R. 6281</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231107">November 7, 2023</action-date><action-desc><sponsor name-id="V000136">Mr. Vasquez</sponsor> (for himself, <cosponsor name-id="M001157">Mr. McCaul</cosponsor>, <cosponsor name-id="V000130">Mr. Vargas</cosponsor>, <cosponsor name-id="C001119">Ms. Craig</cosponsor>, <cosponsor name-id="C001134">Ms. Caraveo</cosponsor>, and <cosponsor name-id="D000230">Mr. Davis of North Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HHM00">Homeland Security</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to increase the punishment for certain offenses involving children, and for other purposes.</official-title></form><legis-body id="HC5073B2A804E4CE3B3841ED734A1A176" style="OLC"><section id="H344F9A5DE55A45599AC23F43A675DAA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Coyotes’ Oppression and Organized Trafficking, and Ensuring Safety Act</short-title></quote> or the <quote><short-title>Stop COYOTES Act</short-title></quote>. </text></section><section id="HD555C5AF3D34497499C0B7B90B937CC7"><enum>2.</enum><header>Increased punishment for certain offenses involving children</header><subsection id="H95E8200753AD42AFAF5F97D6FB0FF341"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2251A">section 2251A</external-xref> the following:</text><quoted-block style="USC" id="H64369A8737174E0B8EAA80E471C309FB" display-inline="no-display-inline"><section id="H662EEE95E4F54BBFA731A576AD3745A2"><enum>2251B.</enum><header>Offenses involving children</header><subsection id="HDA90D573F7C848E09C14362C4EA67E59"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Any person who commits a felony offense involving a minor under section 1201, 1466A, 1470, 1591, 1594, 2241, 2242, 2243, 2244, 2245, 2251, 2251A, 2260, 2421, 2422, 2423, or 2425, within 1,000 feet of the real property comprising a public or private elementary, vocational, or secondary school or a public or private college, junior college, or university, school-sponsored activity, or a playground, or housing facility owned by a public housing authority, or within 100 feet of a public or private youth center, public park, public playground, public swimming pool, or video arcade facility, shall be sentenced to a term of imprisonment of up to 10 years in addition to the imprisonment imposed for the offense under that provision. The sentence imposed under this section shall be consecutive to any sentence imposed for the offense under that provision.</text></subsection><subsection id="HB8E621EC46544949BF8E98B2F397C087"><enum>(b)</enum><header>Minor defined</header><text display-inline="yes-display-inline">In this section, the term <term>minor</term> means an individual who has not attained 18 years of age.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4F5F76979F0B4617A49B9511D1A38DDD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2251A">section 2251A</external-xref> the following new item:</text><quoted-block style="USC" id="H452D788765F7459DB63FC5CCBE8E021C" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2251B. Offenses involving children.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7407817993AD4B86BA14A4F24595B507"><enum>3.</enum><header>Information sharing and reporting</header><subsection id="H72209EA86A284DBABF0AFABB7DD84C13"><enum>(a)</enum><header>Information sharing</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure that the Director of Immigration and Customs Enforcement and the Commissioner of U.S. Customs and Border Protection share the information described in subsection (c) that is collected by each respective department with each other, and with—</text><paragraph id="HD544F4B263AE49FA9AAB3C4D6E4D7C8D"><enum>(1)</enum><text display-inline="yes-display-inline">State law enforcement agencies in States along a land border of the United States; and</text></paragraph><paragraph id="HDE3223738F014ABEA2077F0455EF8AE5"><enum>(2)</enum><text>local law enforcement agencies that serve jurisdictions located not more than 100 miles from a land border of the United States. </text></paragraph></subsection><subsection id="HC5CEC5FECFD14C2B946E1A379D79096F"><enum>(b)</enum><header>Report to Congress</header><text>On the date that is 180 days after the date of enactment of this Act, and every 180 days therefter, the Secretary of Homeland Security shall report to Congress the information described in subsection (c) that has been collected during the previous 180-day period by Immigration and Customs Enforcement and U.S. Customs and Border Protection.</text></subsection><subsection id="H3A6C12F2EA704048B590BEF3F4DA5A86"><enum>(c)</enum><header>Information described</header><text>The information described in this subsection is information about the following:</text><paragraph id="H997B10B2B6BA42DEAFDC6100D51EDEFF"><enum>(1)</enum><text>The unlawful entry of aliens along the southern border of the United States.</text></paragraph><paragraph id="H494F710DACA5449B92F48BCF01D84D60"><enum>(2)</enum><text display-inline="yes-display-inline">Severe forms of trafficking in persons and sex trafficking (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) occurring in the United States, including cases in which the victim of trafficking was smuggled into the United States from Mexico. </text></paragraph><paragraph id="HB38E999408F944FE90EEBF15F4278A21"><enum>(3)</enum><text>The smuggling of aliens as described in section 274(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)</external-xref>).</text></paragraph><paragraph id="H56381BDBA1554C7C837F7A1B0684478F"><enum>(4)</enum><text>The kidnapping of aliens outside of the United States for the purpose of smuggling such aliens into and trafficking such aliens in the United States. </text></paragraph><paragraph id="HCDA1C6D99F4E4C80AED540E0FBA04EBF"><enum>(5)</enum><text>Abuse and assault of aliens committed by traffickers and smugglers.</text></paragraph><paragraph id="HEF5FD553DAB748AB842E17AB4A0AE46C"><enum>(6)</enum><text display-inline="yes-display-inline">The smuggling of controlled substances (as such term is defined in section 102 of the Controlled Substances Act(<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)) and firearms (as such term is defined in section 921 of title 18, United States Code) into the United States. </text></paragraph><paragraph id="HC6459F1C4778423E990A10B8D3A9A86D"><enum>(7)</enum><text>The prevalence of the involvement of gangs and transnational criminal organizations in the activities described in paragraphs (1) through (6).</text></paragraph></subsection></section></legis-body></bill>
