R. 6320</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231108">November 8, 2023</action-date><action-desc><sponsor name-id="V000081">Ms. Velázquez</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to ensure the application of the <quote>Rule of Two</quote> to certain acquisitions, and for other purposes.</official-title></form><legis-body id="HE424CB9E776540C4A591C3851817F11A" style="OLC"><section id="H7354A9AC5E604396A073DC3F6A8C9846" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increase Small Business Utilization Act of 2023</short-title></quote>.</text></section><section id="HD317C72F75FB42BE9487B9FB84D8CE94" section-type="subsequent-section"><enum>2.</enum><header>Application of the <quote>Rule of Two</quote> to certain acquisitions</header><text display-inline="no-display-inline">Section 15(r) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(r)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HD927144D2E244C01815990579C8FE545" display-inline="no-display-inline"><subsection id="H110CCF3C4A3E455B804A3E786C213D74"><enum>(r)</enum><header>Multiple award contracts</header><paragraph id="H790146BC8F1B4EEE8610CCF42ECD5EA0"><enum>(1)</enum><header>In general</header><text>Except as provided by paragraph (2), the head of a Federal agency shall—</text><subparagraph id="HB1ED08B8F06645469B364F013CB087A7"><enum>(A)</enum><text display-inline="yes-display-inline">set aside part or parts of a multiple award contract for small business concerns, including the subcategories of small business concerns identified in subsection (g)(2), unless a contracting officer for the Federal agency is unable to obtain offers from two or more small business concerns that are competitive with market prices and are competitive with regard to the quality and delivery of the goods or services being purchased;</text></subparagraph><subparagraph id="H63C8A0CCF77247B49AB41D285489F30E"><enum>(B)</enum><text display-inline="yes-display-inline">notwithstanding the fair opportunity requirements under section 3406(c) of title 10 and section 4106(c) of title 41, United States Code, set aside orders placed against multiple award contracts for small business concerns, including the subcategories of small business concerns identified in subsection (g)(2), unless a contracting officer for the Federal agency is unable to obtain offers from two or more small business concerns that are competitive with market prices and are competitive with regard to the quality and delivery of the goods or services being purchased; and</text></subparagraph><subparagraph id="H68651B48EDAB406F834309B6E8CEAC73"><enum>(C)</enum><text display-inline="yes-display-inline">reserve 1 or more contract awards for small business concerns under full and open multiple award procurements, including the subcategories of small business concerns identified in subsection (g)(2).</text></subparagraph></paragraph><paragraph id="HC53C45677A8A43CFA8CF9BDBA2CAF585"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply with respect to—</text><subparagraph id="H209DF8B5FBF4414CAA78DA34B95D8B8C"><enum>(A)</enum><text display-inline="yes-display-inline">contracts (including orders) awarded under subpart 8.4 of the Federal Acquisition Regulation (or any successor regulation); or</text></subparagraph><subparagraph id="HED8C29E5A0744CB9BFC7A155DEF6E160"><enum>(B)</enum><text display-inline="yes-display-inline">any multiple award contract or order placed against a multiple award contract with a value less than the micro-purchase threshold.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
