which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 and the Emergency Food Assistance Act of 1983 to make commodities available for the Emergency Food Assistance Program, and for other purposes.</official-title></form><legis-body id="H8583ADCC19884E23BA6BC80262F6C4CC" style="OLC"><section id="H02BC006347F4430B90594C4206297C39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmers Feeding America Act of 2023</short-title></quote>.</text></section><section id="H373A08AD28CF4ABC8EDCAFA49EB8A5E8"><enum>2.</enum><header>Availability of commodities for the Emergency Food Assistance Program</header><text display-inline="no-display-inline">Section 27(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036">7 U.S.C. 2036(a)</external-xref>) is amended—</text><paragraph id="HFAF8E659EFDD4710A0FF635BDADF2A26"><enum>(1)</enum><text>by striking <quote>2023</quote> each place it appears (except in paragraph (2)(D)(ix)) and inserting <quote>2028</quote>; and</text></paragraph><paragraph id="H31E02FCC24204AA2A744069EEFE6D041"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4DDFB2EDED744CA59FDCAB6E8E309030"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text><clause id="HDEC7312AD92E46D3B643EF479433E7DA"><enum>(i)</enum><text>in clause (viii), by striking <quote>and</quote> at the end; and</text></clause><clause id="H8E45CF53EAB741E2A4D1C457304BC38D"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBAC79726E2A244889BADDD113BA97B96"><clause id="H792700EF3E554C1196F07E35893AD316"><enum>(x)</enum><text>for each of fiscal years 2024 through 2028, $500,000,000; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H48CA3CBCF0DF4C83B8C0D32E7E88731E"><enum>(B)</enum><text>in subparagraph (E)—</text><clause commented="no" display-inline="no-display-inline" id="H4DFEE904C34D4DC79B7D1E49A3DF0FD4"><enum>(i)</enum><text>by striking <quote>2024</quote> and inserting <quote>2029</quote>; and</text></clause><clause id="H0EFE79FD32594CC388E3421E0CE710A8" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>specified in subparagraph (D)(ix)</quote> and inserting <quote>described in subparagraph (D)(x)</quote>.</text></clause></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HAE6EADCD84204789A446C275B4F8CAAD"><enum>3.</enum><header>Emergency food program storage and distribution</header><text display-inline="no-display-inline">Section 204(a)(1) of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7508">7 U.S.C. 7508(a)(1)</external-xref>) is amended, in the first sentence, by striking <quote>$100,000,000</quote> and inserting <quote>$200,000,000</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H5B7EE442B0D64BFE8D5F919834A5A457"><enum>4.</enum><header>Emergency food program infrastructure grants</header><text display-inline="no-display-inline">Section 209(d) of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7511a">7 U.S.C. 7511a(d)</external-xref>) is amended by striking <quote>2023</quote> and inserting <quote>2028</quote>.</text></section><section id="H9C4BF0DE4CE645689DC35FAEFF2E22A2"><enum>5.</enum><header>Geographically isolated States</header><text display-inline="no-display-inline">Section 214 of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7515">7 U.S.C. 7515</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H6A0AE7009B684D0CABCE4A13F53189CC"><enum>(1)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAE3C5C90591C40E99E0285A13E565500"><paragraph id="H19AF2B68349C43769DEE95D4A1D4A626"><enum>(3)</enum><header>Alternative delivery options for geographically isolated States</header><subparagraph id="H2E80293CDE624F89BCEDB1BDB7F45E3B"><enum>(A)</enum><header>Definition of geographically isolated State</header><text>In this paragraph, the term <term>geographically isolated State</term> means—</text><clause commented="no" display-inline="no-display-inline" id="HC8C95F4696934AF491ADE763650B6DBF"><enum>(i)</enum><text display-inline="yes-display-inline">the State of Hawaii;</text></clause><clause commented="no" display-inline="no-display-inline" id="HBBB0D3A48AA1471D901A2EEA5C582A3E"><enum>(ii)</enum><text display-inline="yes-display-inline">the State of Alaska; </text></clause><clause commented="no" display-inline="no-display-inline" id="H8462CE11F0834C1C81257FBD52C72CC6"><enum>(iii)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF6F3A7253BBA49DC803728A75DF824DF"><enum>(iv)</enum><text>the Commonwealth of the Northern Mariana Islands; </text></clause><clause commented="no" display-inline="no-display-inline" id="HA12B6E9590F14F259BA20C16240A5FBC"><enum>(v)</enum><text>the Virgin Islands of the United States; and</text></clause><clause id="H642C5C8D25614159A3D1AFA24F817068"><enum>(vi)</enum><text>Guam.</text></clause></subparagraph><subparagraph id="H2DC0C5784D9A4AF7ADEADA87B72F4231"><enum>(B)</enum><header>Alternative delivery options</header><text>At the request of a geographically isolated State, the Secretary shall coordinate with the geographically isolated State—</text><clause commented="no" display-inline="no-display-inline" id="H3713692D6DB14C02BC02562D42A84629"><enum>(i)</enum><text display-inline="yes-display-inline">to establish alternative delivery options for commodities allocated to that geographically isolated State under this section to ensure that the geographically isolated State is able to receive those commodities; and</text></clause><clause id="H66737D96B6CD4D9C9DED2EC8BB89E22B"><enum>(ii)</enum><text>to allow for the geographically isolated State to order commodities through the Department of Defense Fresh Fruit and Vegetable Program. </text></clause></subparagraph><subparagraph id="H26BB4420CA9049ACB8FE8A845C9D0234"><enum>(C)</enum><header>Direct purchase option</header><text>The Secretary may transfer to a geographically isolated State the cash value of not more than 20 percent of the commodities allocated to that geographically isolated State under this section to be used by the geographically isolated State to procure domestically grown food in lieu of receipt of those commodities.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA685C4115EBE4DDDB4D9068DDC5CDE2D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H51C4AA6A47834704ADC4A9F700BE2049"><subsection id="HD5E9F4D6799D4309857EF42ABF8276BC"><enum>(e)</enum><header>Fresh produce packages</header><paragraph commented="no" display-inline="no-display-inline" id="HE9490CCA1DF84A21829B34788B0CA8AC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In purchasing fresh produce packages to provide under the program established under this Act, the Secretary may consider additional factors beyond lowest price in determining winning bids for contracts for those fresh produce packages, including product variety and transportation distance.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H30FC6F24A32943C79D6A7641F0E3F7B9"><enum>(2)</enum><header>Nutrition</header><text display-inline="yes-display-inline">The Secretary shall carry out paragraph (1) in a manner that maintains the goal of maximizing the amount of nutritious food available through the program described in that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
