Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to require greater transparency and accountability within the grant-making process of the National Institutes of Health.</official-title></form><legis-body id="HCACF7C21EC844A6DA19BE0D05FAE9EE3" style="OLC"><section id="H8EF7A4E6C5C44695B16BC087FB77C937" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Grant Reform And NIH Transparency Act of 2023</short-title></quote> or the <quote><short-title>GRANT Act of 2023</short-title></quote>.</text></section><section id="HBD2239E94F7E425F995EB8CFAF7C28CA"><enum>2.</enum><header>NIH database of denials</header><text display-inline="no-display-inline">Section 402 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H632AB0793C8E4594A01118618EF37D75" display-inline="no-display-inline"><subsection id="H851DCAE655844A6AAFADDA595A8BAEFE"><enum>(p)</enum><header>Database of denials</header><paragraph id="H35752E49FEDD499995462CEB1D4A3643"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of NIH, shall establish and maintain a database of each research proposal that is denied a grant or other award by the National Institutes of Health.</text></paragraph><paragraph id="H0753C566B08D4F65AD93F3D9BC865A9B"><enum>(2)</enum><header>Updates</header><text>The Secretary shall update the contents of the database under paragraph (1) not less than quarterly.</text></paragraph><paragraph id="HEAD38E00F01241A49043FB8A738DB682"><enum>(3)</enum><header>Contents</header><text>The database under paragraph (1) shall include, with respect to each denial described in such paragraph, an explanation of the basis for such denial.</text></paragraph><paragraph id="H2D3A296E582749A388BBB33C2928A4DC" commented="no"><enum>(4)</enum><header>Timing</header><subparagraph id="H1687A641B8644172A69F628077875F5D"><enum>(A)</enum><header>Establishment of database</header><text>The Secretary shall establish the database under paragraph (1) not later than 180 days after the date of enactment of this subsection.</text></subparagraph><subparagraph id="H90BFD8D2A7234C8BA51D667D893BE744" commented="no"><enum>(B)</enum><header>Covered denials</header><text>The database under paragraph (1) shall include all denials described in such paragraph occurring on or after the date of enactment of this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA967C1779F9741AD846598FBBA0C7D79"><enum>3.</enum><header>Access by independent, outside researchers to information on NIH’s internal operations for making awards</header><text display-inline="no-display-inline">Section 402 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282</external-xref>), as amended, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HD077188580B54449BFE7D5F824E33F20" display-inline="no-display-inline"><subsection id="H1EB503AC3D82436F833893A24710EAAA"><enum>(q)</enum><header>Access to NIH data by independent, outside researcher</header><paragraph id="H070F97153A9F452E8B50DE96FE312452"><enum>(1)</enum><header>Sharing</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of NIH, shall share with researchers, on request, information concerning the internal operations of the National Institutes of Health in making awards.</text></paragraph><paragraph id="H4C7BF61476AD4BA0AD1FA501ED4B4D26"><enum>(2)</enum><header>Relation to other law</header><text>The obligation imposed by paragraph (1) to share information applies notwithstanding any other law, including sections 552(b), 552a, and 552b of title 5, United States Code.</text></paragraph><paragraph id="HF7F5356EDC4847808B40BC58B9F88319"><enum>(3)</enum><header>Information to be shared</header><text>Except as provided in paragraph (4), the information required to be shared by paragraph (1) includes the following: </text><subparagraph id="H715BA28F5CA348A9ABE2CEF2212D0F05"><enum>(A)</enum><text display-inline="yes-display-inline">Individual scores and written comments on funded and unfunded proposals made by study section members and program staff of the National Institutes of Health (including the Center for Scientific Review and any national research institute, national center, advisory council or board, or other office or agency of the National Institutes of Health) in carrying out applicable provisions of law, including sections 405(b)(2)(B)(ii), 405(b)(3)(B)(iii), 492, and 492A.</text></subparagraph><subparagraph id="H167DE6E1BD8045589507CFFC2F279E9E"><enum>(B)</enum><text>The full text of funded proposals, unfunded proposals, progress reports, and final reports for research awards, including such awards consisting of a grant, a cooperative agreement, a contract, training, technical assistance, or other transaction authority.</text></subparagraph><subparagraph id="HCF9F93A914A54C809C1BA60D2C66A104"><enum>(C)</enum><text>The information in the database under subsection (p).</text></subparagraph><subparagraph id="HC4BC227A21AA4650BF3C2EC9EE21FEB6"><enum>(D)</enum><text>Information on the performance of employees and agents of the National Institutes of Health in conducting research.</text></subparagraph><subparagraph id="HC4A1DD5B1BC8456788A72B4F2EEEAFB7"><enum>(E)</enum><text>The degree to which the National Institutes of Health funds awards below the payline and the rationale for doing so.</text></subparagraph><subparagraph id="HF1A95A6211D94708B943041AD33C6811"><enum>(F)</enum><text>Any other information regarding making awards that is maintained by the Office of Portfolio Analysis, the Center for Scientific Review, or the Office of Evaluation, Performance, and Reporting.</text></subparagraph><subparagraph id="H9759D12901A349ACB82DDD37958F016D"><enum>(G)</enum><text>Any other information in the possession of the National Institutes of Health that is requested in accordance with paragraph (1), including any such—</text><clause id="H01E6B290297E4CB29F4D82904D487C0D"><enum>(i)</enum><text>evaluation of performance; or</text></clause><clause id="H6474438DF7394A03A9D3BB40A8CB4A1D"><enum>(ii)</enum><text>funding or peer-review model.</text></clause></subparagraph></paragraph><paragraph id="HDACC8A1AEA494CF9940E970860A13E80"><enum>(4)</enum><header>Redaction</header><text>Before sharing information pursuant to paragraph (1) regarding an award, the Secretary shall redact the names of—</text><subparagraph id="HACA063B7D5964A6E86059696334FAB52"><enum>(A)</enum><text>the individuals serving as peer reviewers for purposes of the research involved; and</text></subparagraph><subparagraph id="H9A7E586EEE204BAE9F307AE1AAE22E09"><enum>(B)</enum><text>in the case of a grant or other award that was denied (as described in subsection (p)(1)) the individuals or other persons applying for the award.</text></subparagraph></paragraph><paragraph id="H664024DA2C3B40959E65561F65B535DC"><enum>(5)</enum><header>Covered information</header><subparagraph id="HBE8C1E8ADF1A485091CE579528FD2E0E"><enum>(A)</enum><header>Maintenance of information</header><text>The Secretary shall maintain into perpetuity information that is—</text><clause id="H9D89F2EE770D4FC0912298E4C522F454"><enum>(i)</enum><text>described in paragraph (1); and</text></clause><clause id="HCA4106C60E134BB0855A6AAFB558E64E"><enum>(ii)</enum><text>in the possession of the National Institutes of Health on or after the date of enactment of this subsection.</text></clause></subparagraph><subparagraph id="H0BAFDE20033A462AAD18EB223DBD267B"><enum>(B)</enum><header>Earlier information</header><text>The Secretary shall make a reasonable effort to reconstruct information that—</text><clause id="HA2484C5629144FB88993A2E382D07D82"><enum>(i)</enum><text>is requested pursuant to paragraph (1); and</text></clause><clause id="H9528A50DD214490B93AD61D71C12A8A3"><enum>(ii)</enum><text>was in the possession of the National Institutes of Health before the date of enactment of this subsection but has not been maintained in whole or in part.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
