi)</enum><text>the number of such aliens for whom the duration of parole expired, including those who exited the United States; and </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H39AC8C61B2E2476BBE88273D54C62874"><enum>(vii)</enum><text>the number of aliens who returned to Department of Homeland Security custody from which they were paroled, disaggregated by the categories listed in subparagraphs (A) through (E) of paragraph (1).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
