<official-title display="yes">To amend the Internal Revenue Code of 1986 to provide a refundable credit to individuals who donate certain life-saving organs.</official-title>

<section display-inline="no-display-inline" id="H5691A6E87A1040C0BF20233FEA5B6BD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Living Organ Donor Tax Credit Act of 2023</short-title></quote>.</text></section> <section id="HA19AA0613A0F4B10A19A0F8727C0765D"><enum>2.</enum><header>Credit for donation of certain life-saving organs</header> <subsection id="H1D90BB76AAD04CE9B560340302018CEE"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 36B the following new section:</text>

<section id="H6B787F0CE8784760945181D746A3E590"><enum>36C.</enum><header>Donation of certain life-saving organs</header> 
<subsection id="HD38690FE39DA4DF7A78E08CC0F2A93BD"><enum>(a)</enum><header>In general</header><text>In the case of an individual who donates a qualified life-saving organ of such individual for transplantation into another individual during the taxable year, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to the sum of—</text> <paragraph id="H2A95CDDD180F48DDA428F53AC4B81FDA"><enum>(1)</enum><text>costs paid by the taxpayer in connection with such transplantation,</text></paragraph> 
<paragraph id="H0F000218CD0549079192F6F18292C741"><enum>(2)</enum><text display-inline="yes-display-inline">travel, lodging, and other logistical expenses,</text></paragraph> <paragraph id="HBA52CA4597844D80AF86C2E3D49983D3"><enum>(3)</enum><text display-inline="yes-display-inline">medical expenses related to donation and follow-up care,</text></paragraph> 
<paragraph id="HF622F33505DC4F3D9C28B02ADE38694F"><enum>(4)</enum><text display-inline="yes-display-inline">paperwork or legal costs related to donation, and</text></paragraph> <paragraph id="H202D4379FB7E4F389FDEFCB7438A89C5"><enum>(5)</enum><text>any lost wages of the individual in connection with such transplantation.</text></paragraph></subsection> 
<subsection id="HDC706745D16649BF80CB6F30D4CA27A9"><enum>(b)</enum><header>Limitation</header><text>The credit allowed under subsection (a) with respect to any individual for any taxable year shall not exceed $5,000.</text></subsection> <subsection id="H0B490B6F569D4470B0FA3CBEE27EBFF5"><enum>(c)</enum><header>Definitions and special rules</header><text>For purposes of this section—</text> 
<paragraph id="H10BA4DB6214640A1B4A82336AF260529"><enum>(1)</enum><header>Qualified life-saving organ</header><text>The term <term>qualified life-saving organ</term> means kidney, liver, lung, pancreas, intestine, bone marrow, or any part thereof.</text></paragraph> <paragraph id="HDFABDD36470B40A4BD2590916F3BEAA7"><enum>(2)</enum><header>Restriction to living donors</header><text>Credit shall not be allowed under subsection (a) unless the individual is alive when the qualified life-saving organ is removed from such individual.</text></paragraph> 
<paragraph id="H503559BCBAF14CFE919CA5FD6BBA67A9"><enum>(3)</enum><header>Transplant must be in accordance with United States law</header><text>Credit shall not be allowed under subsection (a) unless the donation and transplantation occurs within, and in accordance with the laws of, the United States.</text></paragraph> <paragraph commented="no" id="HAF31882A55264612AF59AAD4552403D9"><enum>(4)</enum><header>Donation</header><text>Except as provided in regulations by the Secretary, an organ shall not be treated as donated unless and until such organ is removed from the donor.</text></paragraph> 
<paragraph id="H0158F4233A8B44A38CA7816CBB25AF85"><enum>(5)</enum><header>Reimbursed expenses not taken into account</header><text display-inline="yes-display-inline">There shall not be taken into account under subsection (a) any amounts reimbursed by any person or entity, public or private.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H78BC04F11EEC4E7F8F25D739587BD5C2"><enum>(b)</enum><header>Public Health Service Act and National Organ Transplant Act amendments</header> <paragraph id="HFC19D051247C441A90641D3669CD2E19"><enum>(1)</enum><header>Coordination with Federal living organ donation grants</header><text>Section 377(d) of the Public Health Service Act is amended by inserting <quote>that such individual has been allowed, or reasonably expects to be allowed, a tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/36C">section 36C</external-xref> of the Internal Revenue Code of 1986 or</quote> before <quote>that payment has been made</quote>.</text></paragraph> 
<paragraph id="HEC64E1CEA6CE4F11AD57F9CBD3349BE2"><enum>(2)</enum><header>Tax credit not unlawful compensation</header><text>Section 301(c)(2) of the National Organ Transplant Act is amended by inserting <quote>the tax credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/36C">section 36C</external-xref> of the Internal Revenue Code of 1986 or</quote> after <quote>does not include</quote>.</text></paragraph></subsection> <subsection id="HA4A4A606F12D41C1AE51C4D59575006C"><enum>(c)</enum><header>Conforming amendment</header><text>Section 1324(b) of title 31, United States Code, is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></subsection> 
<subsection id="HC7519202FC5945A898007B7CA9B56CD4"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections of such subpart is amended by inserting after the item relating to section 36B the following new item:</text> <quoted-block display-inline="no-display-inline" id="H4A3AB15DF3C74D5D9422055B0DBCBBBD" style="OLC"> <toc container-level="quoted-block-container" idref="HDFEDDC07E4514C58B4664A92FBE6FF31" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"> <toc-entry idref="H6B787F0CE8784760945181D746A3E590" level="section">Sec. 36C. Donation of certain life-saving organs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" id="HF8CDF699BC114BA6904299473AA59C4B"><enum>(e)</enum><header>Effective date</header> <paragraph id="H14A1ABA5A0E5403287C1584670CCDFB1"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HAE08822FC6C9412AA96EC42575499CA7"><enum>(2)</enum><header>Public Health Service Act and National Organ Transplant Act amendments</header><text>The amendments made by subsection (b) shall take effect on the date of the enactment of this Act.</text></paragraph></subsection></section> </legis-body> </bill>
