R. 6193</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231102">November 2, 2023</action-date><action-desc><sponsor name-id="L000593">Mr. Levin</sponsor> (for himself and <cosponsor name-id="M001219">Mr. Moylan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to waive the fee for a housing loan guaranteed by the Secretary of Veterans Affairs for certain veterans with a service-connected disability who applied for such loan before receiving a disability rating from the Secretary.</official-title></form><legis-body id="HE7F6FEFFB6F1443C83AD7B81AB5825B0" style="OLC"><section id="H63DB8B0C4FEF437EA03C8154EE69A494" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Assistance for Loan Origination Relief Act</short-title></quote> or the <quote><short-title>VALOR Act</short-title></quote>. </text></section><section id="HCBF43ED505874A51899FAD7E10493815"><enum>2.</enum><header>Waiver of housing loan fee for certain veterans with a service-connected disability who applied for such loan before receiving a disability rating</header><subsection id="H14F12722E51747699DB57BA15FF0FB30"><enum>(a)</enum><header>Waiver</header><text display-inline="yes-display-inline">Subsection (c)(2)(A) of section 3729 of title 38, United States Code, is amended by striking <quote>rating</quote> and inserting <quote>examination or review, as defined by the Secretary,</quote>.</text></subsection><subsection id="H6DBE4A0DF0FD42658AC3F80B51927888"><enum>(b)</enum><header>Refund to veteran</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall refund any fee collected under such section before the date of the enactment of this Act from a veteran—</text><paragraph id="H3AFD80772C7D4A68ABFA35777FFB8729"><enum>(1)</enum><text>who requests such a refund; and</text></paragraph><paragraph id="HE5649E97C9F54A4D96768090D0184F0D"><enum>(2)</enum><text>whom the Secretary determines, pursuant to evidence submitted by the veteran, would have been eligible for a waiver of such fee pursuant to the amendment made by subsection (a) if the veteran obtained the housing loan after such date.</text></paragraph></subsection><subsection id="HE0A30CFAA24A46789510D126E82F1BA5"><enum>(c)</enum><header>Funding fee refund</header><text>The Secretary may pay to a lender, loan servicer, or loan holder the amount of a fee refunded under subsection (b) if the loan for which such fee was collected was active on the date on which the refund was provided. The Secretary shall require that any amount paid under this subsection shall be applied to the loan as a principal balance reduction.</text></subsection></section></legis-body></bill>
