which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XI of the Social Security Act to limit demonstration projects related to abortion under Medicaid and CHIP.</official-title></form><legis-body id="H42968E0E6B1947749FF99C8924F65EF0" style="OLC"><section id="HCB5B7B393DFF4D9C9DAB12E1D6C9F901" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Abortion Coverage for Medicaid Act</short-title></quote>.</text></section><section id="HCCCD4FA2009D4B7CBB2D52318073BF87"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H59DE00F6D8B44FFFA48CCF91113C6BF5"><enum>(1)</enum><text display-inline="yes-display-inline">The Hyde Amendment was first enacted in 1976 and has prevented taxpayer funds for abortions. </text></paragraph><paragraph id="H8953A3444DA9453FAD499833D47494FA"><enum>(2)</enum><text>The most recently enacted Hyde Amendment states that no appropriated dollars shall be expended for any abortion or health benefits coverage that includes coverage of abortion. </text></paragraph><paragraph id="HE5FBBF536DF94B58AC10852549E7C3FB"><enum>(3)</enum><text>The Department of Health and Human Services sent a letter to the States on August 6, 2022, inviting States to use Medicaid funding under the demonstration authority under section 1115 of the Social Security Act to expand access to elective abortions.</text></paragraph><paragraph id="HE6FAF45BD85449D5BA381C4404DBFE06"><enum>(4)</enum><text>The Hyde Amendment applies to all Medicaid funds and cannot be superseded by a waiver under section 1115 of the Social Security Act.</text></paragraph><paragraph id="H0F6CFBA6A62A4639B6578BA3A258366A"><enum>(5)</enum><text>Legislation to permanently prohibit Medicaid dollars from going to elective abortions, including payment for abortions and services that necessitate receipt for services of abortion, is consistent with the Hyde Amendment.</text></paragraph></section><section id="H5BA99890ED394765A6BA49276FBD207A"><enum>3.</enum><header>Limiting demonstration projects related to abortion under Medicaid and CHIP</header><text display-inline="no-display-inline">Section 1115 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HDD5CB93D83464663B453F44C45029671" display-inline="no-display-inline"><subsection id="H2D21D7DFAF724C239C438B3E8C3064A4"><enum>(g)</enum><header>Limitation on demonstration projects related to abortion</header><paragraph id="H0DCCEB911EFE4479A161B4E1EAE30B6C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), beginning on enactment, the Secretary may not approve an application (or extension) for any experimental, pilot, or demonstration project undertaken under subsection (a) to promote the objectives of title XIX or title XXI that provides Federal financial assistance for abortion, or health benefits coverage that includes abortion, including expenses for travel or lodging for the purpose of obtaining an abortion. </text></paragraph><paragraph id="H02C5491DAA8F4F05A5AC342628ED169A"><enum>(2)</enum><header>Exceptions</header><text>The limitations on paragraph (1) shall not apply to—</text><subparagraph id="HB0BEAEF16DE6417FAAD987D7BE6DBDF5"><enum>(A)</enum><text display-inline="yes-display-inline">an abortion with respect to a pregnancy resulting from of an act of rape or incest;</text></subparagraph><subparagraph id="H041C8F17AD114C0BA0AA5FA6EB64BD1B"><enum>(B)</enum><text>treatment to address a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the individual in danger of death unless such abortion is performed; or</text></subparagraph><subparagraph id="H119B384CC31649748415D8EE102E5859"><enum>(C)</enum><text>treatment for miscarriage or ectopic pregnancy.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
