R. 6403</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231114">November 14, 2023</action-date><action-desc><sponsor name-id="G000578">Mr. Gaetz</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the General Education Provisions Act to require the disclosure of student medical and counseling records to parents.</official-title></form><legis-body id="H953A5A78F5E7459D857FD182F253223C" style="OLC"><section id="HEB001B6B1EE94A59872E31131E0285E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parents’ Right to Know Act</short-title></quote>.</text></section><section id="H15DD4C06CF8C41A4B1277B4CAD23B2CD"><enum>2.</enum><header>Disclosure requirement</header><text display-inline="no-display-inline">Section 445 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232h">20 U.S.C. 1232h</external-xref>) is amended—</text><paragraph id="H3C5929F92D124249A7B56F70153E10C4"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HDAF1CD931E1545DFBBD2D396FEB02581"><enum>(A)</enum><text>by striking <quote>All instructional materials</quote> and inserting <quote>(1) All instructional materials</quote>; and</text></subparagraph><subparagraph id="H78ABFB8FFC554B479B47E9C956E0C061"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H295128F437584C628C8AC4E224DAD5D0" display-inline="no-display-inline"><paragraph id="HE8C4728209384616AE422E5C3EB3B680" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">All medical or counseling records pertaining to a student shall be available for inspection by a parent of such student, upon request, unless the inspection of such record by the parent is prohibited by a protection order (as defined in section 2266 of title 18, United States Code).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF6D4B75426A04A2D826881391001F5E5"><enum>(2)</enum><text>in subsection (c)(6)—</text><subparagraph id="HFA9AA40686D04E28BE93251004A5C5E3"><enum>(A)</enum><text>by redesignating subparagraphs (D) through (G) as subparagraphs (E) through (H), respectively; and</text></subparagraph><subparagraph id="H32F64581D8EE42EEBF30564F1181F44A"><enum>(B)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" id="H06578AA319994D60A0BE5C286701CF3D" display-inline="no-display-inline"><subparagraph id="H5A60A7E1117341539E679BF27BCD4186"><enum>(D)</enum><header>Medical or counseling record</header><text display-inline="yes-display-inline">The term <term>medical or counseling record</term> means a record that—</text><clause id="HEF8F1AC07B0A44B0BBEF73D369F7B0C0"><enum>(i)</enum><text>is in the possession of a local educational agency; and</text></clause><clause id="HC53DBDCCCF8E4C53AFC7FE84C586F7A6"><enum>(ii)</enum><text>relates to medical care or academic or mental health counseling provided to a student.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H376C4B678B284C4599207825925F1E7A"><enum>3.</enum><header>Implementation</header><text display-inline="no-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of Education shall issue or modify any rules, regulations, policies, or guidance necessary to implement the amendments made by section 2. </text></section></legis-body></bill>
