R. 6393</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231113">November 13, 2023</action-date><action-desc><sponsor name-id="W000823">Mr. Waltz</sponsor> (for himself, <cosponsor name-id="C001039">Mrs. Cammack</cosponsor>, <cosponsor name-id="F000472">Mr. Scott Franklin of Florida</cosponsor>, and <cosponsor name-id="D000628">Mr. Dunn of Florida</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Endangered Species Act of 1973 to allow certain activities to be conducted with respect to sturgeon held in captivity or in a controlled environment in the United States, and for other purposes.</official-title></form><legis-body id="H839F9B197C044ABEA5CA4CC906075760" style="OLC"><section id="H680B07AB711F47519E44798B5F98FC9E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sturgeon Conservation and Sustainability Act</short-title></quote>.</text></section><section id="HCDAD5E53BCD84151AE5778DCC9B81CD4" section-type="subsequent-section"><enum>2.</enum><header>Sturgeon held in captivity or controlled environments in the United States</header><text display-inline="no-display-inline">Section 9(b) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H465215CF024E4A8EB4832DFA347616C3" display-inline="no-display-inline"><paragraph id="H757CD207E3D8436BB9E586A2E45E69BE"><enum>(3)</enum><header>Sturgeon</header><subparagraph id="H444EF8CE36B64986A82DA813AA085494"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a)(1) and section 7(a)(2) shall not apply to—</text><clause id="H50A34D78EB2644CC8222EE271904BFA3"><enum>(i)</enum><text display-inline="yes-display-inline">a sturgeon farmed in the United States that is legally held in captivity or in a controlled environment as of the date of enactment of this paragraph, until such time as the sturgeon is intentionally returned to a wild state; or</text></clause><clause id="H9BE20B9D3F894CB6BEF5DD2966BC4A73"><enum>(ii)</enum><text display-inline="yes-display-inline">progeny of a sturgeon described in clause (i), until such time as the progeny is intentionally returned to a wild state.</text></clause></subparagraph><subparagraph id="HE2C920C8A01C48EEB840FD25795DABFD"><enum>(B)</enum><header>Demonstration; requirements</header><clause id="H2D1451C94C5B4AD197A04EB1A0258F33"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any person holding any sturgeon or progeny described in subparagraph (A) shall—</text><subclause id="H1B80EAB008C94DC09DDBCED2D23CFB26"><enum>(I)</enum><text display-inline="yes-display-inline">be able to demonstrate that the sturgeon or progeny qualifies as a sturgeon or progeny, as applicable, described in that subparagraph; and</text></subclause><subclause id="HDE96810189BE4963B291DA8777983D73"><enum>(II)</enum><text display-inline="yes-display-inline">maintain and submit to the Secretary, on request of the Secretary, such inventories, documentation, and records as the Secretary may, by regulation, require as being reasonably appropriate to carry out the purposes of this paragraph.</text></subclause></clause><clause id="H23D8F80582B24BBB8B6DC61E991BF7AC"><enum>(ii)</enum><header>Requirements</header><text display-inline="yes-display-inline">Requirements described in clause (i)(II) shall not unnecessarily duplicate the requirements of other rules and regulations promulgated by the Secretary under this Act.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
